The plaintiffs had three purebred bulldogs. They said their purchase contract requires the dogs to get neutered, but the defendants didn’t have their dog fixed. The plaintiffs say the defendants refuse to return the puppy they got from the plaintiffs, so they’re suing for breach of contract. The defendants say the agreement only requires the dog to get fixed if they wanted their American Kennel Club paperwork, which they have no interest in. They argue they don’t want to neuter the dog because it changes the dog’s temperament, and they don’t plan on breeding it.

The breeder says she thinks people should not breed and should get their dogs from rescues. I don’t disagree with the sentiment, but why the heck are you a breeder if you feel that way?

Breeders are not all anti rescue. They breed healthy, registered, quaranteed dogs. For some people, a registered dog is not a good fit and a rescue from a shelter is a better option.

The defendant's see Oscar their dog as part of the family, not as a way to make money. Seems like the plaintiff's have a hard time understanding that. It was the plaintiff's fault for not being more specific in the contract if they were that worried about the neutering/paperwork.

We had a pure bred Shepherd, AKC papers the full nine yards. A mixed breed female got off her chain down the block, made her way into our yard, and we highly suspect became pregnant off our dog. That dogs owner went around telling people her pups were purebred because our dog was, and he found enough idiots to pay him over $500 per pup! There are clearly a lot of people that do not understand how dog bloodlines work. An ironic twist to this tale, the female dog was abandoned by those neighbors, they did a midnight run on the rent, and we ended up taking her in. Our Molly has been with us 12 years now, they used her as a puppy mill!

@Aceofwolves We didn't neuter him as it was planned he would be a stud dog a couple of times. If every owner neutered their dogs, there would soon be a shortage of purebred dogs.

Here's a thought for the Plaintiffs moving forward: charge the extra $1000 up front and then when the buyer gets the dog neutered, refund the $1,000 and give them AKC papers. If the buyer doesn't... then keep the $1,000 and the papers.

I think it's a good idea but they are going to have to give the payoff papers either way. Paying the extra $1000 is basically to cover full registration ownership if they keep him intact. If they get him fixed then they still need to send his paperwork. He's basically just paying $1000 for his ability to breed at that point, not access to paperwork.

Breeders are gross. Do they REALLY not realize that for every, single puppy bred and bought, even by "responsible" breeders, a dog is euthanized at a shelter? Of course they do...they just don't care. Adopt don't shop should be a law, not a suggestion.

The plaintiff's claimed its not abt money yet they got 3k and wanted an additional 1k instead of just keeping the papers as a remedy. The judgement was fair.

Imagine that, you write up a contract with consequences and someone doesn't care about receiving said consequences. How do you go and sue after that? It was funny that they sell a dog for $3000 and say, "it is not about the money..."

They made a contract that says either spay the dog or u get no papers, the Ds said ok fine. So that's that. They need to amend that clause to give a greater consequence. They should have a neuter/spay deposit that they hold and return once the deed is done.

You're absolutely right. The plaintiffs should have said in their contract that the dog should be neutered by X age full stop. I have seen contracts from breeders where they will sue buyers upwards of $20k if the dog is not neutered within the agreed-upon timeframe.

The plaintiffs are clueless. They did read the contract. When you neuter the dog, you get the AKC paperwork. That means if you don’t neuter them, you don’t get the paperwork. Exactly how the judge read it. Money hungry breeders acting like they are a non profit selling puppies for $3k each.

The contract probably needed to say taht if they dont neuter the dog they have to pay the extra $1000, reguardless of papers. A lot of people sell with a neuter contract... it's clear from this, that those breeders need to carefully word the consequences of breaching that as apparently it isn't enforceable.

You have two types of people that own Frenchies, dog lovers, and dog breeders. Frenchies are a high maintenance dog, and can yield a lot of revenue. They have to be inseminated, and pups are usually delivered through ceserean, in order to have a litter. These are not dogs that can just run around and get other dogs pregnant. In my area, they cost upwards of $6k. The cost it takes to even breed these dogs is a high, which is why there are so few breeders, compared to other dogs.

