This is a cautionary tale about how we ordered sails in South Africa, from a reputable sail manufacturer, paid in full, and 21 months later, we have no sails.

We Love South Africa! It's very important to us this is clear. The last thing we want to do is create a negative association with South Africa and the sailing community in South Africa. WE’RE JASON AND NIKKI WYNN. A couple of modern-day documentarians, perpetual travelers, and seekers of tall tales. We’ve been chasing our curiosity around the world on wheels and keels since 2011.
Our first six years of travel were an epic road trip around North America.
Now we’re on a sailing voyage about the world. Did we have any previous sailing experience, of course not!
Neither of us is overly talented, smart, rich, lucky, or retired. But that doesn’t stop us from reaching far-flung destinations, having wild adventures, and managing everything that makes living aboard a moving vessel possible.
We share in hopes of inspiring you to cultivate your curiosity.

Seeing this makes me bought angry and sad. I hate scammers. I'm sure, somewhere in the 1844 comments (so far) that "The Takeaway" should be to buy sails from a local sailmaker. I have known many sailors who appear satisfied with their mail-order sails, but I was always happy that I paid the price for Carol Hasse's (Port Townsend Sails) custom sails. They have lasted TWENTY YEARS of cruising and are still adequate for local sailing. Hasse has retired from sailmaking, but her loft is still operating. Support your local sailmaker, avoid scams.

Owning three different boats and years of cruising I always ordered sails from the location I was at relieving on locals for direction and didn't pay until the sails were in my hands and satisfied with the quality etc. You have learned a hard lessen in life. What if the sails you ordered were made to the wrong measurements or of poor quality, how would you recover your loses then. Never never make yourself vulnerable with something as important as sails. Good luck maybe your video will get your product or a refund, but don't throw good money after bad.

Ideally, getting organized with a group of people willing to take a shift of several hours each, standing in front of their booth handing out a sheet of paper to everyone who come to the booth exposing the Wynn's story and the risk of ordering through Onesail would get the Parent Company's attention very quickly.

The things I've learned from buying thing from other countries over the years are mainly two-fold. 1. Set up your own company when buying anything across a border, company to company transactions are generally treated more seriously than company to private consumer. 2. Unless you have cause to absolutely trust the company (a rare thing indeed) use an escrow service to hold the money until you have the item(s) delivered. Shipping fees are one thing but never pay the full amount for something way in advance, if the brand is serious about doing business they will accept the escrow provision. Will the escrow provider make every deal that little more expensive? Absolutely, but to this day of 30+ years of international trading I haven't been scammed once, so in my book it's clearly worth it.

The number 1 advice is the opposite of what you should do in Europe at least. Consumers have consumer protection. Companies don't. There is no other recourse than take the matter to court with company to company relation.
@philgray1023
@philgray1023 19 күн бұрын
A very important point is that consumer protections that you may expect do not exist in some countries. For example we bought a Seiko watch in Hong Kong from a reputable high street chain of shops. The watch stopped working after 2 days. We returned to the shop. They insisted it had nothing to do with them and it was a warranty claim with Seiko, they would not even try a new battery. Imagine how delighted my son was to recieve a broken watch for his birthday gift! On the other hand I have dealt with Italian engineering companies, where every shred of my being was saying this is a scam, where they shipped goods on the same day the wire transfer hit their bank account - arriving in Australia 4 days later, then taking 3 days to clear customs. A well known engine parts place in Sheffield UK, where the order was fulfilled so quickly that I thought it was a scam, until the stuff landed on my Australian doorstep exactly 105 hours after I placed the order. So if you need any parts 4 engines, try Sheffield. It's a jungle out there.

"Our relation with The Sailmakers was interrupted in Spring 2020". You ordered the sails FROM One Sails in January 2020 when they still had their relationship. You did not go around One Sails and order directly from their supplier. You bought from One Sails and THEY sourced to this other company. It would be like me ordering an iPhone from Apples website, and when the phone never arrives, Apple telling me, "Oh, our relation with the factory in China was interrupted. We are sorry you didn't get your iPhone." Absurd. Nail them to the wall.

