Often times, these indicators are unknown to immigrants and their family members. It occurs most frequently when, following the filing of an I-130 petition for spouse, evidence is sparse.
These indicators, or factors, are not uncommon to many legitimate, authentic relationships. But without sufficient proof of bona fide marriage, government officers may think this is simply another one of many potential immigration marriage fraud cases they are called upon to investigate every year.
As a result, the factors discussed in this video are extremely important when it comes to preparing for marriage green card interviews. If not, then the couple runs the risk of having their answers perceived as perpetuating a sham marriage.

The fraud indicators which may spark deeper inquiry at a marriage immigration interview are:
(a) A short time frame between an immigrant's entry into the U.S. and marriage
(b) A short time frame between an immigrant's divorce and remarriage
(c) The timing of the filing of I-130 petition for an immigrant spouse
(d) Children during an immigrant spouse's marriage to a non-spouse
(e) An unusual number of children and large age discrepancy between the spouses
(f) Low employment of financial status of an I-130 petitioner
(g) Unusual cultural differences between the petitioner and immigrant

Oh, the other question we are pondering is fiancé K-1 vs our getting married in the Philippines and doing spousal visa. Previously I had read that K-1 is faster but more expensive however I read recently that spousal is now about the same time. The advantage of spousal is we would have our wedding in her home town in the Philippines. Thoughts?

I filed a K1 visa after signing a customary marriage certificate. In her home country, there are lots of tribes that do not consider a customary marriage as a full marriage but like an engagement just the same as here in the US. The petition was approved and I then read the certificate and it said words like "Marriage", "Husband", "Wife" and after a year of waiting, and while the K1 petition is still current, I may have to file the I-130. You think they will see that I have filed before and look at the previous petition and see that I may have filed the wrong one only to see that now I've filed the right one?

Multiple filings are not automatically bad. But I am not sure of your case details. You should speak to a local lawyer in your area.

Thank you, very informative. We have one of the flags: age difference. 22F Filapina & 60M (me) USA. I farm and she comes from a farming family too - both raising livestock and butchery. We are very committed to each other, have very similar backgrounds, both want the same lifestyle, family, kids. She has never been married no kids. I was married 30 years but divorced I in 2018, separated 2016. What are your thoughts?

Hi sir . I passed last week Citizensip. And they do deny my citizenship. Reason you application under res .? But when you came here before you marriage. . Than they do citizenship. She’s loved me more than her life .She would have committed suicide if I had not married. Sir what will I do now. Sir tell me what I will write now.

What if it's low unemployment or low wage pay and yearly salary of the sponsor (u.s. citizen) that makes less than say $20,000 a year and almost living paycheck to paycheck? Would her visa application get denied because I like many Americans during and post pandemic have been financially wiped out due to covid ongoing inflation and difficulty of employment? What is your advice on that?

Hi i just watched ur video of 7 points of immagration fraud im from canada i been in america for 24 years im married to an american citizen for 20 years im trying to become a citizen we filled out I130a and I130 forms but never filed them lack of expences both of us dont have very good jobs that pay alot i was laid off last year because of identification and pandemic i need help what should i do thank u

I don’t understand why it’s suspicious to marry someone you want while visiting. There no law against it. What is you get married in there country??? I have known several to given entry with spouse on way back home.

Lawyers recommend 90 days after marriage for filing. File 7 documents together with I 130. Lots of free info from lawyers on Tiktok now

Are you just using them because you first visa got denied? Immigrants need to stop playing with peoples hearts and emotions. I've had a few ask me if I would marry a relative and they would pay me. Heck no. I marry for love, not for a few measly dollars. People should be ashamed of themselves.

A real marriage should never be found fraudulent. This is why a legitimate couple needs to carefully prepare evidence or find someone who can help them do so.

From my own experience, it’d be better to have a couple visits back and forth and then marrying - committing so fast (even though in your heart you may feel absolutely sure) may raise alerts with USCIS.

@@BataraImmigrationLaw I'm pretty sure challenges do not block green card issuances in real marriages. Unless there are no prospect of appeal against an immigration officer's wrongful decision. I doubt the USA do not allow appeals.
