Well, there IS a precedent of asfixiation by a bag over the head... that is how JJ was killed. I forget, did the police find out where Alex was the night Tammy was murdered? Did he have an alibi?

Same! Especially since when Emma testified she stated at least twice that Chad saw Tammy die. Once was in response to John Prior asking whether she thought Chads grief for Tammys death was genuine even though he had already been in an affair with Lori for some time. Emma said something along the lines of….My dad might have been in an affair with Lori but I know he respected my mom as a person and was traumatized to see her die. The other time she says it, I cant remember what it was in response to because I didn't catch it. A content creator did and made a video about it. I clicked on the video thinking she had heard what I heard and it turned out to be a completely different statement about Chad seeing Tammy die than I had caught. It made me start to wonder just how much Emma knows and how long has she known it for? I had a feeling she knew some of what was going on and probably not for long but now I'm starting to think that Emma knows a lot more than I thought and I think she might have been in his close confidence for a long time.

That was huge to me. Chad’s medical examiner witness was only given a very small amount of the evidence, and that small amount was only what the defense wanted her to see. She was not even close to being an expert witness about this victim or her cause of death.

I was cleaning alone in my house and gasped out loud when he said “the murder.” I could not believe I just heard that. Total second hand embarrassment for him. I had to rewind and look at the prosecution team. Ingrid’s head snapped up, and the guy in the middles eyebrows raised to the heavens. Then they looked at each other with a smile.

I didn't find the Defense medical expert testimony very compelling. The ME from Utah that did the autopsy post exhumation nailed it IMO 🎯

None of his experts brought anything to the table that wasn't there. When the guy said something like 'absence of evidence is absence of guilt' it really only brings in none of the hairs were Chad's which the prosecution already established.

When Lindsay Blake was bringing up the pillow or plastic bag after the witness said kneeling or sitting on the chest wasn’t likely be enough to suffocate someone it immediately made me think “but a person suffocating someone with a pillow or plastic could very well be kneeling or sitting on the victims chest to hold them down causing the bruise they found on Tammy’s chest.” I know it’s conjecture but it discredits John Prior trying to make the chest bruise insignificant.

Additionally, she couldn't explain the bruises on the arms AND she did allow for the possibility of more than one person being involved in what might have been a murder. FAR too many open "might have beens" for Pryor's tactic of creating credible doubt. The absence of evidence is not the proof of innocence - and we already have TONS of evidence.

Yes, and especially if a mans knee was pushing into her chest. Not a thorough defense Medical Examiner. She is not a pleasant person to listen to. Unlike the witnesses for the prosecution. Hired experts must appeal to all with their demeanor and likeability. This lady looks and sounds like a dud!

I worked at the ME's office in a big city and I know for a fact that MEs do talk with investigators to get more information. Especially with cases that have suspicious circumstances.

Back on December 21,2000 when my brother was murdered at work while helping his boss close her business for the day and two armed robbers came in, as both my brother and his boss stood holding their hands and arms up over their heads, the armed robbers shot my brother in his heart. While police officers and Detectives were there on scene the coroner finally showed up, BUT instead of going around the store counter to get a close look at my dead brother, that coroner only leaned over the counter, and barely glancing at my dead brother that stupid, incompetent coroner declared “shot in the back of the head”. ALL the L.E.O.’s there on scene knew that my brother was shot through his heart and a MEDICAL Examiner who performed his autopsy found ONLY ONE bullet wound, through his heart.

$350 per hour for a death certified attorney is probably about right. The prosecution only making $65 an hour blows my mind.

There are many Public Defender Death certified lawyers, who make less than the prosecutors ($135,000 per year). One big difference is that Prosecutors pay is just that. The $350 per hour paid to private attorneys pays themselves, law firm split which includes staff, rents etc.. It is not uncommon for private attorneys to get paid 10-30 of their billed hourly fees...depending on how the law firm divides pay, generally based on how long the attorney has worked for the firm etc.... $350 per hour is not that high for private criminal defense attorneys.

