A group of young healthy men with one instigator, screaming vile names for no reason, were drinking, moving towards a person while laughing, accusing, and making demands. Any person by himself would feel threatened with a need to protect himself. This man did nothing but snorkel and was verbally attacked, then hit multiple times. He obviously got worried about his own safety and reacted.

What helps Miu is the fact that it’s all on video. They can put all these “kids” in the stand and they can all say how much they don’t remember but thankfully they couldn’t help but record everything. So the jury gets to see him being punched, kept from being able to get up, being surrounded by able bodied young men. When you’re mobbed like that, I think it’s safe to say that the human reaction is to defend yourself.

The defense did a solid job in questioning this witness. In the video - while this group was screaming obscenities at him - you could see he was still just looking in the water trying to find the phone.

The teenage victims in this case clearly provoked their own stabbings through their own very bad behavior. This case should not have even come to trial. The fact that a jury was conned into buying into the prosecution's lies, including from their lying witnesses is testament to the imperfect nature of juries, and the very imperfect nature of police interrogations, prosecutors, and how far what is arguably the fairest legal system on Earth still has to go. All accused persons are entitled to a presumption of innocence to beyond a reasonable doubt. That standard was definitely not adhered to here. This jury verdict will hopefully be set aside on appeal and the real victim, Mr. Miu, exonerated of all charges.

From the way the teens were harassing this guy in the video, I'm rather surprised anyone else didn't expect it not to end well. There is no excuse for treating people like they did. I would have been terrified with a group like that around me, acting that way, shoving me.... absolutely terrified! And - isn't that what the kids wanted? To intimidate and scare him? Well - sometimes people react when you do that to them. None of this mess would have ever happened if the kids hadn't been out to 'haze' someone, bullying them and trying to provoke them. Where were the group's other adult members? Were they too scared to get involved in stopping this before it got to the end it did? This is a good illustration of why a good number of people just don't want to go out in public anymore . I really thought defendant was guilty before viewing the videos. And I do believe he is guilty of something, but I think all parties are guilty . I'm not sure how to assign guilt though. Those teenagers were so out of line- I'd be devasted if my children ever behaved that way . But they wouldn't have and they never did. I've read the comments. I do think it's reasonable that the defendant felt he needed to defend himself against TWO groups of young people who were verbally assaulting , attacking him, PROVOKING him. I hope something good comes out of this . For both the young people involved and anybody viewing this . JUST WATCHED THE ENTIRE UNCUT VIDEO- someone ,i think the guy in purple&pink shorts or the guy in blue shorts first pushes the old guy down, then immediately once he's down the fat chinese lookin guy in black and grey shorts smacks the old guy upside the head hard as he's trying to get up, then the guy in yellow shorts comes up behind the old guy and pushes on the back of his shoulders like attempting to dunk the old guy, the fat guy in black and grey shorts looks as if he's ready to try another sucker punch while the old guy is distracted from behind by the yellow shorts guy, but thats when the old guy gets the yellow short guy in the belly and the black and grey shorts fat guy refrains from his next attack. before every one realizes they are being stabbed a guy in denim shorts pushes on the old guys back and also gets stabbed, but by that time i think the old guy is already in "anybody else gets near me again and they are gonna get it too mode" THIS IS NOT AS OPEN AND SHUT AS THE COMMENTS ETC MADE ME THINK THE FIRST TIME I SAW THIS HERE. i dont know what led up to them pushing him down and hitting him in the face etc. but he was definitely surrounded by a mob that was growing bolder in their attacks on him fast, especially the chubby guy in black&grey shorts and the yellow shorts guy.. in my opinion the only ones who deserved to be defended against are the guy who pushed him down at the start and the chubby guy who smacked him in the face and the yellow shorts guy. sadly chubby black and grey shorts guy got away uninjured, it was his first strike that made the old guy realize his life may be endangered and the situation was escalating.

When I first read the back story about this trial I thought for sure this defendant had an uphill chance. But then I saw the video, and listened to this young man’s testimony-it’s not so clear cut. I’ll wait until I hear all the evidence before my final decision.
