Derivative Citizenship

If you have children under the age of 18 and you become a naturalized citizen, as long as those children are under 18 years old the day of your naturalization, they will also become citizens.
Once this derivative citizenship happens, you should file an N-600 to re-iterate to USCIS that your children are now citizens and take away the confusion.

Just completed N-600 for my son who is 17 and has a GC but has been residing in the UK for reasons of study. He should have returned to the US by now but still there because of COVID. We have put in a supporting statement to this effect, hopefully he will be approved.

@@florianschmidt5828 he was denied a US passport on account of him being out of the country in September, the month I got my citizenship but they said USCIS are different so he may be granted citizenship but haven’t heard anything since filing his N-600. He’s been back in the US since January, he is working here now and has his GC, if worse comes to worse he will have to wait a few years but will see.

This is my issue, I am an American Citizen born in America, I have lived in America for at least 8 years, but had two kids in mexico with my current partner, we are not married yet, but I want to ask for their citizenship, I live in mexico and work in America every day, do you think I can fill the form myself? Also, when I try to fill out the form, I don't get a specific field on the form where it specifies that I want to file for my kids citizenship, I only get a OTHER.. option where I have to explain what I am trying to do.

@@funhouse1077 If your kids are in Mexico, USCIS has no jurisdiction over them. Before they turn 18, please go to the US Embassy in Mexico and do a CRBA. It will work like their US Birth Certificate. If your kids are not in the US, they are not a US Citizen via CCA2000 because one of the clause states they have to be "legal and physical custody" of the US parent and entered US as a LPR.

What if this child is an adult living abroad with visa Truist and the us mother never registered the child as a us citizen. Child was born abroad but now is an adult. Should she file N600 being outside of the USA or inside the USA?

Thank you for this video. Inmigration laws are complicated, I agree that although a passport is valid proof of nationality, a certificate of naturalization is the definitive proof. Also as Mr. Hacking stated in the video for any paperwork /petition involving the USCIS a certificate of naturalization is required.

Inaccurate information. I am the actual derived citizen without a Certificate of Citizenship and I was able to file a petition for my spouse WITH only my US Passport. Unless it is revoked or cancelled, the US Passport is a conclusive proof of US Citizenship. At the end of the day, if Mr. Hacking shows his US Passport, do you think USCIS even has any authority over him? The exact same US Passport without limit is awarded to both US born, or naturalized/derived citizen and it shall have the same exact power, or someone is discriminating. As far as Social Security is concerned, US Passport is the preferred proof. I visited the Social Security office today and confirmed it. If they cross reference and gets ok from Department of State, they DON'T EVEN ask for a Certificate of Naturalization.

@@stevekim6862 I can confirm what you said. Anyone can see on the USCIS forms that they ask for a certificate of citizenship as something optional but not required. This video is misleading, this person is just trying to have you file for N-600 unnecessarily and charge you for it.

hello sir i was born in the USA year 1991 and my parents are both filipino. when i was 3yrs old they decided to go in the philippines and petition me as a dual citizen but in the age of 18yrs old it has a hearing to attend the recognition as a filipino citizen but on the said age me and my mother go to the bereau of immigration but they said that there is a new law for that like we need the affirmation of recognition and Id ...my question is what i can do ?i overstay here in the philippines or not? what should i do ?can you help me pls sir?Thankyou in advance 🙏🙏🙏

Can you please Answer me ? I just applied for citizenship of us. During the proceeder i changed my 16 years old daughter name and i filled up child information with new name uploaded court order to uscis. The officer who interviewed me said that getting a passport alone is enough proof of the kid's citizenship and doesn't need n600 application anymore if I opt to getting a US passport. So do you mean if he doesn't do the n600 and he wants to marry overseas in the future, the passport won't be valid as proof of his citizenship and cannot petition someone?

My wife just received her citizenship yesterday (naturalized) my stepdaughter (her biological child) who I raised since she was 2 who is currently 11 years old and lives with us in the US, is she automatically a US citizen as well, or do I have to wait until I get the approval of the N-600 before I can claim she is a us citizen and apply for a passport etc?

