@@BataraImmigrationLaw I'm pretty sure challenges do not block green card issuances in real marriages. Unless there are no prospect of appeal against an immigration officer's wrongful decision. I doubt the USA do not allow appeals.

What about dating ONLINE for a year then the US citizen flies down to Nigeria for 1 week….they get engaged then 2 days later married?! Is that considered fraudulent??

A real marriage should never be found fraudulent. This is why a legitimate couple needs to carefully prepare evidence or find someone who can help them do so.

From my own experience, it’d be better to have a couple visits back and forth and then marrying - committing so fast (even though in your heart you may feel absolutely sure) may raise alerts with USCIS.

Hello I need a guidance. I have applied for I-129F petition for alien fiancee for my girlfriend in Ghana. When I was doing my citizenship I believe I erroneously put on the form she is my wife. I have just received an RFE for my application and they are requesting a divorce certificate for me and her because USCIS records indicate that we have been previously married, but indeed we never got married. What do I do in this regard?

I’m wondering about could someone who is citizen can submit petition to his step mother ( and his step mother married with his biological father when he was 5 years old ) but his biological mother hasn’t divorced, which means his father married with two women ( because in Iraq country it’s legal marriage with more than one women )

The paradox is that foreign spouses of Cuban citizens in the United States never have to request any type of waiver or leave the country for a consular interview. They don't have to experience any hardship. The United States gives special privileges to Cubans even above its citizens. Not even members of the armed forces or Native Americans enjoy these privileges. The laws are not the same for everyone.

I have received 5 times a requests of evidence I respond but they keep send me till they respond case complete and been transfer to the embassy but in their review ask me for evidence with the officer at USA embassy unbelievable

Five times does seem unusual. If they are asking the same question over and over again, then it is likely because you have not provided certain evidence they want.

Hello, my dad has been stuck in the islands for 8 years. I am a US citizen , I tried to file his green card and his form I-601 but it came back denied because I was not a qualifying relative. Why does children not fall under qualifying relatives and do I have to file form 130 before 601 or it doesn’t matter?

There are various rules for I-601 and I-601A waiver. The differences are generally made as a result of Congressional concerns.

Yes, the majority of the information is applicable for both types of waivers. The biggest differences are (a) the qualifying relatives and (b) what issues might be waived.
