According to Indiana Supreme Court Rules, Mediation “involves the confidential process by which a neutral, acting as a mediator, selected by the parties or appointed by the court, assists the litigants in reaching a mutually acceptable agreement. The role of the mediator is to assist in identifying the issues, reducing misunderstanding, clarifying priorities, exploring areas of compromise, and finding points of agreement as well as legitimate points of disagreement.”Indiana Supreme Court Rule 2.1
Do you need to have a lawyer during a mediation? No, it’s not a requirement that you have one there. You and the other party both get to decide for yourselves whether to work with a lawyer and if you do, you will be able to decide how involved their role will be. But there are some issues to consider when deciding if being represented by an attorney is in your best interest and advantages as to why you would hire an attorney for a mediation.
First, some factors to consider when deciding whether to hire an attorney for an employment law mediation:
Financial Obligation - Can you afford to retain a lawyer for the mediation as well as pay your share for a mediator? Typically, fees for your lawyer are your responsibility, and mediator costs are split equally between parties. Are there arrangements that need to be made or possible settlement payments that would allow you to afford legal counsel?
Complexity of issues to resolve - How complex is your situation? How well do you know your responsibilities and entitlements? What are the issues? How confident are you in your ability to advocate for yourself? Issues of employment law are typically very complex and fact specific.
The Other Side - How willing of a participant is the other party? How motivated are they to come to an agreement through mediation? Is the other party a large corporation, or a small group of individuals?
But what are the advantages to having representation at your mediation? Mediation is an emotionally charged and stressful process, and having someone experienced by your side when you’re going up against your employer can ease tensions on both sides. Plaintiffs may hire attorneys for mediations because:
You have someone to help advocate for you;
There is someone to help you keep your emotions in check during a charged situation;
You have an objective person who can hold the bigger picture in mind and depersonalize things during the mediation process;
Your counsel can help you feel safe and supported;
There is instant access to legal information and advice about matters you might not be aware of (for example, tax implications);
If you work with an experienced lawyer, they will have many previous situations they can draw from to help can suggest creative solutions
Your legal counsel will help you evaluate offers and proposals that are put forward for you to consider;
You have someone who’s staying up to speed on your situation and can, if you fail to resolve all your issues in mediation, give you advice on what steps to take next;
You can potentially be more efficient in coming to a resolution as you do not have to break to get legal advice and re-schedule the mediation for a separate session.

A friend of mine mediated and settled she said thanks to u and ur advice thanks for ur help to many people take a lawyer would be the best but talking to a attorney like she said would help thats what my friend said 🤣 and yes remeber u are going up against lawyers so have a good opening statement and tell what happened to u how were they unjust to u discrimination. Have a number make it higher then what u will settle for because they will always work u down thats what my friend said.😂 mam my friend said ur rewards are in heaven god bless may the blessings rain on you.

It is honest that you are saying "if you believe you have a case, be confident and present it" because all the opposition is doing in some sense, granted you have a claim, is gaslighting you. They throw a lot of legal jargon that the common person does yet understand. But in your gut you know they did you wrong. Thank you for this video!

Your video helped me , saved me, from getting nothing in my mediation eeoc case. I represented myself and my opening statement worked! My mediator told me “your opening statement got you the settlement” thank you! I kept it facts and not emotions in my open statement and that changed everything !

@@onyekachiononobi4727 I stated 3 facts of my case followed by the amount I was asking for. Every fact used to prove my case I wrote down. I also used lawyer jargon to support my facts (sounding legit) this all amount to me getting a nice settlement

I don’t want money. I want my RA and to be left alone to do my job without fear of being written up for every little thing they can think of like I’ve observed happen to other employees. They will make life miserable at work to get you to leave.

The EEO didn't goes as well as I would have liked, the attorney that was given my case wasn't experience with federal....this was his first case come to find out. I had a bad feeling and should've pulled out in time. Trust your gut feeling cuz that's money lost when I honestly could've represented myself better. My case is still on going with union tho and hopefully coming to an end soon

Thank you for this great video! Prior to the meditation, should I give the EEOC investigator all of the documentation and proof I have or should I hold on to some proof for trial?

