McDonough, Georgia - On June 20, 2023, While on patrol, a Henry County police officer pulled over a Dodge Charger that his laser clocked going 96 mph in a 35-mph zone. When the officer approached the Charger, he recognized the person behind the wheel as Henry County Sheriff Chief Deputy Michael Yarbrough. "Really?" the police officer who pulled the chief over for speeding immediately asked. Shortly after receiving Yarbrough's license, the officer returns to the cruiser and makes a phone call to another person for guidance. “Guess who I just pulled over?” the officer is heard saying. “Who?” the person replied. “Yarbrough.”
The officer asked if he should write him a ticket. “It’s your traffic stop, do what you think you should do. I’m not telling you one way or another,” the person said. “I don’t care for him, so I’m going to write his [explicit].” The officer later walks up to Chief Deputy Yarbrough and hands him a citation. "If you would sign right here," the officer tells Yarbrough, "Please slow down, have a safe day." Georgia does have a super speeder law. Under it, super speeders are ticketed for traveling 75 mph or faster on a two-lane road or 85 mph or faster on highways. It adds a $200 fine to a ticket. The citation only states a “warning” and does not have a $200 fine on it. It does state that Yarbrough must appear in court.
In a statement, Henry County Sheriff Reginald Scandrett said, "Chief Deputy (Yarbrough) reported to me immediately after the traffic stop occurred that he was issued a citation for speeding. Any questions related to the citation itself should be directed to the Henry County Police Department. After reviewing the facts of the incident, I suspended the Chief Deputy for 40 hours without pay for the severity of the traffic citation." A spokesperson says Yarbrough was on duty at the time but did not turn on his lights or sirens.

🚔 ~ The cop driving the car should have been arrested. I don’t want to criticize the cop who initiated a traffic stop or anything, because I’m glad he gave him a ticket. There are definitely citizens who would’ve only got a ticket, but there’s also many times a citizen would have been arrested and had their car towed.b

@@RickMakely Depends on where you are from. Not in my state. Speed, in itself, in my state is not means to make it a crime. Do you know if its that way in this state? In some states, over a certain amount, over the limit, is automatically a crime.

If you or I had done 60mph the speed limit we'd have gone to jail and our cars would have been confiscated. He debated whether or not to even issue a citation, and when he did he didn't even charge him the full amount.

I got lucky once on a ticket like that, 93 in a 35 on a highway down by the beach with just me and one park police around. Radar detector went off at 105 but he locked me at 93. Gave me a ticket for dark tint and I was on my way

This is a rarity in the USA. Everything being on camera is making the Police more honest and forces them to act with integrity. There is still a long way to go. Even in this instance there were many things wrong. For a start a cop was doing 96 in a 35 because he thought he could could, he alos had another cop as a passenger, that is not integrity. Secondly the cop who gave a ticket only did so because he said, "I don't care for yarborough so I will give him a ticket". Unequal justice based on personal likes or dislikes is not acting with integrity. Consequently, when we see this video of a cop giving another cop a speeding ticket and we think it is good it just means we have extremely low expectations of integrity in our public servants. I just did some research on this case. The police withdrew his speeding ticket and let him off with a warning. This never went to court.

@atheistfromaustria I cannot explain. Every state has its own laws, as does most counties and sometimes cities. Because he signed to acknowledge a ticket is meaningless, he could go to court and deny it. If the cop who wrote him the ticket does not turn up in court then he wins, the case is dropped. He may also agree to some lesser charge with a prosecutor before it goes to court. Normally, in most states and lower jurisdictions anyone caught doing 96 in a 35 would go straight to jail and at least spend a few hours there or maybe overnight before getting bond. Yes, this cop got special treatment still. There was a case in Florida many years ago where a female Florida State Trooper gave a police officer a ticket, all her colleagues refused to talk to her. It was so bad they had to keep her working in an office job and would not let her go out on patrol because all the other police officers said they would not come to her aid in an emergency. An old friend of mine was a police officer in New Mexico, he gave a cop a speeding ticket and that was pretty much the end of his career, no other cop spoke to him again.

@@Spacebird42He didn’t have a grudge, the chief deputy would’ve gotten arrested if he was a normal civilian. 93 in a 35 is 58 more than the speed limit and could’ve been counted as felony speeding and reckless endangerment. He is lucky that the office gave him a ticket. He’s not “holding a grudge” for doing his job.

@@makeitsimple9990 - This looks like pretty much any guy on earth showing off a new car to his friend. You find an empty, straight stretch of road, and you put the hammer down for a few seconds of adrenaline. If his driving record is otherwise good (and he's contrite in court), most judges will recognize that and he'll just pay a fine. @@magna116 But when YOU are caught doing 96 in a 35, you try to do everything in your power to avoid a ticket or arrest, you beg and plead with the officer and make up excuses (when I am saying "you", I am referring to civilians in general, not you in specific). In both cases, in this interaction, and interactions with civilians, it's within the officer's discretion to warn the offender or cite them. Arresting is more for reckless endangerment cases such as fleeing/eluding where it is imperative to get the driver off the road. Not every recorded traffic offense leads to citation or fines, especially when it costs the state courts' time.

Nice to see all being respectful with one another. Cops really can't do much for each other when working, except to not write each other summary citations. The best course of action is that he should ask the operator why he's driving at that rate of speed without any audible lights or siren, forcing him to conduct a stop. After hearing some reasonably professionable explanation. I would have then sent them on their way without a ticket, just like many Officers routinely do with unknown civilians on a daily basis. The Officer and his Chief knew they were wrong. The ticket, IMO wasn't necessary.

@@zoloftam142 Georgia is a “super speeder” state. I think when I lived there, it was at the officer’s discretion, but you can go to jail for 24 hours for going 20 MPH over the speed limit

well, great job by the officer, the chief did the bare minimum after f*ing up big time. Over here, you are not driving for at least a year and you have to go through a psychological test before you get your licence back and if somebody dies for whatever reason (because somebody gets scared and drives against a tree), you are facing a first degree murder charge. The worst part is that we will never see all the videos of incidents where it did not went that smoothly or the officer just let the other officer go.

I have to respect both of the officers for the traffic stop. One officer going to do his job anyway, the other taking the accountability of his actions without being a d.o.s. about it. it could get tossed out latter, but the fact the way this was handled, is good for both sides!

Agree. Never write someone just b/c you "don't care for him." If he is a qualified customer, then write him. If not, give him a pass! We let citizens off with a pass ALL the time! Usually the driver will "talk themselves" into a skid (ticket). Good luck ya'll! Happy motoring!

I didn't think the "well you know I don't care for him, so I'm gonna write him up" was very professional. By letting his personal biases involve his decisionmaking during the stop AND verbalizing them, he made his case against him weaker.

Uh... 96 in a 35 is grounds for towing the vehicle, license suspension and arrest. He 100% was above the law in this case. If this were a civilian theyd be in jail.
