The plaintiff claims the defendant’s dog killed her dog right in front of her. She’s suing for the cost and upkeep of her dog, along with pain and suffering. The defendant says he feels terrible about what happened to the plaintiff’s dog, and that he offered to make things right with her by getting her another dog.

I felt so sorry for this lady..tears were falling as she told her testimony of what happened to her precious dog ..I pray she finds comfort when she finally purchases another puppy🙏

Yes! My heart goes out to her 💔 $500.00 does not even compensate for the tissues to dry her tears 😭the stitches to mend her heartbreak 💔heart or the balm to comfort her soul!JM explained the law but THE LAW “is not” a HEALER!

The defendant did seem sincerely and genuinely remorseful for what happened. I could even see the anguish and remorseful tears behind him.

I feel bad for this lady. But, she put her (own) dog in danger. She's so nosey, she took her dog across the street just to find out if the defendant got a new dog ? She could've found that out the next time she saw him. My eyes are always open when I'm walking my little dogs. I keep them away from bigger dogs, at all times.

A heartbreaking case. Judge Milian's comments in the end, her empathy regarding the plaintiff's plight and her explanation about the exclusion of pain and suffering in the claim for "property" (aka, Trudie) was reasonable and heartfelt.

This poor woman made me so sad....when you live for your animals it's like living for children...As much as it is painful for her, Trudy is always with her wherever whenever. Pets know when they are LOVED! and you can tell Trudy was very loved, I hope she finds peace with this somehow, cause she really was so upset, rightfully so, but it was hard to see her that way...

My dog and 2 cats are my world! If I watched one of them being attacked and/or killed I would NEVER be ok again. I pray something like this never happens to me!

Legally, pain and suffering cannot be awarded for the loss of a possession. Under the law, dogs are no different than any other possession, like a table or chair. I don't agree with it personally, but that's the reasoning behind it.

@@BrunkDartender234 i didn't know that because it is considered property and someone damages your property..you can't get pain and suffering? This happened in DC were a lady actually left her small breed dog at a doggie day care while she was on vacation. The dog was attacked by a bigger dog and she sued the place. Last time I checked the lady was actually had a case because they said the dog was property. This is so interesting

@@DC45193 Yes, there is no legal precedent set for pain and suffering for a damaged/destroyed possession, even if that possession holds sentimental value. The standard is to award the value of the item at the time of loss. I'm not familiar with the DC case, but the dog owner in question would have a case for veterinarian bills as a result of the attack and the value of the dog, but not pain and suffering. Edit to add: Anyone can bring suit no matter the merit of the claim. This specific DC case also depends on the contract (if any) the owner had with the dog daycare. The owner may have to prove gross negligence on the part of the daycare to win her case. Some contracts include clauses that absolves the business of things beyond their control, but if the business can be shown to have acted with negligence the dog owner will have a better chance to win the damages of her lost pet.

@@DC45193 Pain and suffering has a pretty narrow definition in law. It strictly applies to physical damage suffered by the complainant. Say the dog owner tried to stop the larger dog from attacking her dog and was bit in the process, causing bodily harm to herself that she could prove. Then she would have a cause to sue for the pain and suffering she directly received as a result, but still no cause for the pain and suffering of the dog or the loss of it. Hope that makes sense!

I don't care what breed of dog killed the plaintiffs dog, controlling the dog would have prevented this whole mess. Let your dog run amok, and there will be consequences. BTW, listening to the plaintiff was heart breaking. So sad.

I agree n not sure how i guessed she was gonna say 500 b4 she did but she did lol anyway um my other guess was closer to 700 nice dog, and the crown noone said that its also the type and strenght of the jaw of a pit, and also perhaps their energy level, owner type yes but also these things play a big role coool i tyepd this as a advertisment playedn fisnhed as it did lol

He did offer to pay for the cremation, pay to get her a dog, and even some cash. He offered and she refused it.

He doesn’t automatically owe her whatever she wants, especially if let’s say it is a ridiculous demand. There is a difference between paying what your responsible for, and being guilted into paying more than someone should get just because they want it.

I love that there was no animosity between the two neighbors. They understood that this was a tragic accident and didn't want it to come between them. Hugs to them both.

I get that the plaintiff could not get “pain and suffering” but I’m surprised she was not given a ruling based on the negligence of the defendant that led to her loss of property, being her dog.

I am not sure if pepper spray would halt a dog in the middle of an attack because it would be so wound up and intent. Does anybody know the answer to that?

