That was terrifying. A judge is basically deciding my future and they're worried about whether or not I'm wearing cologne?

The system is really broken. I luckily had a husband with a good income so i was able to wait out the system and win with an attorney. But, people without any resources are literally tortured trying to get help while suffering illness. I know how much I suffered for years trying to get through the work days. Then im reduced to having to convince a judge i can only sit or stand so long. It has little to do with feeling so ill that you cant function well enough to do your job. So what im saying is the determining factors are really not right. It needs to be judged truthfully according to how a person is functioning. It should be a panel. Amd it should be determined in 90 days max for the well being of peoples lives.

I agree. The system was created to be a life boat for people with disabilities. Most people can make more money working vs. going on SSA disability, but, SSA has made it so hard to prove that one is disabled. SSA takes so long that it's not the lifeboat that it was created to be. It's more like that island mirage that you have to swim 10 miles to get to for safe harbor.

I feel that im gonna get screwed! I was denied, filed for reconsideration, denied that, now i have to request a hearing. Im a 100% disabled veteran. My reconsideration was denied because ssa didnt recieve additional medical and non-medical information from the federal jhie.

Don't give up hope. 2/3rds of everyone who applies is denied at application and SSA denies approximately 85% of everyone at reconsideration. If you look at SSA statistics, generally, you will have a higher percentage chance of winning at your hearing. It will be very important to make sure all your updated medical records are turned in before your hearing.

I want to say something rreally UGLY about this video... gonna try to bite my tongue. I worked for close to 20 years...worked pretty hard at times, anyways, I had the 40 credits I needed to qualify for SSDI... really long story (short); I went got myself locked up for some things that I may never forgive myself for. I was incarcerated for 8 1/2 years, durring my incarceration I became sick, it took them 5years to dx me with Meniere's disease (for 5 years I thought I was dieing.) Well come time to come home I filed for SSDI and was denied because the forty credits I had 8 1/2 years ago had EXPIRED. Now I'm stuck between being sick, trying to file for SSI with no clue what I'm doing, stupid attorneys don't listen to me, and trying to find some way to get back to work...IF I'll ever be able to do that again... In essence the system steals our money... it's ALL a JOKE...

Man I wish I could get him as my judge and you as my lawyer ,I've learned a lot from you both ,I'm here in Texas though,they can I got nothing to hide from ssa

The judge in my case asked if I have worked in the last two years and who I lived with. The judge only spoke to a Job person and he told the judge there were no jobs I could do. Then the hearing ended with him wishing me a happy birthday because my birthday which was the next day. I am waiting on the decision now

@Xxjs6 I lost my case, although I am 59 approaching 60. My lawyer didn't help one bit. One thing to remember is that lawyers are mostly ambulance chasers

Ill call your firm when you open seems like yall are great, my current representation seems to care less about me as a client and during the hearing my legal team kept saying i dont have this i dobt have that, never even got a call back for my mock interview i felt as if i was thrown to the wolves

I have my ME next and I'm nervous that the Dr will not find me disabled, however I'm preparing myself to have to go see the judge incase the ME Dr. doesn't

It makes me really sad that someone’s future can be determined by how they appear to the judge on the day. Someone struggling with a disability and not enough support is less likely to present with perfect grooming or an immaculate house.

I have a hearing in 08-2024 and I haven't worked since 12-2018. Right now I am living in between a bush and a chain link fence behind my local Walmart. Is this something that I should tell the judge or keep it to myself?

I have a question. Can someone get an approval letter from ssa if they start out with a lawyer, have all medical information confirmed without having to go before a judge? Or do everyone applying to ssdi or ssi need to go before a judge before a determination is given? Thank you in advance.

It is not mandatory to go to a Judge to receive a favorable award for Social Security Disability. Seeing a Judge is after a claimant has been denied at both Application and Reconsideration.

You see the judge after being denied twice. They are the 3rd step.

What are the differences with SSA attorney vs an advocate? I’m in northern CA and we have no attorneys around here just representatives. Should one get an attorney vs a representative advocate? I feel like nothing is being done and im the one constantly sending files or new treatments/ plans given to me by all my specialist. And provider those documents new meds etc to the representative to make sure it’s being reviewed at SSA. Or were ever my claim maybe now. I’m at recon and it’s been at step 3 since October 2024

A SSA Attorney is someone who is a licensed attorney with the state they practice law in. Like any attorney, they are generally required to go to law school, pass a state bar and maintain good standing in the state bar. Some states (like CA) do not require a person to go to law school in order to take the state bar. A advocate or non-attorney representative is someone who has not gone to law school or is a mamber of the state bar. Most Non-Attorney Representatives will take an exam that is given by SSA so they can be paid directly by SSA for their legal fees if they win a client case. We have both Non-Attorney Reps and Attorneys who work in our firm. To answer your questoin if you should get an attorney or a rep is difficult. The number one thing you should look at is what is the persons experience in SSA disability cases? Have they done 5 cases or 500 cases? How long are 40 credits good for if you’re just sitting around getting medical treatments/care basically being a full time patient and waiting on ssa (at recon and with DDS). So will my credits in the meantime start to reduce? I’m now at about 1.5 year since I last worked and I’ve worked for 26 years.

Great question! Typically, your credits are good for 5 years after the date you last paid in on a consistant basis. There is a term that SSA uses called Date Last Insured. Depending on how old you are, your date last insured is generally 5 years. As long as you prove your disability began during the time you are insured then you should be eligible for Disability Insurance Benefits. You can reach out to SSA and ask them what is my date last insured. You should also be able to find this by created a myssa.gov account. I hope this helps.
