Thanks a lot. I filed a lawsuit against my former employer in 2018, and it is still going on! I fall in the whistle blower retaliation/discrimination/wrongful termination category with all the aggravating circumstances that you mention (evidence, documentation). It has been a nightmare, but fortunately a very aggressive firm took my case. We are living the corona virus alerts, so the case is even slower, nevertheless I don't care because my lawyers are fighting for me, no more re-victimization. Actually, believe it or not my lawyers are humans! (emphatic). Thanks again.

Very helpful video. I was wrongfully terminated by FedEx for complaining to Osha about safety issues. I was bullied by management before the complaint and it got worse after. My last check my pay rate went down. So much I'm going through to tell it all. Think about this folks before giving FedEx your business. The employees are going through hell to earn money and get you your packages. Because of FedEx Ground in Quincy Ma. I'm now in the hospital to treat my severe depression and suicidal thoughts. I got inappropriately touched at work went to my boss’ boss, went to HR nothing was done, filled a police report, reported it at work again, nothing was done. It’s been a few years and I STILL have to work with this guy at least once a week. If you’re in doubt see a lawyer, Dont hesitate.

I’m glad that you filed a police report; it makes no sense why ppl who complain about this illegal activity, but don’t call the police for assaults. I hope you’ve found a better way to make a living.

I’ve had to sue for wage theft, sexual harassment, retaliation, intentional infliction of distress, emotional stress, assault, discrimination, defamation of character, etc.

Maritza Romero yes, fortunately I have a good lawyer and always had enough evidence to back up my claims. I’ve been part of class action lawsuits as well, those have always helped out.

Timely video for me. In Alaska and was fired for not being a team player and not covering up years of failure to follow FAA and FCC regulatory policy. The most egregious example could have resulted in a $255m fine. Granted it would have been negotiated down. I tried to be a team player and fix these issues internally. In retrospect, I should have just gone to the FAA, FCC and OSHA. I think things would have sucked less in the long run. Boss and peers were more concerned about looking bad than regulatory compliance. At the end I was burnt out and jaded. A team builder was brought in and he started an argument. Team builder later admitted in email to me he handled the situation wrong. Lost wages and benefits total so far approaching $200k. Attorney proceeding with first volley next week.

PLEASE take this video very seriously if you are thinking about suing your employer! This is the best KZfaq video on this topic. I am knee deep in that difficult phase and I have gone through almost every scenario you mentioned. It is tough. Very tough. Even though I don't think I would do anything differently, I do wish I knew this information ahead of time so that I could be better prepared emotionally. I am reliving every instance, and even those events that I had documented but already forgot about!! Thank you again for this video. It is a perfect warning or preparation for anyone who has been recently wrongfully terminated.

thank you for shedding light on this complex subject. without given a reason, i was forced to resign & repay the sign-on bonus & relocation allowance recently. many employers like mine fully exploit the gray area of law & lack of resources in their (ex)employees. it saddens & angers me how much an employer or those in power can get away with precisely because of the roadblocks you mentioned.

Thank you so much , mr Robertson . All your advice gives me an idea can start fights big company currently I am still working. (I almost quit the other day because who sexually harassed me still working on the same shift with me) I didn’t realizing this company wishing to me go away until I watched your KZfaq post. I told HR what happened and they act really care but its not going to change a bit. Its very hurtful but hope I can find attorney like you so I can trust. Thank you for your great advice.

Hey!. Great video, very good insight. I resently won a labor board case about six months ago and still I haven't been paid?. What should i do? hi Robert, This is very good content and very helpful. I have a particular case for my friend. The brief description below in Points, 1. He is working in Investment banking and Resigned recently and serving the Notice period. (Before Corona Virus hit the world) 2. For health and safety purpose he requested management for Work from home, but as per company policy, he is not allowed to Work from Home and has been told to come to office till last working day. ( this in 3rd week of march ) 3. The important thing is >> He is asked to get the test and submit a medical certificate on Corona, if positive or Negative. 4.Conclusion>>If Corona Report is Positive Management will release him as soon possible if the report is negative, he needs come to office till his last working while all his colleagues are working from Home irrespective of Corona threat. 5.His Points..He wants to sue the company if Corona Test results positive because till now Management didn't allow him to do work from home and also he will be in risk by coming to office till his last working day. ******Please advise what will b a proper way to go legally on this Particular case*****Very important and looking forward to hearing from you soon.

