Armed Scholar Question First thank you for our videos teaching me and many others of gun laws. The state of CA is complex regarding them. Is it legal to purchase an off roster handgun or any gun from an US citizen out of CA through an FFL transfer ? Background check waiting period etc... While off roster sales in CA private sales will be sold at a higher price due to supply and demand of course. In free states that obey the Constitutional Bill of Rights that makes them free people in the USA they are allowed them and not have the value to be able to get them. The Subjects in Commiefornia must use FFL transfer for purchase of all guns from other than Dad, Grandpa etc.. 2nd question Have there been other times CA residents had guns purchased legally in CA through an FFL and owned them for years. Legally owned even modified to remain legal in many cases. Then when the recent assault rifle law is passed and registration, featureless or fixed magazine is required to possess them is voted on and passed. The law is added to it that makes any legally owned magazine fed semi auto shotgun that was currently required 10 shell maximum magazine and a bullet button device illegal to possess. No registration or featureless option allowed. Fixed magazine I believe not an option either. Not possible with a Saiga or other AK style. Made illegal to possess. No compensation for them. Many expensive and valuable legally owned property made illegal and a criminal to possess by law ? Under the 2A with no options? Not just illegal to buy or sell etc.. Not voted but added like this to a law voted on and passed. I am not understanding how CA can do this. What would stop them doing this to other or all guns this way in the future or other rights this way ? Off roster handguns could be made illegal to possess by law with no grandfather in or registration legality etc for example ? It is confusing to me. There was no amount of crime or homicide with their use to justify this law this way I have heard about. Thanks for your help.

Isn't every Californian exempt from the roster with the execption of the FFL. In other words the roster only applies to activities by an FFL at the retail level. The roster says nothering about the activities of the buyer. If an FFL is confused and sells you an off roster handgun, then it's the FFL that has the problem not you. The roster says nothering about possession.

@@Liinglingg find a gun shop that is willing to work with you on this and educate themselves. This is rarely used, I assume. If it is from out of state you’ll have to fill out an intrastate form and interfamilia form. I filled everything out with the licensed dealer I used. Hope this helps.

You can find lots of CA FFL's with out of state intrafamilial transfer experience on CalGuns site. Shouldn't be hard to find one near where you live.

You might hav to drive farther away. Poway Weapons and Gear Range near San Diego did mine. Although they were confused. First they called me when it arrived and asked if I was law enforcement exempt. I said no, I didn’t have to be because was gift from my daughter. Emailed the associate the rules regarding infra familial transfers and informed him it was legal. They asked for an email from my daughter stating that it was a gift. When I got there they said it wasn’t a true “ intra familial transfer” because she would have to present for it to be an intra familial transfer so it wouldn’t be $19 and the charge would be $100 instead. I didn’t question any further and paid then$100 and they did the DROS. Very confusing transaction that is obviously very confusing to try and legally comply with and many FFL don’t understand and don’t want to mess with.

Manuel, You don't need a FFL in AZ. Your daughter needs to be the registered owner of the gun. Find a FFL near you willing to accept shipment from AZ then your daughter overnights the gun to the CA FFL. You still do DROS the background check and wait 10 days. It’s not because “private” party transfers is not about secrecy. The Ca doj ultimately becomes aware of all the transactions I talked about in this video.

@@tbonekenny yes. Have your parent ship it from their local FFL to your local FFL. You’ll have to call around to find a local FFL willing to do it. Things CA needs: letter of gifting, including SN of pistol and addresses of both parties, parent’s Drivers licenses. What the CA FFL will need from you: FSC, DL, Second proof of ID. If this is your first pistol, there’s more to it.

@@greglewls2749 if you or your father is an FFL that’s okay. If neither one of you is an FFL, doing only CA online registration violates federal law. The CA online transfer paperwork doesn’t reflect federal regulations which in this case is 18 USC 922 (a). What I recommend: keep it simple and delete your post. Delete any post saying anything about your firearms your father gave you. If caught, blame the CA DOJ. If you want help on it let me know because there’s a lot of legal regulations (CA, UT and Fed!!!) around this and it’s easy to break the law if you rely on CA DOJ.

How does interstate interpersonal transfers work? Would it be the same process? Is an interstate interpersonal possible in California?

​@@tbonekenny you mean the sender and receiver are both within California? Both must be non-prohibited persons, they should both have FSCs. As long as the transfer is within the family you can use the online system. If the sender and receiver aren't in the same family, you can't use the online system and have to transfer via FFL and do the background check. That's the normal Private Party Transfer. Note: The online system will accept transfers that violate State and Federal law. Only use the online system if the sender and recipient of the firearm both have residencies in California, and are within the immediate family or approved family list.

make sure model numbers, colors, and calibers are the same, or go to a different FFL lol.

Every maker has a different method and even within the same maker it's inconsistent. Even then it will not note nuances like Glock Austria vs Glock USA. Your best bet is to advise what you're looking for then ask for help. Good luck.

I would say no because you are not bonded by any governmental agency or police department. I did that job myself but in Virginia. And if there’s one thing we were drilled time and time again was that we were not cops. We were not law-enforcement. We were private citizens that did a job that empowered us to arrest very specific persons. Our bell piece was our warrant. Obviously federal law gave us rights and abilities as long as we were doing that job. But still we were not law-enforcement officers. The guy who trained me and my partner was a retired police officer and he constantly drilled into my head, do not even let people believe you are a cop because you can still get convicted of impersonating a police officer. He was also a stickler for the type of badge we had because he knew somebody with the round badge that looked like a US marshals badge and they never corrected anybody. They get convicted of impersonating a US Marshall.

California’s intestate succession laws apply. Similar to intrafamilial transfer. Will be doing a video eventually on estate planing issues like this.

My barber has duel residency CA and TX he has purchased firearms in Texas. Of course firearms not on the CA roster. But it’s a gray area when bringing those firearms across state lines I assume since “they’re illegal” in the state of CA. A bunch of BS in my opinion.
