The People's Court

The plaintiff hired the defendants to fix the foundation in his house and repair a chimney. He argues his house is in worse shape now than it was before and is in disrepair. He’s suing for damages. The defendants say they did a great job, and they couldn’t even finish the work. They’re countersuing for tools that weren’t returned.

I know people that have been their job for 20 30 yrs and still suck at it. I believe the Defendant is one of those type of workers

The plaintiff gave away their tools. The judge said that you can't do that. Yet he did not receive any punishment for doing so.

Because a. nobody could demonstrate the timeframe in which he gave them away and b. she has judicial discretion not to entertain the counterclaim of people who already lied to her, saying he signed a contract he didn’t sign, and who continuously attempt to interrupt her and scream over her. That’s the #1 reason to control yourself in a fucking courtroom-the judge CAN and WILL throw your claim out. I also suspect they didn’t have evidence of the value of anything, which would make her decision easier.

I agree with you Thom Gage. I think at least $100 compensation should of been awarded. No idea what it was or the value, but he lied and said he had no idea where they were…. They were just gone. Then later admitted he gave them away. Zero question he should of been penalized something. Overall it was a good judgement though. Only this minor thing that I agree should of resulted differently

She was mad at the plaintiff for lying, but ultimately the defendants abandoned their tools when they could've picked them up any time. That's why she didn't award them anything for it imo.

I think because she felt like they dragged him along for so long for the $1600. They didn't have any proof for asking them back. Or making any attempt to get them back. They didn't deserve the cost of the tools. They probably would've had a case if they paid him the $1600 like promised, and made any real attempt to get the tools back.

well maybe its a big pitbull or rottweiler and maybe he was using the threat of sicking his dog on him if he did not sign because the plaintiff told him that he cant let him leave unless he signs . who the hell says i cant let u leave , unless they have something to threaten people with , like a weapon or a attack dog ,.

It’s very sexist of her to assume just because he’s a big guy he can’t be scared or intimidated. And since she’s worked in domestic abuse because, it’s fairly ignorant for her to think that physical size is the only thing that matters during intimidation. It’s fairly clear by the way the plaintiff talks and acts that he’s very, “I’m gonna get my proof and things one way or another”. So yeah, not bs, it’s called self preservation. There’s literally a recording of him saying “I can’t have you leave without signing”. There’s literal evidence that he was trying to intimidate him. She should’ve seen it right than and there, but nope. She has her bias in the way.

@@Saphthings exactly right . and there have been other episodes where this judge gets irritated if a male litigant is not willing to get into physical fights with other males if they do or say something that can be offensive to their wife or girlfriend . she assumes that because a person is a male then he must be willing to assault other males to defend his woman's honor , she lectures men when they try to act macho but then she also lectures them when they dont act macho enough !

The only reason JM didn’t give them an adjustment on the tools is because they already lied to her beforehand and at that point she had enough of all of them. Even though the plaintiff lied nobody was able to prove how long it’s been since the tools were left and after a certain point it could be considered abandonment and he could technically do what he wants with them.

The guy said it , humping block, that means he did the donkey end of the work but probably never used a trowel or laid a brick , just mixed mortar and watched. You know a laborer who thought I can do this I’ve been watching for years. The home owner was trying to get the job done on the cheap and is just as unscrupulous as the defendants. They deserve each other.

I've watched cases from this genre for over last 40 years now, after seeing 1,000's of cases, I've come to a disturbing conclusion: PERJURY is pandemic in our courts, and for those who want proof, this video provides it, because this case is, by leaps and bounds, THE best example I've seen so far. In fact, he gets caught in a bold-faced lie, admits it, yet still wins his case 'hands down,' with no additional financial penalties charged to the defendant. This is a serious problem on its own, but when coupled with the fact that far too many litigants have filed frivolous law suits such as 'as-is' used car sales, and unpaid loans. To make matters worse, very few litigants on either side of the gavel bring evidence to prove what they claim. Then there's the pit bull owners, and dpn't get me started on them...

I really thought she was going to grant them the $365 for tools . However , I think that she would’ve awarded him mostly all of his monies back from having to redo it . So she just figured they ought to be happy he only asked for $1600 back and since the tools sat there for weeks , technically it was abandoned property - but she was already ready to rule and didn’t feel like getting into the logistics of that .

SO BASICALLY THE DEFENDANTS DIDN'T KNOW WHAT THEY WERE DOING. WHAT WAS FUNNY HOW DID THE DEFENDANT GO FROM THE DOG HAD HIM SO SHOOK UP HE SAID HE'LL REPAY. IT WASN'T TIL THE RECORDING HE STATES HE'S BROKE & MADE A PYMT PLAN ON THE SPOT DAMN LIAR. I think the judge frequently lets her biases influence her decisions. She will start questioning one of the litigants with her mind made up. The plaintiff was shifty.

