The plaintiff says the defendant brought her mother for a visit and she had an accident on her brand-new couch. She’s tried to have it cleaned, but it’s ruined. She’s suing for the cost of a new sofa. The defendant says she had the furniture professionally cleaned and checked with a black light, and it was fine. Now she wants a new loveseat, so that’s why she’s suing.

I'm sorry but just my personal feelings- I couldn't ever find it in myself to sue someone and their poor incontinent mother just for a new couch...money and things mean nothing in life, it's about relationships and what you can do for others

I agree. I've never sued anyone. I've loand people money from 3 thousand bought a car for 5 thousand the person come took their car gave me 2 thousand back. Never sued they were family. Never spoke to them again. Because they never paid their loans back to me. And I was back than kind of person that couldn't say no. I loaned a very large a mount hoping in return to get extra money. It was some kind of investment. LOL ....... I lost everything end up in apartment for a while. Not a very good life. So moved back home with x/ husband. Been here 5 yrs pay him rent and 3rd of all utilities. Which is fare. Never will i be friends with anyone. And I trust NO ONE !!!!!

@@annward4149 that’s a sad story. It would be less sad if tou actually sued them. Trust isn’t the main problem. You need to not only hold yourself accountable for your action, but the people you choose to trust also. That is why it is good to sue.

I don't know about you guys but I absolutely loved the look on the plaintiffs face when their mutual friend dimed her out about the cat and dogs peeing everywhere and how it always smells in the summer!! And then the crowd after she said that stuff was priceless!

I used to work in housekeeping at a hotel, it was one of my jobs to treat couches & mattresses after they were soiled by a guest. It is possible to get the smell out. I’m with some of the other commenters that it’s more of a Psycholgical problem that she’s having than a smell problem.

It seems to me that the defendant DID take steps to correct this: she cleaned it herself, had it cleaned, she tried to sell it for her…it isn’t like she just picked up her mother and disappeared. Does her EFFORTS count at all? PLUS, the plaintiff HAS ANIMALS that could be possible “funk” factors in the house. This was kind of embarrassing for both sides. If I were the defendant, I’d definitely count my friendship with the plaintiff as done.

@@puzzliteor just replace the cushion she peed on. like the guy said it’s possible to have seeped into the actual cushion and went beyond the fabric. machine wash the fabric and get a new cushion. she always says to mitigate damages and it seems like the defendants attempts to mitigate went complete unrecognized bc she spent all tht money to try and have the problem take care of just to still come out 700 additional dollars bc it wasn’t to the plaintiffs satisfaction. btw THE PLAINTIFFS OWN WITNESS said her home didn’t smell of urine. the only one tht seems bothered is the plaintiff herself.

@@slCHARACOUNSELING Yeah, they also get a TV appearance fee that the show is required to pay. Still, this case had to have been headed to an actual small claims court before the show picked it up. But, I do agree that if it were possible to "dramatize" a fake situation and get it on the show people would be doing it.

@@googleyt2622 It's my understanding that part of the way they find participants is to troll the courthouse looking for interesting cases. But some of these seem a bit ridiculous, it would be easy enough to spend the $20 filing fee on a fake suit that would look good to the producers.

A similar thing happened at our house. The elderly father in law of a family friend, he was suffering from dementia, and he had an accident on one of our chairs. Unfortunately he had a bowel movement. My sister was able to deep clean the chair with her carpet shampooer, and we didn't have an issue after that. Accident's happen, especially with individuals who have dementia. They're unable to control themselves.

Well in tht case if you know your friends mother or if it were your own mother tht is incoherent why would u care take for them and put them on your couch or allow it if shit and piss was a big issue... regardless if they had a brief on or not they could still urinate or even shit on your couch they have a disability you would of been aware of . This case is sad because it was about the plaintiff being materialistic instead of being sentimental.