I heard you talking about how a “good”lawyer can help you through the process of a lawsuit because it’s stressful. I also heard you say that you need to trust your lawyer. My question is how do you know that you are hiring or considering hiring an attorney that is good? How do you know if the attorney you’re considering is honest, knowledgeable and talented? Are there signs to look for? Are there things that I should be asking them in order for me to be able to evaluate their competency? I’m aware that you can go online and read reviews and comments from past clients regarding their experiences with that lawyer. However, everybody is different.. everybody’s got a different perspective and experience. Negative comments might not accurately depict the lawyer. There are disgruntled people, immature people, and people who are mad because they just didn’t get their way. I want to evaluate the lawyer based on who I am and my perspectives. I want to discern for myself. How do I do that? Do I just have to pick a card from a hat and hope I get lucky? Or is there some guidance that you can give me to make the best decision for my situation? Any pointers would be appreciated. Thank you for what you do here on KZfaq. I know knowledge is power and you are providing that knowledge through your platform.

I was put as the butt of jokes and rude comments by my boss who is an attorney. Even a comment was written about me to be on display at a company meeting which stated my first name - drop the ball - and then my last name. Everyone else listed had nice things written about them but me. I still have a copy of email with the word doc that stated that comment. I was told she was only kidding, but it was bullying, specially since the idea came from her spouse and she distributed it by email to the team at work. Her comments were demeaning and rude.

Hello Mr. Branigan. I just saw some of your videos and really like them. My friends are working in a Fast food restaurant in Canada. Their manager is very unfair to them. They are working for 35 hours but getting paid for 25 hours per week. Moreover, he is doing discrimination at work. All of my friends are very depressed but their Permanent file is under process so they don’t want to take any action. They all are so stressed out. I saw some of them crying sometimes so badly. Can you please suggest something?

I’m a CDL Class A city driver, brought up issues about trucks violating DOT regulations and rules & regulations that aren’t being followed at my terminal. Let my manager know that I would be speaking to HR and his boss, which lead to him telling me in the same day that work is slow and put me on “on call”. So now I’m just sitting at home not making any money which I need.

My employer asked me to help her conducts interviews to hire an assistant for a store I was managing. After interviewing a paticular applicant that I really enjoyed and wanted as an assistant, my boss made the statement that she wouldnt have to pay her (the candidate) much money because she was older and invaluable to the job market. I told her that that was inappropriate to say that. Anyways, she hired the candidate and fired me out of nowhere like 3 weeks later. She said I violated every requirement in the contract. The candidate quit soon after I was let go. Can I sue her for wrongfully terminating me?? In my original contract she stated that IF I violate any contract agreements I can be written up and 3 write ups may lead to a termination and I never received a write up for anything. Ever.

Another great and informative video! BTW... EVERY SINGLE POINT PRESENTED IN THIS VIDEO APPLIES TO BRINGING ANY LEGAL ACTION!!! I do mean any legal action, especially any type of tort. I have been in civil court (which can be very uncivil) as both Plaintiff and Defendant more times than I can count on one hand, and it is: not fun; consuming of your emotions, time, joy, finances, you name it; painful; and as the prevailing Plaintiff you might end up with piece of paper called a judgment that is more useful in the bathroom, fortunately not in my cases but I have seen it happen. And it “feels” extremely personal, like the worst violation you can imagine, but in reality it is a process that takes mental toughness similar to a Navy SEAL to push through. Still all good with filing your suit? OK, you might make it through then. But indeed, first make sure you trust, trust, trust... did I say trust?... your attorney and follow his lead and advice. If you are in the CA jurisdiction, I believe Mr. Robertson is high on the A list of counsel you should be talking to. Why? Because his presentations here are chocked full of excellent advice for most any type of action and especially workplace law situations.

@Key Preacher, I understand. A legal action is a no holds barred, brass knuckles fight. To go through litigation when it is personal is difficult to a degree that as indicated by what you said "It's better to just find another way to earn a living than to bring in such toxicity." Litigation is TOUGH, PERSONAL, and HARD; and is the last place anyone truly wants to be. But to receive justice and be made a whole in society means fighting in the legal arena. Mr. Robertson provides very real insight and truth relative to that fight in this particular video post. I can say that because of all the experiences I have had in court as a Pro Se litigant with a 100% win record. Litigation is neither fun nor easy, but it will provide a measure of justice and compensation if you have a case with i(s) dotted and your t(s) crossed. I pray you find and receive what is righteous in your situation.