What you fail to add is they get holidays off, only work 8-5, get insurance, 401k , paid expenses in addition to their salary. Whereas private attorneys don't have these luxury. Further more state attorneys get paid every day if they have a case or not. Private nope.

pETER. I would love to hear your thoughts on the Christopher Gregory case some of the judges rulings we trial watchers need some input from an lawyer like yourself. I know Daybell is huge trial right now and other high profile cases are not being covered. Maybe in the future you could look into that case

The "M" word is telling, however would not sway me because I have slipped up words. However, I do think it is confirmation bias to not review all of the documents and only reviewing what the defense sent. Because the defense is biased

yes it was a bit rich of prior mentioning confirmation bias when literally the def witness is paid for to lean towards the defense.. like pot calling the kettle black. for me, the list of documents (blake stated) this Dr. didnt review is much more substantial info because of what she eventually came up with "undetermined". but "the murder" slip-up is just his subconscious pushing it forward.

I believe it was just a slip of the tongue, but at the same time I believe Prior has got to be tired of trying to defend someone he probably, in his gut, feels is guilty. I know attorneys defend people that they know are guilty, but this is a very long drawn out trial, and I can’t imagine he even likes Chad.

It hit me like a ton of bricks the minute Prior said "at the murder". I think Prior KNOWS it's murder and that's why he slipped when he said "at the murder". If he believed it was a natural death he would have said death. That said, Prior was hired to do a job and he's trying his best. Unfortunately, the cards are stacked against him.

It is astonishing how many Americans confuse strutting around, aggressive speech, bullying the witnesses, being disrespectful, insulting and fat shaming dead victims, sl*t shaming women etc. with good lawyering! Actually, a good lawyer is not about courtroom theatrics and being a primitive, misogynist peacock. It is all about good manners, logical thinking, excellent examining skills, having a clear strategy, finding irrefutable arguments, quick thinking and connecting the dots. It is about legal competence, like Lindsay Blake has it. Pryor might be a colourful showman, but a murder trial is not about seeking attention, it is a solemn quest for justice for the victims.

Prior is a human being just like most of us and he has a job to do. I believe he believes Chad is guilty. How can you not believe he isn’t once you hear all the evidence? I would imagine very few people believe he is innocent in the deaths of Tammy, JJ and Tylee. I believe him saying murder was a slip of the tongue.

Yeah. I think defence attorneys are immensely important to the system, but I can't imagine what it's like to know/believe your client committed such awful crimes but still have to do your job.

1. JJ was found suffocated with a bag. 2. Prior's client is charged with murder, the slip doesn't do anything for me. 3. I was shocked at how low the prices were, I expected at least a half day for multiple people at a higher cost per hour. I thought it would be in the tens of thousands.

What I took away from their “expert” testimony is that JP only provided a few of the documents to get the result he wanted. On cross examination she said that she didn’t need to have all the documents or that they don’t allow outside bias to predict the cause of death. Isn’t that in relation to an autopsy performed before the burial? Wouldn’t a washed and embalmed exhumed body require a detailed medical history along with investigation notes to better understand the person’s body?

Prior knows Chad is guilty but is doing his job with little defense to work with. Personally I can't stand him but that's his very unpleasant job. Chad's guilty!

I really think the prosecution has this one, they've presented a very solid case. I don't think when he said murder it will be a big deal, but he did say it and if they pick up on it they may consider it something. I think if I were on the jury I would have a hard time with the defense witnesses simply because the defense has tried to slip in and misrepresent testimony. He twists witnesses words and tries sneaky tactics which causes me to mistrust him. His witnesses need to be really good for me to put a lot of stock into the testimony. That may be wrong, and I would try to stay fair, but I'm not sure I trust the defense to be honest. Let's hope his witnesses are good so the trial is fair. I think an obnoxious attorney can affect the outcome when they come across as dishonest.