That's the thing when owning a home is that it's the responsibility of the home owner to find the right people to do whatever it is that you need done. But the defendant offered to pay put for in a payment plan to the plantiff for messing up the job.

Wow! I really think you are starting to open your eyes to the reality that the responsibility of ownership outweighs petty landlord/tenant disputes! Some times (over half - most of the time, actually) it's better to rent. I know you'll forget saying this but I will remind you that the responsibility of home ownership isn't worth it.

@@lilo4399 IDK. I like owning my home. Yeah upkeep can be a pain, but you have more leeway when you own. Another thing, some landlords put in the contract that the tenant is responsible for all upkeep and maintenance. Mortgages are usually cheaper than rent as well. I pay under 800 for a 3 bedroom, 1.75 bathroom, 2 car garage, my own washer and dryer hook ups, and a really good size yard. My daughter pays 1600 for a 3 bedroom apartment, with no lawn for her kids and she has to pay to do laundry in her apartment complex laundromat. I can put money back to save for repairs and upkeep. It depends really. But home ownership does have a few more advantages IMO.

@@ButtonsCasey that's awesome. It sounds like you have a daughter and some grandchildren so I can definitely see how owning a home is more advantageous for you. It's nice for the grandkids to have "Grandma's house" and to be able to provide an equal give and take while you take care of yourself and your family. You have stability for them and they can take care of you when you become elderly without putting you in a nursing home. To each their own. Only a special percent of the population gets to be grandmothers. Cheers to you and your family!

I completely agree that the defendant should have to give back the 1600 considering that they signed the paper but the fact that the judge let the plaintiff get away with giving away their tools and lying is beyond me, I've seen her take money off of litigants Awards just for the simple fact that they got caught in a lie and the guy admits that he gave away their tools she couldn't have taken off like an extra 200 bucks for their tools why? I can't stand the way she goes back and forth on the way she rules.

@@peryole sounds to me like the plaintiff wouldn't have given him his stuff because he wanted that money, the defendant said he went back a week later to try to pick them up, the plaintiff should have put the tools at the end of the driveway so the defendant could have just picked them up not put them on the side of his house where the defendant doesn't have access. You can't just give people's tools away without waiting a reasonable amount of time, well I guess you can but there should be some consequence and normally there is in her courtroom, I don't think he abandoned his Tools in any way if he tried picking them up and couldn't, I also don't believe the plaintiff for one second that months had passed why would they go months without their tools when they need those to do their job.

in Canada....Ontario at least,....the BBB will NOT tell you if there have been complaints, etc. If it's a bad company, they say "the file is out" (that means they're working on complaints.) So you don't hire THAT company...

I have watched this show beginning with Judge Wapner. She was totally wrong on this. They deserved compensation for their tools. Sometimes I think she is trying to be a hard ass like Judge Judy!

A lie by omission is still a lie. Purposely leaving out integral or important information in order to lessen the blow or to downplay something, is still considered to be a lie in a court of law (I know this is an arbitration show, but Judge Malian calling it a lie makes sense) because it’s being willfully or intently deceptive.

@@naiadolling That's based on your subjective and individual moral compass. By that assessment, everyone is lying at all times. It is impossible to know or tell every integral part of anything. We all, whether knowingly or unknowingly, omit integral components of information. Hence, why framing the proper question is a lawyer's best advantage. She asked what happened to the items, and he said they were gone. Had she outright asked, "did you sell the items?" and he responded with a lie; then, we'd be on one accord.

@@mjgutierrez Actually it isn’t. Lying by omission really is a thing in courts. I don’t get emotionally involved with things like this, I was simply explaining why she said he lied. Because KZfaq doesn’t allow links, I can’t share it with you. But look up “perjury by omission” or even “lie by omission” legal definition and you’ll see that it is, indeed, a real thing in courts. Where you intentionally leave something out that is important, in order to downplay whatever you did. Or to avoid admitting certain things. It’s only possible when if you’re asked a specific question and give a partial answer that’s not the full truth. Hence why Judge Milian said “why did you lie to me?”.

I don't know, she doesn't give the men anything for the tools and the guy even admitted to lying in court and that didn't seem to bother her. I'm kinda starting to lose interest in this judge.

The only reason JM didn’t give them an adjustment on the tools is because they already lied to her beforehand and at that point she had enough of all of them. Even though the plaintiff lied nobody was able to prove how long it’s been since the tools were left and after a certain point it could be considered abandonment and he could technically do what he wants with them.
