In this video, Immigration Attorney Carlos Batara explores the use of simple, everyday matters like your first home together, the technology you use, your children, and your finances to weed out fake marriages that you may be questioned about..
Some couples think that answering questions about their relationship will be easy, a proverbial walk in the part. They minimize that their recall is less than perfect.
In reality, many of the questions in this three part permanent residency interview guide are geared towards separating real, bona fide, legitimate marriages from the ones which are attempts to bypass normal green card channels.
As a result, many immigrant husbands and wives will never experience the rigor of the inquires that are shared here. They will pass their first marriage green card interview.
They will not be forced to endure a second interview, known as a Stokes fraud session, with an U.S. Citizenship and Immigration (USCIS) officer.
Nonetheless, traces of these questions are sometimes asked at the first marriage green card interview. This means preparation for a marriage-based adjustment of status to permanent resident status should not be ignored.
Take your first home as an example. That’s easy enough to remember, right? You still remember the address, the building, and whether it was a one or two story house. End of story?
Nope.
Did your living room have a carpet? Easy answer. What color was the living room carpet? Still easy.
How about the drapes? What about the carpet in the bedroom? In the hallway? Did the kitchen have cabinets? How many shelfs were in those cabinets?
Still easy?
And these types of questions and answers can go on and on and on at your immigration marriage interview.
Don’t take a chance that your memory may not be as perfect as you think.

i agree if you are legit than all you need to do is pay attention to your soundings my wife just got her green card 2 weeks ago we were ready for all these questions and lots more but we had none of them except what day did you meet let me see your birth certificate and divorce decree than just going over the forms to make sure they were complete we came with a suit case full of documentation and needed none of it but maybe because we were prepared and the interviewer did not want to waste time with us

@@BataraImmigrationLaw What if you know someone that got married to illegal immigrant what can one do about this she puts her hands on him physically she threatens him and she has no green card she came out of Cuba through the Texas border what is someone supposed to do in this kind of matter oh just to say she abandoned you ever children that are in Cuba with her mother hasn't seen them in 5 years.. she has gone from man to man in America.. My best friend, U.S. Citizen, married to a lady from Venezuela. The immigration police went to their house at 4:00 a.m. Unfortunately, she does not live with him therefore was not there. They went right for the closets and bathroom. Her clothes or make up were not in the apartment. They even talked to their neighbors. They accused them both of marriage fraud. She is in immigration jail and under deportation.

Thanks so much for all your tips. I'm having interview within next week and I think I'm getting ready but I feel abit nervous because I don't listen well with English. I wonder if I can ask the officer to speak slower or my husband can help with translate

You should bring an independent translator to help you. Yes, you can ask the officer to speak slower.

I did ask officer to speak slower and yes, I really appreciate that. I could understand him all. It was not hard, he just asked about how my relationship start and when , any dates and other informations that I filled in the form to make sure they're correct and yes/no questions in form I-485

I love your work, and tips! I Have a question and I hope you read this. My Wife and I have been married for almost a year, we live together, however my wife will go to college and it's about a 40 min drive with toll. I told her to save money she should dorm there, and we agreed. The question we ask is that will this action affect us? Of course I will bring the paperwork that she is living within her dorm to obtain her education, to save money, we even apply for family housing because I support her so much & I wanna be with her but we are not sure if we will get it. If she does dorm do you have any tips for the marriage interview relating to this? Thanks!

You will need to document your relationship closely. But as long as your marriage, you should be able to prove it.

Great video. Thank you. I am 20 years older then my wife and we had to jump thru a few hurdles. We are now waiting on our interview date from the NVC. You mention that the interview with both the husband and wife. In china they do not let the petioner go into the interview with the spouse. Also Since we have been married for 9 years will the questions be the same a a newly wed couple?

Spouses are not always allowed. Each office is diffferent. There is not set formula for what questions will be asked. If you downloaded my questions checklist, there is a discussion on prior marriages there. I would antipate some questions on that area. But as I tried to point, my questions are only a guide. Use them to figure out what your spounse might be asked. There is no way possible to predict questions in advance with certainty.