I work In a medical waste plant where we deal with needles and blood daily, well the lights went out in certain parts of the plant. So I told my employer that I can’t work if I can’t see, I’m not going to stick my hands in a bucket full of needles and blood when I don’t have any light to see, so then he tell me well it’s part of the job go home. I was wondering how could I go threw osha to try and sue or is it even possible for me to sue? It’s not part of my job to work in the dark it’s going on a month now and he has yet to get the lights fixed, please help

Depending on your state’s laws on the matter, once your doctor has identified your physical limitations, you can request a “reasonable accommodation.” I made a video about reasonable accommodations so I recommend you watch it.

The statute of limitations depends on the type of claim that you have and the type of employer you have. In most cases folks have somewhere between 6mo to 2 years to bring their claim. However, some statutes of limitations are shorter than that and some are longer. Usually, when folks realize they may have a claim, they should call an employment lawyer and let them figure out if they have a case and what the SOL's are because it can be very complicated.

@Branigan Robertson I have a question. My company is headquartered in Cali so I was hired out of California but I live in TN. How does that work in terms of the law? I believe my paper work says according to CA law… so does that mean I would need to be represented out of Cali or TN?

Most likely you'll need a TN lawyer. Most employment laws are based on employee residency, not where the corporate HQ resides.

Hey I stay in memphis tennessee. I was wondering do you or can you take out of town cases? My manager is stealing from our payroll, not paying us all our overtime, even from the stores themselves. He even cheated us out of our Christmas. The owner of the company knows about this, but take a blind eye to it and everybody has just gotten comfortable with the situation. We only get check studs maybe three times a year and they not even in order or some missing

My wife was recently terminated from a pizzeria that opened up in December of 2019. When she was hired the position paid 12/hr, within a week the owner offered her a salary of 30k annually with a 2% stake in the company. She never signed a contract for this salary. After being fired she returned to the location and requested payment of her wages at 12/hr plus the overtime (she averaged over 70 hours per week and worked 14 hour shifts four days in a row per week). The owner asked her to sign a salary contract after she was terminated that asserted she was only owed 557$ for the two week pay period. She refused to sign the agreement and the owner has since publicly stated that she's refused payment, detailed the reasons for her termination and listed information obtained from her resume. We're pursuing redress through the labor board for the unpaid wages. What civil recourse is there?

If you're in CA, you could hire a private lawyer like me, but the problem is since she only worked there for a short time, the amount of money at stake is relatively small. But I think the Labor Board is an excellent option for you. The Labor Board does a great job on small cases. They are slow due to the sheer number of claims filed, but they do a pretty good job (in my opinion).

I was making $140,000 a year when I was wrongfully terminated 15 months ago. I have a case thats in process now and looking for a good offer from the employer or possibly going to trial because I computer $2MM in damages and they offered us $25,000. My question is, how far out into the future should I sue for front pay? I am still unemployed and have no idea when I may be making that kind of money again so I figured I may get a job paying $100,000 and damages of $40,000 per year from age 37 to retirement at 65. Is this appropriate?

Nope. No jury member in their right mind would compute damages out for that long. When you get closer to trial, your attorney should hire an economist to run these numbers for you. That will lend your situation credibility. The furthest I've seen projections is 10 years, but that was for someone in late 50s and their job prospects were minimal.

I have repeatedly been verbally abused by a co-worker whom I manage. He has 2 convictions of Domestic violence and one active open case. My director is aware of this and has done absolutely nothing to stop it. I have literally been physically sick, can’t eat and suffering emotional and mental distress. Then I was asked to work from a different location due to the circumstances he has caused. Might I add I am a survivor of domestic violence and abuse myself. I have several witness statements and one which the director tried to intercept and hide, but got caught in the act.. I can’t make this stuff up🤦🏼‍♀️

I just wanted to know if I had a case. company flew me out here to Guam on a contract my first contract stated that at the end of my year I would get a completion bonus of $6,000. It also stated that I was not eligible for 401k and then I asked him to give me that money and they turn around and put it in 401K which I was not eligible for. or seen any kind of package for a 401K plan. Also stated in my contract that they would give me a car and then after my contract of 2 years that it would be eligible for me to purchase. I told them I do not want the car and they took it out of my travel subsidy anyways without my authorization. Also in my contract it states in there that they have to give me a month warning if I'm getting fired or let go. They fired me. And are refusing to pay me my last month's pay and all the other money that's in my contract. I just want to go home. sorry for making this post so long.

