Fox News was sued by Dominion Voting over the coverage of the 2020 Election, but they had recently settled the case. We go over what this means for Fox going forward, and whether it was the right call.

Dominion is worth 226 million. How can the settlement be 3+ times the value of the whole company .

That's what I was thinking. I hadn't even heard of Dominion until then. I get these machines and their production are worth a lot of money but definitely not to the tune of 230 million.

You seem to have forgotten about punitive damages. Fox had already been found liable by the judge, and Fox probably felt like the jury would award even larger punitive damages. This would have cost them much more had the damages portion of the trial commenced.

Allegedly, one of the stipulations of the settlement was firing Tucker Carlson. If true, that belongs in the Hall of Fame. It's easily Top 5 worst legal settlements in history.

All of this did cause damage, loss of reputation, loss of future contracts from state governments. There are actually safeguards in place to catch errors. Fox implied that this was also biased against Trump.

It's strange how suddenly defamation suits have suddenly become so easy to win. They used to say it was really hard to win a defamation suit. I'm sure politics isn't dirtying the justice system at all.

well, technicaly, they didn't win, they did settle, no trial occured Fox most likely did pay to not see the discovery phase that might be discover way more than the dominion case

@Phil 65 Lying isn't illegal. Although I can't think of any recent suits won where the defendant was lying. You're lucky being stupid isn't a punishable offense.

Nope, from what i can see, the only thing they do is make voting machines and ballot counting software. That's it. This is basically the equivalent of the IRS or the FBI suing for defamation.

Usually really enjoy your content my dude, but you should probably have done a little bit of research before going through with this one. Though i appreciate the whiskey may have played a part in the "late to the party" rant here. The damages related to contracts and growth that were already negotiated for Dominion voting machines, which were either cancelled or put on indefinite hold, following the defamation against them. This pretty much killed Dominion as a company, as they will never be able to compete in the viting machine market again, despite the result, its just not worth using them, and you hust have to look at Trumps recent town hall to see that this wont be the last time voting machine integrity will be lambasted by cry babies. As for the defamation in question. Fox weren't just expressing opinion, they were outright spreading direct lies about it, as though it was fact and news. We know they were spreading lies, as the Dominion investigation including discovery, which showed that the main talking heads and upper management & Murdoch, all knew it was all a load of lies, but that repeating them despite knowing it was a pile of poo, they decided that it was beneficial for the stock price, so they would continue to do so in the name of profit. This was one of the main factors that prompted the summary judgment, as the judge could look at the submitted schedule of evidence and say definitively that Fox had knowing lied, at the cost of Dominion, and had without question, defamed them. Im all for freedom of speech, but there are journalistic ethics, and no media empire bug or small should be free to defame public or private companies/people. As for Fox settling, they had already lost, they were going to get ridden by Dominion for upto 1.6billion in damages if they continued, and as the top honchos were due to be deposed as part of the damages, who knows what skeletons were still waiting to be brought out of the cupboard, or what other conditions Fox would have had to submit to. Fox deserved worse than what they got, and its just sad that this judgement barely dents their $4 billion liquid cash pot. I just hope the Smartmatics suit spills even more of the tea tbh.

But as we all know, she will never get sued for defamation, because the courts will toss the charge instantly, just as they should have here. The facts are simple. The 2020 election was highly suspicious, and the public at large had a clear right to discuss what it saw. And dominion's own actions lent credibility to the accusations when they went into hiding in response. They only came back out when the left started bragging about "fortifying the election" with no consequences, and they could see they had nothing to fear from the justice department. Just because some executives thought the story was a conspiracy, doesn't mean it was lies. The reality of the situation here is clear. The big wigs at fox, namely the children of Murdoch, are dyed in the wool progressives, and they lost the case on purpose. This whole thing was just an excuse for them to get rid of Tucker, and start shifting the network left.

Dominion will never get used again? _Good_ - they knowingly participated in the biggest election fraud in the history of this country. Only getting shut down and never used again is too gentle a punishment. Fox didn't lie, it just made the tiniest baby effort to appear to look a little bit fair when everyone else marched to the blatantly and obviously false claim that the election was fair and secure. Like we were all asleep and had no eyes and didn't SEE the cheat happening in front of us.

Well, now that there was a settlement, legally they DID admit to lying, and that everything they said they lied. Cause if they didn't lie, they never would have settled and destroyed Dominion with their proof and taken all their money. Cause there was PHYSICAL EVIDENCE to their claims being true. How can it be Defamation, when there is literal physical proof of it.

A settlement is not a legal admission of anything. A settlement is an agreement OUT OF COURT. It does not legally determine anything. A settlement is an agreement to drop the lawsuit. That's all.

It's not an admission to anything. Although you can infer an admission. The thing is, a settlement just says that for whatever reason, they want the lawsuit to end. It could be any number of reasons like they know they were going to lose or that the discovery and legal costs were going to cost more than any benifit a win would achieve. There could be more reasons to.

@@sumduma55 You are wrong. There is no "Infering" Anything. If you had proof, you win the lawsuit. Any money costs could be recovered, ESPECIALLY for a massive Corporation and Business. There is only ONE reason Fox would settle. ESPECIALLY for such a high cost. Cause they admit they did lie, they know they lied, they know they can't win with the law. And so taking a smaller hit before going to court where they will be hit with a bigger case. Settlements IS an Admission of Guilt. Cause there is NO REASON. NONE. That would logically get them to stop. If Fox was NOT lying, then they would win and turn around and get Dominion to pay the mass amount of money they demanded instead, damages for their Reputation, force them to pay all their court costs and legal fees, then set presidence that Dominion did indeed fucked up in the 2020 election and open the case for many others to sue the fuck out of them and ban them from being using in 2024. This move, all it shows is Fox admitting they lied, they fucked up, and now bowing on their knees, begging to not be punished even more harshly. Fox, Admits, they fucked up.

You can settle just to avoid a trial. There's no way Fox would get a fair trial
