The plaintiff says the defendant is his hellish next-door neighbor, whose brother rammed his car into his fence. He had to have it repaired and the defendant won’t pay for it, so he’s suing. The defendant claims he had someone lined up to fix it at a third of the cost, but the plaintiff went ahead on his own.

I swear I seen almost every episode of peoples court, if I ever sue or get sued I will know exactly what to do lol I will have a folder full of evidence, photos, videos, witness testimonies, and more! lol

Yet why agree to anything if he is trying to put it on his brother? I'd understand if he was actually telling the guy to go after his brother but he is not he is somewhat agreeing to fix the fence.

I feel like Judge Judy would have awarded the plaintiff since it was his "guest" and told the brother to recoup the money.

That would only work if the brother was a guest and did not simply visit the property for whatever reason. Just because he is the brother of the renter does not mean he is always welcomed at the brothers home meaning he isn't a guest, and unless the brother invited him he isn't a guest

That would only hold up if it was a signed rental agreement saying that the renters is responsible for his/her guest. If my brother kills a man I wasn't there and had no clue it happened, can or should I be allowed or ordered to serve part or all of his time? I think not

Some people get really emotionally attached to their fences. Clinically it's call fencefantasia. Although it can take up to 2 years therapy is the best treatment.

I love that this court has the judge and her spouse answer a question at the end. and on Judge Judy's newer court cases her and her granddaughter talk about the case that was just on. it gives you insight into what a judge is thinking. it is informative.

There was a brother. The defendant even states that the plaintiffs brother came to his house and they talked about him hitting the fence, and the brother told the plaintiff he would pay for the repair.

But was he a guest? The defendant wasn't home at the time and it didn't seem like he had given him permission to be there, either way we never got to know. The grandfather might have.

No it’s the grandfathers home . The defendant was not even in town . His brother was visiting the grandfather , and he hit the fence . If anything sue the grandfather and the brother .

This was the worst Judgement I have ever seen by Judge Millian. If my brother kills a man and I had nothing to do with it, can I serve any of his time? No I can't, nor should this man be financially responsible in any way. Worst call I've seen

That’s not really relevant on the same lol. When you have guests at your house and they damage your neighbours property it’s on you. You then can sue your brother for the damages you paid because of him.

How hard is it for adults to be adults? We share our fences with neighbors and one side came crashing down last year. Our neighbor paid for it to get fixed and we paid her back, monthly. 1700 bucks for half of a fence. Expensive but damn fences ain't cheap, especially if they are done right. Now to just get the other neighbors around us to fix the damage their dogs caused.

Also during covid. We just ended up doing a cheap repair cause it was going to be expensive. It worked out since the part of fence that needed fixing was seen or used by anyone so we can just do a cover up job lol

How many times have I heard Judge Milian tell someone that a promise is just a promise, and not a contract!?! Why did she order the defendant to pay anything at all? This was just wrong. The defendant had nothing to do with the damage, and despite his offer to help out the plaintiff, he should not have been held to that so-call promise.

Her decision hinged on the legal theory of Detrimental Reliance. The fact that the defendant committed himself to helping financially, coupled with the fact that the plaintiff “relied” upon that verbal commitment, to his own potential detriment, is why the defendant was ordered to pay. Had the defendant *not* made such a commitment, the plaintiff could very-well have decided not to go through with the repair, and would therefore not be out of the money that he felt the defendant owed.

Ugh. I can't stand when people add whipped cream to their story so they sound EXTRA amazing. "I told him I trust you, you do great work, I'm really impressed by what you do, I feel as though your work would be excellent for the fence, and I know that you would be a great person for this job at a reasonable price." 100% that conversation did NOT happen. This is how it went for someone who went to small claims court: "You're a carpenter, right?" "Yep." "How much for the fence?" "(cost)" "Okay, come at 5."

These Cases Are becoming very contradicting in a sense the judge would say promises are things that can be broken it’s not a binding contract but then also to say based on your promise they relied on that is very confusing very technical “if you tell me your giving me my rent money and i go pay my rent does that mean you owe it to me if you promised”

It's based on a legal concept/remedy called Estoppel. For Estoppel to be successful you have to prove that they relied on the promise (e.g take action such as building the fence), not all people will take action based on a promise, I think that is the disinction.

I think the tenant is responsible for what happens with his guests causing damage . Then he should be the one to sue his brother. I also think if the cost was reasonable, which it was, the complainant should decide who fixes the fence. He is totally innocent in all of this and shouldn't have to settle for a cheap fix.

The defendant repeatedly represented himself as the property owner. It wasn't until the suit was filed that it was revealed that his grandfather actually owned the property.

