Hello Sir for exemple when you apply for I-130 petition and in your visa classification they make C-R1 and in the cover sheet dow they make IR1. what is that. thanks

Hello sir, just wanna ask.. if ... is there a limit in amount of characters in given names on immigrant visa? Cuz the visa they issued me doesnt exactly matched my passport.. well, it didnt appear my suffix name “ I “ on my visa. Any advice? Should i return my visa packet to the embassy for some correction regarding with mg suffix name?TIA.

thanks for sharing, im still waiting for my 10 years green card and my extension letter is until march 17 deadline. they asked for additional evedince and we sent it last week of february. my froblem is we are planning to go for vacation on last week of april 2019 to philippines and we bought a ticket already! what will i do? thank you.

In general, all immigration applications are taking longer than in previous years. Although I do not know any details about your case, it may be wisest just to cancel your vacation. I presume your legal status is more important than taking a trip.

Simply because he came to the U.S. once on a work visa will not disqualify him from receiving a green card. Of course, you cannot file to petition/sponsor him unless you are married. Even if you are living in another country, as a U.S. citizen, you can file immigration papers for a spouse. Good luck.

I'm not sure what you are asking. However, it sounds like you already won permanent residency, but then moved before you received it. If I understand your situation correctly, you could schedule an appointment with the local immigration offices and tell them what happened. You may need a second appointment but this at least gets things moving forward.

In 2014 I came America my green card expired after 2 years in 2016 we filled in December 15 to remove the condition in this October we are celebrating our 6th wedding anniversary we love each other too much it's totally fair and legal marriage we done all the required documents and information but don't know why I'm still waiting for my green card we are leaving together at same address since from 2014 even my in laws also here in United States of America. Don't know how much time it will take to get my new green card .

I cannot tell you why there is such a long delay. But you're not alone. A lot of cases are facing lengthy delays at the current time.

It’s rake so long to get it actually they said from 12 to 18 months. And could be less it’s depends on how many people submit their papers and the paperwork process in America take time because they follow the rules and check everything. Good luck

Hi BataraImmigrationLaw, Thanks for awesome videos. My friend - a lady 1st came to the US 7-year ago under K1. However, at that time her husband-to-be (betrothed) denied to get married with her cause he had another woman. She stayed in his house, together with his parents for 3 months. She hoped that he would change his mind but he didn't. She came back to Vietnam after that. Currently, she got married to a US citizen. Her current husband sponsored her as CR1 (for spouses). They have 2 children and she is waiting for her permanent Green Card. But USCIS just sent her a mail asking for the divorce degree of her and her 'husband-to-be' in the past. She was shocked because they never got married. How can she prove that to USCIS? Thanks a lot.

It would seem that a well-written affidavit, with relevant information attached, would help. I think that if there are other persons who know the history, they may also be able to provide strong written statements explaining what they know about what happened.

Sir how are you? Thank you for sharing your knodledge with us... Im 28 years old and am a legal permanent resident for almost 13 years(green card)... I just got married 4 months ago in my homecountry( Peru) we got married because we love eachother so much and its killing us because of the fact that we are far from eachother... I have a daughter and a babymomma that 4 years ago she accused me of domestic violence and i was took to jail and i bail myself out the next day. I showed up to court few days after and i heard judge saying that hes dropping my charges because there was no evedince of violence. But everytime i travel to a different country and i get back to the US... US immigration officer send me to the second check up overview(you know the little waiting room they called) and they always asking me about this incident(domestic violence) ... My question is : how can i find out why i still got that on my record? Is it gonna effect me if i want to be become a US citizen?if it possible for me to petition my wife even if am permanent resident? How long its gonna take? And if its faster to petition my wife if am a US citizen or a permanent resident? And how long would of take me? Please ill really aprecciated if you can give me an answer for my questions. You have a lot of questions, most of which I cannot answer adequately without more information. For your criminal records, start with the court where the case was filed. Check there. Domestic violence can present major problems when a person applies for permanent residence or citizenship. It seems that you should be able to apply for your wife even though she is not living here.

Tbh I'm not sure if it'll leave because I had a case dismissed and for some reason it's still found when I'm getting background checks and I have to write a letter(for some reason) on what happened during the incident and status of it. I know this is super late sorry.

Hi Sir.I am green card holder IR1..I had my naturalization interview last year Nov.6.I passed the interview but they need more evidence RFE.I hired a lawyer to help me through the document they need.And we submitted it Dec.5before the expiration date Dec.9.I was waited the results and called the uscis.The agent said they didn't get the documents then while I'm on hold the agent said they got it but the officer received it on Dec.13.So the agent said to just wait.Mu question is how long to wait after we passed the RFE.My lawyer doesn't seem interested to follow up the uscis.Hope you can help me.Thanks

It may not be that your lawyer is not interested. When it comes to how long will it take for USCIS to respond, no one really knows. Your delay, going back to December, is not that long. Being told to wait is normal. Patience is called for in such situations. The government has a lot of cases, and what they are reviewing may be more complicated than you think.