Hi, I have a question about N-600 form please, Part 2, Question 22 (Have you been absent from the United States since you first arrived?) My son 8 Years old left US once only for one trip 1 month and he came back, would that consider absence? very confused, because under this question they say complete the following information if you are claiming US citizenship at the time of birth if you were born before October 10, 1952. What if the parent naturalizes, the kid is living with his naturalized parent, but the kid didn't have a green card at the time? They've applied a citizenship certificate they took biometrics and are waiting for it. Can there be a case made that the child is a derivative citizen? Should the child apply for green card even after parents are naturalized?

Hi I need help please, the scenario the father became a US citizen back in the 80's from Haiti. The child was born in Haiti back in 1968 the father never filed anything for the child. The child grew up in the US & went to US schools & graduated as well & has never left now in the 50's. What does that child now an adult need to obtain citizenship or does the citizenship automatically get passed down from the father?

Your son is an automatic citizen already, all u need to do is go to post office turn in paperwork and get him his passport.

Sorry , but I don’t think u will automatically citizen even ur dad is naturalized..I’m naturalized 2014 and I petition my daughter year 2020 when Covid hits, so her papers kinda delay, but the USCIS email us that they will expedite coz she’s turning 18 this year, so she can get benefits under US child citizenship Act.. hoping she be here before she turn 18 and apply for her passport to be a US citizen.

I have the same issue, because l tried to do so, but when I started filling up the information, it asked to put an email address, when I put my email, the process didn’t got through stating that email address already in use for another account, also when putting phone number, it said phone number is belongs to another active account.

Hello. My family immigrated to the United States as political refugees on asylum in 1984. I was 4 years old at the time. My mother became a naturalized citizen in 1990 when I was 10 years old. My father became a naturalized citizen in 1999 when I was 19 years old. I am now 41 years old and believe I have a claim to derived citizenship through my mother. My issue is that I do not speak with my mother anymore and do not have access to any of her legal documentation… Is there any way around this? Please advise… Thanks!

Im in the same boat as you but i do talk to my parent, you need your mom paperwork to show to uscis that she is a citizen and you are under 18 when she was a citizen, you better come back to mama.

@@um8440 I became a US citizen on September 1, 2022. I didn’t claim derived citizenship through my parents, I just went and took the citizenship test on my own and passed. At the end of the day I’d rather earn my citizenship from my own merits and not just inherit it from my parents.

@@um8440 that’s great news! Congratulations! My step-brother automatically became a US citizen when my stepmother became naturalized as well. He joined the Marines, but couldn’t advance because he couldn’t get the security clearance due to having dual Hungarian/United States citizenship. We are originally from the country of Hungary which does not allow us to renounce our citizenship, so legally we have to keep dual citizenship with Hungary and the United States. In order to advance in the military you have to be 100% United States citizen. I’m sure I was technically already a US citizen as well, but like I said I didn’t have any paperwork from my mother so I didn’t want to risk it. I just applied to become a US citizen, took the civics test, did the interview and became naturalized on my own.

Thanks for making this video. I am interested in asking about your services and whether you have done a case successfully like mine. I'm a US citizen and have been for decades. I live and work outside the US. My child was born abroad. I needed to show evidence of 5 years lived in the U.S. I only have proof of 4.5 years. I'm short by 5 months. I want to ask whether (1.) I can move back to the US and live and work there for 5 months and then apply again from abroad? Or (2). If I should bring my family to the US with me on a tourist visa and start living and working here and then applying right away as a permanent resident in the US. If option (2.) is doable, please tell me how can I apply for my daughter's citizenship/passport here? I was told she is entitled to a passport right away. However no one can tell me what forms to apply and where/how to submit them. Additionally what documents / ID I have to submit. If you know please do tell me. Also how much are the total fees? Any idea how long the process for forms to be processed? Lastly, if your firm can also do this in Florida, how much would you charge me. Thank you.