@@Aceofwolves I don't consider a mutt as what they're talking about. I've never had a "purebred" myself. When you talk about show worthy you're talking about comparing to the standard of the breed. If the breeder is really concerned about keeping the integrity of the breed, then they sell puppies as show quality or pet quality, my understanding. I would say that mutts are way stronger than purebreds because you don't have the inbreeding associated with keeping a breed. Mutts are less likely to have genetic defects like hip dysplasia or deafness or a bad back that's found in certain breeds. BTW, the comment is directed towards showing and not the cooler things like agility. Bottom line is, I'm agreeing with you, in case that's not coming through. Wow, I realized that I originally commented on this video a year ago.

I hate how much the plaintiffs treat these animals as absolutely nothing more than a business. That dog is a part of the defendants family.. not there to make them money.

Honestly, if you don't want to breed your dog just get it spayed/neutered (barring health risk to anesthesia). It doesn't change their personalty; it just removes their desire to breed. Also, it's perfectly okay to purchase a dog that fits your lifestyle from a reputable breeder. It is also perfectly fine to adopt a dog as well.

I think if the judge wasn't going to consider the defendant's $1000.00 offer for not neutering the puppy she shouldn't have asked the plaintiffs if they wanted to consider that offer. Just like she threw out the option to return the puppy. Notice how Harvey Levin at the end says that would be something that should be entered into the contract in the future

He could make a ton of money off this dog without papers. Today he might say he won't, but what happens when a good friend or family member gets a dog and wants to breed their dog with his? Even without papers he can still sell those puppies and make a money. I disagree with this judgment mostly because they signed a contract stating they would have him neutered and they broke the contract. They should pay.

Yes but the contract stipulated that the cost of that breach was not getting the papers. The defendants just happen to be fine with that so it’s inconsequential to them. The plaintiffs need to rewrite their contract so the cost of the breach is either additional monies owed or repossession of the dog.

@@jccanteen That's true, they do need to update their contact. He lied under oath, saying he didn't know about it until pup was 7 months. So that alone destroys his credibility! They can't breed using the dogs lineage but they CAN still breed, I don't believe for a second that they won't breed and make money off of the puppies. Hopefully they will stick to their word and not breed.. But I will bet money they will breed him..

Old generation: there’s too many dogs and cats around. Let’s spay/neuter them; that’s better then euthanizing them. New generation: we can’t find kittens and puppies anywhere; they are going extinct. Let’s pay thousands of dollars to get one.

So I have these dogs and the contract I have with my breeder gives you a "discount" price if you sign agreeing to spay or neuter the dog within so many months and if you don't prove this you owe the breeder the rest of what they would charge someone who wants to breed the dog. This protects bloodline and any poor breeding practices of buyers who get these type of dogs to turn around a quick buck at the expense of the bloodline and purety of the dog

Dogs that are AKC certified go through tons of health checks to make sure that they are the healthiest that they could be for that breed, so that they're only breeding the best qualities into the puppies. Given the health history of bulldogs, it would make sense that if someone was interested in having a healthy pet with a long lifespan (especially given the breeds health history), that they would want one that came from certified healthy parents. Especially if they had the financial means to do so.

@@lisabinhawaii Are you suggesting that because you can't 100% guarantee to never have a health problem in a pet, that there is zero health benefit to making sure that the pet you purchase comes from a line of healthy ancestry? Maybe you can't eliminate ALL health risks. But you can certainly reduce the risk of a lot of them by paying attention to the lineage of the pup you purchase.

JM is wAAay off on this case. My English Springer is from champion bloodlines, we signed a contract @ SPAYING (done @ 15 months old), thus NO BREEDING! ✅ Frenchie breeding is expensive cuz it requires IVF and they have great dispositions. 💗💗 Sorry, love JM but she needs more information. Neutering is better but these defendants just wreak of shadiness - they couldn't make eye contact throughout and that's just for starters 🤷‍♀️

