The best question to ask an attorney when you hire them is: When was the last time you tried a case like mine? Unfortunately with Covid, all lawyers will have to say it has been a while since they have tried any cases.

See Baysa v, JRIC and Gass, case number: 18-CA-006452….. In most cases the Court will order the Plaintiff and the Defendant to attend a mediation. They do this to encourage settlement and take a case off the Court's list of active cases. And often times the parties may just agree to discuss settlement.

This is a common tactic lawyers take. They will sign you up, but when it comes time to hire experts they don't want to spend the money, or they might not be able to afford it. So, they pressure you to take the low settlement. You may want to find a new lawyer who has the ability to try your case. Good luck.

Ask your lawyer to file suit and ask for a court date. Sadly, getting a trial set is impossible until the pandemic is resolved.

Another suggestion is to find out about litigation finance firms, if allowed in NY. Here in Florida, when I have a client who is in a desperate situation and an insurance company that is dragging its feet, I put my client in contact with a litigation finance firm. Such firms will let you borrow money, after evaluating the case and your potential recovery, and will let you borrow some money that you can use for medical treatment or even for your basic needs. You don't have to pay anything back if you lose the case. If you win or settle, however, the interest is a bit stiff. So, say your case is worth about $50,000 to $100,000 and there is insurance available, but the insurance company is only offering $15,000 to settle, and you would maybe net $2-4k. You may be in a better position if you take a $2k loan on the case and let your attorney do what he or she can do to get the insurer to pay a fair amount. If you win, you may end up paying the finance company $3k, or $4k (depending on how long it took to settle). If you lose - you pay back nothing.

@@MattlawAttorney Looks like the pandemic is working in the insurance company's favor. They know many claimants can file a law suit, but you can't have a trial with 12 people sitting 6 ft apart.😭. This gives them more time to sit on settlement offers and insurance funds. Is mediation a good choice now?

This is the most common problem I see every day. Sadly, lawyers run a business, and they have to get paid. And the insurance companies and the government know that many claims won't be brought because lawyers won't get paid, or the client can't pay. So, they use this to exploit the public.

@@MattlawAttorney but if an attorney doesn't take time to review the evidence how can he make a decision as to whether he can make bank on a case? Or do all attorneys shy away from cases "under color of law?

In some cases an out of state lawyer can enter their appearance in a case when there is a local lawyer who vouches for the out of state attorney. For example Gerry Spence and Don Keenan have tried cases all over the country even though they are only licensed in one or two states.

No, the insurance companies that cover medical malpractice are quite different. For the most part these insurance companies specialize in medical malpractice coverages. They have different claims handling policies and procedures. Their relationship with their insured is also quite different. Most hospitals are self insured to some extent, which is like having a high deductible.