I would think so, especially if you have done things as a couple during the time together. Although I have seen such situations questioned in depth.

Every interview is different. If you're worried about your ability to answer questions, I recommend you discuss your case with a lawyer before going to your interview.

Hi I would really love your opinion on a matter. What if there is a woman who got married legally for 2yrs now and the husband is a US citizen and he filled for both his wife and her child. After coming into the US with her child they both got a 2yrs green card but then her husband took away her evey rights and she has being going through abuse and depression. She then decided to go at a family members house for a while but when she needs to go back home the husband refuses for to come back but she has no choice but to go back there because she has no where else to live. She is still learning about the country it's self, the way USA works and life. What is your take on her situation.?

I'd suggest that she look into the Violence Against Women Act.

Hi Carlos I watched all your 3 videos and enjoyed everyone of them. Plz here is our case, I met my wife here in my home country, Africa, and three years later we got married. She came to Africa and while she was young, so she stayed here for a very long time. We have been married now for over 3 years and all those years we lived in my country. She now returned back to USA a month ago to prepare petition for me so I join her in USA. Please what is your best advice on our case? How long does it take before I join her? Please share some knowledge with us. Thank you sir

I cannot say with certainty how long the process will take. In recent years, it seems all types of immigration petitions and applications have started to take longer from start to finish.

Thank you for the informative videos. We are a couple in a loving relationship both living in Dubai UAE and I will be traveling to Pakistan to meet his family and we will become engaged there with a celebration of the rings. I am from the US we both have good professional jobs here, but I will be returning to the US next summer. We will marry here in the UAE next year. Our question is can we fill out paperwork before we return to the US for spousal petition and green card , please advise us, as we don't want to live separately..

You can file the paperwork after you have married. Proof of marriage is required.

I don't practice in Texas, so I do not know what a Class A misdemeanor means in terms of immigration law. Since even misdemeanors can harm your chances, you should consult with a Texas lawyer to assess the impact of your specific conviction on seeking immigration relief.

One bad answer won't kill your application. Even a few miscues won't probably hurt your application. But an overall pattern of wrong or bad answers is a big problem. I don't see why you and your husband will not do well if you take the time to think about and prepare for your interview. Everyone has memory lapses. But preparation helps to lower the thing you may have forgotten because your spouse can help flag your recall.

I written in my green card form as single if I won I can add my kid because I fail to write and get a smartness photo of her because she study far away from the region I work,but is my biological kid can bring front his vivid certificate in KCC for approval of fill DS 260.visa form .

Hey I came to the United States on a work visa 4 years ago but I overstay and married to a US citizen a year ago. I’ve been using my social security and my state id to work but my work permit expired 3 years ago but my employer don’t know, so I continue to work. Me and my husband is looking forward to file for my green card will that affect the EAD card they going to send after i send in the paper work? Please answer

You have to admit the truth in your filing. When you file for a green card, if you're successful, you will get a new work permit.

Hi Carlos I'm legal married but sometimes I think my husband is just useing me for his green card .he always saying we want this right if things don't work out between us I will never forget what you have done for me. his always text his babymom that back home in Jamaica. like everything is going to soon be ok. I'm a born us citizen his from Jamaica. our interview is sometimes this month what should I really do? I really don't want to go because I feel like his just using me for his green card.

Honesty is always the best policy. You can go to the interview and explain your situation honestly. If you are still living together, tell the officer. If you are not, tell the officer. Answer all questions honestly. Beyond that, I cannot counsel you as I do not know enough. Take care. Best of luck, whatever you decide is sppropriate.

My spouse is 43 years older than I am. Despite the age difference we love each other, he's a U.S citizen and we are planning to get married. Is the age difference is going to be a problem?.

The age difference will be something the government takes a look at. But if your relationship is bona fide - that is, authentic and genuine - you should do well. Of course, there are various related factors, as the video and download share.