I can't believe this plantiff brought this lawsuit! She should be embarrassed for dragging these people into court and making a hard situation more difficult. It's a couch ffs, a person with medical issues had an accident on the couch, let it go! The value of this couch is worth more to her than the dignity of an elderly lady with issues 😔

Furniture is expensive. Sometimes people have to save months, or even years, to be able to afford new furniture. People have the right to expect their property to remain in reasonable condition in their own home. It is a really unfortunate accident, but it shouldn't be the plaintiff's responsibility to bear the costs of that accident.

I think the Plaintiff wanted to get rid of the couch over subconscious issues. Probably wasn't a smell there, but her mind couldn't allow her to sit there. Which is understandable

I would want a new couch to. 🛋 They go out and buy a new couch because the old one smelled from the animals peeing on it. Then the NEW couch is drenched in pee from a visitor, who the plaintiff finds out after the incident, has a history of daytime incontinence. The frustration the claimant must have felt!! She deserves a new couch. 👏

Why I dont bother with used upholstered furniture!! With that said, I could never bring myself to sue a friend over their mother having an accident on my couch. Also if it smells, why is it still in her house?!

The plaintiff is a real piece or work. She reminded me of my mother. Dogs and cats galore peeing and pooping wherever. Growing up our home stunk like animal pee and poop and lack of bathing and my mother and sisters were nose blind to the putrid stench. I would leave our house and others could smell it on me just like I can still smell it on my family. I am allergic to animals so I have a 10 lbs miniature poodle, almost 6 yrs old and been potty trained since weeks old. He gets bathed every Tuesday at a doggie daycare and we have a hygiene routine daily including wiping his butt after going poop and he even wipes his paws on the outside rug before coming in my CLEAN NO SMELL HOME. Why are so many people with animals so filthy? It’s her animals stinking up her home but she has blamed it on this poor old lady! Absolutely no excuse!

My ex sister in laws cat was in my Dad's home for around 8 months and they did not clean the litter box. It was full of piss and took about a year before smell was gone

@@CA-cg3uf Oh my! And cat urine is so bad. It never comes out with just soap and water. Someone I know bought an investment home where stray cats had sprayed an area of bushes for some time, and they actually had to dig up the beautiful bushes and burn them, dig out all of the soil in that area and order a load of clean soil to put there. It cost them a lot of money just to rid the area of cat piss smell. And people have no clue their homes smell, and they smell too. My sisters and mother would come to visit me and I would have to discreetly turn on the whole house fan we had, open a window slightly even in the winter and try to keep them in a room that we always laid crocheted afghans on the furniture so I could wash them after they left. You could smell this on their clothes and in their hair. My husband would take my mom’s husband to hang out with him in the garage, then air out the garage after they left. They all smoked too (I never allowed them to smoke in my home but you could smell it on them) so we all know the stink I’m referring to.

@@CA-cg3uf it's so sad they constantly blame the cats. Cats are in fact very clean animals. Of course if the litter box is never cleaned it will stink. That's negligence to the cat and the cat will be forced to pee elsewhere if the litter box isn't cleaned.

The Plaintiff was a caregiver for the woman too. She admitted that she was aware of the problem happening before so why couldn't she have taken steps to protect her couch.

Therefore, the plaintiff failed to inform her as her aid “ hey Cindy your mom will need to wear diapers in the day as I have noticed that she couldn’t hold it. It doesn’t takes many brain cells for that analysis.

The plaintiff was never a friend. I could never bring myself to sue a friend whose mother with dementia, whom I once cared for, had an accident on said sofa. Clean the damn thing or have a professional come in and clean it. Is a sofa worth more than a friendship? And as if the defendant isn't already going through enough... bring her into court for this bs???

As someone who's mother has crapped herself on the couch, if you clean it good enough, the smell comes out. My dad had to use a hand held urinal and it spilled on the couch and floor. I got the smell out. Some people just don't know how to clean properly.

