Smart Drive Test

This is a basic introduction to Canadian rules for log books. It cuts through all the jargon of log books. Outlined are the rules for driving, work and rest time.. This log book information will keep you in compliance with hours of service regulations in Canada.

do I need to take 2 one hour breaks if I am off 14 hours or can I continuously drive with out a break if for example I drive only 8 hours a day and usually have at least 14 hours off consecutively per day?

What if you take your 8 consecutive hours off duty during your 16-hour cycle? Does that reset your cycle back?

Hi Rick. Thanks for the video. I work for a telecom company and was recently informed that I need to start filling out a log book. The reasons for this, even though I'm driving an F150, is that once I hook up any trailers, my registered weight goes above 4500kg therefore legally making me a commercial driver. Three or four times a year, I don't get home that night. Also, maybe a handfull of times in a year, I drive over 160km radius from home. That is 160km as the crow flies, right? Do you recommend keeping a full time log book for drivers like me who are the occasional commercial driver?

Hi jdeveau - thanks for your query, and you are right, the 160km is in a radius around the home terminal. If the company's policy is to have you fill out a logbook, I would counsel you to do that. And there may be some tax benefits for staying away the odd night here and there. And the logbook is a record of you being away. As well, when you hook up to the trailer, you won't have to remember to have the logbook filled out if you're already in the habit of filling one out. Let us know what you end of doing. Switching from a driving job that doesnt require a daily driver log (Work in town only less than 160km from home base), to a job running freight on the highway. Do I need something to show to CVSE if I am pulled over withing the next couple weeks? And if so, what? (Also from BC, Canada)

Hi Chris Forsyth - Thank you for your question. Most of the time, the CVSE will know that the company runs local. And you're going to have daily trip sheets. If they want more information, they authorities can go to the company and request your time sheets. Otherwise you don't need any other paperwork if you're running less than 160km from your home terminal. If there is anything further we can do, drop us a note. Always happy to help. How to calculate the 10hour off duty in a 24 hour day block? How to say the starting and ending of a 24 hour block?

I have a question So say I start at 6am Drive for 13 hours .5 hours pretrip .5 hours post trip Can I start after a 8 hour off duty ? Without taking any breaks in the day ? Also can I get paid for my breaks from my employer?

I drive mostly local with no log books required just basic sheets , once a week ill go for 4-6 hr delivery where i am required to have a log book. How can I have 14 days record if i only do it once a week and i was told that inspectors do not even want to look at basic sheets when getting pulled over at scale.

Hi Kris K - Thank you for your comment and query. For the days that you're doing local work, put the date range on the logsheet and write local work. You'll have time sheets for those days that you're not keeping a logbook to back up those date range days that you're not keeping a logbook. If there is anything further we can do, drop us a note. log book exemption . ? in the mto handbook it has . on page 26 #6 daily log exemption , it has 3 different bullet points , for ? a local delivery driver, do I have to meet all 3 examples or any one of the 3, thank you for your time,

Hi Elroy - Excellent question - I don't have the MTO handbook in front of me, but I'm certain you're talking about the exemption to keeping a log. Yes, you must meet all 3 criteria to be exempt from keeping a logbook - 1) must not operate beyond 160km of your home terminal; 2) return to the same location from which you started at the end of your work day; 3) and only work for one operator (employer) that day. As well, you--your employer rather--must adhere to the criteria below that which states: that you're employer has to keep records to verify the number of hours that you are working. I would suggest that if you have any doubts, or concerns about your employer's record keeping, it might be easier to keep a logbook - that way it covers you. If I only take a one hour break during my day and then eight hours at the end of my day that’s 9 hrs off duty. Can I start up again after nine hours off duty.

Is it legal to take the 10 hours off-duty in one consecutive block? Or do you NEED the 2 hours in a different spot

A 16hr day is (6am to 10pm) not 8am to 10pm as long as you take two 1hr breaks or 4, 30min breaks

You must have taken that new math in school! Your 13 hours of driving must occur within a 16 hour window. You can't drive after 16 hours has elapsed in your workday. Unironically typical army training makes you stay awake 3 days straight if they cant handle a 16hr drive you cant handle the job

Hi Daniel - yes, a Class 3 drivers operating beyond a 160km (100miles) of their home terminal are required to keep a logbook. In fact, any commercial driver operating beyond that 160km (100miles) must keep and maintain a logbook both in Canada and the United States according to the respective country's hours of service regulations. So even if I take a 10 hour consecutive break , I have to take a 2 hour break again to satisfy the minimum 10 hour off duty per day rule?

HI Premkumar R.J - yes. You must take another 2 hours off in a minimum of 2 breaks in increments of not less than 30 minutes. The reason for that is so you don't drive the full 13-hours in a straight shot. The aim is to get you to drive in no more than 4-hour blocks. See these logbook examples: www.smartdrivetest.com/learning/teaching/truck-drivers/logbook-sheets Often times, the break is not going to be a break per se. You're going to be getting load/unloaded, and after 15 minutes of logging on-duty time, you go off-duty and that time will count toward your 2 hours off during the day. All the best, Cheers Rick
