Does the child having/not having their own room become a factor in the evaluation? I know a couple that lives in a large studio. The male is going for joint physical custody for his 2 year old. She has her own room at her mom’s (thought doesn’t use it) but doesn’t have her own room at his place. Although, he has a area cut out for the child with a bed and everything for her. What are his chances?

But I want the courts to have full visibility on the home I have provided for my daughter. I have even asked my attorney if she would like to have an evaluation.

Now, if the parents are getting divorced, does that give the parent who is keeping the home an advantage? If for example, my wife is remaining in the home because she bought it prior to marriage, am i at a disadvantage out of the gate because equal parenting time would mean he'd be living somewhere new half the time?

Hi, So I have a question cps just gave my friend back his son and everything is going good for him only thing is the apartment complex he rents from is trying to charge him $50-$100 for replacing his mailbox key. well, i told him he is more than welcome to use my address as just a mailing address so he can get all his mail without having to fight with the manager of his apartments. but he told me that he was trying to do that but cps told him he COULD NOT do that that he had to have the same home address as his mailing address. i told him that doesn't sound right to me bc what if you have a PO box? and he told me cps told him he had to buy a PO box which is about $50-$100 right now. my question is can cps tell you that you can not use 2 different addresses ( for example i live on 2nd st but i have all my mail go to my moms at 6th st) he's not living at the mailing address its just a safe place where he will for sure receive his mail with no problems. sorry if this is long i just feel like they are kinda overstepping and pushing my friend around bc he doesn't know any better and is scared if he doesn't do every little stupid thing they say they will take his son. like really some of the things they have had him do are just ridiculous.

I have a question so my son is with my husbands mom and she got a cps case well I have contacted the cps worker and told her that me and my husband would like our child his case is I'm California and we (my husband and i) just moved to Texas the cps lady said she would be sending someone to check our house so we can get our son but my question is the house we just moved in to is a 4 bedroom home and I take care of my grandfather my sister doesnt live with us but she still has a room here (bc shes the baby child and my mom said she could keep it) her room is locked do I have to have my sister unlock her room for the person who is coming to check the house to be able to go in there? In my situation, my mother in law flies out from China to take care of our 10 month old during the day. I am applying for day care soon as mother in law can only stay for 3 months at a time. My wife has an AVO that protects my son, her mother and I because she was committing domestic violence in the home. I had to make emergency care arrangements for my son by sending him to stay with my parents for one month. I commuted to work and visited as often as I could to take care of him. Can my parents submit statements about this and their concerns for his welfare in staying with my wife? Can I detail my concerns?

My brothers school did this to my parents 5 years ago. It happened after we continued to see Persistent scratches and bruises all over his body. Keep in mind he has severe autism too the point to where he can’t speak and is an angel :). He began to pinch us which was unusual and we assumed it was a form of defending himself (which was and he now continues to do it to us when we aggravate him) and also cried and fell to the floor when boarding him to the school bus. How do you report a custody evaluator? This person seemed to have a vendetta and went above and beyond to make me look horrible. She also didn't do a home visit. I've done all these things you guys recommended.

After mom got caught in a bunch of flagrant lies and then disappeared (parental kidnapped) with the child for 9 month, I was given full custody. After getting physical custody, the court then tried to make something like joint custody work by asking the Probation Dept to investigate. At the first meeting with the junior investigator, my daughter started a temper tantrum as the investigator ran the doorbell. I let him in, then picked up my toddler daughter up, asked her to take a nap, and promised we would work out why when she woke up. She woke up an hour later, wanted a lot of hugging and she could not remember why she was angry before. She only threw one other tantrum with me, but her timing was seemingly abominable. The probation officer’s total comments about the incident was: “He handles discipline with a firm hand.” Mom was too angry to make any kind of visitation schedule work. The court gave up and left everything in my hands. That is another long story.

This seems to point to separated parents. What about normal families having to go through a visit? I was looking for common information but didn't find it. My common sense is, keep your home clean. Be prepared for every room to be inspected in your house. Do not have any smelly trash in your home, no open knives, use electrical wall child proof covers ect...good luck parents.

