Assaulted for flying a drone | A cautionary tale

11 ай бұрынI was assaulted in Clay Banks park near the American River in Rancho Codova recently [08-06-23] for simply flying my DJI Avata in the empty and open park. There was a trail that went along the edge of the park where I met a mentally ill Terry. I detail what happened, what went wrong - what I did and offer some advice on what I could have done differently.

Great suggestion and in fact for commercial work - I do use a chest mounted bodycam similiar to law enforcement that clips onto my vest. Unfortunately for me, I was flying as a hobbyist and did not wear one. I even had a GoPro with me for filming that I didn’t use either. This was one of those 0-100 moments in the blink of an eye that really made me re-evaluate the absolute NEED for a camera at ALL times. As an update to the story; a woman contacted me from a local Facebook group and actually gave me a picture of the guy that assaulted me. I forwarded her information to the police department and they ended up closing the case. The justice system in California is abhorrent. They had my testimony along with an eye witness and now the identity of the individual and the police STILL did nothing. The woman out of safety would not release the identity to me so I unfortunately cannot sue him, but I am looking into further action. Thank you for your comment as it’s really important to learn from something like this.

This is the reason why I don’t enjoy flying my drones anymore. I’m glad you’re alright from that assault.

I appreciate it 🙏- yeah it took me several days before I could even touch the Avata. Now I’m not sure I want to even repair it, but I know I have to. I don’t want that A-hole to destroy my enjoyment with this drone, but I can definitely relate to where you’re coming from.

Dang, first a foremost I’m glad to hear you’re OK! I’m glad to hear you didn’t escalate the matter since yo my were carrying. If he would have escalated then you then you would have the right to protect yourself. Yeah, just like you,here in Southern California there is a huge problem with mental health. Stay safe and always keep your camera rolling for your own self defense🙏

I was physically threatened while shooting a North Carolina Trailer park and then again about two weeks ago filming a Stone slab business. I expect it to be worse once the Karens figure out how to use remote ID apps. I've also had a few incidents in my neighborhood while testing cameras or batteries over my yard (usually about 10 feet in the air), just verbal though. They don't realize that they face more privacy issues with second floor windows around them than one of my drones, flying in my yard below their fence line. Funny fact though: I was also threatened by a contractor on a job site until he found out that the bank was not going to give him partial payments for the job until they got the pictures I was taking. He was my best friend after he found out why I was there.

That’s really funny, but sad at the same time. Crazy the miss information and stigma around drones. Do you use body camera or vest or anything to make yourself look more official? I don’t have as many problems on the commercial side of things - in partial credit to these things. I appreciate your input though; at least I’m not alone.

I use a vest for almost all jobs...have been since some lady almost ran me over in a parking lot.

The Insta360 Go 3 camera would be perfect for something like this. You can even set it to come on with voice control. Wear the medallion under the shirt with the thumb-sized camera on the outside in the standby mode until needed.

Curious, are you going to be wearing a go pro at all times in the future? I have dealt with one guy that got really upset with me and I was able to de-escalate but I wish I had a camera strapped to my chest in case. I’d like to know your thoughts. Thanks and wish you a speedy recovery.

Funny thing is I have a body camera and vest for my commercial work, and I’m rarely ever bothered to the degree that I was. Go figure, in the middle of nowhere trying to be alone is where I ended up getting assaulted. I appreciate your story. - at least I’m not alone. From now on out, it’s camera always and pepper spray.

Wow. I presume you filed a police report. I once had a DroneBase job to do flyover shots of a fenced-off small house up a dirt road behind all kinds of no trespassing and other threatening warning signs. So I wore my 38 on my belt while flying. But no one was around. I do now wear a GoPro on my chest along with vest, etc. Maybe now I should wear my bear spray. There are crazies out there!

Yes, it would have been so much better if you could have filmed the incident to share here but also to give to the police. They have facial recognition software that can find the guy so he can be prosecuted and pay for your loss that he destroyed. The crazies seem to be multiplying. It's getting so hard to make ends meet with the rise in housing, food, insurance, vehicle, utilities, etc. A lot of people are finding themselves in bankruptcy losing everything. Maybe this guy saw the article on the news about drone footage being the cause of one guy losing his home insurance. I guess the Insurance company was looking for reasons to drop people and this home had quite a bit of clutter which in fact does cause huge problems for fireman during a fire event. Layoff of high paying jobs in the tech sector multiplies this issue then there's the tech companies requiring people to go back to work at the office 2 or 3 days a week that has some people in a tizzy. It's possible this guy isn't normally like this but he has been driven mad by the national spiral for the last 2.5 years that might have affected him more than you or I. As an avid bicyclist myself, I don't like hearing stories like this because it gives all the good bikers a bad name. People already get perturbed when a bike is on the road. Ironically cyclists get the same scorn as drone pilots do so they have that in common.

Well said! In our argument - I had mentioned that. I said something to the effect as the same reasons motorists hate bikes on the road, your hating on me. You give bicyclists a bad name. In regards to your 360 camera idea; I actually had a Hero 10 on me as well as my iPhone and Canon R6 II for filming KZfaq. It escalated so quickly I didn’t even think to film. I’m going to go with an always film mentality from here on out for sure.

He most likely rides that same route often, spread some cut tacks on the trail, nothing worse that getting a flat tire when you are on a bike. If you had a pen knife with you you could have stabbed his tire, hard to pedal away on a flat tire. Bicyclists where I live are rude and go zipping down the trails when there are little kids walking with their parents, they have other places to ride but why ride on a walking trail?

Well to his credit he was riding down a bike trail, but that’s where the niceties end because he was a terrible human being. Pulling off the bike trail in a field to assault someone for practicing a hobby by himself in an empty field is crazy. It does give bicyclists a bad name for sure. The fact that it went 0-100 so fast - I was shocked more than anything. I’ve never had a guy get so heated while simultaneously remaining on his bike; he really gave the feeling [body language] like he didn’t want to fight while at the same time sounding like he wanted to fight. Then he took the cowards way out by taking off as soon as he sucker kicks me. I feel pretty confident that I will find him.

Glad you Are ok. So did the Cops Show up? Was you able to press Charges for Being Assaulted. Anyone take any photos when Assaulted? He should have to pay for your Drone And be charged with Assult. I hope you get your Day in court

I plan on staking out the area as the police have been worthless. Took 25 min to even show up and another hour to begin canvassing area. We have this area by nimbus dam and across street where all the bicyclists park that has a camera and when I told the officer about it he seemed completely disinterested in it. Since he all decked out in pro bike gear he probably uses the trail often, so I’m going to have eyes and ears on that trail including stake it out.

I would have held him till LEO arrived. Then minute he puts hands on you, then yeah it's assault. You are starting to armchair quarter back the whole situation. You did nothing wrong. He destroyed property and put hands "feet" on you. Just because you pull a firearm doesn't mean you have to fire. I can yell loud enough he would probably shit himself and lay down on the ground for cops to arrive. In life mistakes happen, but you never need to apologize for someone else's bad behavior.

Don't be further victimized by wasting a lot of time trying to find him. Cut your losses. But you might post some "WANTED" flyers along the bike path with description, etc. And he might squirm if he sees them of the police looking for him.