Question im working at a job 5 months now that job went downhill fast first in the interview i let him now that i got experience in this job and i showed him wjat i got maybe hopefully i could get a better pay later company lied and i told him that will they change my schedule or will it be the same every month company lied no ac in the kitchen got heat rashes and felt dehydrated when it was summer wet pass 90 degrees i felt like I was working in a desert in the kitchen they cut my hours and gave me 3 days off this month for no reason they want to change my position permanently without even let me know before if I approved i really feel discriminated and and feel like that job see me as another number what can I do what could I do thank you

Hi I'm not a Florida and I have issue where I'm working never been written up always on time always doing extra when they asked for me to do extra I'm always willing and able to perform my job without a problem lately I have had this problem where somebody's been threatened me and also tracking my vehicle just as well as the transportation that I drive for the school I did go to HR and complain about it nothing has been done told him about the phone told him I also about the little try cuz that they were putting.

A lawyer asks a client to carefully and accurately say what happenned when you wanted to appeal a case then after explaining he said you had interests which conflicted.I replied ok I'll describe that one phrase differently.I never heard back from lawyer, and that happens a lot.Most lawyers just ignore you if it isn't a case that is or could challenge i.e. 3rd parties without being diligent enough to get a better understanding of advising to make clear disclaimers that show how to gain trust of 3rd parties and then move on.

So I received my paycheck before I was let go, and it was for a total of $41 when I worked a double shift, I’ve been let go of the job for unknown reasons I haven’t done anything wrong and found out I was underpaid. Every other hostess got paid 15 an hour and he decided to pay me 14 but I didn’t even get paid 14 an hour for my final paycheck. Should I pursue it in court? I need opinions.

I got injured, but didn't want to sue my boss.. I wanted to sue the manufacturer of the machine that almost amputated my fingers because it was made without a safety guard to prevent what had happened to me. My boss said he will go after them instead, so I am still waiting. Did I make a wrong choice 🤔

So I just got back from quarantine due to covid.. And right after I came back on Monday following up tuesday I got fired because supposedky I was lazy or slow... I wasnt being lazy I did the work they told me to do.. And on that I didn't even get paid because that pay went to the loan so I pretty much didnt get help from the company I felt like I git screwed over.. So the boss used my paycheck to pay the loan but I told him I don't have money I'm broke I was counting on this paycheck.. I don't even know if I should sue

You should still sue. Find an employment lawyer that's Pro Bono and they can tell you if you have a case. I sued a previous employer for wrongful termination and won

I stay in India, my boss physically hurt me when he was passing through me and he even didn't said apologize instead on next morning he told in meeting that everyone is onus to listen to their senior which was a sarcasm to me. So, he was very powerful in the company and I didn't said to any employer though it happen in front of everyone but they didn't noticed at that moment. Even telling to HR Manager will be a big issue. So, my boss is onus for any penalty ?. Because, I left this job and forced myself unemployed. Sound gloomy but I don't need any pitiness or mercy, I just want to hear true from your side as advocate and show me difference between law of USA and India for this situation mentioned as above.

I've never filed a case. After the vax mandate I was accommodated with an exemption by my employer. The project lead is a notorious control freak, he felt I wasn't doing my part to "safeguard the population" and that's when the harassment, unfair treatment and intimidation started. I was fired today. I don't want to go through a lawsuit, but the right decision isn't always the easy one. That project lead needs to be held accountable for his actions and stopped from doing the same thing to anyone else. Although I'm totally stressed and losing sleep over it, these videos are amazingly helpful and comforting, the more I learn. I have a case.

You know how to relieve your stress? Find another job so Income is not cut off and you don’t need to worry about money. meanwhile your lawyer can handle it and he can mention in the demand letter that the company pay for his legal fees.

surprised? you shouldn't be. you are contractually obligated to work certain amount of days/hours a week if you can't then it's your problem. maybe you should have tried to renegotiate the terms of your contract beforehand.