My son’s evaluator spent two meetings discussing the ex girlfriend. Rarely mentioned the child. Didn’t do a home visit or speak to my sons ex-wife, with whom he’s been successfully coparenting for 8 years. The evaluator charged $3000 and now wants another $1500 to “write a report” for the judge. Outrageous! What a scam.

Is co-sleeping really frowned on by courts? My daughter is 5 and she co-sleeps with her mom when she’s with her and she always wants to sleep with me I’ll put her in her bed and she runs right into my room

We have investigated a case where the evaluator ran a Pro Mom organization which the father felt was bias. With stats on children that was brought out by Attorney Marilyn York recently at the TedX talk it can make a person think "what is going on with the Family Court process" and are these custody evaluations that are not baring much or any differences like mentioned in your video are having any kind of positive impact as a whole let alone warrant the price tag on an evaluation. In your video you have mentioned 50/50 or close to, but the fact is a major portion of fathers get 80/20 or a 70/30 So, the 50/50 or close to projection seems a little misleading.

The courts and cps are all gender biased. I have not been able to speak to my own children since January. I filed a motion to vacate or alter the order allowing me to speak to my kids. I was stay at home primary caregiver for over 3 years. Out of the blue I'm someone to be feared of violence. Btw I'm disabled and have limited use of my right side. He lives with my biological father his entier life and he's 10 years younger then me. When I went into the livingroom I seen my drunk father ontop of my 5 year old brother choking him so I will admit and I probably shouldn't, but I lunged at my father got him off my little brother and choked him till his at the time wife came home about a minute of me being on top of him. That day I was kicked out of my father's house along with my brother and at the time step mother. The next day rolled around at it was finally my little brother's birthday we were at the step mothers parents house for that night and my mom was p*ssed at my father for what he had done let's just say I'm no longer allowed to see my little brother and father yet I still sneak out to see my little brother. Would it be wrong if I tried in court for custody of my little brother? He lives in the next state over from me but would it be worth it when me and my fiance is financially stable and has the room for him to have his own room? They have lost all rights to having dogs because it was being beat half to death, starved, not taking care of, and more. So my fiance wants to gain custody of him as soon as he says to us that he wants to live with us. Mind you the poor kid takes showers with his uncle (my fiance) eats when his uncle eats, and attempts to sleep in his uncle's room when he attempts this the kid gets dragged out of his uncles room by the upper arm even if he is asleep and is forced to sleep in the living room with the parents even if the kid screams at the top of his lungs. He'll the kid tried running back into the room last night for safety. Do you thin it would be a good idea to take him in when we are stable enough to do so?

What if the child was molested by the other parent? How is 50/50 even a possibility? When the parent who violated the child and didn’t do what’s in the best interest of the child?

In other words forget divorce - keep your money. Set up separate lives and avoid the hassle, lies, loss of thousands into maw of broken system.

This is one more hoop to jump through, you're custody chance is quickly determined almost immediately upon first petition, the in between is just the system trying to validate itself, amd hopefully catch violations to blame their decisions on, instead of the inequality inherent in all family court cases. My ex cheated. She broke up with me, then had her new boyfriend over while I worked, lying about who he is. He played daddy and family with my kids while I worked, going to movies, zoos, playing Legos, eating meals together. We had agreed we would live together for the kids sake for the time being, and we agreed no dat I g involves the kids. She spitefully did the opposite. She moved out because there was no way this arrangement was working. She was just using me to buy time and save money to leave anyway. 3 years later, still haven't gone to trial. She got a protection order to go with her petition for full custody, saying that I would 'lie' and report the criminal fraud she has performed over and over. That was approved without question. These led to reduced visits. 3 years of nearly nothing. Now my lawyer says you are a great dad it's proven, but 3 years of being with her is my weakest attribute for my case. The offense I've suffered for three years, on her manipulation, my lawyer says is the excuse the judge will use to strip my fatherhood DO NOT listen to family court people. You have to legally assert ypur rights pre-trial or get them denied so you have appeal strength. Minus some radical event, the proccess is bullshit they know your outcome already. all people involved with the family court are slime