As a breeder, myself, I feel strongly the judge made the wrong call. We have a spay/neuter clause in our contract and, while we don't impose a time limit on spaying and neutering (because we want the dogs to mature fully, without any hormonal imbalance), we DO make spaying or neutering mandatory AND specify that the dog may never be used for breeding. Whether or not the dog has "papers" is an entirely different subject from whether or not the dogs are permitted to be used for breeding purposes. Regardless of the status of papers, our dogs are not permitted to be used for breeding purposes unless we agree to register them with "full registration". Period. The plaintiffs, however, our flat out lying by saying they are selling $3,000 dogs while also saying they are not in it for monetary gain. That part is laughable. We breed primarily to improve the breed but there is obviously also a business component. Our dogs are valuable and there is certainly a capitalistic aspect to our breeding business. The defendants in this case should have been required to pay a price commensurate with full breeding rights, assuming the plaintiff even agreed to allow it, and that's that. 100%, the wrong decision was made in this case.

right? its definitely a monetary business even if you love what you do, you need to make money at it or you wont be able to CONTINUE to do what you love doing without going into debt. i just started breeding parrots (lovebirds) this past year and im only breaking even on my first couple clutches because of the amount of money ive put into it on buying expensive incubator and brooder. the first couple clutches pretty much just payed me back for what ive put into it. its a joy and a love and a hobby but its a lot of work and theres a reason we have to charge .. lovebirds dont go for as much as like larger parrots but are easier to breed, though i dont even let mine breed as much as they TRY to breed (my hen is CONSTANTLY laying eggs and i try to keep her from doing it so often since its just not as healthy for her to be that hormonal all the time lol... id rather have all healthy birds and healthy chicks than risk my hen becoming ill from over laying) i dont know if a whole extra thousand dollars would be the right price for negating the contract since the contract never specified what the full registration price would be IF they broke contract but i do think there probably should have been some sort of monetary recompense to the breeder in this situation .. maybe half the amount? not sure. its tricky if they didnt word the contract correctly. word to the wise to make sure things are worded right or even have someone knowledgeable in law look over your contract and discuss what the you/the breeder would want to see happen if certain stipulations are broken so that they can look over the contract and make sure it has been worded correctly to fit your needs.

No need for papers unless you’re breeding. 3k is cheap for a good line Frenchie. Yiu can’t make people neuter spay a puppy. The only recourse she has is the papers and whether or not they get a limited or full registration.

I had to sign the exact same type of agreement when I got our Havanese puppy. The breeder also offered an option to pay an additional amount to receive some sort of “limited” AKC paperwork if you’re interested in either breeding, or SHOWING the dog, because a lot of people don’t realize that dogs competing in (professional) dog shows have to be 100% “intact”.

Completely agree!! The contract was clear - neuter by a set date. The defendant signed the contract and initialed the part about neuter. They breeched the contract so why did the plaintiff lose? They can (and probably will) breed this dog and sure, maybe make less $ than if papered but the contract was clear to have him neutered - period. The defendants should have lost here.

The contract was clear that if they didn't send proof of spay/neuter they wouldn't get AKC papers. For the plaintiffs to win the contract needed to say that if there is no proof of spay/neuter then the defendants have to pay $1000. Hopefully the plaintiffs changed their contracts after this.

For all the people negatively commenting against the plaintiffs, the defendants breeched the contract. Wether he wants to breed the dog or not is a moot point. They purchased the dog with certain restrictions and then failed to comply. The judge has her head up her ass on this one.

He failed to comply and the remedy of the contract was imposed… he don’t get the papers. Not his fault the plaintiffs created a poor contract. They need to revise their contract. You can’t add penalties to contracts after they’ve been breached. You can only hold the offending party to whatever the contract states and in this case the only punishment listed is not receiving the papers. Just so happens the defendants don’t care about that.

Actual the point isn't moot, the plaintiff's explanation of why that contract includes the clause is so they can't reproduce their breed.. and compete. This then is the equivalent of a non compete contract.. well they have the dog as a family home dog. They aren't competing.. The give and take of that clause was that they would exchange the signed breed information for proof the dog was neutered... they didn't neuter the dog..they dont get the paperwork. Pretty simple. This is what happens when you make contracts yourself and not seek guidance from a lawyer.

The judge just showed her ignorance when it comes to breeding PEDIGREE dogs. The plaintiffs have gone through Championships and have had to win with their male and female, they go through International championships and have had to win and they go through all the trouble of getting the puppies AKC registered as well and now these people have a TOP QUALITY stud dog, who they can stud out and have puppies worth $2000 each, and that's WITHOUT the AKC papers, and all they get is a slap on the back of the wrist for breaching the contract. SHAME ON YOU JUDGE...