Good judgment. The lousy brother probably wreaks havoc everywhere he goes. The plaintiff sounds like a bit of a self entitled jerk. You can't tell me who the hell can fix your fence. If I can't afford that carpenter then we have to compromise and agree. Case closed. Glad the defendant won.

Actually your wrong. The plaintiff does get to pick the contractor, as long as it’s a reasonable estimate. It’s actually the law. Think about it, would you want the person thats already damaged your property be allowed to pick the cheapest contractor they could get and get screwed twice? Hell no, you wouldn’t stand for it and neither would I.

The plantiff can have anyone he wants to fix the fence if he so chooses but unfortunately this defendant isn't the one who damaged it. I don't agree with Milian's decision.

Accept that's not how the law works. If someone hits your car, you can't take it to the best mechanic in the state and have a $40 dollar fix get ballooned up to $500 because that's what the mechanic charged. The plantiff can come to court saying "I have this quote", and the defendant can also come in with another quote to show that the plantiff is being unreasonable. There's literally hundreds of cases on this show about this very thing. There's a reason why you're not a lawyer, and it's entirely because you don't know anything about the law and instead use your bias emotions. Maybe study the law for a few years before you decide what's legal and what's not.

I side with the defendant on this. That dance could have been repaired for far less. 2 entire panels didn’t need to be replaced. It would have been cheaper and easier to just replace the damaged boards. The plaintiff decided to go ahead and replace 2 entire panels, so he should be responsible for the majority of the cost, and the defendants brother should only be responsible for the labor and material cost of replacing only the damaged boards.

Okay if they share a property line, how is it just on plantiffs property? If it's a shared fence, which most are, how the hell does plantiff get to dictate everything? It would be both their fence. And how the hell is he suing the person who isn't the homeowner, or the person who damaged the fence. I am so confused.

I always thought that if one neighbor put up the fence it didn’t necessarily mean the other neighbor had to pay. What if they didn’t want a fence, or care? I mean of course be a good neighbor and freaking pay half!! I just didn’t think they legally had to? Pls let me know!

@@Kat-bu3bn We share fences and unless the neighbor damaged it, both parties have to share the cost. Just went through this last year when the wind knocked out one side of our fence.

When the fence was built, if one neighbor paid for it entirely, then he had to build the fence within his own property. The guy who built it owns it 100% even though the other neighbor gets the benefit of it. If the neighbors originally shared the cost of the fence, it can be built on the property line and they co-own it.

@@ButtonsCasey that's where you made your mistake. You should have sued the wind on TPC. Even if you lost it would be fun to watch the Judge yelling into the wind.

never ever tell somebody that u will pay anything for any damages . defendant would have not had to pay anything if he didnt say he would help pay. especially if the damage is cause by a person who hardly ever even contacts u to see if u are dead or alive . his own brother caused him to have to pay money to his neighbor .

so i can damage a guys fence then go to court with no evidence and tell a story and the judge will believe me? the defendant had no evidence of anything he said! was there a brother? was the person who knocked on the plaintiffs door the brother? i think someone schooled the defendant on how to avoid paying the full cost

I agree and disagree ; it’s the grandfathers home . The defendant was not even in town . His brother was visiting the grandfather , and he hit the fence . If anything sue the grandfather and the brother . However if the brother stepped up and offered to pay for it , then the plaintiff did rely on his promise . But again the amount was the big dispute .

Why would the defendant have the right to decide how much he should pay and who the contractor should be? I'm confused.

Me too. It doesn’t work that way with a car and it wouldn’t work that way with a fence either. I can only assume it’s because he didn’t actually hit the fence that she decided the way she did 🤷🏻‍♂️

Why doesn’t Kennan use his homeowners insurance or the auto insurance of the person who hit the fence with his car? The guy who owns the fence shouldn’t have to pay any money for repairs.

I have to know in a case like this where the litigants are neighbors and covid-19 lockdown was in effect. They are FaceTimeing into court but from houses next to each other. Do you send a bailiff to stand out on the sidewalk? Was that a meeting topic at some point?

What about homeowners insurance or even just being the homeowner…(renters also have an option to buy renters insurance) as if someone fell on his property and sue he’s responsible Or even the damn car insurance 🤨🧐

The judge is very inconsistent, recently she said 'it's not because a person promises to do something that makes it legally binding', and in this case, apparently it was, even though the person offering to pay had no legal obligation to pay anything as it wasn't even him that damaged the fence...

Plaintiff can't be to concerned if he isn't going to pursue the guy who hit the fence. My guess is the Plaintiff is paying Willie for the cost of materials and a slab. Plaintiff is then pocketing Willie's labour cost. A slab in Australia is a 30 pack of cans or stubbies of beer and is usually what we pay a mate for helping us out with something.