I plan to do a constructive termination letter to my employer with all the many complaints they put me thru. I was advised by an attorney to add the complaints to it and hit them hard with everything they did to me. 🙏🏼🙏🏼😪

Hello, That was a very good information. Im in PA going to Mediation next Wednesday. I had taken the school to western district of PA over the mask mandates as an employee and a woman. I was trespassed from the building on first day of three inservice days at the beginning of the school year. I right away sent a letter to the superintendent then the entire school board and HR about how harmful masks were. I had told the principal that HR knew last year that I could not wear a mask. I was placed in Cyber working from home last year which kicked the can down the road. The judge finally closed the case but 5 out of 8 counts were dismissed without prejudice. I know that HR knows I have a case going in prose. I sent RTK to the school district to see how many people were aloud to work from home this year they said they don't have that data. also NO Exemptions were given to not wear a mask. I didn't open the EEOC till march 4, I was only offered FMLA as an accommodation but not from Dr which proved i had a disability stated I could certainly work from home. That said $$ amount should be large I did not know I could go on UC while still working so 108 days off not pay. I'm also 63 and feel that played into them pressuring me to comply. They knew this was my only income. Paraprofessional special education assistant.

How did this work out for you? I have a mediation coming up because of my ability to not wear a mask at work. It’s so comforting to read that other people are having these issues because I feel alone and crazy having to even go through this process for a harmful face covering.

@@JustchillLex95 Thank you for your reply. I wrote it out and summarized the retaliation piece and added that being 60 years old, it is harder to get 2nd interviews once they see me. Plus, the compensatory damages I lost contributing to my 401k. I did reach out to an EEOC attorney and have an appt on Tuesday for consultation. Sigh, this is such a big process and very overwhelming. I appreciate the KZfaq channels that help. Thank you again!

Thanks for your videos! I resigned from an extremely toxic work environment. Prior to leaving, I did not say a word to anyone where I was going. When they asked where I would be going, I told them I would be taking time off. I've now found out that a former co-worker told everyone, and now I'm getting calls from former co-workers after keeping it private. She found out through someone I work with now that she's friends with. Can I do anything about this? She has totally evaded my privacy.

Hi there. I was dismissed from my job 3 weeks before my wife was due to give birth to our first child. My termination put a significant load of stress on my wife. So much stress that it affected our unborn baby's heart during those final week to a point where his heart depolarized. Medical staff determined that because of the constant stress the baby was under, he would not be able to handle a vaginal birth, therefore we went in for an emergency C-section. Can this be considered when it comes to compensatory damages?

You can still file a complaint. I just got an email back, telling me that they will arrange an appointment.

Get an attorney right away! They will file the complaint for you. I had the same issue. Get a contingency lawyer.

@@jasmines2250 I’m pretty sharp and these lawyers don’t want the work. I ended up having a problem with a contractor in the past and the lawyers didn’t want to work either I did all the work and when the case. I local police were amazed of the work that I did. I’m not sure what the deal is.

i am so confused now, i went to an attorney, they told me i had to go before the EEOC to see if I have a case because the EEOC has to grant permission to pursue a lawsuit. I was under the impression i couldnt have counsel for the EEOC interview. They told me to reach back out after the interview is over with a postiive decision..

Not sure if you still need this information since it has been five months, but many attorneys will send you to fill out your EEOC complaint to see first if they will take your claim and investigate then the attorney will back that up by taking your case.

@@DrScott-su4eu thank you for replying. the lawyer i was speaking with wasted my time completely. when i reached back out with my right to sue letter they said congrats!! we no longer handle these cases were doing covid injury cases only now. im reaching out to the bar for ethics complaint because i could have found a diff lawyer that would have not wasted so much of my time. i am in the process of looking for one for NJ that will take my case as i have an abundant amount of evidence. I have about 30 days to file hte suit. I just have no idea how to present my case as i struggle with explaining things. if you cant tell. haha.

I don't have a lawyer. When I started this, it was hard to find a lawyer/attorney. It's like the ones I contacted didn't want to touch it. I agreed to mediation however is it too late to get an attorney?

Can you give us some examples of where going pro se went well? For anything be it civil or criminal? I'm not an attorney I just want to know why this should be deleted if its not bad advice. The bad advice would be representing yourself. In my eyes