So many people don't understand this. Breeds were created to pass down desirable traits. Maybe dog agression and human agression are not considered desirable traits now, but they were at many times in history and generations of line breeding doesn't just go away because some people have sweet bully breed mutts with mixed genetics and don't like it when people tell the truth about pit bulls

This hurtful. I remember when my sister 6 pitbulls attack my basset hound. I happen to be wearing steel toe boots, I drop his leash and started kicking and punching the dogs in the face. When I got 5 off him, the last one I had to fight with and keep other off him. He ended up running up the street, I finally got out the driveway area with a shovel to keep them back. My dog & I had scrapes and punctures but we both made it out without being killed. Year later same dogs was put down cause try to kill the neighbors dog after they jump the fence

Pit bulls are known to turn on other dogs and animals, even those they are raised with. Experts attribute this negative trait to years of interbreeding the most aggressive dogs for dog fighting. With regards to attacks on humans, a 2018 report showed more than 35 dog breeds contributed to 433 deaths in a 13-year period, but pit bulls contributed to 66% of these deaths, followed by rottweilers at 10%.

It's not true on how you raise your pitbull. My grandma had a pitbull she raised from a puppy sweetest dog you'll ever meet but if you put her in a room with other dogs she would almost break her leash to get after those dogs. Pitbulls are just sometimes very aggressive when it comes to other dogs.

@@rxnupe Definitely how you raise them. I've been around Pit Bulls that are well behaved because of their owners. They act like babies and mind their own business, but will protect their owners or the property if there is a threat.

All dogs are aggressive. The only difference is that a pit bulls bite will do more damage . little dogs actually tend to be more aggressive, because they don’t know they’re little .

I completely disagree with you. I had a pit that was over bred, attacked by the people who owned her in an attempt to kill her, and ultimately surrendered to a pit rescue. She was an amazingly gentle dog. She never did anything aggressive towards a person or other animal. She loved my cats and they would sleep curled up together.

But she was just out on the street. Right? I sometimes walk my chi on the street or a park. I don't deliberately take her near big dogs but what if one came our way? Very scary. I may start carrying a big stick.

This blows my mind the serotypes behind pitys.. I have a pit and an Australian Cattle Dog and my heeler is way more aggressive than my pit with the exception of someone coming towards anyone in my household in an aggressive manor which I approve of. She has no issues in public or around other dogs. She pays no attention to anyone or anything other than her handler. It is not the breed it is the owner and the training.

Most people can’t be bothered to properly train and socialize their pits. It really also has a lot to do with their nature as well. Sometimes you get lucky with a really laid back pit who isn’t dog/ people aggressive.

@@riandraegon556 you’re disgusting. Pits don’t “snap” unless they are poorly trained. but guess what? all badly trained dogs snap. they just have strong locking jaws. but if they are trained well and have good, loving owners, they are fine. I truly hope you don’t have any pets.

I think it's not that pit bulls attack more often, it's when they do their anatomy is designed to do massive damage. I know folks who own chihuahuas and their dogs have attacked every single person in the home and every person who visits but the damage is minor. A big problem is containing the dog. Pitt bulls are great diggers and jumpers so they escape easily if you don't have the yard designed right

Other dog owners know exactly what their breeds are capable of instead of the rose colored eyes pitbull owners. I wonder if thats why theyre the most dangerous killer dogs. Maybe their owners are in such denial all the time. And not because I say so, look at the statistics and real life cases where they kill and kill and kill. Have fun.

I feel for the lady...I've seen that senario played out several times. It's trauma that triggers the same emotion as losing a child. I hope she's sees her pup across that bridge some day.💕💕💕

That’s crazy. I’m not even a pet owner. But if ur dog kills my dog, why doesn’t ur dog die too. Or you you pay me for my pain and suffering!!! This law needs to be amended. That doesn’t seem right at all.

25 years ago I was friends with a family that had a pit bull dog from a fighter lineage. All of the siblings were put down because of them being vicious. The one my friend had died of old age at 13, had no teeth and never bit anyone. I couldn't believe the dog was so gentle when the siblings were the total opposite. I do understand that pit bull rescues tend to be good because they like the love they're getting. I still will not let one around my grand baby.

I’m glad you won’t let around. I’ve read they attack a certain blood type. But I’m not sure if it’s true. But I will say my grandpa and my dad were both attacked by a dog on the forehead and low and behold I was attacked on my head by a pit bull and my daughter at age five walked by one didn’t touch it run by it simply walked by it and it attacked her. We joke it’s a family curse getting attacked and scarred on the forehead by these dogs. But I do believe they are dangerous

I think the plaintiff should have gotten like 1000$. I hate that the law sees animals like property, because yes there's a price for the animal, but clearly there's an emotional aspect to it, the love and care for your dog, all the trauma and nightmares from the event... Especially it's not like her dog was run over by a car, it was clearly the defendant's fault. Her dog could have been alive today. She deserved more.

