This kind of crap happens all throughout the workforce. I used to work at Costco where customers thought just because they pay a membership that they can abuse the staff and treat them like crap, and the management would (not) have the staff's back when an incident went down. I saw the same entitlement mentality many years ago when I worked in the airline industry. A co-worker was injured when a passenger grabbed her stapler off the counter and threw it at her at close range. That person ended up being banned from the airline and my co-worker was off from work for quite some time after that incident...and no charges for the sake of the airline's image. I know in places like NYC there are second degree assault laws that protect transit workers, but like in a previous comment, it really depends on the DA's...and right now there is a epidemic of corrupt DA's in this country. I spent 40 years in the workforce and I strongly believe ALL workers should be protected by assault laws.

Lol... I used to work at a vet clinic. We had this huge dog owner pin and start choking one of our tiny female vets. Male staff and his wife had to pull him off. Vet almost blacked out. After they were separated, the vet went to the office manager in tears. She wanted the cops called. The office manager told her she couldn't call the cops because the owners might leave a negative review. The practice owner confirmed this policy. Obviously, the vet quit shortly after all of this.

I was assistant manager at Sam's club. I stood up for employees a few times. If they ever file a complaint, regardless of what happened, its a $100 gift card and letters of apology from club/district and a meeting for me in the office. Even if they agree with my judgement they kowtow to the abuser to prevent a bad wrap. Even as they agree with me that they are only inviting more bad behavior. It becomes a problem of responsibility. You can pass the buck, shift the blame, say its not our problem just let it ride. Never thinking about what that does as a culture long term. Note I WAS a manager...

I work as maintenance at a grocery store and I daily get mistreated by customers. I'm normally collecting carts so I'm the last store employee they see. The most common thing I get is they are mad we are out of there favorite item or that checkout took to long. It kinda bothers me cause I just fix things and collect carts. I don't order product or man a register. What am I supposed to do about it?

You have to be a clown to think that Disney doesn't want this. Florida lawmakers very much love and need Disney despite the one moron running the State. Look at the size of Disney and how many people they employ and the revenue they bring to the state.

I've had DVC for 34 years, and while rare, I've seen some unruly guests. I'm 100% happy with this change in the law.

Disney has never protected it's cast members against a guest inflicting physical harm on them. If the cast member decides to press charges then that cast member will be potentially terminated and also cast members are just supposed to take the beating. Don't believe me start asking questions from cast members.

No, the general public has no right to file charges against another, you can make a police report that you were assaulted, but it's still up to the DA to actually file charges.

DIsney Park in Florida has sovereign rights to its territory granted by the CIA when they bought the land. They have thier own police force and cannot be legally compelled by the state. That's why there's a no fly zone over it. Look it up

@@Zan_JaynaDisney does not have its own police force. They have their security department but that has never been considered a police force. Orange county made the security department remove any blue or red lights and they never had the ability to enforce any traffic laws.

Hospitality worker here- look when you're in a hotel room, resort room, Timeshare, whatev that's your home away from home, it's laso technically soemone else's home you are occupying. Be resepctful. Don't trash the room the property and just do- whatever you want. If you want to do that, go back home. We have the right to remove troublesome guests we think are presenting a problem for the good of the rest of the ones who AREN'T Disney absolutely should follow suit, and make it abundandly clear such behavior isn't to be toterated- irreguardless of status. Crack down on this trash in the resorts and in the parks, and maybe ppl will want to come back.

Regular WDW guests (not DVC) or Annual Passholders (AP)… if they are found to break the rules, cause a disturbance etc… they are immediately trespassed, their tickets or AP are cancelled, and they must vacate their resort room immediately… and they are NOT refunded any money paid upfront. That money is forfeit. Maybe with DVC they just void your contract? Normally, you can resell your contract back to Disney of you no longer want it and they will pay you for that contract. Maybe they will just void the contract and you get no compensation for Disney taking the contract back? Just a theory/

Without any knowledge of how the share system works in this case, my initial feeling is that if the governing body wants to expel a share holder, the reasonable thing to do is to force a buyback of the share and then just bar him/her from returning. Isn’t this already done?

Disney will probably just void the contract & not offer any buy back if they trespass the DVC member. But they needed this new law to make their (Disney) rights to be clear so that the trespassed person can’t try to sue.

In Florida there is no duty to retreat before using deadly force in self-defense in any place you have a legal right to be, it is a "Stand your ground" state, so Castle Doctrine wouldn't apply in that way. There is a separate concept in Florida law that there is a legal presumption that if the defender is in a dwelling they have a legal right to be in and a person breaks into the dwelling, that it is presumed reasonable for the defender to believe the other person is a deadly force threat. That could have interesting implications in some weird case of someone being shot in the lobby, although again the person has to be in the commission of breaking and entering or a similar felony, not merely trespassing after entering legally.

@@ninersix2790 I was only focused on a hypothetical assertion of the presumption of a threat based on breaking into a dwelling, if there's separate evidence that the defender was in fear of deadly force harm then the presumption is less relevant. Basically the presumption is important if someone breaks into the dwelling but isn't visibly armed or is armed with a melee weapon but not immediately menacing, if they are menacing with a weapon or doing something else to present a deadly force threat that's an entirely different analysis. And I also was only focused on that piece, as you say the prosecution can separately argue that based on the totality of circumstances it wasn't reasonable for a defender to be in fear of imminent deadly force separately from the question of duty to retreat or the capability of the victim to use deadly force.

