Bluto's name was changed to Brutus in 1957 because of confusion over who owned the name "Bluto". Since then the names are used interchangeably so they're both correct. Although in a select few pieces of Popeye media Bluto and Brutus are seperate characters.

If critics are threatened with legal action every time they review a game (or any form of media), criticise it, and give it a bad score, there’s really no point in reviewing anything; we’d be left in a world where every game receives a 100% rating and every review becomes worthless and untrustworthy.

True. And the outcome of that kind of scenario already happened towards the end of the 2nd console generation (Atari 2600, Colecovision, Intellivision, Odyssey 2), the great videogame crash. So devs who are willing to sue over reviews, because they are unfavorable, are happy with putting the entire industry at risk for their own selfish reasons.

Isn’t every industry ever based off: make things that people like? People review the things they like or don’t like? Just because this guys review was critical didn’t it cause this game to get a ton of popularity and more people to buy it? Idk I’m pretty sure the lawsuit wouldn’t stick

Part of being able to prove slander is to also prove damages related to said slander (as Riggs points out in his video). The irony is that his video, and this one, will just bring more attention to the Popeye game and more people will buy it just to try it for themselves. This company will make more than they lose from all this nonsense.

@@hicknopunk I really don't buy that reasoning. Why would I (or anyone else) buy a game that two reviewers gave rock bottom reviews to? That's generally the whole point of a review, to help others avoid paying for things that won't be enjoyable. There are those people who enjoy bad games. But I really don't think there are many of them.

regarding the ps4 issue there actually an easy way to get a hold of them. make a negative game review. when they email you to threaten to sue you just respond with questions about the trophy.

I can’t believe that people are still scratching their head over the Brutus thing. In the ‘60s Bluto’s name was changed to Brutus due to a misunderstanding by King Feature who thought the name Bluto was owned by Paramount.

Just a quick FYI, Brutus is the name of the vilain since 1970s I believe… When Popeye released a few years prior, it’s nemesis was called Bluto. But because of copyright issues, after a few years they created Brutus…In short, it’s a ‘different’ character but in fact it’s mostly Bluto with a new name. Therefore, after that, Popeye nemesis became Brutus going forward… a little bit of Popeye history :)

Wow, unbelievable. Really glad to see you stand up for John so strongly. Can't believe this company would go after someone for their review, especially when apparently there are so many issues with their other games, and the customers have been struggling to get in contact with them about those issues. Just despicable. Can you imagine how bad it would be if some of the contacts/email addresses this company used, to contact KZfaqrs and let them know they were suing them for slander, somehow accidentally leaked to the community? So customers didn't just have one generic ignored customer service contact to follow, and could instead raise their concerns directly. That would be crazy huh?

@@catboss6720 basically big companies file “defamation” lawsuits against smaller companies or people. The smaller companies or people get scared of the legal fees of getting sued, so they take down their negative opinion of big company (even though it’s not really defamation). Effectively, big companies are able to legally stop free speech because they can afford to pay more lawyer fees than people or smaller companies. (This is US only)

I recall Jim Sterling did a review on this game too and he hated it are they going to try to sue him as well?! And as I recall there is something called the first amendment that is still existent so you and anyone else is entitled to express their opinions on games whatever the good or not. Nintendo should've made Arcade Archives: Popeye for the Switch, or put the NES version on the NSO NES app. After all, Nintendo made the original game themselves. I mean I once played a Board game edition of Popeye.

When someone's broadcasting to a relatively large audience and specifically telling that audience to not buy a game then that's no longer a matter of simply given one's an opinion or journalism. There's a clear difference between "I don't recommend buying it" and "do not buy". It's not slander, but it can get you into trouble nonetheless.

Brutus is a character first appearing in the Popeye the Sailor TV series from 1960, an enemy of Popeye. Created to fulfil Bluto's role during a time when it was erroneusly believed that the latter was not introduced first in the original Thimble Theatre, Brutus is essentially a new character meant to resemble the earlier Bluto in both appearance and actions. In trying to avoid the use of characters borne out of Paramount Pictures productions, King Features Syndicate's TV cartoon introduced Brutus as one of the main villains, in addition to the Sea Hag making her animated debut. Jackson Beck, who provided Bluto's voice in many theatrical cartoons up until their end, voiced Brutus in the series.

I dumped the assets from the game and there appears to be files that point to a lot of unused characters, mostly pirates, and a few popeye characters that are referenced but not in the game files at all, almost like this was either a reskin of a pirate game, or it was rushed so fast that its all just an alpha build where all the placeholders are still hanging around