Unfortunately with pit bulls it's not always the owner. This breed is very unpredictable and regardless of how you raise them can attack without cause or having any prior incidents.

@@yourenotready82 I have a Pomeranian & I can tell you first hand you're lying. Every dog has its own personality. Poms are the yappiest & yet the most loving, compassionate & extremely smart, curious, energetic & playful dogs. Pitbulls are agile and powerful dogs, they are dominate, territorial & are tempermental. Their jaws lock down & when they do they do not let go until their prey has stopped moving. The two personalities are night & day & so are their behaviors. Your pit could be sick or not feeling well one day & you are unaware of it & all it takes is for your Pomeranians to make one false move, nip or yap in a way that doesn't make your pitbull happy & you're going to tragically eat those words like thousands of pet owners have in the past by trusting mixed breeds around each other, especially one that is known to be deadly. The biggest & most deadly mistake you can make is putting your guard down & thinking because your pit hasn't attacked, means he won't.

@Robin D. Wow, poor lady, Glad to hear she didn't lose her life. Hopefully your brother had a change of heart & decided to giver the dog away to a shelter or something or he doesn't have the dog around children or other family.He should have listened to you. Yeah I am the same way. I've got nothing against them in general either but I also am not going to be ignorant to the statistics. There is someone here in the comment section talking about her friends child rides their pit like a horse on its back😳😳 These child neglecting parents who video their kids pulling on their ears, jumping on them as they say "See, pits are so loving & friendly, they would never hurt my child" While that pit is sitting there taking ti at the time, it's just a matter of time before it snaps. Sadly the child doesn't know any better & they end up paying the price. I'm like you, I have to laugh when I hear idiots say they are no worse than other dogs. I beg to differ, no they certainly are not.

The problem I find with many pitbull owners is that they buy a pit/pit mix because they look scary and they think that'll stop people from potentially starting shit with them. So they buy these dogs to be attack dogs rather than family dogs. You can't have an attack dog and a family dog rolled into one, especially if you are not a professional attack dog trainer. You treat it like that and it will act like that. They may be fine around you and your family, but you have conditioned them to be distrusting and aggressive towards anyone and anything else. Also, ofc you're only going to see aggressive dogs and the victims in a court room. You don't go to court cuz you got attacked with cuddles and kisses. What kind of a leading question is that?

People in certain areas like pit bulls to protect their cash and drugs...I have neighbors! Those pits are often chained outside not kept like family pets.😢 I've come across very sweet pits at the dog park, I'm a fan of the dogs, not their owners!!!

Exactly! Most of the time, people buy pits because they “look mean and tough” and are often treated with cruelty. It’s really very sad. There are so many animals in this world that are treated worse than dirt. People are mean and treat animals as if their live doesn’t matter. Don’t know how people can do the things they do.

@ŁÜVŁÜV KÃÇTÜŠ Not in the US. In many cases, they live in kennels most of the time, and go to live with their handler's family once they retire. The K-9 units belong to the police force, not the handler. Should a handler leave the force, The dog is usually retrained with another handler. These dogs weren't brought up like normal puppies. A lot can have socialization issues.

I am PISSED hearing the end of the case. Being a dog owner myself, no amount of money could bring my baby back but WTF! Complete ignorance and I’m more disappointed in the judge, $500……the “lol” alone would’ve had him paying the whole 5k. I would’ve given that lady the 750 on the spot. Absolutely speechless.

I can’t… my cat got run over when I wasn’t at home. My dad asked me if I wanted to see her and I said NO THANK YOU! Bawled for the entire day thereafter and couldn’t get another cat for 10 years. The fact that she witnessed the mauling is unfathomable. Geezuz Christ.

@@bluepuppy1139 she didn't want any of that even tho the defendant offered. The defendant offered her money which was the amount that her dog is worth. She was greedy in wanting a different breed of the dog and wanted him to pay the full amount. That is greedy.

The fact she had just walked away. And went back home with her dog. And the pitbull followed. Almost like he tracked the dog to kill it. Which shows these dogs are vicious. And he just was speaking with her. How did the dog get loose and he didn't see it. He shouldn't be able to own a dog. He seemed kind of dense and lackadaisical. And he should have paid the $750. What the husband initially asked for. If he was really sincere.

Every breed has traits. It's indigenous to the dog. It's your job to get an animal suited to your environment. My uncle owns a storage facility after 11pm his pit bulls are out when the gate locks. They do their job very well & they love the storage yard.