Who buys a piece of fabric covered furniture that doesn't have removable/serviceable cushions?!? You can get a piece of High Density Foam and the wrap for $70 and the cover itself can by professionally cleaned.

Yeah, it doesn't make much sense to keep chasing an odor down into the foam. Just replace the foam. It's not a trivial task but even a basic DIYer could do it without much trouble at all.

My couch (sectional) doesn't have cushions that are removable - they're attached to the couch. 🤷‍♀️

@@JenniferFuchek The foam is still replaceable, but you would need to take it to an upholstery shop. It would obviously cost more, but it would still be considered "serviceable" to a professional.

In my opinion, they both should’ve known better. If they both cared for that lady and knew she had bladder issues they should have had her in an adult diaper, or protection on the couch. Ridiculous they’re in court for this.

As a CNA some are combative to them. It makes people feel less than normal to wear them. And also she's have to check to make sure she actually wears them. It can be a bit demanding sometimes

I much prefer the Judge's demeanor in this episode - she is calm and wise and compassionate. I am not a fan of her usual aggressive and sarcastic approach.

Depending on the fibre it will smell . If it went through to the cushion then its impossible to get the smell out . You have to replace the backing cushion . If its something like a microfiber water/moisture will not penetrate it also the odor wont go deep into the cushion also .

I used to work in a care home where the ladies would wet things when the more negligent caretakers didn’t take them to the bathroom or secure their briefs correctly. that’s why when I brought my $2000 couch (which is a lot for a social worker, but I’m obsessed with it), I paid the extra $170 for a protection plan. Basically if it’s something that they can replace like a seat or back cushion gets messed up, they will do it for free. If they can’t do a replacement, they will replace the whole couch for free with something comparable. Having things go missing or damaged with no recourse is unfortunately something I’ve experienced a lot in the last few years, so I learned how to protect myself. Warrantees and protection plans are definitely important.

I do believe that regardless of how well you clean something, the smell can come back when it is humid and hot out. I also could understand the psychology of simply not wanting to sit on a couch that was peed on. And I appreciate that the defendant tried multiple means to try and remedy the situation. It was a used couch, so I think the outcome was reasonable. Regardless, I would not have the heart to do that to someone I consider my good friend, especially considering it was the sick mother who I also considered to be a lovely person.

I couldn’t imagine suing any of one my friends if something like this happened to me! Two reasonably intelligent women and neither of them though of having the cushion replaced by a “Upholstery” store? I would never sue any one of my friends, if their elderly parent had an accident in my home! With friends like this plaintiff, who needs enemies! P.S. This reminds me of an episode Seinfeld, in 1994 “The Couch” Poppie Peed on Jerry’s couch. OMG it was so freaking funny!

@@dorothycrowell2867 Her friend didn't ruin the couch. Her mother did because of an uncontrollable health issue. Had her friend not agreed to sell the couch for her, the plaintiff would have lost. Being her mother's caretaker doesn't make doesn't make the daughter legally liable for anything. If her mother does something that the mother can be held liable for, the daughter would only be responsible for paying the bill out of her mother's estate, not out of her own pocket. So, you'd need to sue the mother. The defendant problem was that she essentially agreed to pay for something she's not responsible for in an attempt to save the friendship. That made her liable.

Because she couldn't afford to pay for the couch. That's why she offered to help her sell it. She did what a friend should do (even though she wasn't legally liable). She cleaned it herself twice and paid to have a professional clean it. If it really smelled like urine, the plaintiff would have thrown it away.

How can he clean the fabric and not the cushion? He knows how liquid works right? If he's doing a cosmetic clean, that's not helping. The cushion needs to be saturated with water/solution, then sucked out, if we're going to get to the root of the scent.

Ohh yes to protect her moms pride. What is wrong with her. It’s easy. Get her a new couch or money to replace it. Mommas pride is worth that. When my mom got lung cancer and did this in a store on a chair. I told the manager I’ll buy the chair later. Gave them my signature to let them know I was being honest. A day later I went in and bought the chair and asked them to please get rid of it for me. Solution. Everyone happy. Momma kept her pride and never knew it.

