If I got a less favorable onset date I would just keep my big mouth shut and deal with it considering they could review and find no disability or at least not as severe as they want it to be from one or multiple conditions mental, physical or may a mix of both. Just remember that multiple impairments can be disabling in a lot of circumstances.

I’m new on this channel and must say I’m very shocked CDR information wasn’t mentioned! I know other channels say that information is in your awards letter. My awards letter doesn’t mention it so I’ve wondered if that is due to my age. I’m on SSDI and was getting close to 60 years old when I applied.

At this age it’s highly unlikely they would give a CDR My age is 63+ SSA Told don’t worry about anything, She checked off a redetermination 7 years, I thought that meant I would have to see a another doctor to see me , she chuckled a little and said basically I’m untouchable, then she said “ Don’t worry, Don’t hide Go & smell the roses 🌹 but don’t hide indoors. I thanked her so much . She gave her phone number & ext If anyone messing with you please call me I’ll take care of it ..SSA is looking for overly suspicious stuff I wish you the best 🙏

They love to change dates on a whim. This is the first time ive heard about alledged onset date and established date Not that it makes a difference to them. But im beyond hope. Ive had like 5 different dates I don't know how to play ssa game so im giving up. To hard for me .

Is it true that 10,000 applicants die each year waiting for their Social Security benefits? That's sad.

Yes, from the data we have read it appears approximately 10,000 people die each year waiting for their Social Security Disability benefits. It's unexcusable. SSA has rules in place that they are suppose to expedite terminally ill claimaints and even those cases can take 6 plus months for approval.

I have a lawyer. I filed a little over two years ago and got turned down twice. Im trying again. I have not worked since i think feb of 2021. Doctors say my spine is so bad i cant lift over ten pounds. By God its true because its unbearable. Cant hardly stand or sit for any decent amount of time and im about bed ridden. My doctors have sent letters in my favor and im 43 at mom and dads because divorce happened over this mess and ive lost almost everything. I wish i could work. This is the worst time ive ever been through and just cant get help from disability. The squished out discs and nerve pain running down my legs along with muscle spasms and a few other problems that i dont even want to talk about aint no joke. Will i ever get help from them.

Thank you for the comment. Unfortunately, we meet so many folks who are in a very similar situation. Unable to work, in lots of pain and barely suviving financially. Continue to hang in there. You are not alone and there are many people going through the same fight as you!

You're not the only one. Sadly. I'm at the end of what I can go through. I first applied in 2017. But I definitely got a judge that made his decision before he ever talked to me. And a lawyer who either didn't care or didn't know how to help. I'm now writing to politicians but I have no hope for that doing anything for me. If I'm not approved being homeless and s*icidal I'm not what it will take.

I worked 45 years and was 62 when I won my case. Immediately after I left the court room Social Security told me I would have to wait years before I get a payment unless I signed a document and waited till I was Full retirement age. Is this a legal legitimate act? I was never sent my paperwork as if it was some kind of a scam being pulled on me.

i was approved within 5 months. I was approved may 2nd and got my check deposited for 35 grand June 5th. Now i need a part time job my SSDI check is 300 less than the LTD insurance I was getting thru my old job. So now I am screwed even worse when it comes to money and insurance because now i am not receiving as much. I want to leap. I am happy I was approved and started receiving money but I still have to pay it all back to the LTD company and it urks me when I was taking a 40% paycut. Disabled people are 2nd class citizens and apparently don't need a roof over your head or food or don't pay anyone to cut your grass. My house is a total mess because my spine in my neck is shot and my lower back. Can you imagine?

Yes my back and neck bi lateral spinal stenosis had hearing recently I was denied even though neck nerve impingement . Waiting on decision from judge.

They took 400$ out out montly for living in an old camper that had no water, no air no heat, water damaged ceiling and floor falling in. All because it was on my parents land and they paid 60$ a month for my power hook up. Its a camper not a trailer home. Should they still have taken 400$ for whats called, contributions??

