The plaintiff says he brought his car to the defendant to fix his air conditioning. He claims the defendant told him it was fixed, but it stopped working again almost immediately. He’s suing for a refund. The defendant says he replaced the air compressor and all was fine. Four weeks later, the 20-year-old car had a new leak, and he claims the plaintiff didn’t want to pay to have it fixed.

Because he charged the customer 5 hours to take his dashboard apart and never properly repaired his A/C system. I worked on cars professionally for 18 years, this mechanic messed up and knew it, and his paperwork would have, and did incrimate him. That's why he didn't bring any paperwork

As a mechanic, I can legit see this happening. It is really expensive fixing AC and if you don't replace the whole system on an old car, you run the risk of parts gradually going bad or sometimes going bad shortly after old parts are replaced. That being said, it looks pretty bad that he has no paperwork, texts, etc. to support his side of the lawsuit.

As a mechanic, you know how much we enjoy paperwork. But you are correct, documented 3 c`s and CYA! Especially signed waiver of this is what has to be fixed 1st with a notice that other things may fail with no guarantee it won't happen. Also guarantee the parts and work done, oring can be easily pinched. Any old timer mechanics will tell you about old school Chevy v8s. The 90`s. Replace the intake gaskets a in short order the hoses blow then radiator, then water pump and then sometimes heater core.

I feel bad for the mechanic. AC's can be tricky and there's a lot to the system. Plus parts are crap anymore.

I'll join the mechanic's thread. Since you are all mechanics, like me, you know that evaporator cores usually butt up to the firewall and the only o-rings are accessible through the engine bay. If the core is leaking then the mechanic should have stated it was the problem, not try and blame it on o-rings. Things he said were true about one new component leading to problems with associated components but as a shop owner you have to anticipate this and make sure to warn the customer, and especially in writing on the work order, and then let them make the choice or just refuse to do a half job.

Trust me, he could care less what you think. If he has a back log, then he is probably a good mechanic. His mistake is not having a book keeper / office manager to protect him from the uninformed.

I agree. Been through this recently with my 2007 vehicle. One problem after another. Even had to change my AC compressor like in this case but thank god it worked out fine. Finally just sold my vehicle. Didn’t wanna deal with future problems lol

You go disconnecting, moving old lines, there are weak points from age, rust, rot, rubbing on things, it's going to create more leaks. The longer you let a problem go or let a car sit, the more likely it is those things will happen. My family cars are almost always junkers, been sitting, cheap, and I've seen it so many times you might as well just change everything.

The plaintiff isn't any better...he's clueless and seems to feel that because he paid the guy some money, he should fix the entire car to restore it to new. Even the judge wasn't buying his constant blame for every little thing. Neither of them have proper evidence.

Then bring evidence to receive the amount that you want to get. Also, Im sure she knows how much a gallon of milk is. She actually gives people generous amounts when doing rough justice and the only thing she took out was the compressor that is in his possession.

Yup. If the mechanic had explained himself better he might not have lost. It seemed as tho he just expected her to understand that when you replace a weak compressor with a new one that there's a sudden increase in pressure and temperature changes that weren't there before so old parts could start to leak.

Mine is a 1997 Toyota Camery, three years ago, it was $2000.00. It belonged to the deceased mother of my daughter's friend, Steve. It was well taken care of!! I wrecked my car, this little low car was hard to get used to, but I love it!! I did put new all weather tires on it and a new bumper, runs like a top, NO PAYMENTS!!!

I do not feel the defendant was trying to scam him in any way. But I do feel he's not as skilled of a mechanic to handle more detailed repairs like this one. Other than he seems like a good and genuine guy overall.

The new mechanic is wrong. The clutch will not engage if the freon is low. He does not need to replace the new compressor with another new compressor. By the way I'm a mechanic over 20 years

I had a 2005 Lexus,that I bought in 2015 and the A/C suddenly stopped working. It wasn’t the compressor,it was still cold,just wasn’t coming out. It was the blower motor. I purchased another used vehicle, and immediately took it to a mechanic and they found the same problem. It happens a lot. Shutting the A/C off before shutting the vehicle off,increases the life of a compressor

This is typical of many auto repair shops. I've been in the automotive repair business for a long time and I know what can happen. The auto AC business should be handled by AC specialist, especially on older VE-HI-CLES, lol. The mechanic here did not write up a work order, first mistake. The first thing to do as a shop owner is write a work order as a diagnostic. After you've found the culprit or culprits, you inform the car owner what you have found without hands on getting into the job. Then you write down the cost on all parts and labor. Very important to stipulate in writing that if you happen to find any additional related items that need to be replaced, that you will stop the repairs, notify the owner and address the related issue. Make sure they understands and agree before signing the work order. Obviously there will be additional cost but you're giving the car owner the option. Otherwise, you won't have a leg to stand on when your standing in front of Judge Marilyn Milian...