I think my suggestion would be that they return your money, and you simply state publicly that they have done so and leave it at that. I don't trust them anymore, and the only reason they're trying to do right by you is because of your media attention. If the only reason they are now trying to make things right is because they are being forced to do so, then they don't deserve your business. You don't owe them anything; don't support them by buying their product. Just get your money back and contact a different sailmaker.

I ordered a mainsail from a well known US independent sailmaker with a good reputation for the type of boat we have but about 1000 miles away. The boat is kept near Annapolis and the sailmaker agreed to check it while visiting the boat show. After checking the boat he sent us a quote somewhat less than the local rainmakers and we ordered it. It arrived on time but I kept thinking the shape wasn't quite right. The man who I had discussed it with reviewed my pictures and said it was OK. But by the end of the summer I was getting annoyed and call up the sail loft and insisted on speaking with the big boss. He agree to check the boat and sail when visiting the boat show. When he did so he agreed it was cut wrong and shipped me a new sail cut correctly. The lesson I learned was deal with a local sailmaker IF at all possible. While this episode did not cost me any money, it was annoying and time consuming.

Sail making is part science and part art. Boat should be close to where the loft is cutting and making the sail. New sails go thru a fitting process once completed to check all aspects of fitment. It's very common for a new sail to go thru several re-cuts. Beyond a down payment, only at acceptance should balance be paid.

Building contractors are notorious for defrauding customers. The fact that it took you ten years to recover is telling - but did you get interest money, and money for your time and aggravation? I guess things can change though - I last met with Craig in 2016 at Cape Town and things were fine with him. I wouldn't let it rest and suggest you at the very least get a Cape Town lawyer to send out letters to them - they will be easy to locate as they are so well known in the sailing community. Honestly OneSails should take care of everyone who was duped by these sail makers in South Africa because they were operating under the OneSails brand. If things go wrong and OneSails just goes "Oops, sorry. These guys aren't actually us, we were just letting them use our brand name in exchange for royalty payments." then it means their brand and the reputation that comes with it is worthless. Also as far as I'm concerned if you let someone operate under your name then technically they're acting on your behalf and you're responsible for what happens.

A perfect example of this is whats going on with Lagoon and the 450's (and a few other similar designed models) with the weak bulkheads. Lagoon at first denied there was an issue, but after almost 1000 of the 1100 450's seem to have issues ranging from just bending bulkheads to outright broken, Lagoon now is helping the owners get their boats fixed. OneSails needs to skip the denial stage, get working on fixing this issue, not only with the Winns, but with everyone else, then tighten the ropes on who can use the name and put some QC in place to prevent this from happening in the future.

@@Big.Ron1 But doesn't that relationship end at a certain point? OS Italy say that "the relationship had been interrupted in Spring of 2020". It's like if there was a local McDonald's franchisee who was doing shady things then I'd expect McDonald's to take responsibility (because of the licensing). However, if McDonald's corporate then ended the licensing agreement but -- despite that -- the local franchisee kept using the name and didn't remove the signage then I wouldn't expect McDonald's corporate to help. I guess part of this comes down to when the sails were ordered and when (and how) the relationship was "interrupted".

As soon as you mentioned wire transfer to South Africa, I didn’t need to hear the rest of the story. They all seem to end similarly. They stole all your money, and then went back for more with the shipping fee. Never wire money to anyone you can’t “tag” with legal process if they screw you. Pay the fees on letter of credit as cheap insurance when the vendor is an unknown in some far away place.

Same here. I like the fact that the sailmaker talks me through the process. At my local sailmaker I got a tour of the loft even without having a YT channel. He comes to my boat measuring up, discusses different options with me and so on. I've had to wait more than a year for my mainsail to be ready but he explained that he's had a lot of trouble getting cloth, which is true. Sails are very particular and a good relation with your sailmaker is very important. Which also allows the company to accept or not accept your business. They are absolutely not obligated to do business under the terms that you dictate to them. If they are wise (and want your money) they will. However if the product they offer is difficult to find, and both of you know it, then you are pretty much of the mercy of their conditions (if that is really the product you want/need). In these cases the buyer puts himself at risk. Custom sails for sailboats are not available everywhere. So you go to a reputable seller to minimize the possibility of problems but getting screwed happens more often than we think.

