I feel totally identified and although the hearing has been postponed 2 times to gather evidence, being away from my 7-year-old boy due to the mother's wickedness and revenge, It is something that kills me little by little every day, I still have my son's pajamas on the pillow that I hug every night and it is very unfair because my son loves to be with me. As you have said, it is all a strategy and it is something that I already knew, I am Spanish and my wife is from South America, since I refused her blackmail and did not help her to obtain Spanish nationality Well, now she is going for British citizenship and that is the first step on her part. What hurts me the most is that I always helped her until I got tired and now my son pays the consequences.

Going through this now, just completed a year on my non molestation and my ex is applying again, so off to court I go to defend myself. Amazing that I typed 'applying for a non molestation order' into you tube and the first video that comes up is yours...says a lot about how this order is being abused.

I have a court date set for the 18th September. Received an email at 5pm stating I'm due in court tomorrow at 2pm. Is this normal? I can't even contact my solicitor until 9am.

Hey, great video, quick question My solicitor said to accept a cross undertaking even though the allegations are false. is this the same thing as accepting the allegations?

No it’s taking no blame for any of the allegations and just that you basically make a promise to not see the person or go near the house.

I found this video in hopes to gain understanding as a woman against my ex who does have access to our son. He gets him every other weekend sometimes during week. But continues to harass me by being abusive at the door, threatening to get me sacked, a smear campaign, turningmy chikd against me. I've been more than reasonable but now I have to protect myself as I can't co parent with an abuser. That said I didn't know women are abusing the system in this way. My heart goes out to men who are dealing toxic women like this. There are genuine women like myself, I want my son to have relationship with his dad as mine died when I was young. But he is making us all miserable because I have a new boyfriend

Google psychopath. They are dangerous and cannot change. And listen to the psychologist and narcissist whisperer Ross Rosenberg and his video of do not uncover the narcissist, he will destroy you. You are too nice which is why you became his prey in the first place. Tough life lesson for self love. Also listen to the: boundary boss book. First save yourself, then the child. Good luck

Its tough my ex left, moved in with another man, smear campaign was against me thou and for 7 months had me arrested 4 times nor let me see our children and has gaslighted me saying for 7 months daily shes coming home needs time loves me. All the way upto 17th June 2022 today got given a non mol. It broke me but helped me see clearly without my rose glasses on. Some women are nasty but yeah I still hurt bad from her and this bf of hers. She made me believe she wasn't with him just living 😆 Thst she loved, wanted me and coming home. For 7 months. I was so stupid. Now I just know that's it for the first time I know. He still loves you to. He wouldn't be nasty if he wasn't bitter. I got like that a few times, but I was being tormented for half the year whilst still obsessed with my ex. Your his kids mum. I know his pain. Good luck x

Yep its happening all over to men by woman gaining the upper hand in child custody and financial settlements. The law has to change to stop one the leading causes of male suicide. My wife did just that, she put a non mol and Occupational order on me based on a statement that was fabricated and disgusting with no evidence to back it up- its that easy. and this woman abused me for years physically, emotionally and manipulated our children to them making out that I was the abuser. My life has been turned upside down all because I wouldn't leave our house before we had settled the custody of our children. The justice system stinks.

Thank you for the useful video. There is another perhaps less common reason for a non molestation order. Which is one the increase and that is if you are the sponsor for a migrant who is on a spouse Visa. Under dv they can apply for automatic indefinite leave to remain if they can prove using such orders and other that they are the victim of dv. Which is what happened to me

Dont marry foreign women, dv is their ticket to residency in the uk. They dont need to stay married to you long enough to get citizenship

This is currently happening to my wife's Uncle. Her aunt didn't learn anything about the British culture and two weeks before her visa was ending, she disappeared to her relatives to do this order so that she can claim asylum and get a direct ILR. This loophole has and is allowing certain people to exploit the daft law.

Iam currently going through the similar situation , I have been served 2 non mol in the period of 9 months , though one of the lawer advised me to take the undertakings for the 1st one I contested it ,later on the day of contest the application was withdrawn by the applicant , the recent one I requested the court for contest again but to my joy application was just dismissed staright away on its initial hearing by the judge due to lack of enough grounds for the non mol application .

well done, wish you luck, its high time they just start checking the evidence submitted before a hearing, so many of them could be thrown out even before they get to court

I’m a victim of child alienation. And a non moles order. 9 months in we had a 3rd/4th court date. I breached the order apparently by talking to my ex outside court. I said don’t lie in court directed to her brother standing next to her. I’ve court in two days. What are is the likely penalty? I’ve read a lot about prison. That’s a little worrying. First and only breach. All I said was don’t lie in court today. My daughter relies on it. Altho the allegations were that I shouted don’t lie you child abuser. This is not true.

@@paulplayer9092 this is exactly why you have to contest the application in the first place. If she says he shouted and has a witness from the family, then frankly that's not a witness unless it's on video as we all know certain families will lie for one another. No evidence is no evidence, and they csnt punish you for no evidence, if they do then ask for leave to appeal, if they refuse leave to appeal (likely) that just means you have to submit an appeal anyway and the appeal will be heard by another judge. Remember a judge JOB is to draw conclusions from evidence available, if there is no evidence then there can be no balance of probability on which they can base a decision therefore the only reasonable action to take is to determine that there was no breach.

