Part 2 of a video series about how to self-build a timber-framed garden room office (aka tiny house)/wood workshop in the UK.
This video covers permitted development/planning permission and building regulations that apply to outbuildings such as garden rooms.
The purpose of this video series is to provide all the information required for viewers to build their own garden room rather than just a montage of the building work. It took me months of research to learn everything in these videos so I hope to save people time and money.
The videos are a mix of theory and footage of the build including all the mistakes I made along the way. I am not a builder or tradesman, just a keen DIY-er with some basic tools. Everyone can do this!
In the longer term, I hope to turn this channel into a community for garden room self-builders and to eventually evolve into a woodworking projects channel- the real purpose of my garden room!

Well done on the effort taken into the research and overcoming the daunting task you knew you had ahead...I'm about to build a 10' x 7' shed and a separate Man-Cave (internally in a workshop extension)...and there is no where near the amount of work you had to do,so Bravo and well done on the informative videos.

Hi Ali, many thanks for your amazing series of videos it has given me a firmer understanding of the building process and the dos and don'ts. I have just recently been given planning consent to build my garden room which is over 15sqm internal floor space and within 1m of the boundary line. Even though my build will be made with 0 rated fire classified materials, building control have informed me that I have to apply for approval regardless, which makes me believe that this maybe a recent change and worth sharing

Hey Tony. Congrats on getting your PP, that's great! Hmm so yours is going to be brick/blockwork or will you clad with Fire Class 0 cladding? It drives me crazy that different b regs departments throughout the country say different things. Was this the council or private company? I'm not surprised someone said it needed approval though. Good to know, thank you and I'll keep it in mind for that video when I get to it 👍

I found your series of videos when looking for information on flat roofs. An outstanding series explaining every aspect of erecting an outbuilding. Although I live in the Netherlands building regs are not too different, apart from the measurements themselves similar rules apply. A big difference are the permit prices, seems to be a flat rate over England. In the Netherlands each council can fix their own rates, and is often a base rate with an added percentage of the calculated building sum, the total for a £10.000 outbuilding can be in excess of £700-800. The allowed area without a permit is 35m², above that a permit is needed in the Netherlands, also the area rule for total built area of your land applies, for covering more than 50% a change of planned use of the land is needed, this also is needed when building forward of the frontage line of the original house, even when it's just 10 centimeters, eg in case of insulating the walls of the house from the outside!

We plan to build a wrap around side Hallway and utility room on our house, which will be level with the current floor of the house the main issue is it will likely be just in the height restriction at the front of the house but the natural land slopes away to 60 centimeters to the rear meaning what should be permitted development requires permission although as several other houses have the same extension it will be a formality of twiddling fingers

Well I’m two episodes in so far just absolutely brilliant. I built a shed a couple of years ago to comply with these regulations but I got away from the flat roof look wish I could post a photograph so I could show you even though it has got a flat roof you would never guess-most people

Local Planning Officers are in fact wonderful people and deserve more from life than being called tedious, obnoxious busybodies and i frequently wave at them as i am driving and see them crossing the road in front of me

Hi, I share what I learned from discussion with my local building regs office. Seems as at 2020 in my area (Somerset) to build over 15m2 within 1m of the boundary is quite challenging due to the substantially fire resistant provision. Inspector told me roof would need to be non combustible e.g. tiles or slate, insulation should be non combustible and cladding would need to be fire resistant with no timber battons etc. So I will be building under 15m2 in which case can build out of timber, epdm roof etc and no fire restrictions. One other point, I would like to include toilet and maybe a shower. In this case no approval for the building is required (under 15m2) but a application is needed for the installation of new drainage serving the WC. Hope that helps someone!

Hi. Really informative video. Thank you. Could I ask 1 question? Mine will be within the 2m boundary. Does the max 2.5m height include any deck the building will sit on? And how would it affect any slope in the garden? Thanks!

Hi Ali love the videos. To get some internal height back can we use 4 x 4 instead of 6 x 2 roof joists on a 4.5m span?

I would highly recommend trying out the Pocket Estimator app. It's free to use and gives you material and labour prices based on BCIS data. It's a great way to get a ballpark figure for the cost of the works and gives you something to compare the builders quotes against. Also the app provides a breakdown per m2 so you can easily compare.

Hi, a really helpful video - thanks. With regards point 8 and the rule that an outbuilding cannot exceed 2.5m from ground to eves, if within 2m of the boundary, does anyone know when this rule came in to play please? Thanks.

extremely informative and helpful and gives the confidence to go ahead and build - one question though to clarify regarding the boundary - so is a timber structure acceptable without having to add non combustible or class o cladding if it is more than a metre form the boundary?

