judge gets annoyed with Amber Heard lawyers as she explains a verdict statement as try yet again try to manipulate such an obvious statement.
Actor Johnny Depp is suing ex-wife Amber Heard for $50 million for defamation in connection with Heard’s 2018 Washington Post op-ed, in which she spoke out about being the victim of domestic violence. Heard’s article did not specifically name Depp as her alleged abuser, but according to Depp’s lawsuit, it relied “on the central premise that Ms. Heard was a domestic abuse victim and that Mr. Depp perpetrated domestic violence against her.” Amber Heard is counter-suing Depp.

Actually, this is a win for Heard because the Jury is going to judge it on the Title alone and not the content of the article. Depps Lawyers wanted to file a motion at that time because they don't want that. This video title is not accurate at all.

How can the judge say only the title matters after all this. The title says "I spoke up against sexual violence.." which isn't exactly about Johnny. @Advanced Driving It doesn't matter what "one" believes. This isn't a criminal case, not all the jury needs to agree. This is a civil case, they only need a majority vote to declare a winner, it doesn't require 100% to vote one way. Even the burden of evidence is lower, they only need to believe it's more than likely true one way or another, which is vastly different from criminal. In criminal cases there's additional requirements to help protect from wrongful conviction, with criminal cases the burden of proof must be "beyond a reasonable doubt" and 100% of the jury needs to agree before a verdict. In this, all they need is most of the jury to believe it's more likely than not to be true and they have a verdict. Something else that is vastly different is that in criminal cases there's two trials and two juries. The jury that convicts (or not) and then another sentencing trial with a new jury that decides on punishment. That doesn't happen here for civil, this jury once they decide on a winner then has to sit and also make the decision for damages. So even if a decision for winner is reached quickly, they also need to debate how much an appropriate award will be, they have no restrictions to only give what was asked for. They have to look at the actual damages they think occurred and their value and then decide on additional punitive if they choose to do so. So the jury has a much broader scope of things to discuss. A criminal case the convicting jury doesn't decide on sentencing so that there's less chance of bias carrying over to the sentencing jury who hears an entirely different type of presentation.

They did a good job demonstrating how her co-opting those organizations to amplify false claims of sexual and physical abuse damaged his career. It’s clearly proven defamation causing damages, so even a guilty verdict acknowledging her defamation would go a long way to restoring him, regardless of what monitory damages or punitive charges they want to add, which the judge said they could also consider, punitive damages to set an example to discourage future false defamations.

Amber will think she's able to get away with *anything* and will 100% double down on her abusive behaviours If Amber wins, anyone who might've been motivated to step forward and admit they've been abused will probably not do so, because Amber will have proven that pointing at a victim and saying "No actually THEY abused ME, they're a liar, I never abused them" is a winnable statement...

Malice, as they explained in the trial, simply means making a statement knowing it is false. That's all. So not hard to prove in sense it just goes to whether AH is lying or not.

You should think it is even more defamatory b/c she said "I spoke up against sexual violence." When all of her testimony/evidence was unrelated to sex. The sexual allegations were never supported by ANYTHING, not photos, no testimony, NOTHING other than a blanket statement "sexual violence." She testified that she wrote the op ed. Although there was testimony that the headline was drafted/created by the publishers, it was still HER STATEMENT. She retweeted the statement as her statement. She owned it. She republished it with a link.

I can't stand when Twitter people say that their tweets aren't endorsements. They absolutely are endorsements, especially when you quote them and write more about it. She had no problem with the headline because it said exactly what she wanted to say, therefore she owned the headline as her own.