Hello, I have a similar question as yours. But I believe that I do have proof of living in the us at least for 5 years not continiously but I have lived in America for at least 7 years. Here was my original problem and thr question that I asked earlier today, do you mind letting me know if you have information on how to file the form by yourself or if you had to get an attourney? Here was my original question .......I am so confused, I need some advice. I am an American citizen, I lived in the us since I was 11 years old until 15 years old, I went from 5th grade to 9th grade while living in the us. My parents decided to move to Mexico but my dad would still drive me to school daily in san diego. Eventually I graduated high school and moved to Los Angeles. I worked for 4 years in Los Angeles and moved back to Mexico after that. After a few years went I back to Los Angeles and worked there for 2 years and again went back to mexico to live with my girlfriend who at the time was pregnant. I had my first child 4 years ago and then another child two years ago. My kids are 2 and 4 years old, they live in Mexico and I live with them, I was born in California and currently work In San Diego, I drive back and forth daily. I want to get citizenship for my kids who were born abroad, but currently have no intentions to live in America. Can I fill out an N600 form myself to ask for their citizenship? Me and my wife are not married yet, but we have lived together since our first child was born.

@@funhouse1077 Hey, your case is easy - You file the circular birth announcement at the Consulate in Mexico. You just need proof which will be your old transcripts, job letters and apartment lease. Any bank accounts and medical docs etc will also help. You don't need a lawyer. Its straight forward for you. just show proof in USA. Your school records there etc as mentioned above. Go online to your local consulate and set the appointment. take your old passports, and driver's license as well as your transcripts etc..

You will be applied for N600 application proving that you are a citizenship as long as you don't turn 18 years old This is what happened for my daughter I have to apply here for the n600 coast more then N400 It's was $1,170 just to get the certification of naturalization because can't apply a passport because has to be proven you are a naturalization or US citizen I did it before turn 18 years old .

Supposedly, you can get your child a passport with secondary proof, which is a copy of your naturalization, birth certificate showing you’re the parent and the child’s green card

I became a naturalized Citizen in 2006 when my daughter was 4. Fast forward to 2020 my daughter was supposed to have her IR2 visa interview on April 23rd and travel to the US before her 18th birthday on May 23rd. Due to the COVID-19 the embassy rescheduled my daughter interview beyond her 18th birthday. Will my daughter still benefit for automatic citizenship under the the child citizenship act of 2000?

This was my original question and still looking for answers thank you........ I am so confused, I need some advice. I am an American citizen, I lived in the us since I was 11 years old until 15 years old, I went from 5th grade to 9th grade while living in the us. My parents decided to move to Mexico but my dad would still drive me to school daily in san diego. Eventually I graduated high school and moved to Los Angeles. I worked for 4 years in Los Angeles and moved back to Mexico after that. After a few years went I back to Los Angeles and worked there for 2 years and again went back to mexico to live with my girlfriend who at the time was pregnant. I had my first child 4 years ago and then another child two years ago. My kids are 2 and 4 years old, they live in Mexico and I live with them, I was born in California and currently work In San Diego, I drive back and forth daily. I want to get citizenship for my kids who were born abroad, but currently have no intentions to live in America. Can I fill out an N600 form myself to ask for their citizenship? Me and my wife are not married yet, but we have lived together since our first child was born.

@@funhouse1077hi you can apply for CRBA. As long as you live in the US before they were born. And CRBA is more cheap than N600

Are you sure? I turned 18 on 2/22/2001. This law started on 2/27/2001. I think I missed it by 5 days.

Hello.. I jst got my US Passport last year of July. I did the Adult Derivative at the US Embassy. Do I need a Certificate that says I'm a US Citizen? Why pay over $1000 for a certificate of citizenship when one can just apply for a US passport for $130 which proves US citizenship????..... Also you do not mention that for those on a low income the N-600 fee can be waived

Passports are not the end all be all for derived citizens. If you plan on joining the military or need a security clearance, then you need a certificate of citizenship or equivalent.

Makeup your mind. You can't include the word "automatically" become a U.S citizen and then add the following statement, that you have to fill out paperwork. Its one or the other, but lets say hypothetically, if both parents are "naturalized citizens" of the U.S. and the child is at the age that qualifies him/her to gain American citizenship through, I believe the term is "Derivations" or to Derive Citizenship, would it not be illegal and unlawful to deport said person? Technically? I mean I'm confused. If both my parents are naturalized citizens and in turn makes me an American citizen how can ICE even get the ball rolling to begin with to detain and deport the person? I'm sure white Americans don't have this issue, I can bet my LIFE on it. It boggles my mind. These are my parents, both U.S citizens and I am their child which would make me a citizen also ....simple right? What is there to prove? ....aahh its the color of my skin that's the problem.