Hi, I am looking to build exact measurement as you and build a gym area with toilet and shower. I asked the planning office whether I require building regulations as I am building a toilet and they said yes I need to get build regulations. However, I am within the 30m^2 rule yet they suggest since I am putting a fixed unit such a a toilet I need to get building regulations. So I am wondering whether you got the building regulations for your toilet and shower room? Thanks

Hi Ali, a quick question on the 'less than 1m from a boundary rule'. Is this from the cladded wall or the extremity of the guttering/overhang? Superb series by the way. 👏

Hi Ali, great work BTW! I'm currently planning a it of an epic office/gym space. As I'm on a big country plot with a I don't have to worry about the boundary rule, I just read that the rules on the 30m2 have changed now and it reads like this: 5. Outbuildings and other additions must not exceed 50% of the total area of land around the original house. Is this correct?! Hoping so as I'd like to 8mx5m so I can partition the space effectively!

Hi Chris, the 50% rule hasn't changed as far as I know. The 30m2 is a b regs rule not PP/PD so anything over 30m2 internal floorspace supposedly needs building regs. That said, think of farm outbuilding-much bigger and obviously not b regs standard so best speak to your council department and explain what you're doing, they may let you build bigger without requiring b regs.

Hi Ali, this is a great set of videos and has really helped me plan my project. Do you happen to know that if I'm restricted to height of 2.5 meters, is this 2.5 meters from the ground or 2.5 meters from the base?

HI, love the series. I don't suppose you know when measuring the hight of the eves, if its on a slab base do you measure from the top of the slab or from the ground?

Hey Aiden, everything here is still the case but the b regs rule around building within 1m of a boundary has turned out to be far more complex as each council has a different opinion on it seems. I'll get round to talking about it soonish.

Great series of vids, and loving your website! I am planning a build but just wanted to check as your website states you can include partition walls to the allowed 30m2 internal area. Does this mean you could build a thick partition wall (I want some sliding bookcases to act as the divider wall so estimate ~0.5m thick by ~4m wide => 2m2) giving 32m2 internal? but only 30m2 usable floor area?

That's my understanding, the 30m2 refers to internal floor space so a partition wall and even skirting reduces this area 👍

@@AliDymock This series has helped so much but i'm a little confused with the 30m2 rule the second part where you say that the floor area refers to the INTERNAL floor area so you can build slightly bigger than 15 or 30 square metres if, when the area covered by external walls and the internal partition walls is deducted from the external area, the internal floor area is below those thresholds. Would the cavity within a cavity wall count as area I can deduct?

Your videos are so helpful man 🙌🙌🙌 I do have a question.. the workshop I'm building is 28m2, is made of timber and will be right up to the boundary however after watching this video I have accepted that I will need the fire proof cladding to meet building regulations.. but do I need to apply for building regs for them to approve this or by using the fireproof cladding does this negate the need for building regs? Hope this makes sense!

Hi Ross, it makes total sense. As I understand it you don't need it to be signed off if it counts as non combustible. The trouble is that every council seems to have a different idea of what is non-combustible, a topic I'll cover at some point at the end of the vid, probably as a written piece rather than a video.

Just those hand drawn sketches and a covering letter explaining the project and pointing out how little it varied from what would be permitted development.

Hi Ali, Can i apply for retrospective planning if the final roof height is 2.65m flat roof with 1 m to boundary. Built with non combustible 20sq meters.

I've not come across a rule on that so I think as long as it's detached, even by a foot, it counts as an 'outbuilding' for PD and PP purposes

Loving these videos Ali! So informative. would you know what constitutes as sleeping accommodation though? surely any space could be sleeping accommodation. just trying to put a bed in my cabin but the sleeping accommodation thing is getting in the way! hope you can help. Cheers

It's never been that clear to me but if you stay away from 'self contained', i.e. having a proper kitchen and bathroom, then I can't see an issue. You're probably not allowed to rent it on AirBnB (although I've seen it) but a bed, toaster, kettle and microwave shouldn't cause you problems. If you do more research on this, do come back and let us know!