I have a question. When I sponsor my spouse here to the US under K1. We have 90 days to file register for marriage in the US. When do we file form I-130? What is the purpose of form I-130? Thanks.

The I-130 and the K1 are "dueling" petitions. You file one or the other. If you file a K1 and it's approved, you will not need to file an I-130. (Assuming, of course, you get married within the 90 days of your fiance's arrival in the U.S.)

Prenupital agreements are not uncommon. To be on the safe side, whomever helps you should go through your prenuptial agreement to review the details and also seek to understand the reasons behind the agreement. You want to be sure there are no provisions or reasons that might cause the government to perceive as a red flag.

正 conviction automatically disqualify an individual for AOS,because that falls under “good moral character”.

Not all convictions disqualify a person from winning permanent resident status. However, since convictions often present tricky issues, trying to handle such cases on your own may not be in a person's best interests.

I think the real key is to clean up incorrect record regarding a previous divorce first. This will prevent additional problems later. I don't understand why anyone would forget a previous marriage.

A medical report written by a physician is probably better proof. If she is the U.S. citizen petitioning for you, then a new child may affect the affidavit of support requirements.

Do i have to do my taxes together with my husband to get approved in our case? since he has never done his taxes i think it will do more harm then good if i get him an ITIN because he has never done them and my ignorance i didnt know he could do taxes without a social. To the extent possible, I think couples should file jointly. If there is a problem with your old taxes, then clean those up with a tax expert before going forward with your immigration case.

So I am an Egyptian Muslim on paper and my boyfriend is a Christian Egyptian but has had the US citizenship since he was a kid. We are both agnostic in reality and we've been together for three years. Thinking to get civil marriage in Cyprus since it is the closest where we can do that. Does that apply? And is it better to apply for permenant residency after 2 years of marriage? How do we prove that we are living together throughout those two years? And does he have to stay in the US with me 18 mnths out of 3 years for me to be eligible for citizenship? You have to meet the Affidavit of Support requirements. If you cannot find a co-sponsor, you can utilize certain assets to meet the required income level.

I came in with a Visa as a kid, got married to a US citizen, I have Daca now. Do I have to go out to Juarez for my interview? My I-30 got approved and my first email from NVC says Juarez for my interview location

prior to marriage i suggest to consult with an immigration lawyer as the first consultation is always free, my mom's sister suggested i make an appointment with popkin, shamir and golan in los angeles as we were living in glendale then but they were expensive so i shopped around, anyhow lawyers accept momthly payments and will give you tips and suggestions like a photo album which is not necessary but will help your case and cards or letters received or sent over time.

My fiance is going to the military . I'm undocumented and we are going to get married soon. I want to live on base with him after he comes back from basic training. Is it possible to be granted special permission to move with my husband if he gets relocated to another state? Or will I have to wait for the 3 years to even be approved for a Visa. so I can follow my husband to wherever he is set in the military . I'm 22 and im in a long distance relationship with a US Citizen while I reside in Canada! Customs denied my entry to visit him for 4 months and wont allow me to visit the states unless i provide them with ridiculous amount of documents that i cant provide until at least 4 months into the future. we decided to get married and we love each other very much and just want a normal relationship where we can live together in his town, but after my traumatic experience with customs flagging me im so paranoid they will deny our petition for marriage based green card. i keep telling myself it will be okay because our relationship is real and its not a sham but its so difficult to reassure myself when im convinced the government is out to get me for no reason. we are unable to live together or have joint bank accounts because we are in a long distance relationship & im afraid of what a good response is if during the interview they ask how we decided to get married! is "so that we can live in the states together" a sketchy answer??

You need to file the family-based petition. I'm working here on Saipan a US teritory and a coworker of mine is married to my distant cousin in the Philippines. She just recently got married to a US citizen and is now a green card holder. I learned that she filed for a divorce and sent the papers to my cousin in the Philippines for signature. He didn't signed the divorce papers but still the marriage push through. His wife totally abandoned their marriage and not in speaking temrs. They had 2 kids and have never talked to his wife for more than a year.

Not living together would raise a red flag to the government. But as long as your marriage is legitimate, you can overcome such concerns. You may also have some problems with the affidavit of support if you have financial problems. Does he have other options? I don't know. I would need to know a lot more about his immigration situations and history. This is one big reason I often suggest that folks talk to a lawyer before taking big steps. I wish you the best of luck.

All you can really do is do your best. If you stutter, I am fairly sure the officer will notice. Most of the time the line between real and fake is pretty clear. However, given your worries, you should probably visit a lawyer in your local area to help guide you through the process and attend the interview with you to make sure you're treated fairly.

Out of my personal experience, the interviewer was such a nice lady that I did not even notice when the interview had started and she made it easy and she talked about general stuff and encouraged us to say contribute but she was clever as most of the stories were general stuff married couples would talk about with their friends in any setting.

