What does the Social Security disability judge need to hear from you if you hope to win SSDI benefits? How do you stand out from all of the other disability claimants that your judge will meet that week?
As I discuss in this video, your main job at your hearing is to tell a story - your story. Your topic: how and why your serious medical issues prevent you from reliably working at even a simple, entry-level job.
But your story has to contain certain essential information.
When you filed for disability you identified an "onset date" - a specific date when you claim that your medical condition had deteriorated to the point where you could no longer work. So your story must explain why you chose that onset date.
Your disability claims file contains medical records. Those records reflect treatment you have received over time. So your story must explain how you and your doctor tried different procedures, medicines and treatment options to help you recover your function. But despite your best efforts and compliance with treatment, you have not improved.
Your disability story should reflect your struggle to get better over months or years. You may be recovering from a procedure performed three weeks ago, and your recent pain and discomfort may be what you are thinking about today.
But you need to take a broader view. Your recent procedure is part of a much longer narrative that stretches back months or years. So your narrative must focus on on-going struggles.
Your disability story should also reflect who you are as a person. Judges will be much more open to approving your claim if they sense that you are a fighter and that you view the disability process as an absolute last resort. Don't come across as someone who has given up and who has internalized the idea that you are "disabled."
Finally, your disability story must be delivered clearly and concisely. That's where your lawyer comes in. Practice answering questions.
Learn how to focus on work capacity issues. Avoid meaningless descriptions like "not very much" or "any length of time." Learn how to condense three or four years of your life into 10 or 15 minutes.
Experienced public speakers don't speak off the cuff - they practice and practice until their presentation is clear and concise. Your lawyer is there to help you refine how you present your case - that's why we get paid.
Most likely you have been waiting for months or even years for an opportunity to appear before a #disabilityjudge. Your hearing will last 45 minutes to an hour - so every minute counts. Use this valuable time to tell your story effectively.

I was 100% honest through all of my hearings with the judges, everything, and I still never won my disability case, and I have everything from spinal stenosis, bulging disc in my back now a disease that radiates from my spine down my legs, it also affects the muscles in them, causes me to lose control of my legs, and I almost fall, Also have syncope that’s heart related, also have heart disease, second stage glaucoma, RA through my body and many other things, and I still got denied, I didn’t have a really good lawyer to represent me and I lost it all and even put in hundreds of dollars to continue going, but I know my God’s gonna take care of me, even if they didn’t see that I was fit to have my disability granted to me that I’ve paid into myself for years

If your doctor or doctors deem you disabled and unable to work and Social Security denies you disability isn't that discrimination? What's the point in having doctors then

I completed my Social physical and mental review recently for my first time application. I have to say I have never experienced two more unprofessional people from attire to verbage to attitude in my entire life. These have to be bottom dwellers in the medical system, the one had my name totally wrong ,she had my number totally wrong ,she told me that I had a difficult name to pronounce which I don't absolutely crazy. She missed the appointment and told me it was my fault I'm not sure how that works, and that was the mental health professional..lol. If one is assigned one of their medical people, don't go!! see if somehow you can get your own. My mental health gal was barely even dressed in regular clothing😮

Your videos are so helpful. Thank you. My son is a 21 year old Type 1 Diabetic who also has Hashimoto's. He was also diagnosed with the following mental health issues as well. 1. Persistent Depressive Disorder (Dysthymia) {300.4/F34.1} 2. Other Specified Bipolar Disorder (296.89) 3. Social Anxiety Disorder (300.23/F40.10) My son lost his only sibling in a single car accident. It was a terrible trauma for him. He has terrible social anxiety. He rarely drives and sees his friends on rare occasions. Like a few hours every 3 or 4 months. The management of this Type 1 Diabetes suffers greatly with his metal health problems. I was made aware that SSA has a two system classification but have not been able to find out any details. If you believe it would be beneficial to others this would be a great category to go over. The two system challenge is significant in his case. Thanks again.

I'm not sure what you mean by "two system classification." If you mean SSDI vs. SSI the definition of disability is the same but SSI is means tested so household and family support will offset any SSI award. If you mean younger claimant vs. older claimant, you are correct - it is much more difficult for a 21 year old to win with the same conditions as a 51 or 55 year old.

