What does the Social Security disability judge need to hear from you if you hope to win SSDI benefits? How do you stand out from all of the other disability claimants that your judge will meet that week?
As I discuss in this video, your main job at your hearing is to tell a story - your story. Your topic: how and why your serious medical issues prevent you from reliably working at even a simple, entry-level job.
But your story has to contain certain essential information.
When you filed for disability you identified an "onset date" - a specific date when you claim that your medical condition had deteriorated to the point where you could no longer work. So your story must explain why you chose that onset date.
Your disability claims file contains medical records. Those records reflect treatment you have received over time. So your story must explain how you and your doctor tried different procedures, medicines and treatment options to help you recover your function. But despite your best efforts and compliance with treatment, you have not improved.
Your disability story should reflect your struggle to get better over months or years. You may be recovering from a procedure performed three weeks ago, and your recent pain and discomfort may be what you are thinking about today.
But you need to take a broader view. Your recent procedure is part of a much longer narrative that stretches back months or years. So your narrative must focus on on-going struggles.
Your disability story should also reflect who you are as a person. Judges will be much more open to approving your claim if they sense that you are a fighter and that you view the disability process as an absolute last resort. Don't come across as someone who has given up and who has internalized the idea that you are "disabled."
Finally, your disability story must be delivered clearly and concisely. That's where your lawyer comes in. Practice answering questions.
Learn how to focus on work capacity issues. Avoid meaningless descriptions like "not very much" or "any length of time." Learn how to condense three or four years of your life into 10 or 15 minutes.
Experienced public speakers don't speak off the cuff - they practice and practice until their presentation is clear and concise. Your lawyer is there to help you refine how you present your case - that's why we get paid.
Most likely you have been waiting for months or even years for an opportunity to appear before a #disabilityjudge. Your hearing will last 45 minutes to an hour - so every minute counts. Use this valuable time to tell your story effectively.