Hi. Ali With the 2m from boundary rule, could my roof start at 2.5 height at the boundary side and taper up away from the boundary to 3m. I wish to build 1m away from the boundary

Unfortunately not! 2.5m is the max height anywhere on the building under the

Hey Big Ali, you have answered what many companies and experts have not been able to answer. 4, forward of front wall....I have phoned these companies and all they repeat is the cutnpaste blah blah from PP. That "line" could be the 15 metres of your house front or a line along that wall running to the two side fences. Number 4 on your list makes the north East and North West section of garden as no build zones. Nobody could tell me difference between front garden and side garden. Only issue could be if you live in odd L shaped house or huge triangular garden, then I'd guess some leeway would be given

My garage is a timber frame construction and the size is 6x5 with an dule pitch of 3M. Is the overall height ok to be 2m from the boundary fence? Or it can the don’t at that height? Also is it ok to be made from timber. Is this classed as non combustable

Timber itself is of course combustible but can be clad to be meet 'non-combustible' standards. That's absolutely fine if you're two metres from the boundary-you can go higher if you like to 4m-just keep your eves at 3m

You're welcome Stephen. Umm I did briefly and do get asked quite frequently. I'm yet to really get my head around how they fit together, especially for the roof but clearly there are advantages such as: lightweight, speed of build, lack of thermal bridging etc. I'm not sure where the wiring goes though.... 🤔 I really wanted to do a timber frame build as I just like timber. I think it's a lot stronger, more versatile too - you can make your building more bespoke and change your mind as you build so I guess pros and cons!

Only reason I ask (not stalking honest!) is that my garden project also requires electrics, water and waste to be room to bottom of a flat garden.I'm in HP6 so not too far away. I couldn't see details of "Ben" the guy who helped with your services and trench digging. Can you share?? Thanks Stephen

Hi Ali, thank you for sharing this with us. Its really helpful. I have a quick question about the Height of the building, The 2.5M ht. includes 100MM concrete bed base or we can have 100MM concrete bed and then 2.5M building height which is in total of 2.6M? I know this might be silly question to ask, but can you please clarify this? Thank you Sunny

As I understand it, the height should be 2.5 from ground level so if your slab sticks out of the ground say by 100mm you have to include that in your overall height

Hi Ali first thing your videos are awesome very helpful, but the thing I'm struggling with is the 2m from the boundary as 1. every video I have watch is close to the boundary then 2m 2. 2m is also putting the shed in the middle of my garden lol :(. Is there any loophole you can direct me to to get around this problem. Many Thanks

Let's clear this up for you then :) Permitted development - as long as you're under 2.5m max height you can go as close to the boundary as you like. B regs - if within 1m from the boundary and between 15 and 30m2 internal floor area then you need to use non-combustible cladding like cement board OR treat the cladding with a flame retardant. Which depends on what your local building control company will sign off ... if indeed you ant it to be signed off.

What if your garden and surrounding gardens are on a slope. Would I need to consider the neighbours land is lower and would I need to adjust the height per their land?

it would usually constitute 'living accommodation' but a few cabinets, kettle, toaster and microwave would be fine.

Ali, these videos are fantastic and have all the answers to the questions I’ve been asking for a long time! Can I just clarify something please with one quick question, I’m going to be building a wooden structure in the back garden with a sloping roof. I’m lucky in the sense that our back garden is quite big, if I build it two metres away from the back fence and two metres away the side fence then I can go up to 3 metres in height (total including the roof) from the ground?

Best instructions and explanations I've found, brilliant work, thank you for all the effort. Quick question... Can you stagger the height of the roof or does it all have to be the same height to avoid planning and regs? Just thought about raising the ceiling that isn't close to my neighbours fence... Could do with a workshop crane. Again, thank you, my wife actually supported me building a workshop following watching your series! Cheers pal! 😁

haha, excellent. I'm convincing both partners - hard to do! So the height doesn't affect b regs but for PD the max height is 2.5m if you're within 2m from a boundary EVEN if you're higher roof height is many metres away from the boundary - it still has to be no more than 2.5m.

If I have a large enough garden and want more than 30m2 without the need for planning permission, can I build two separate outbuildings, each 30m2?

Hey Ali - this is exactly what I am building I'm still a little slow with getting my head around this. Can you confirm for me that if I do leave a 1m boundary around the outbuilding and it is between 15-30m2 and no more than 2.5m high.. then 'm fine and I don't need to apply?