I have an MRI from 2017, severe spinal stenosis, degenerative disc disease, herniated discs, arachnoiditis. I need to pee every 45 minutes to an hour, I can't stand or sit for too long, I need to be in bed all the time. Wake up 3 to 4 times to pee at night, I can't sleep. I've been missing a lot of appointments. Every time I contact a lawyer they say I'm too young and that I'll be denied, I'm 46, nothing works, physical therapy doesn't work. I have an audience August 28th. I'm not going, I just don't want to live anymore 😔

You're not the only one, I'm in a similar situation 44 and just as many problems if not more. 2 law firms have lost 2 cases now.... But i do think you should go to your hearing (even if you lose), if you do end up choosing to live and try for disability again later... You're "not going" to a previous hearing may hurt you in a future case, but 🤷 I'm not a lawyer but I do play one on YT. If you are under 50, you almost need to be in a wheelchair, missing limbs, or blind to win. Last lawyer said "we have a mountain of evidence" but for some reason ssa wouldn't consider it or didn't believe it. So I feel your pain!

Too young is not a reason and is prob age discrimination. Find another lawyer.

Please hang in there don't give up. I recently stop working I've been diagnosed with heart failure I'm only 47 years old so I understand. You can't give up keep fighting 💪

@@jacksycz 𝙏𝙤𝙤 𝙮𝙤𝙪𝙣𝙜 𝙞𝙨 𝙖 𝙧𝙚𝙖𝙨𝙤𝙣 if you don’t have enough SS work credits. Also “if” approved young they’ll revisit the case annually & any misstep (must remain under Dr care) will reverse the approval.

It is not required to have an attorney to win your disability claim. But some claimants find it helpful to have guidance.

Yes, those are mental disabilities. I have them and on VA Pension. Social Security is a lot tougher to be approved based on mental disabilities. What physical secondary problems do you have based on those problems? You may want to connect it and how it prevents you from working.

I started by educating myself about the process and how to properly file and present my case. I am doing this on my own and without a lawyer/attorney. I have a number of medical diagnosis and go to the VA hospital on average of once a week. My court date is the end of this April, 2024. During the entire process, I also applied and receive VA Pension as a Persian-Gulf War era vet.

My doctors gave me restrictions of no driving over 30 minutes, I have to take a 15 minutes break every 45 minutes, and no repetitive arm movements, what do I need to do, I keep getting denied. I went out on disability retirement from my job in 2015, and I'm still waiting on other surgeries, my doctors said no work until I get the surgery. Please help

Could be a lot of things - your age (are you under 50?), the nature of your diagnosis, whether your doctor is a specialist, are there objective tests to document your condition? SSA makes it very difficult to win.

No it would not. If the SCS reduced your pain to the point where you could work then you might no longer be considered disabled by SSA.

If you are under 50 ssa is going to expect you to be a Walmart greeter or movie ticket taker or put pens in a box.... Would likely be Johnathans response. They always think you can transition to "easier" work... I've tried the easier work and got fired from that too. Now, if you are over 50 your chances are better if you have the evidence.

I have been in an appeal for 3 years on my own Accord..My family has in the past , gone behind my awarenesses, and gotten my rights, although it was extremely challenging and will deny this fact, because of their own personal advantages, they left me in the dark. They have convinced several GOVT AGENCYS OF THEIR IDEAS. THIS HAS CAUSED SERIOUS RESENTMENT'S AS ONE MAY COULD IMAGINE, IT ALSO HAS BEEN DEBILITATING, TO MY RECOVERY, AND HAS ON CAUSED ME REGRESSION IN EVERY WAY. MAYBE A CLINICAL STUDY, TO NOT MAKE A PATIENT AWARE OF THE TERMINAL ILLNESS, TO SEE IF PEOPLE OVERCOME, WHEN THEY HAVEN'T BEEN TOLD THEY HAVE , A TYPICAL BASED ON EVIDENCE IN PAST TRIALS AND EXPERIENCES, this is all I can assume, as to why I have been left in the dark on one side, and DELIBERATELY driven insane,literally on another. I NEED HELP, FAST AND KNOW ONE WILL HEAR ME AND IF THEY DO, my words have no creditable value, IF NOT MY WORDS, WHO'S WILL STAND FOR MY LIFE. MY LIFE MATTERS, AND I KNOW THIS..I WONT GIVE UP.HELP ME TO KNOW WHAT TO DO, EVERYTHING I TEXT IS READ BY THEM. THANK YOU