There are plenty of other companies that will be happy to take my money on those terms. Many companies if not all do business on a thirty-day payment due for their own supplies and expenses, some go out to ninety days. This is the company paying its own bills, rarely in business does a company pay on delivery. I have run a couple of companies and owned a couple as well and these are all common business practices. At the very least, morally, One Sail is responsible for knowing about the fraud but not warning its customers and larger public more actively. Today, social media can be more effective than international law. When One Sail’s bottom line is at risk, they will more than likely do the right thing, which cost them little but can pay off for them in spades. Sailors who need sails is their business. They can either rise to the occasion, or be hurt through indifference. It already sounds like N&J are not the only ones who were scammed as it’s gone on for a few years. One Sail certainly seems to have liability in this situation. One Sail must immediately step up and pay your loss in full. I can't imagine the sailing community doing business with them otherwise. Thank you, Wynns, for warning us. And please keep us posted.

It was all I could do to click the thumbs-up choice for this one! Hopefully, now that you've had contact from the parent company, the situation will be resolved. Might be too late for One Sails to save their reputation because the cat's out of the bag and all the catnip in the world might not get it back in there. It shouldn't take a social media storm for companies to do right by their customers. Their original response was penny wise and pound foolish now having tarnished their brand by revealing their lack of willingness to stand behind their producers.

It seems One Sails Italy, need to do some quick Public Relations Management decisions and sort this out. They might feel that they too were the victims of those allegedfrayd, but nevertheless, their name is the one that will be associated with it. That said another sailmaker has a great opportunity for marketing !

So sorry to hear you have been dealing with all of this. Sounds like now there is some response. Hoping they actually come through, promptly, with all sails and they are high quality and fit. I am sure I am not alone in my skepticism. I'd like to have a word with them on your behalf right now!:)

Legally ONE SALES is fully responsable for the amount of money, damages, collateral consequences and other; please find a good collection law firm to recover all the money and products expected. There will be plenty of good firms waiting for your case.

As a South African I'm so sorry to hear this. The sailmakers here in Cape Town are generally a reputable bunch - we hate it when something like this happens. Reckon nobody at my club (300 boats) will be buying sails from these guys (if they are still around) when I let them know this story is going the rounds.

Possible way in future is to pay the money into a trust account of a lawyer/accounting firms in these countries that can verify/control the purchase and release money on your behalf.

I have watched your adventures from episode 1. I love sailing, love the lifestyle. Your doggedly persistant efforts and adventurous spirits have certainly given you experiences that could not be duplicated. From what you have shown, seeing what it really takes i am too old for the shit you have to put up with. As a couple approaching retirement your trials have shown us this takes money and youthful energy. I am now resigned just to fly wherever and be a "credit card captain" a month or two a year. Hats off to you, keep the faith.

Whether or not One Sail HQ in Italy is Liable for the actions of their South African branch (according to their lawyers). They ARE Responsible for those actions. If they issued a license to those Scam artists to operate in their company name, they should be the ones taking the hit for those actions not their customers. It's a failure of due diligence on the part of One Sail HQ. I wouldn't get lawyers involved as international disputes are almost never worth it (huge biases in favor of local parties), but consider filing a complaint in Italy.

Actually no, if Italy terminated their franchise and "published" that info then it moves to the SA ex-franchiser making what are now legally "counterfeit" goods. Italy can prosecute on that basis and also serve them with "cease and desist" or whatever the equivalent is in SA. But if the laws are not robust enough in SA then its a waste of time. That is why its a quagmire. Italy can't accept responsibility even if they WANTED to - because that would weaken their case against SA if they were still standing behind their sales and product.