Castle doctrine applies to your home, any home in which you are an invited guest, your apartment, an office or place of work that you own or rent, your automobile, condos, hotels, and yes, time shares. The question has nothing to do with castle doctrine. Castle doctrine is about whether or not one has a duty to retreat when confronted with a threat before acting in self defense. You can not assault someone in your home when there is no reasonable claim of self defense, no matter how "home" is defined. The relevant questions in this case are "do the rights of the lessor supercede those of the lessee" and "can a tenant or home owner be removed from a property if they are found to be in violation of the lease". The answer to both of those questions is yes. It has always been yes. As it applies to the DVC employee, the law seeks to remedy a loophole in which the decision to take action was potentially the exclusive domain of DVC and not the injured party.

DVC owners are one of the least likely to assault a cast member. Most members actually really love Disney and defend cast members. Just because this was a rule, doesn't mean that DVC members were going around assaulting cast members. Holy crap, some of you lack critical thinking.

The laws are always stacked in Disney’s favor! My wife broker her arm on a ride at WDW last month and they know we can’t do anything about it. No apologies, nothing but an ambulance ride. Sad!

@@jennifereddleman6656 We were on the family raft ride at Typhoon Lagoon. We were holding the straps as instructed when my wife’s elbow hit a barrier, forcing her arm forward, braking her wrist. This was confirmed at Celebration ER. We spent 6 hrs of our park day dealing with it and they wouldn’t even give us some Lightening Lane passes to makeup for our lost time. Horrible customer service.

I don't know, I've saved thousands of dollars on Disney accommodations, and onthe rare occasion I haven't used my points, I can easily rent them for a small profit, and if I would choose to sell, I could do so on the resale market for roughly twice what I initially paid for the contract.

This statute essentially makes any timeshare just like a hotel. Hotel operators can decide they no longer want you at their establishment for, among other things, "illegally possesses or deals in controlled substances as defined in chapter 893 or is intoxicated, profane, lewd, or brawling; who indulges in any language or conduct which disturbs the peace and comfort of other guests or which injures the reputation, dignity, or standing of the establishment." Once they ask you to vacate, you must vacate or they can call law enforcement to forcibly remove you and, possibly, arrest you if you refuse. The statute (509.141) states "Any guest who remains or attempts to remain in any such establishment after being requested to leave is guilty of a misdemeanor of the second degree." So, if the operator tells you to leave and you don't, law enforcement will be called. It does no good to try to plead your case with the cop because their job is to see to it you leave, not to hold court and determine if the operator had the right to tell you to leave. There is also language in the statute that discusses refund of unused days when time is paid in advance and I don't know how that would work for a timeshare. I do know that it's not law enforcement's problem to figure that out if they're asked to make you leave. That's a civil problem to be dealt with in the courts. Bottom line is, if you do something to cause yourself to be kicked out, you're leaving one way or another.

Disney was already able to trespass regular guests (and often do). They are required to vacate their resort room immediately, any park tickets or annual pass they may have are also cancelled and they do not get any refund for the unused room or tickets. You forfeit that money. The problem, in this situation, was that as a DVC member this man was technically ‘in his own home’ and so Disney needed to consult with their lawyers about how to trespass a DVC member. This new law is clearly the result of that consultation & clears up any ambiguity that previously existed fir DVC members.

yeah, you don't own that property, you share it with 52 other families, most of which wouldn'r be happy about what you've 'done to the place' during your week. Would be a different story of you alone owned a unit, and didn't share it. You own that week at that resort, and usually a specific unit- which you can exchange for if there's soemthing available at another resort (fees apply). But for the most part- that's your little home for a the week you're on property.

While, I don’t think DVC members have the right to assault cast members. It’s still his property. I think this is completely wrong that they can bar him , it should go under a civil matter just as if it was a tenant you can’t just evict somebody from their property. It’s his property. he has a deed! This is a deeded property. He has property rights so sorry That happened but at the same time this is what happens when you try and shove a lot of people into a small house if you own the house you can have as many people as you want, if you rent then you Can put restrictions on how many people can be in a bedroom.

HOAs can foreclose on a house for non-compliance and that's a deeded property too. Government can take your house if you don't pay property taxes and that's deeded also.

More of a reason I'll never go back to Disney. The people that go there now since they changed the characters have changed. I've seen serious fist fights at these parks. Cursing yelling pulling hair punching dragging etc. This is supposed to be the happiest place on earth. It's the most expensive and the most violent now.

I don't understand why this law is necessary or how it benefits the "average Joe". Look, if someone comes onto your home property (not a timeshare) to landscape it and you get into an alteration with them (for whatever reason, and even IF it's your fault), you don't immediately lose rights to be in your home or on your property. The courts decide that. (If you hauled off and hit you landscaper for no reason and broke his jaw, well you might eventually lose your property anyway due to legal fees or going to jail.) But, i don't like this idea that the Corporation can overcharge you to live for a period of time on their property and essentially be judge, jury and executioner over whether or not you can remain there because you somehow "violated their rules". What if this was 4 years ago and as a timeshare owner you "violated" the timeshare management company's "mask rules", etc.? -- Do they get to permanently eject you from the property you've paid into and have deed rights to be there?