I've dealt with AC problems myself on cars in the past. The mechanic is right when he says that the AC system is pressurized... so with a fresh compressor, that now puts pressure on seals and hoses that up to that point had not been under pressure for a while and may have dried out due to lack of lubrication. Therefore they in turn can leak now that they are again under pressure. So I understand his position here but am unimpressed with his business acumen. The plaintiff pretty much got a free ride here . The O-rings are fairly cheap and all it would essentially be now is a couple hours of labor and a freon recharge.

Communication is important. The mechanic should have prepared the customer and told him that this could potentially happen and it may be extra if it does. Either that or just change all the o-rings and hoses and include it in the price from the start.

The majority of people out there just dont understand anything about automobiles and how they work. I've known people who could talk the talk but put a wrench in their hand and they dont clockwise from counterclockwise even though they can tell time.

I've dealt with them as well. You don't just change the compressor and not do pressure checks to check for leaks. I believe the plaintiff when he says the next day.

Yeah that’s what I was thinking. I had a 99 Honda civic with the same issues. Once I was told the cost to fix everything I decided it wasn’t worth it to throw money at it. Eventually I just drove with the windows down and replaced it for a newer car.

Shit I'll buy another car for the price I would pay to fix the AC... Seriously I have bought cars for $1200 because the AC worked... I had a car that ran absolutely perfect nothing wrong with it except it did not have reverse you couldn't go to reverse to save your life but you can go forward just fine the AC worked great and everything else worked lbvs

Never take your car to a mechanic to fix the AC.... always take it to a shop that fixes only car AC systems or you will get this as your result.

When a defendant walks in with no paperwork they are either so sure they are right or they are ill prepared for being sued. In this case he was ill prepared and it cost him.

I don’t understand why she does ‘rough justice’ when other people don’t have evidence, she says that’s ‘you’re problem’. And that defendant shouldn’t assume the plaintiff would provide evidence for him (when they talked in the hallway).

I had a same situation with the AC compressor except I was going to the dealership and yes you have to watch them cause all you get is the back n forth the run around as I call it, after coming back the 3rd time I had to get some base in my voice to let them know enough is enough n if they couldn’t fix it I’m taking my business else where low n behold they finally found out what the problem was, long story short watch everyone.

Both parties seem pretty good it just went really bad but I think where they come from it's just a handshake nobody really does paperwork. It was just one of those cars that needed way too much money in order to get fixed

I worked in a small dealership for a few years in the 80s. Every car that came in with AC issues needed a new compressor, even if an O ring would fix a leak. We would even clean the old compressors and paint them to reinstall as new. Same with alternators. I got out of the mechanic biz because if this. Sad that this still goes on.

Old cars are like that. You fix one thing and something else goes. It's just the way it is. The car was "stressed" being so old. Once the new pump with high pressure replaced the old weak pump. More leakes started by weak and dried out seals. The only solution is replacing every component in the system or buy a newer car. Case closed.

My dad's an ASE master tech with 30+ years experience. The best thing you can do is notify the customer on a quote/repair order of any repair they've requested, any problems that could occur as a result of the repair (because that's a thing) and any/all costs that could be expected. Most people want to fix their cars as cheaply as possible. If you own an old car because buying a new one is expensive, you're going to spend as much, if not more money keeping the old one on the road and in good condition. Lesson of the day is, if you maintain your vehicle well, find a mechanic you trust, and don't try fixing your own stuff (if you're unqualified) to save money, you'll at least know what you've got and what to expect.

This exact same thing happened to me, took it 3 times, leak the 2nd and then they had to remove the dashboard, but because it was still under warranty, they said no. Eventually I had my dad do it for waaaaaay less. Some mechanics, even the car dealership mechanics, have no idea what they’re doing

The final straw is when I replaced my tires, another car shop stated it required new tire sensors, they replaced them and messed up the tire sensor configuration so then one of the tires always flashes low, then they’re like, “oh we can’t fix that, you’ll have to take it to the dealership.” 🙄🙄🙄 stop touching things, if you can’t fix it!

It DOES take many hours when they have to take the dash apart. I had a plugged heater core and the heater/a/c doors wouldn't open. They quoted me $2K to fix it. This was 5 years ago.

He should have known that the seals were going to go bad from the leak test you have to do after the service is done. Not doing one can result in a huge huge fine. Most mechanics I know are paranoid about that. He may have been able to charge for the extra seals and even the cost of going into the dash. A compressor run without 134a may possibly be destroyed if the oil also leaks. It can happen but not always (I’m a certified parts specialist)

Compressors have a low pressure switch to keep them from burning up if they get too low on freon the clutch will not kick in the compressor

This drove me crazy... The judge is stuck on having the plaintiff break down each and every word of the story - "what do you mean by charging toward you? What do you mean by getting in between you?". Then the plaintiff takes forever telling the story and says the word vehicle about 57 times 😒🙄. My nerves!

O rings dry out and crack over time, especially if they are no longer under pressure. So when the new unit was installed they would have blown. The mechanic was right to say they weren't a problem before the new unit was installed, BUT he should have known this would be an issue and either replace them anyway, or let the guy know it's possible this could happen and if so to call back and he'd sort it out for him. Just needed explaining clearly to the fella. Poor business sense.