That's exactly right. If your building isn't within 1m of a boundary and is 15-30m2 you're fine. Still need b regs for electrics though but a registered electrician can sign it off no probs 👍

So the 30mtr2 only applies if your using it as a living accommodation is that correct? I am looking at build a garden room but want it bigger than the 30mtr2?

if you have living accomodations, it must have building regs. if its between 15 and 30 m2, it must be made of non-combustible materials or be 1m from the boundary. if its over 30m2, it must have building regs

Just realised my comment was ambiguous to say the least! I have found the answer in the technical guidance document for Permitted Development (I know this wouldn't have applied to you but it is useful to know for future reference); Taken from Permitted development rights for householders - Technical Guidance - Page 6 - “Height” - references to height (for example, the heights of the eaves on a house extension) is the height measured from ground level. (Note, ground level is the surface of the ground immediately adjacent to the building in question, and would not include any addition laid on top of the ground such as decking. Where ground level is not uniform (for example if the ground is sloping), then the ground level is the highest part of the surface of the ground next to the building.) Useful for me as at the front edge of my shed its 2.6m to where the eaves will be, but from the raised ground level at the back its approx 2.5m. Wish this definition of where to measure height of eaves was more common place!

That's great to know, really useful. Gives some more leeway. The back of my building where the ground is highest is about 2.9m high and on my mum's side is well over 3m so it's good to know it's all fine. Hopefully viewers will read your comment!

I was just about to add a question to these great vids querying where the height is taken from. My plot is 2m above the ground level of the house and slopes a further 0.5m across the area of the proposed building. I’d assumed the measurements would be from the highest point of the land under the building and it is good to have this confirmed. Can I ‘gain’ an extra 0.5m in building height by levelling the site to the lowest point? A retaining wall on two sides would hold back the higher areas. Is the height then taken from the highest point of the surrounding land or from the levelled ground beneath the building?

Iain Allardyce I've been having this problem myself and there's 2 conflicting rules. So if you're on a slope and have one end 2.5m and the other end say 3m that is fine, however, it seems to be ruled out if it's within 2 meters of the boundary. If within 2 meters of the boundary the MAX OVERALL height has to stay within 2.5m.. It's very confusing and i've seen several websites show diagrams of a structure above 2.5m at the boundary but have also seen a few cases where the local planning officer said they slope rule doesn't apply within 2 meters of the boundary.

@@AliDymock Ali, I am of the understanding that If any part of the building...is within two metres of the boundary of the area around the house, then the height limit for the whole development is restricted to 2.5 metres if it is to be permitted development.” That means that even if there is a slope the same rules apply and prevents the disaster picture you shared on your video :)

Question: If an building has has had PD declined as it was attached to a building and exceeded limit of extensions already added to the original , can it then be build as a detached unit?

I would expect so as long as the rule of no more than 50% of the area around the house hasn't been breached. It has to be detached though, no sneaky through-door!

Do have a question for you, If the garden building was placed 2 metres away from any boundary would that mean it doesn't need to be substantialy built with non combustible materials? Currently reading though planning/building regulations, 'Any side of the building within 1m of a boundary will need to be suitably treated so it is substantially non-combustible' If that's the case and all goes well the house I'm buying has a very large rear garden so 2 metres isn't too much of an issue Great videos by the way, have been looking at buying summer houses and insulating them myself but thinking do it all myself

Hi Ali, Just designing a workshop of my own and I'm encountering some issues with overall height similar to what you encountered. Spoke to my local planning department the other day and explained that overall height was likely to be ~3m. They suggested I pay £55 to have them look at my case and clarify if I need permission or not. Is this what you did or did you put in a full request as this is around £200 with my council. Hey Neil, hmm what's the £55 for? I had a free sit down with a planning officer to discuss the project then paid the full fee for planning permission. Maybe they are asking you for a payment for the preliminary discussion?

@@AliDymock they suggested it was to establish if planning is required which isn't really in doubt. I thought it was poor advise as I'll no doubt end up paying £55 for the inevitable decision, only to then pay the fee for the full application. Fingers crossed mine goes through too 🤞

@@neilattwood6227 Yeh that what it sounds like to me. The initial consultation can be a good thing. For example, in my area of London there are a lot of 'beds in sheds' -basically people renting hovels so meeting in person allayed any fears of that-especially as I had a shower room in there which looks suspicious. So think about where you live and write a cover letter -I explained how it wouldn't affect a tree with a TPO, how it wouldn't affect neighbours etc, think that went a long way. I also pointed out that the only diversion from PD was 0.5m height. You'll be fine and it's worth it for the extra ceiling height and ability to have a warm roof :)

My congratulations on a thoroughly well-made series of videos with great information. I'm about to start on my own garden room and I've learnt so much from your videos - thank you :-) One question I have, what did you use to clad the walls that were next to your property boundaries with (Class 0 fire rating)? The reason I'm asking is that I want to avoid building regs but also want to build a bigger building than 15 sq metres.
