So I was just talking with eligibility and they told me vets with 0 percent ratings are going to be contacted to bump those ratings up. It seems to me they are trying to get people connected above and beyond.

For me the VA gave me a 0 as well and even said it was burn pit related and still gave me a 0. They instead connected it to my sleep apnea despite the fact that i take Sudafed and mucinex every and also I use some nasal spray. This has nothing to do with sleep apnea

Sent me a short letter Feb 24 - too late for any backpay. Dear Veteran & it went on to say I may be eligible….. Would have been nice to have received a letter 33 years ago so I could’ve gotten the medication before I became full-blown sick; but, it is what it is for the government.

Yes I’m getting emails. I do have an ITF for a deadline of July 24, will be filing presumption sinusitis,increases on rhinitis and hemorrhoids (new schedule) Have 2 supplemental denial secondary claims with a deadline of September 24 (effective dates will be March 22 if rated) Clay, excellent explanation of what’s what.

#1) I'm diagnosed Woth having PTSD.. BY A Psychiatrist.. I am getting care and treatment from the V.A. with group therapy.. and Meds.. I've been denied Service connection in the past for Lack of evidence.. I'm awaiting a decision that has been "DEFFERED" this is back and forth for the past 2 + years I've sent Lay statements.. pictures.. even a Copy of my Medal awarded in the country that the incidents (plural) occured.. it's a trip how they DONT BELIEVE ME! even with EVIDENCE!!! DIAGNOSIS!!! AND ONGOING TREATMEMT AND CARE.. it's mind boggling.

I filled for Sarcoidosis when I received a letter about the PACT Act in the mail on 02/28/2024, got a call from a Doctor on 04/24/2024 to set up some testing. I called the doctor back on 04/15/2024 and exactly a month later 5/24/2024 because I have had anyone call me to do these tests… so just waiting.

Even though I have a lot of issues that fall under the pact act, and I got screwed. My VSO was useless, and there's no one near me that I'm able to get help with it. It's absolutely ridiculous

Brother I’ve been to 4 VSOs they’re all terrible. Mine didn’t even submit any of my evidence I handed him, I had to submit them after he put the claim in. The guy didn’t even submit my dd214s

Agent Orange exposure with the dx of hypertension would be covered under the PACT Act for Vietnam Era veterans who's service was within the designated time/date and location(s). - Clay

I have a question regarding a migrantes C&P examination. The C&P examiner is going to review my records which is very unsettling to me because I have statements and pictures that I would like the examiner to look at. Is that normal procedure for them just to only review my records? And for me not to see an actual doctor or NP?

“Review of your VA Medical Center treatment records show a diagnosis of asthma on October 11, 2022. Private Disability Benefits Questionnaire show date of diagnosis for asthma was September 18, 2023. The entitling criteria were not met on the date of the law change. The effective date of this grant is July 23, 2023. Service connection has been established from the date VA received your Intent to File (ITF). When a claim of service connection is granted based on a change in law, and all the requirements for a grant were not met on the date of the change in law, the effective date is the date VA receives the intent to file when a prescribed form is received within a year of the ITF. (38 CFR 3.114, 38 CFR 3.155, 38 CFR 3.400)” This is what they quoted on my HLR decision letter. Since I was initially diagnosed by my VA PCM in Oct 2022. My original ITF was also July 23rd, 2023 (before the Aug 2023 deadline). Should this be an easy supplemental to get my Asthma retroactive’d back to Aug 2022?

Need advice, I’m having a hard time getting a diagnosis for chronic fatigue from my civilian doctors even though I have multiple symptoms. In anyone’s experience might my chance be better trying to get a diagnosis at the c&p exam?

Question? If one is already 100% P&T...is there any benefit to pursue a Pact Act claim? I know many veterans, including myself, that refuse to register in the BurnPit registry...primarily because non of us trust the VA! FACT.

