Not Getting the Job Done

The People's Court

The plaintiff hired the defendant to repair her deck. However, the plaintiff alleges that the defendant’s work was “horrendous.” She claims the defendant only showed up three times, dug holes in the wrong spot, and left the job unfinished. The plaintiff is suing for a refund. The defendant argues that he did a lot of work for the plaintiff, and he doesn’t owe her anything.

the plaintiff most likely planned this from the start . thats why she did not look for professional licensed deck builders but she probably asked her so called girlfriend ( maybe someone she sort of disliked anyway ) if she knew any guys that did that kind of work and i bet the plaintiff's plan all along was to pay the defendant the 2k up front and then wait until he completed the whole job and then stiff him on the rest and end up only paying 2k for the whole job . but the defendant , being the street smart guy that he is , somehow picked up on that half way through the job , so she got mad that he figured it out and she sued him .

I read the posted comments. Most of them are ( ). I am a contractor, in business for over 35 years. First, a dollar amount had to be firmly established in writing. So say 4800. If 7000 was the average he was too cheap. Keep the 4800 - 30% down, 30% halfway through with an established mutually agreed to baseline, then the remainder on completion. What skills did he actually possess, and, if he did drop a bag of weed in her home she should have asked him to leave. If I have to explain why you would definitely not be one of my customers. Did he present her with plans? Did he know a permit was needed? Who was the other contractor - was he insured? Everything this gentleman did sounded borderline incompetent. Now let's get to her. She's a moron. That line about being "too judgmental" was nonsense. She wanted to use her card to get the supplies with - no. Period. Moreover, this should never have been any kind of "collaboration" between the two. She has a clear idea of what will happen because he presents such to her, and that didn't happen. I didn't see a shred of professionalism from him, and I saw a woman who makes really bad choices about the people she associates with. I'm a professional; the contractors I work with are professionals, we answer to a higher standard, and watching this exchange between two idiots is painful.

Both plaintiff and defendant are awful. Defendant is a lazy, lying, condescending, patronizing a$$. Plaintiff is a liar. "I said some things I shouldn't have." Yeah, you mean you lied to the judge's face. I disagree with JM that he did $2,000 worth of work. He tore down the old deck and dug some holes (on plaintiff's dime for the rental), and he left a huge mess behind. That's not worth $2K. In a perfect world, plaintiff would've gotten at least half of it back and it would've gone directly to her neighbors who helped her out.

@@christophernunn77 I COMPLETELY UNDERSTAND WHAT YOU ARE SAYING! I WAS A BARTENDER/CLUB MANAGER FOR OVER 20 YEARS. I WOULD MUCH RATHER BE AROUND PEOPLE WHO SMOKE WEED THAN WHO ARE DRUNKS. I'VE SEEN ALCOHOL DESTROY MORE LIVES THAN EVER. MORE VIOLENCE, MORE DESTRUCTION. WEED IS NOT LIKE THE BIG DRUGS 😒 THIS GUY SHOULDN'T HAVE SMOKED IN FRONT OF A POTENTIAL EMPLOYER. THAT'S ON BOTH OF THEM! SHE SHOULD HAVE KICKED HIM OUT, HE WAS SHOWING HIS A** TRYING TO PROVE HE WAS A BIG MAN! IDIOT!

I'm not arguing as to who was right or wrong but I don't think I believe that the plaintiff even paid her neighbors $4,000 I think she may have paid them something but I think it was very little, I think the fact that she got caught in a blatant lie trying to get extra money shows that you can't trust her word, if I was the judge I would have dismissed her case right then and there, it's not like she made a mistake in the math she just wanted to get more money from the court.

I'm 4 minutes in, and the plaintiff seems off, but I don't believe he accomplished the job in a timely manner either. They both have bad personality traits in my opinion.

I'm glad the defendant won. She has a problem, she lied to the Court on how much it cost. And cracking her knuckles is just showing the atmosphere that was on the job. She's a nutcase.

Ah I note in this clip as the Judges are speaking, the scale in the background was lower on the left side, now it's lower on the right. Does this indicate leanings or doessomeone just play with the scale? Why not GLUE it to a level position? LOL

the plaintiff most likely planned this from the start . thats why she did not look for professional licensed deck builders but she probably asked her so called girlfriend ( maybe someone she sort of disliked anyway ) if she knew any guys that did that kind of work and i bet the plaintiff's plan all along was to pay the defendant the 2k up front and then wait until he completed the whole job and then stiff him on the rest and end up only paying 2k for the whole job . but the defendant , being the street smart guy that he is , somehow picked up on that half way through the job , so she got mad that he figured it out and she sued him .

This Plaintiff is a total train wreck. To come into court saying she paid one amount, then inflating it almost SEVEN times is ridiculous. JM should have just thrown her case out at that point. The Defendant seemed like a nice guy- and I have to disagree with JM on calling the Defendant out for "mainsplaining"- I think he was trying to actually calm her down.