I assume she is a U.S. citizen. Normally, the person who is petitioning the immigrant is the primary financial sponsor. Is this what you are referring to? If it is, you will need to find co-sponsors assuming her income does not mean the affidavit of support guidelines.

I didn't have money for a lawyer, but it would have been good to check with an immigration lawyer first, perhaps, because the lawyer, like you would have been able to see things I couldn't see because I was being manipulated. Green card marriage all the way. Also, he/she would have said exactly what we needed to do, then we wouldn't have been told the incorrect thing to do. My biggest regret now. You seem like an honest lawyer, no natter that you deal strictly with immigration. He's also used the VAWA against for the abuse he committed. Will this change your response to me? I hope it doesn't.

@@BataraImmigrationLaw if a person applies for VAWA...details won't be shared with the citizen spouse, no matter if it's a fraudulent case. Its hard to find honest, full of integrity lawyers who specialize with immigration.

My name is Liberty; I have just married a US Citizen who is in the military serving in Germany. (we both live in Germany now) I am an international Master student studying in Germany. We met here in Germany, fell in love with each other, and got married this month (August 2020) after a period of one year and a few months. I have entered the states twice for the purpose of tourism and sightseeing before I met my wife in Germany. Presently my B1/B2 visa is still valid until February 2021. I will be completing my Ms. Program in March 2021 and my wife is expecting to be reenlisted in 2021. However, we would like to start the process of adjusting my B1/B2 status and I would like an overview of the steps to take until the very final step. I would be glad to be aware of every single detail beforehand and the best steps to follow so that we can both move together when she moves to her next duty post.

Mr. Batara, I am an American citizen living in China with my Chinese spouse. We have one child (age 2) together, who has received his U.S. passport already and we have a daughter (age 9) from my wife's first marriage. We have been together since around September, 2016 and married September, 2018. We have decided to move back to the U.S.A. for a number of reasons, one of which is the health of my elderly parents. Because of income issues and in an effort to avoid a separation from myself and the family, my brother has agreed to sponsor my family to go to the U.S.A. His income well exceeds the required $33,125 four a four person household. I have a couple of questions I hope you can answer for me. First, because we wouldn't live in the same household, would he be the sole sponsor or a co-sponsor with myself? Second, if he is the sole sponsor, should he or I fill out the Form I-130?

Been married two years to my wife, been together for 6years. Living in the states now, went to school, now I have a good job. Its very nice living here, there are a lot of opportunities if you have ambition. I've heard people saying all kinds of crazy stuff, pertaining to getting there papers. Listen I don't care where we are, as long as I'm with her. Most of you worried because you are not legitimately in love with your spouse. If you are then why are you so concerned about being denied. Be truthful, and walk straight. I honestly don't think you have anything to worry about if you straight

What about black women and the welfare department or the child support department , we as black men , balck west Indian men ,we want our children to be we weren't raised on depending on the government for nothing but the truth but you have a system that is against the black skinned man it's easy to be over looked i have two sons that i am paying child support for and i haven't seen or heard from thm in five years and i have a court order but the system don't care about the black skinned man success . @@BataraImmigrationLaw My brother met a girl who came to America and got caught at the border. They talked to her and said she may meet the requirements for asylum. So they let her in on that, I don't know all of the details. She's been showing up to every court and meeting date she was told to. She is now pregnant with my brothers baby and they plan to marry. But she was told she didn't meet requirements for asylum and there is nothing she can do, the best she can hope for is being deported for a year. The baby will be born just before this happens and they will be married. I was wondering if there is anything else that can be done?

I'm not clear on your situation. It seems like you might qualify for a fiance visa. However, you're probably better off, at this point, going through the differences between filing a fiance visa and a spousal petition. I'm coming on a B2 tourist visa to visit a friend and she said we're getting married so i could stay here instead of the K1 visa taking too long. My question is, if i come on the B2 visa, and I stay for more than 90 days, is it OK to get married??

It is possible but you run a risk of being seen as committing misrepresentation when you entered the U.S. I suggest you speak with an immigration attorney who can explore your situation in greater depth.

I-30 was approved and the I-485 is in tent to deny . Yes being married isnt easy at all for green card. Entered illegally 1997. It was a misdemeanor. This is what were dealing with right now.

Hello, If I marry someone on a J-1 Visa and has the no objection statement from their embassy, if our I-130 and I-485 case is still processing by the time his J-1 Visa expires, will he need to return to his country? Or is there an amnesty period or will we need to apply for another visa so that he will be able to legally stay with me while we wait for the paperwork to be processed?

Am I allowed to go to school while I wait for my work permit and travel document? My lawyer said if the school allows it I can, but i'm still not sure. I took some classes at a college here on a TN visa, which is now expired. I've gotten married since and filled for my family-sponsored greencard, and i'm waiting on my work document and travel document now. I just wanted to know if me taking classes at a college will be a problem. Does immigration know if I'm in school? Since I did have to give the school my social security number and old TN visa before it had expired. Thanks in advance