Objectionable! @ 2:00 when an employee obtains a new job it is non of the old employers business what they making as they took a risk that was a bad debt, now they have to pay their damages lost wages as if he or she was employed from the time they were discharged to the time they were offered back their position.

I’m about to file a lawsuit, I thought I had a good case, and damn sure a good cause. But I’ve never been in a court room battle, I tend to shy away from That stuff. But after getting treated like a 4th class human from my job, then fired for no reason, even though I somehow had three write ups, that I’ve legit never signed nor even knew about. I was homeless when I found this job, making 85k-90k a year, I was willing to do anything to keep my job, so much it has almost killed me. I feel like I was used for my tax credit, as I’m a protected veteran, and then tossed out like trash. They couldn’t even let me go in person, they called me at 5:30pm on a Monday… and couldn’t give me a reason, then didn’t pay me for the full week, as I technically still have yet to receive a formal notification that I was terminated. I truly don’t think the person who tried to fire me had the power. And he was also the one I had issues with, and was planning on filing a claim with EEOC. Didn’t get paid my vacation time, three months of commission they swindled me out of, so now seeking restitution.

So i think i have a good case and am definetely outraged on matter. My circumstances involve workin for contractor exclusively for last 8 years. Ive worked entirw time as a 1099 employee and had no issue with that until i recently started realizing what that meant for me as i was not told or understood reprocussions. Keep in mind im 95% sure now i am very very misclassified. Now contractor suddenly calls meeting and drops bomb on us that they sold company to some big wigs on the inc 5000 list.... now this company is continuing the same practice and in my mind they are also doing their best to cover their tracks and limit their liabillity. They can file all the tax forms and even comp waivers they want to but that does not change fact that they are continuing to misclassify a whole 10 man crew of employees. I say employees bc they schedule, i get paid by hr. I use their equipment, im expected to do training and take classes, they mandate certain ppe. Ect. Ect. But also want worker comp waiver and w9... Is it even possible that it is all on the up and up, am i over reacting to something that can be legit.... someone maybe advise me please or chime in on it.. i prbly have 1000's of hrs in over time in last 3-4 years alone that they did not pay bc 1099... my understanding watchin utube lol is that is not ok. My crew is considering filing a joint lawsuit now against both employers.... tho that is the last thing i want to really do. we feel very wronged at this point tho as we really did build the company ourselves with very little help from the money man.... thats all they contributed is the $. Now they get to just go sell it all and we expected to just bite tounge now and watch them all get richer off the pay and benefits we should be recieving.... it feels pretty fkd.

What happens when your boss lies about you but you win your grievance and he is still there because the company felt sorry for him because he claimed to have cancer then 4 years later see the same boss on social media cussing with proof videos but still nothing is done about it. Countless complaints from other employees how mean he is but HR keeps letting it happen.

I have been harassed since November 2022 and it’s still on going What manager tells an employee to not talk to the other associates at work? Is that even legal? From 2022 my manager has harassed me by believing those who are his friends versus asking me what’s happening. November 2023 told me not to talk to new employees, no training, and off the register I haven’t made a mistake or anything Now being told I’m going to be terminated because I chased the new people away I haven’t even met the new people been keeping busy with answering phones, customer service learning new things at work, and watering the plants Management blames me for losing three new employees 1st employee attacked another supervisor and I was not there 2nd new employee attacked another employee and I wasn’t there 3rd new employee quit and the management said I made her quit, I haven’t even met her nor have I talked to her He threatened me on April 2024 that he will terminate me if I speak to a new employee and if I touch the computers Can I sue him? And who do I contact?

What if your employer doesn't give you bathroom breaks and makes you as EVERY TIME? No one else has to ask for bathroom breaks. I am afraid to ask for them because the managers act like I am putting them out and being annoying. I wear diapers to work and bladder pads to work everyday. I am so humiliated. I am diabetic so I need more breaks for restroom. This has been going on for over 2 years but today I had to wait 6 hours for a pee break and lunch break. I am totally done with all this BS. Should I even bother with legal help? I need my job for the health insurance for my husband's foot with a hole in it that neve will heal.