Much respect to you RGT 85. You'll always have people who dislike you or your content, but you'll also have people who enjoy your videos too. Just keep doing what you do. If you review things you're gonna have people who review you too. And on the internet? You're asking for opinions, toxic or not. You were being real in this video and I for one appreciate that. And to John Riggs, thanks for telling it like it is. You're appreciated too brother. The company wanting to sue you just because you reviewed their bad game in a negative light is even more telling about their ethics than what your video even said. As you pointed out, by its very definition, slander is a spoken LIE about a person or company. If Riggs had said "The game this company made sucks. Maybe if they spent less time huffing paint and more time developing, it'd be better" or something to that effect, they MIGHT have reason to claim slander. Because, in that example, he would be stating something as factual that he cannot prove and that the company could easily dispute. Also, again masterfully said, if they WERE to sue and win, it would be the end of reviews of any kind. Because if a no-name company like this who puts out what appears to be cheap shovelware titles to make a quick buck can win a slander lawsuit on a reviewer who BOUGHT the game and gave his honest OPINION about it, then how long would it be before Nintendo or Sony or Rockstar or...ANY of the big companies sued for the same thing? It would also have a chilling effect on games, because, let's face it, one thing negative reviews tend to do is make a company actually go and fix the game. They want as many copies of the game to sell as possible, so they look at negative reviews and say "Let's fix that problem so the game will sell well". Now, let's look into a world where a developer can sue someone over a negative review. Suddenly, they have nothing to fear about releasing a broken, incomplete mess of a game. Because, if someone posts a negative review, they can just sue them and get their bank off the game that way instead. Frankly, if I were Riggs, I'd tell them to bring it on and, if they actually follow through, file a countersuit against the company for filing a frivolous lawsuit. That way, they'd not only lose on their claim, but they'd actually have to PAY Riggs for his claim. Because the simple fact is ANY lawyer that would even SUGGEST that Riggs can be sued for his OPINION on a game is mind-boggling. That lawyer should be disbarred, fired, and fined for such an action. And, if it comes to the courts, the judge should take EXTERME umbrage at their audacity.

Working in law I can confirm that people have a huge misunderstanding of Slander or Defamation. As much as you can sue for reparation, it's not a crime. Not only that, but it's incredibly hard to establish a convincing case. You would have to prove that the person *intentionally* said wrong things with the intent to harm. 1. It's nearly impossible to prove intent (unless it's specifically stated somewhere that they planned to cause harm) 2. It's almost as hard to prove that the person knew that their facts were wrong...

The game defames and slanders itself. You can review any product, not just games, and give your opinion. John Riggs is a nice dude.

I was actually very curious on this Popeye game as well but when I saw the pictures it looked pretty bad but then finally JohnRiggs made a video basically it's a horribly/lazy remake of a classic Arcade/NES game which to be honest I rather play those versions instead. Yeah JohnRiggs shouldn't deserve being sued from a company who couldn't handle criticism about there game. It's stupid and ridiculous.

Bluto vs. Brutus (Wikipedia) After the theatrical Popeye cartoon series ceased production in 1957, Bluto's name was changed to Brutus because it was incorrectly believed by King Features that Paramount Pictures, distributors of the Fleischer Studios (later Famous Studios) cartoons, owned the rights to the name "Bluto"

Dating yourself with a cd isn't a thing since you can go to Walmart and buy one. When I talk about my 8 tracks that's dating myself. And Brutus was bluto when Popeye was first on TV

Tbh I'd expected the person who reviews a game to give a honest opinion, regardless having purchased it or revieved a copy from the company. This is the reason why I watch & value the reviewers opinion. You're always honest with your videos

Didn't a developer actually sue the Jimquisition about a review one time and lose? Seems like that might be able to help create some kind of legal precedent.

As a game developer myself, I'd never do this kind of stuff. You've got to be able to take CRITICISM. Otherwise, you and your developer team will only get worse. Literally threatening to sue someone over your game being criticized is the most childish thing I've seen a developer do over the past couple of years.

Supreme court has ruled there is no such thing as a "false opinion" so a lawsuit would not ever make it to trial.

The defense to slander or libel is the truth. I imagine the challenge of establishing that some objective truth about a game has been ignored would be a tough one where opinions are concerned. I mean, if a reviewer says "the controls are wonky and the lighting sucks" while someone else states the exact opposite, who prevails in a court of law and who establishes whether those statements are objectively true or not?

This is ridiculous that a publisher can even threaten to sue for a review or opinion. This is a slippery slope and they can screw themselves. Are they going to sue video game magazines for bad ratings too?

Ones willing to threaten lawsuits because you hurt their feelings tend to be small developers, usually just an individual.

More power to you. A few things to note, though. First, the company behind this is primarily known for its calculator and similar apps for the Switch. Second, the maps used in the game appear to be assets directly from the Unity store. Third, there are technically only three maps. They repeat them for day, night, and rain, but it’s only the three level maps. Fourth, there are really only two tracks: the main background music, and the short theme that plays when Popeye eats spinach. Fifth, the objective of the game (collect object, such as letters spelling out a message, thrown by Olive while dodging Bluto/Brutus and others) is taken from the Popeye game for the NES, only it’s different because now there are these large 3D maps you’re traversing. Make of that what you will. Finally, on the positive side, the art style for the menu screen and for the 3D models of Popeye, Olive, and Bluto/Brutus is very faithful to the source material. This isn’t a full-on critique, per se. Just some objective facts about the game and its developer as well as one positive opinion. Make of them what you will.

John Riggs had since apologized for this video saying he actually goes back and plays the game every now and then and said it’s not the worse game after all and like it’s actually a game that he actually really likes