1000% correct! Spot on!! I don't trust him either. I understand ensuring reasonable doubt but if you have to lie or misrepresent testimony then you're about as believable as an ocean in the middle of the US. If I were a juror I'd have a hard time believing his witnesses or anything that he tried to prove because he comes across as so dishonest.

The idea of confirmation bias was not a good strategy for Prior because I thought, why are the documents withheld from her, a risk of creating confirmation bias but the documents Prior gave her, NOT a risk of confirmation bias? Some of the documents she received weren’t medical documents FYI, there were some interviews. What great prosecution documents were withheld then? If I was a jury member, I’d want to read them now.

This expert's testimony was luke warm at best, because she essentially said that, judging by the incomplete paper evidence that she got, she wasn't sure what the cause of death was. Since she did NOT perform the autopsy on Tammy like the prosecution's expert, her not being able to decide how it happened is irrelevant at best - because she factually testified that it MIGHT have been murder. That is not what Pryor brought her here to say! As for Pryor's gigantic Freudian slip, if one juror noticed it, that would be enough.

Its not enough. They all have to believe hes guilty without doubt. Its the defense that only needs one person to doubt the prosecution.

@@lisedale6767 Fortunately, Pryor is essentially only trying to create doubt about Tammy's death, and I don't think he is succeeding. There are no doubts whatsoever about Tylee and JJ, however, and only a single one of those murders is enough for a life sentence or a DP. With a dead woman in his bed, two dead children in his garden and so much evidence of his murderous cultic teachings, there is no way Chud is EVER going to see freedom again. That jury is not stupid.

I don’t think it necessarily matters if a juror realizes consciously that they heard “murder” or not. As a lawyer you choose your words very carefully because they have an impact on how the statement is heard. And I think his using the word murder subconsciously permeated the jurors minds.

The state only charging the salary paid to the prosecutors is NOT comparable. None of the overhead of the state is included in that; taxes paid on behalf of the employee, administration like HR, office space, etc. The State would need to bill the attorney out at a rate closer to 120-150/hr to pay that salary. To put it another way, the state attorney might earn 50/hr, but a lawyer billing at 50/hr would only see 20-25 of that as salary; the other half is going towards all those same things - office space, administration, employer taxes.

Off topic, but would love you to explain the new motions in Kouri Richens case. Defense filed to remove prosecution, then filed to withdraw from defending Kouri. So will the multiple motions filed by them go away if they are allowed to withdraw?

I didn't catch the slip up live and had to replay it multiple times before I caught it. As a juror it wouldn't be a big deal bc he has stated the opposite 100x. That said I found it interesting and wonder if that's what Prior actually believes.

All the could’ve beens were exactly covered by one of the doctors doing the autopsy, specifically said there are ways to cause asphyxia that don’t leave physical evidence, but because there were no physical causes found ie, cardiac disease, evidence of pulmonary disease, COPD, CAD, congenital heart defects etc so when there is no evidence of physical defects or of physical evidence (damage) of past events, and the person is a healthy 49 year old woman, with other people present, homicide is what the medical examiners choose as the manner of death. As the first medical examiner testified. I imagine the prosecutor will remind the jury that the ME went over all that when explaining the different causes of asphyxia.

Always stating that The State cant interrupt his defense always claiming that the State has had ample time to review evidence/witnesses with all thier 4 lawyers and that Prior feels that that The State doesn't get to bend the RULES! Overall I agree that John Prior has been on his toes with every witness! As always I love all your videos and professional Attiney input on avery case!🥰

When I remember how Lori had a team who didn't do very much and see Prior working this hard without any assistance, I'm more impressed by the job he's doing. I still think things look grim for Chad and will be surprised if all three murder charges don't result in guilty verdicts. (But if there's doubt, it could be in Tammy's death, unfortunately.)