Brian Hudson thank you mate. Much appreciated. That info is going to help me. I did have to do an interview about it but I stayed firm and said I spoke to him and not her. So I’ve admitting speaking. But at no point admitted to breaching any order. I will appeal if I’m needed which I didn’t know was an option. Thanks.

Thanks for the info. I'm court tommorow morning. In a list of 8 things,one is true,the rest is nonsense with no evidence, so I intend on contesting regardless.

I've had mine served to me today. Split in Dec 21 but she's been contacting me daily for several months saying she's coming home soon, came to see me 3 times a month caught on cctv this last month twice, entering my house alone. All whilst I'm on bail BTW. Today got my non mol 27 accusations 10 percent true but exaggerated hugely and rest just disgusting lies. 9 years and you think you kbow someone. Anyway I have screenshot of all the contact some thru her many fake Instagram accounts but last few weeks been from her personal email address, again. Loves me, coming home blah blah. Today non mol lies. Have I got a chance to show judge every day for 7 months she's mentally manipulated me and abused me? Will he see her coming round. Non mol was applied on 11th June, she messaging me every day before and upto 17th June. Will judge get to hear and see my hundreds of messages of her basically perverting the course of justice as I'm still on bail. I've told police twice had them out and both times did nothing but been arrested 4 times, bailed 2 are nfa 2 are ongoing. One time I had police out they said shut down my email and social media and they won't investigate the fake accounts....I was on bail, basically admitting I did very wrong. But I had to in order to try snd stop her. I know most will say I should have cut her off when she left me for another man in Dec moved her and our kids in the same night they left our home.but she gave me hope and week after week I believed her. Then I'd try to let go and she'd contact and hook me again. 8 wanted my family home. This non mol is a step to far now I have cut her off for good snd she has since 17th. I hope I can get help because I'm awaiting surgery from emphysema and don't get paid sick. She also left me in debt. I have all this evidence but worried they won't care like police??? Sorry for bad punctuation snd long message. Someone please help?

I had my ex agree to "undertakings" before child atangements , got gagged every stage and still came out the bad guy no doubt professionals rigged the system for financial gain, can i expose what happened without being sent to jail?

my ex didnt even submit a scot schedule, she was supposed to back in Aug 2020... it is now Nov 2020, DRA for NMO is coming up in Jan 2021. I have been arrested and interviewed on suspicion of breach of NMO and RPI'd twice now.... more potential arrest/interviews coming up

Why would it be law? If it were, it would give a lot of abusive parents the ability to further abuse their children. How would you write such a law to prevent such unintended consequences?

I was in court yesterday. My solicitor told me to accept the order even though all the allegations are false. Let’s spend your money on getting access to my children rather than fighting this non molestation order. Was this the wrong decision. The hearing was being recorded and she did state for the record that I accept it but disagree with or it something. We have filled for child access straight away. I have lots of evidence. Im with my kids all the time on days out ect then I was served this non mol because she couldn’t afford to live at our family home. I have text messages the day before she filled for this asking what time am I dropping/picking the girls up ect. Clearly see she is just being vindictive. Will i be granted access now I’ve accepted this order? Help please!

the problem is that once you agree something like that it is viewed as a fact by the court in all subsequent hearings, and for any professional required to write a report, so in my opinion by accepting you create a mountain to be climbed at a later date and you are a bit of a sitting duck for any future allegations/procedings

Well done..great advice. I found it all out the hard way though trial and error and disbelief. It cost me everything and I have experienced true failure on almost every level. But at least I'll never wake up next to my ex wife again, so I wouldn't trade. The law is an abomination and I now despise my country of birth, have nothing but contempt for it and see these injustices as another part of its collapse. It's where it deserves to go and I'll never shed a tear for it or anything else again after the loss of the last 6 years, 2 amazing children, a couple of million quid and my belief in the United Kingdom One regret? I wish I'd learned to hate this state more , and sooner. I'm 60, penniless, assetless, and it's year zero for me but my new partner and baby son are worth more than every year of my marriage x 1000 ...so fuck it. The only thing men have is strength , even if it's deluded stupidity..keep it for yourself and fuck the system, fuck this point in history and all those who profit from it.

Something quite frustrating is that we are naked before the law and if we want a lawyer to defend us we must spend the money that could be for our little ones!! It's all very unfair! Yet some say they want equality. In what? If we are the ones who do not have legal weapons.

I did the mistake of accepting my non-molestation order despite it was all lied. I was self-representing, made a huge document showing all the evidence with messages and videos and pictures that the accusations are lies but wrote in the end I would still accept the order. The judge just read this bit and put the order in place. I might try to contest the order. I don't know what to do. The order will expire 23.12.2020

there is no expiration to molestation orders i believe

Non-molestation order expires after 1 year in England. Just do not accept the order, then she has to take it further and she has to show evidence. You should not accept because you create yourself a problem/dangerous situation for no reason because breaching a court order is serious and goes on your record. You do not need to send any evidence. Just write that you refuse the order.