Oh poor Trudy!! My tobee lived to b 18 and I still cry and miss him and my Pekingese...I adopted a shitzu from a shelter who can’t b around children(may be a biter) my grandkids live 3 hrs away. But I can’t imagine seeing another dog kill any of my babies. They would have to get thru me first! If I c a bigger dog around, we just go inside.,so sorry Trudy! U were a beautiful angel on earth. Those eyes...❤️

Its like.. Blame the shark for attacking the prey or realize putting a shark in a swimming pool is a bad idea. Pitbulls are dangerous they can do massive damage. Had a neighbor whose pitbulls tore a toddler in two. Tragic. Just cannot see why people keep these animals.

Pitbulls by nature are not dangerous. It’s how they’re raised!!! Just like children, born innocent and ignorant and are taught evil. And then even if they are the sweetest Doggo ever, they’re still an animal and they’re just born with certain instincts. And of course I feel terrible that this happened to her and her dog. It’s just awful! I hope she can heal and hopefully eventually get a new baby! XoxoX

It’s sad that unfortunately pets are only considered property given how much value and love they bring to our lives. Sadly I’ve had to put down 3 pets(1 dog & 2 cats) in the last 2 years. But at least they were elderly and not injured or such. My heart still hurts from the loss of them in my life. I truly believe that it’s never the dog’s fault it’s the owner who must be responsible

Owners need to contain their dogs. The defendant was negligent. The plaintiff should have gotten more compensation.

These types of cases truly hurt and baffle me. Although I understand that pets are considered property under the law, they still have souls. A car is property... My lawn mower is property. I can go outside and take a hammer to either, as they are mine, and never get into any trouble. But if I were to do that to my own pet (which I never would), I could be charged with animal cruelty and get arrested and get hit with major charges. If anyone in here knows... How is it so one sided like that? How is it that someone else can cause your animal to die and you get awarded a depreciated value, but if you don't maintain your own pet, you can go to jail and be charged way more?

I hear the pit bull question a lot. My thought is that 1) Pit bulls, as a bully breed, require a LOT of training. They need to have very thorough training and need to have a bond with their owner. and 2) Small dogs tend to get away with bites more frequently than other dogs because they do less damage. In fact, a lot of smaller dogs are more vicious than big dogs, they just get away with it because they're "cute"

It’s the way you raise them. I had a big Pitbull never hurt anyone , my nieces road on its back like a horse…. It’s the owner not the dog… people want the Pitbull to look mean and aggressive . Rottweilers are actually more aggressive they’ll even turn on their owners..

I wish the law would change for these kind of cases. I don't have any children, so my special mommy affections go to my mini poodle. There can't be a dollar amount on a pet you love, but what I do think is fair is to compensate the loss with the price of a NEW puppy of the same breed or similar breed if the same breed is not available (ex. if the dog is a designer dog, replace with a designer dog (malitpoo = morkie). If the dog is full breed, replace with full breed (Pomeranian = Long-haired Chihuahua). They got to do better with the compensation because these types of dogs are expensive to obtain. Just award the cost of replacement with new pup prices.

I hate that you can depreciate a dog. If anything, an older dog is more valuable due to the time invested in its training (if the love has no value). It cannot be replaced

It's not really about depreciating. It's about what people would pay for dog. She got much more than she would get if she had sold it. In any event, this type of case can never really be satisfactory.

Heartbreaking to watch, so sad to hear this wom as n had to watch her dog viciously killed. I HATE hearing that, owners should be VIGILANT with their dogs , NO MATTER THE BREED. I have a malinois and a labrador, my labrador is the 1 I have to keep a eye on AND I DO.

I owned 2 pitbulls they are high maintenance. idc what anyone says they are powerful dogs who need to be tired down. Like hunting dogs you can't just take a dog who is breed for certain things and say i want it cause its pretty if your life style can't work around that dog type your in for disaster. Like owning a sheep dog they need stimulation if not they go crazy. I can say half is ownership and half is dna.

If money can’t bring her back, why is she suing him for 5K? My heart breaks for her, but I’m confused about the lawsuit after her saying that. I mean, she was suing for shots, grooming etc, which imo indicates a bit of greed in this case-AND they wanted the defendant to tire place her with a Yorker pup which is far more pricey….all of this put together tips the scales on the side of money hungry more so than sadness over the loss…under the circumstances, the defendant is openly genuinely remorseful over the situation and God bless him for it-he’s a good man with a good heart. I don’t like that she spoke I’ll on Sean in her post interview either.
