Thats what liberal lawyers are best at: "that doesn't mean THAT, it obviously means THIS. I interpret it as this, so therefore my stance is the only correct one." They do this for 2A claims as well, if they can open it up for interpretation, they are subsequently able to interpret whatever they want. IE it doesnt really apply to anyone in the military, so the whole thing is bunk. Then they go after all of the rest of the rights, which will be "interpreted" that you don't have any of those rights either.

It's definitely something, we've all seen the videos from the guided tour,the SCOTUS has seen the videos, and it is common knowledge that certain videos were either destroyed or withheld from the public because they showed that the vast majority of the Capitol tourists were peaceful and was ushered in by the Capital police. Nancy Palosi was responsible for the security of the Capitol and her refusal of the National guard is very suspicious to say the least.

What Alito proved is what we all know. A TWO TIER justice system. It all depends on the interpretation of the prosecutor. If a prosecutor WANTS to charge someone, then they can INTERPRET a statue anyway they choose. In almost all cases, the defendant wont have the resources to properly defend themselves so they will be found GUILTY. Yet another prosecutor can show preferential treatment depending upon various reasons such as venue, etc. This is why uniformity is essential to the rule of law. If the rule of law is subjective, then the execution of justice is contingent upon other factors other than the law.

The problem is it is impossible to create laws before crimes are committed. When they find a way to 'game' the system (Thanks to folks like Alito), we have to try and patch the hole. Assuming the powers that be, allow those holes to be patched. Al Capone, for example, had to be busted on tax violations because despite knowing full stop that he was the one ordering people to be killed, there was no law that could be used to put him behind bars.

Other than MSM telling you to think that. Think I"m wrong? Ok, show me one person that was charged with an insurrection on 1/6. If you can't, you're being told what to think and that should bother you. Were there a real insurrection congress would have been taken over. It would have been a much different affair. More like the cities burning for the 6 months previous to 1/6. People were burning, looting, murdering. Yet strangely a lack of people prosecuted over it.

who didn't understand the law? it is common for judges and attorneys to review and discuss statutes like this, e..g. Trump's lawyers have been questioned and challenged by the justices on several of the arguments they have brought to the Supreme Court. The mere questioning and challenging does not prove that the attorney doesn't know the law, it is a normal part of the process.

I do think Alito has a very good point. Imo, anyone that protests and impedes official gov't business like that, should be charged in accordance with the written law. Whether it's blocking a bridge and impeding free travel of citizens and gov't vehicles, or protesters in the courtroom. Something needs to be done to stop these maniacs who think they can stop traffic and hold up thousands of peoples lives, just so they can yell and scream about something. You have every right to protest...you do not have a right to purposely impede everyone else's freedom. Now, should people be in jail for 4 years for trespassing? No. That's way overkill and could be considered cruel and unusual punishment for a misdemeanor.

Good grief. How about an emergency for police or fire, getting your child on time, etc, etc. This blocking the roads needs to stop. I worked for one of the biggest fire departments in the country in South Fl. and when I-95 or the FL's Turnpike got shut down for an accident, FL Highway Patrol was on us about the millions of dollars it cost to keep roads shut down, and pushed to have them open ASAP. So close them for protestors but open fast after a serious car wreck, got it.

That statement no longer rings true! When you have so many laws (10s of 1,000's ) and so many of then you need legal scholars to interpret them, they are no longer just or even legal laws because at some point in their use of complicated wording they will violate the US Constitution and therefore be Invalid!

INTENT is necessary. Intent to specifically hinder or delay specific action (eg. a vote) versus specific intent for a general disruption irrespective of a target (e.g. the general public). BOTH are (imho) criminal, just that the first can come as two charges (the target as well as the general public). People have the right to peaceably assemble and protest, collect signatures, recall politicians from office and replace them. People do not have the right to steal time of others via blocking freedom of movement.

Exactly what did she say that is "arrogant"? She is answering his questions and providing her legal argument based on the law. In the end it is up to the 9 justices to decide whether or not they agree with her. But simply answering the questions asked to her is not "arrogant", unless maybe you just think women should be seen not heard....

Washington, DC is a federal reservation comes under the jurisdiction of the federal government, so yes, the president can call on the NG. President H. Hoover call on the military to break up the Bonus protest. Gen. Douglas MacArthur was the commanding officer for that operation. Look it up.

@@tvbtvb5124 Trump cannot call the DC National Guard but he requested both the DC Mayor and Nancy Pelosi as the Speaker to activate the National Guard for DC. That is the procedural law that is required for a DC response. Trump made the request to both and they both turned him down. As if they both wanted this to happen.

One of the foundations of our justice system IS equal application of the law. Its actually addressed in plain language that there will be no favorites or exceptions, that the law for murder is the same here or there and so are the guidelines for punishment. They have thrown that out the window since our country was taken over by fascism.