If the claim was denied, no matter what you need an appeal. For instance...if you submit migraines and you receive a denial. If you want to submit migraines secondary to tinnitus, you would require a supplemental claim. Which also means you need new and relevant evidence suggesting the secondary connection in the first place. - Clay

@@TheCivDiv 2012 VA denied my claim of right arm condition to include radiculopathy,muscles spasms,numbness. They said I did not have a dx. But I had a cervical radic from the Amy in my file. The C&P examiner said my radicular symptoms were due to service connected "carpal tunnel". The CP said the nerve studys prove carpal tunnel and not right arm radic. The nerve study tests where the basis of denial. A neuro doc just dx me with radic right arm backed up from service records as well as VA MRIs etc. The VA doc put in my records this week that nerve studies can't be the sole basis of eliminating cervical radic and degenerative changes do occur even when a nerve test is negative. Oh, I had carpal tunnel surgery done(VA) but still have radic symptoms. My current VSO was no help. Lot of moving parts to this. But, I have a past dx and current dx. Plus, continued care since 2011. I just don't know what to file. Secondary, high level review or supplemental.

@@TheCivDiv I was denied in 2012 even though all the evidence was there. So do I do a high level review or do I do a secondary or even a supplemental. I can prove ongoing evidence since 2012. Can back pay from 2012 happen? and does that determine what type of claim I should file.

Sorry bro, feeling dense and a little confused. I heard what you said LC. And, on VA site, "Application expires on: October 26, 2024". How do I check for my one year time limit (sometime in June), or does the August date supercede that now?

If you have an ITF that expires on 10/26/24 that means you started your ITF 10/27/23. Meaning, your back will go to 10/27/23 and not when PACT Act was signed which was 8/10/22. - Clay

Have Va record of Albuterol in 1997, out in 1993. STRs have same. PACT and TERA. When I file I will include all chf, cad, etc … if I win later, does back pay follow initial PACT date?

@pennydittl3850 , if you served in that theater, I would file for an increase on a presumptive of GERD. For my symptoms I got 30% with the IBS. Farm as much evidence as you can.

According to the denial the c & p was submitted on March 14th, and was reworked April 26 and was denied on May 1st. Now at the c & p the examiner said this is pact act and a tera and cancer and that all cancers are approved per the pact act. I hate all this back and forth. So our vso said to appeal but to the judge. 5-7 years from now. So we were told that the veterans are the ones who are clogging up the system with all the claims and just go live our lives and forget about any of these claims. The system stinks. When they established the pact act they should have hired on more staff to handle all the claims that it would bring. But instead they give themselves raises. Granted, every system has its abuse, that I understand. But they should have known this would create a backlog and hire for that. I have contacted one of our federal representatives to look into this. Not sure where this will get anyone but it’s worth a try. Thanks.

Off topic question here, I filed for gerd a week or so ago and just got a call from the va today, they’re doing an over the phone exam in a couple weeks with a va doctor. Is that normal? I’ve never done a c and p exam over the phone… I’ve been diagnosed by va doctor and ER, with gerd. Has anyone done an over the phone exam for a physical ailment like this??? Any help/answers would be awesome.

I would also add to get copies of your medical records before the phone exam so you know what they say. Compare this to the DBQ so you have all your facts together and do not forget anything. Have notes for the exam and take notes during the exam.

CivDiv, My father was awarded 100% in March 2024. He's a Vietnam War 0311 and it's been 55 years since he's received a disability pension from the VA. We filed his C&P January 23, 2023 under the Pact Act. He has not been paid the back pay for August 2022 even though he filed his claim well within the Pact Act due dates. How can he put in for the back pay to August 2022? We were told by the VBA rep that my father should appeal the date of January 23, 2023 to August of 2022. We understood this back pay was automatically dispersed based on when he originally filed. Do I file an appeal or a supplimental claim for his back pay? Also I'm an OIF/OEF vet and I submitted my intent to file the same month I filed my father's claim in 2023. I completed my fully developed claim by Sept 2023. Do I have to file a supplemental claim for the back pay to August 2022? Let me know and keep the C&P gouge coming!

No disrespect to ANY veteran. But I'm sick of hearing about the PACT ACT. I wasn't in Viet Nam or anywhere near. Is this my fault? I'm an honorable discharged disabled vet and I should be treated as such by the VA, not "fucked" around regarding my disability claIms!

Soooo I just did my Migrain CP exam. She told me no doubt about with all evidence (log, standby, letters missed work) no reason why shouldn’t be paid. She agree mines pretty bad. Alls he said was “ I can’t tell you what said DBQ but u will be happy and you should compensated to fullest for it” Soo was soo nice NOW up to the VA!! BUT I just red CFR 86 that migrain is only 10/30/50. I am at 80 now so to even get pay increase I have to get 50 and it only get me up to 90….. FML!