This is a standard practice with AKC breeders, especially show dogs. I have bought 3 Shetland Sheepdogs. The first dog I was told by the breeder that it was p to me to whether or not I wanted to spay or reed. The second breeder it was in the contract to neuter at 6 months. The first breeder was not a show breeder, the second is. I also bought another dog from the second breeder. A good breeder also won't want to pass on possible defects in the breed. Both my dogs from the show breeder were too big for the breed standard.

There are tons of them at shelters. Their health issues and special needs usually mean that people with a romanticized version of them buy one from a breeder, can't handle the trouble and expense that comes with that particular breed, and then ultimately dump the dog at a shelter once they're no longer so cute and little.

The dog can still pay alot for studding people pay ridiculous amounts for mutt dogs and and glorified mutts (doodles) I've seen mastiff, great Dane, lab, pitbull Rottweiler (all one mix) for 2 thousand dollars

Get one from a shelter AFTER you do a lot of research on the health problems and special needs of the breed. Being "beautiful" shouldn't be the only reason you get a dog.

I bought a pure bred Corgi. What right does that breeder have to make them get the dog neutered? I won’t get mine spayed for awhile and I got her AKC certificate & tag w AKC number. I would never sign a contract like that. I don’t get it. They paid that much money to do what they want to do. Ridiculous

Neutering does change temperament (usually).....it makes them LESS aggressive...that ALONE is a good reason to neuter...not to mention the health improves and the millions of homeless animals ALREADY.

I love how she seems to think people still won't be willing to buy French Bulldogs without paperwork. As she always loves to say, if it sounds like a duck and looks like a duck , THEN IT'S A DUCK. People will STILL buy those dogs bo matter what and then turn around and breed through puppy mills . Disgusting. The plaintiffs did not argue their case well enough.

We don't do it for the money, but we sell the puppies for $3,000 and if you want to bred the puppy then it's an extra $1,000. But it's not because we want the money. 😒😒😒😒😒😒😒

I don’t agree with the breeder usually if you are going to breed the dog they are more expensive not if you’re not going to breed them. But Harvey is right my friend who used to breed dogs made it very explicit on what the repercussions are for not breeding the dog monetary etc. and she never had a single problem

The plaintiff point on fixing the dog, so the defendant can't breed the dog with the registration of a not fixed dog. And that with the fixed dog, the city tags are cheaper. But I do not blame the defendant for not doing the spay. So the plaintiff was wrong on wanting money if the defendant does not spay. Stupid contract.

I think it's unfair that they can breed the dog and make money off of a dog they supposedly bought as a pet. It's also in the contract. Neuter within 7 months. And they signed it and didn't get it neutered. Therefore the voided the contract. They should have to give the dog back or pay a penalty.

These breeder cases always turn my stomach. That whole AKC thing and papers is just a money making racket with no real inters in the life of the animal. I agree with the defendant. Once I pay for a dog, i don't care about papers. Just leave me and my dog alone. I paid you, he's mine and you shouldn't have any right tryin g to get more money from me or tell me what to do. the dog is mine.

I wish more people realized how expensive it is to breed responsibly. If they are having all the health checks, usually they breed through artificial insemination etc, with a 3 dog litter at $3k they very likely broke even or lost money. People just see the price tag and have no clue what goes into it. They should not have gotten away with just no AKC papers. One of the few times I think Judge Millian was dead wrong. You can still sell frenchies for a good chunk of change without papers, they paid $3k for theirs not planning to get papers.

the hell is wrong with these breeders today. so many of them want to dictate what people do with the dogs after they buy them. I've had two AKC purebred dogs over the last 25 yrs, I didn't have to get that paperwork if I didn't want to, but once I bought those dogs no one else said what I did or didn't do with them. They're getting really sickly obsessed with these animals today. So not normal.

Not everyone buys a high cost dog to breed. If you pay $3000 for a dog with intentions to breed your going to sell for a pretty penny. The one buying the dog is going to want to see bloodline I know I would if I were purchasing a $3000 whether I breed or not. The defendants have 2 males if question more if they purchased a female.
