The plaintiff says an elderly woman crashed into her car, so she brought it to the defendant for repair. She claims the vehicle is in worse shape now than before and needs even more work, so she’s suing for damages over a negligent repair. The defendant says he told the plaintiff the car was totaled, but she insisted he try to repair it.

We recently went through a similar fiasco with my Audi. It was wrecked and, as if dealing with the insurance wasn't bad enough, the body shop was worse. They didn't fix issues that were part of the claim and we are still dealing with unresolved issues. Both the insurance and the body shop refuse to resolve this but would rather point fingers. If people could merely own up to their mistakes, the world would be a better place... and my car would be running better.

It's not uncommon for insurance adjusters and body shops to work together and milk the system through kickbacks. 30 yrs in the business and believe me, there is much corruption.

I'm a autobody mechanic for 30 yrs, saw the picture of the damage and would have repaired the door if one could not be found, that simple. The body shop was scamming her, or her insurance, seen these Scinarios too often.

I cannot believe the rude comments in this section regarding the plaintiffs facial features. Do we know it is from the 'Botched plastic surgery' many are attributing it to, as opposed to a medical condition or medication she could be reacting to? Have those commenting done research to understand that medications such as those used for high blood pressure, can cause swelling? Or that a condition like Cushings or Hypothyroidism could account for it? I have to assume they haven't, or have and choose to ignore the possibility, because making fun of another individuals appearance brings all those low enough to do so, closer together. And I gave us all credit for being adults in the comment section. Appears only some are!

When was the last time you tried to find a part for an older vehicle? It isn't easy. Even the shop I've been using for 17 years had trouble finding a control arm for my truck. They eventually did find a used one that had to be shipped from 5 states away from where I live. Not always so easy. And unless you've gone through this before you shouldn't make it sound like it's so easy.

I had an accident recently and due to COVID, it was challenging dealing with the insurance company, plus the person that hit the car didn't have any insurance! For the life of me, my Insurance Agent had me contact the different departments of the company some were based in TX, NY, and Cal. I did the leg work to get a settlement from my own insurance company which took over a month. Because the right hand was not talking to the left hand and calls weren't returned or made, I was stuck in limbo! Now, this was another battle I had to deal with.

Last year 1 month after buying a new vehicle we got hit it took almost 4 mos for our vehicle to get fix. So yes it was was/is true part was/is hard to get due to the pandemic… Lucky for us the other driver had good insurance we had to call his insurance every week to get the rental extended.

My truck sat for 7 months at my mechanic's shop. I needed my transmission rebuilt and they had to farm it out so my truck sat without a transmission for 7 months while my old transmission was being rebuilt in another shop. I couldn't drive my truck to another shop because it had NO transmission in it. It isn't always possible to take your vehicle to another shop when it's waiting for repair. The transmission shop was way behind and I wasn't on the top of their list, I was waiting in line.

@@williamtrask1582 It had nothing to do with a better job. Not all shops will or have the time to rebuild transmissions. The shop they sent it to does nothing BUT rebuild transmissions. I have another vehicle so it wasn't a problem I just wanted to make an example for people that they cannot always get their vehicles worked on when they want them worked on.

I had an ABS brake module that was on order for almost 2 months before my car could get fixed, because it was programmed specifically to my car. The auto company had to release it and we have shortages right now. This is not uncommon in these times. I didn't want to wait over two months for the part, but without it I had no brakes and could not sell the car, and certainly didn't want to buy another vehicle at the inflated prices we see now. So what else are you going to do? Got to wait. It's not the repairmen's fault.

I was in a 5 car pile up 11/30/21 and here it is April of 2022 and I am just now getting my settlement. Yes, it took that long for USAA to accept responsibility on behalf of their client. Thankfully I was the last car to get hit so damage was minimal but at least 3/5 vehicles were totaled.

They're still around in the US but unfortunately only produce 4 models at the moment. And three of those are suvs. Their new Outlander looks great but it's just a rebadged Nissan Rogue. Definitely not the same company that they were in the 90's and early 2000's.

The door was not available not because I’d supply chain issues...they don’t even manufacture that brand in NA...not since 2015, the plant made replacement parts for a few more months. That’s it.

All car parts were. Our old Chevy truck had an issue that needed one little part to fix. They couldn't get it for months. Husband just took the truck, traded it in and upgraded from the 2015 to a 2021 bigger Colorado. Yeah I'm kinda peeved. Nothing else was wrong with my truck!!

The insurance company should have just found a car like it and bought her a car, minus the deductible. Sue the insurance company. I don't know what year this occurred in, I found one for $5,000 with just 102,000 miles on it in just a few minutes. I think that is what the insurance company should have done if parts are not available. Insurance company could probably have found one in a junk yard with a good door to use. It would just have to be painted, but so would a new door have to be painted. I'm thinking that if she sues the insurance company over it, she might end up with more than that after punitive damanges are awarded.

I just got my claim handled. Car pulled out in front me and I t-bone him. He didn’t have any insurance and he wasn’t a us citizen so he lied about his name. This happened in December and I just got my car back 3 weeks ago!!! What was originally a new bumper turned into needed a new battery, I had an oil leak, needed new brakes, and the insurance company didn’t want to pay for nothing because my car is luxury (Mercedes) I had to talk to a manager to get my rental extended because they couldn’t tell me when I was supposed to get my car back and I’m not coming out of pocket when I have full coverage and it’s your fault why I don’t have my car back. I have warranties on all my parts and my insurance company wanted to put just any brand part on my car.

Sure they didn't want to pay for a car they covered. Lol. Your other issues it sounds like, according to the insurance, weren't caused due to you hitting someone. Another thing, the insurance company goes by what a mechanic tells them. They don't decide themselves what gets put on/in a vehicle. I also want to point out luxury vehicles aren't based on name (Toyota has luxury vehicles), or cost. It's the other stuff such has heated steering wheel, seat massagers, water resistant windows and the such. That would not have any bearing on a bumper or cosmetic issues, or anything with under the hood unless it damaged something that controls those settings. An oil leak, brakes, brake rotors, brake pads and battery, don't. You have a lot to learn about car insurance and vehicles.

@@ButtonsCasey that’s the thing they didn’t want to do anything that the mechanics were telling them that my car needed. The mechanic told them I needed a new battery, they said that they wanted to put an older battery that’s not in my warranty with Mercedes in my car. And then said I would have to pay for the Mercedes battery if I wanted it. No you know I have a warranty you need to honor that. I drive a 2020 which is basically brand new!!