That's why I don't think it's fair what they are doing.. Did you know if your homeless you'll get the max on disability.. And if you live with a family you'll get lesser..

My husband was just approved with onset date March 2020. Would the amount calculated based on what he paid in as of that date?

My daughter’s onset date is sept 2020. She was approved feb 7?2024 for SSI and ssdi. She received her first backpay check today if $2829. It was for SSI. Her lawyer says she will receive backpay for SSI and ssdi. I sure hope so!! She deserves it!

One HUGE question, in order to grt more of my back pay sooner HOW do I prove I need it for purchasing a cash car under 5000$ but not buying from a dealership? I cant show them a bill for a cash car before purchasing it and by the time I sent them the asking cost it would be sold by then out from under me. Any suggestions?

Thank you for the question. secure.ssa.gov/poms.nsf/lnx/0502101020 - this rule outlines what SSA is suppose to release SSI Backpay money for sooner. "Car when necessary to get to doctor appointments or medical treatment, especially if the recipient lives in a rural area with no public transportation;..."

Will the Attorney receive a fee for dependent children, once the Parent has been approved? I was finally awarded my benefits in October, and received 2 yrs of backpay. My attorney was paid 7200 from my backpay which was expected. However, she told me I had to start the process to get my daughter eligible benefits which i did on my own and they again awarded my attorney another 6000 from my daughters backpay. I am confused bc i cant get a clear definition on if that is paid additionally to an attorney or of that money should cone back tobthe dependent? Ive been going round and round with SSA reps everyweek and nobody seems to know. I have filed a reconsideration to have that money pulled back and i cant get any resolution

This is a great question. The fee agreement you signed with your attorney should outline what fee's they are entitled to. Also, SSA has an attorney fee dispute process. Typically, that dispute process is outline in the Notice of Award.

Is the spend down thing just for SSI or also for SSDI? Is there a food and shelter deduction on every single check? Or is just for the backpay for the prior time you were found disabled before getting approved?

Great questions. SSI is the asset based program and SSDI is an insurance based program. SSI is the program that has the spend down requirements. SSI is the program that does food and shelter deductions for every month you are receiving free/gifted food and shelter. If those months are part of your back pay then they will be deducted off your back pay. If someone is receiving free/gifted propotions of their food and shelter even after they have won and ongoing month to month then they will continue to be deducted until you can show SSA that you are paying your fair share of food and shelter for where you are living.

i hear the law does help people at age 50. How does it help someone on benefits keep them?

Great question. The law does help people at age 50 keep their benefits if you are ever under a CDR (Continuing Disability Review) - the 50 (or 50 plus) depending on your age - category will apply when SSA is reviewing your case. First, if someone is under the age of 50, SSA can ask the questoin if there is ANY job in the USA that exists in significant numbers that a claimant can do. (ANY JOB - meaning, even if you were a Medical Doctor, and if you're under 50 - if that Medical Doctor can be a parking lot attendant (full-time) then the person under 50 will not be considered disabled. However, when someone is over the age of 50 - they look at the claimants past relevant work, they look at the claimant maximum physical capacity and they look at if there are transferable skills from that claimants past relevant work into the persons maximum physical capacity. I hope this helps answer your question. The topic of transferable skills is one of the more difficult ones for our new lawyers to learn.

You only get backpay for up to 12 months

In Tilte II (SSDI) cases a claimant can receive back pay up to 12 monthrs prior to their filing date and all the dates they should have received SSDI payments while they had to go through the SSA disability process to win their case. Example, if a claimant files today and they have been disabled for the past 2 years and then their case takes 3 years to win (from the date of filing). Therefore, by the time this person wins their case they have been out of work for the past 2 years and the additional 3 years it took to win the case. This hypothetical person can get up to 4 years of back pay. (note: there is a 5 month waiting period for Title II cases as well) - We talk about that in this video. Thank you for the comment.