Being someone's caretaker doesn't make you liable for their actions. The plaintiff didn't sue the person who did the damage because she knew she would lose that case. You're not going to be held responsible for damage caused by a health issue you can't control. She went after her friend instead. Sad!

Urine does not just sit on top of the fabric! It soaks down into the cushions, whatever they are made of. The professional stated he only treats the fabric and can not say the smell will not come back. Who the heck wants to sit in their living room smelling urine. The defendant should have replaced the sofa without being sued - end of problem!

I was a caregiver for my MIL with Alzheimers. I can't imagine a friend suing me, with that being said, if this happened on a friends new couch, I would replace it. Not everyone can afford a new couch and they shouldn't have to be out.

Similar happened to me because my ex-fiancés sister’s boyfriend at the time got so drunk that he threw up all over our coffee table and expensive area rug and in the morning realized he had peed on our $1200 guest bed. We cleaned the puke and had someone professionally clean the bed which was still under warranty, but I swear I could still smell the urine. I was pretty upset about the whole escapade, and they offered to replace the bed. We found a suitable bed for $600, because he was essentially family. Edit: Obviously my situation was much worse overall and they totally understood and therefore offered to help. This is someone with dementia that couldn’t control it, and as upset as I was, I would have never sued over it.

I would NEVER sue a friend over a couch. My 85 year old dad lives in a 1 bdrm 1 bath apartment that is part of our custom built house. We purposefully built our house with our aging parents in mind so that when they can no longer take care of themselves, they can live in the apartment. This gives them a sense of independence while we are here to help them in anyway we can. My dad has accidents and we know that he can’t help it. If this should ever happen to us , then we would replace the furniture that he soiled. It’s a no brainer. Just do what’s right

My husband is a professional carpet and textiles cleaner… sometimes people will still smell a smell due to a psychological effect. Their brain just still believes there is a smell. Lots of interesting things can happen with this kind of stuff!

The smell can come out - I have removed even male cat spray. Once you know the specific odor creators there’s some cleaner to counteract it. It was probably a mental thing - or her husband being really bent up on it. Glad to see many comments feel the way I did watching this; I couldn’t sue a friend over an accident her elderly mother had, it feels almost cruel when you add the needless shame the mother might be feeling :/

When I was living in Spain, my girlfriend bought a Himalayan kitten and that thing was psycho. It peed on the couch and no matter what we did that smell was there - had to throw it out (the cat AND the couch)

Once your nostrils become accustomed to these types of scents, you will not notice them. That is common sense. You should rub alcohol over the surface and allow it to dry naturally. Had the plaintiff's son never urinated on his bed? 🙄

I actually got cat urine out of my house. Not the carpet; you are SOL when it comes to fabric. I had a cat piss in my fireplace and no matter what we tried it would NOT come out. I started to remove the floor tiles around the fireplace when I decided to use an outdoor cleaner called 30 seconds. I had nothing to lose. I sprayed in the affected areas and it started to fume up. 30 seconds later the smell was gone! It saved my fireplace and we didn't have to sell the house! It's very easy to remove the urine smell from a human than from a cat.

I'm actually surprised the plaintiff won. It was an accident that wasn't caused by negligence or malice. But if she knew something like this happened before, why didn't she take steps to prevent it? She was happy to have them over and sit the mom on the nice couch. Oh.. I just realized she probably only won because the defendant agreed to help pay for it by selling it and thereby created a sort of contract. But the plaintiff didn't hold up her end of that deal, so idk. How sad.

Your insurance will still pay because the law in every state that requires insurance says they have to as far as I know. But you would not be personally, legally liable. If you walk down the street and destroy someone's gate by falling into it having a seizure, no court in this country is going to hold you liable.
