This video is part 3 of our series on how to prove extreme hardship for a waiver. Entitled “Secrets To Presenting And Winning an I 601 Waiver”, these videos share advice on preparing, developing, and presenting evidence to maximize your ability to win a 601 waiver.
Here is our hardship waiver video playlist: • How To Prove Extreme H...
Based on over 20 years handling complex i-601a cases, immigration attorney Carlos Batara prepared this series to share secrets for demonstrating extreme hardship over that period: www.bataraimmigrationlaw.com.
Part 1 of this series provided a general overview of the process for proving extreme hardship for an immigrant spouse. Four secrets of practical evidence advice necessary to ensure your i-601 waiver is approved were introduced.
Part 2 went into more depth on how to develop evidence to improve your chances for success. It laid out how to transform evidence of an ordinary hardship into proof of an extreme hardship. It focused on the difference between direct and indirect hardship sources, as well as the distinctions between family members who are qualifying relatives and those who are not.
In this video, the focus remains on the specific of evidence preparation for proving extreme hardship in i-601 inadmissibility waiver cases. Three primary items are discussed.
First, the three rules for evaluating extreme hardship that USCIS officers and immigration judge must follow in I 601 cases.
Second, how these three rules lend themselves to building mini hardships. (The indirect and small “h” of non-qualifying relatives.) This effort of starting small and growing larger can be likened to collecting pebbles of evidence, which together turn into a monumental, bigger hardship. (The big “H” of qualifying relatives.)
Third, the importance of storytelling as a vehicle for presenting your evidence in a comprehensive and cohesive manner, facilitating thorough review by adjudicators.
Storytelling enables i-601a hardship applicants to outline positive reasons to get an i-601 waiver approved, and not simply discuss in a rudimentary and sterile style why they meet the regulatory requirements. It allows immigrants to illustrate how they are making the U.S. a better country, factors which are overlooked in robotic formulas for preparing extreme hardship waiver applications.
The purpose of this three-part video series is to share tips and insights for evidence preparation, evidence development, and evidence presentation not discussed by immigrant advocates and legal representatives. In so doing, the process of earning a green card through marriage for an immigrant spouse becomes more likely and within your grasp.
If you’re facing the prospect of surviving the consular processing interview, this video is for you and your spouse.

I watched your three episodes, back to back. I love your style of teaching and engaging your audience. I am apsychologist and do forensic and immigration type of work for the past 25 years and I always focused on the individual, personalize my reports and that was the edge the attorneys used to fight the cases in court. Hi Dr. Fonte. Thanks for the kind words. It's good to know you're in the Florida area. Once in awhile, I get cases down there and more often than not, their problem is that they have not developed their cases strongly enough, including the absence of psychological examinations. I looked at your You Tube channel. You have some really good topics for clients to watch. If you don't mind, I"ll reach out to you related to some work I have been developing on the role of psychologicals and mental health experts in immigration cases. Until then, take care.

@BataralmmigrationLaw I watched all your videos from Part 1 to 3. I hope you can help us about Extreme Hardship. Am I (Beneficiary) the one to fill up the FORM I-601 or my spouse (Petitioner)? The officer told us to make a Letter (EXTREME HARDSHIP) based on my RELIGIOUS BELIEFS. Is it okay to consider the Letter of our BRETHREN even they are just our closest friends and Letter from my spouse's relatives? Thank you so much!

@BataraImmigrationLaw 2 жыл бұрын
Supporting letters, made under penalty or perjury, can be helpful - so long as the letters address pertinent issues. The waiver request is made by the immigrant, but the hardship issues should center on the U.S. citizen petitioner.

Thanks sir Carlos for the very informative video on hardship waiver. I've been following your presentation regularly. My question this time is: what should anyone do if while awaiting the interview for the green card (being married to a US citizen), the couple divorced. Most likely the US citizen spouse will not come for the interview anymore. Is there any other way for the beneficiary to get a green card?? What should she do? Thanking you in advance.

Hi Attorney! I wanna ask something. If you will be approved for your form I-601A and you are under J-1 visa when you came to US, then you overstayed your visa, once you get back to your country, will you be having an interview for your visa interview right away or you have to wait after 2 years to do the 2-year residency rule? Is this form I-601A that was approved within US has no expiration date? (Assuming you were already married to your US citizen spouse within US).

Do you think a spouse (who entered illegally) of a US citizen has any chance of avoiding departure and time bar, if the citizen has an average paying job, no kids or major medical problems and isn't drowning in debt?
@BataraImmigrationLaw
@BataraImmigrationLaw 4 жыл бұрын
Maybe, maybe not. On the surface, the situation sounds grim. But who knows? The person's situation needs to be explored in depth. Then and only then can one provide an evaluation of a person's chances to win a hardship waiver.
