Toms is gated on Amazon and requires approval to sell. Amazon doesnt allow used shoes to be sold on their platform. Toms is in the right here.

Yup which means the used ones were listed as new and a big no no. Now somehow that seller got "ungated". how? did someone mess up? clear them without looking? Or did they lie to get ungated?

I agree. We can't sell Nikes, Adidas, and other shoe brands. How did AMZ let that get through? I'm always banned and have a takedown when I do it.

There should be a repository that we can check before we list an item to ensure we don't list anything that violates IP or something like that we are not aware of. I listed an item I got in Target clearance one time and had no idea I was not allowed until I got the threatening letter from their attorney to cease and desist the listing, brand, etc.

This is another reason why I take pics of all items I list on Amazon, include details, and never list anything as new. I only wish they would let us do more than 6 pics but I use all 6 for every item. Companies are out to get us as resellers any chance they get it seems.

I have approximately 20 different pairs of Toms in my closet right now. I've never had a problem buying (second-hand) or reselling their shoes, but they are 100% authentic and marked as used with flaws noted.

The fact that this is Amazon is the key point here. You can't sell preowned shoes on there, so one of three things happened. 1. He got ungated in Toms (not hard to do), but was selling preowned, fake, and/or dirty shoes as new 2. He wasn't ungated in Toms, but created his own listing and was selling preowned, fake, and/or dirty shoes as new 3. He wasn't ungated in Toms, but created his own listing in a different category to get around not being able to list as used and sold preowned, fake, and/or dirty shoes as preowned shoes in a different category For obvious reasons, I'm on the side of the resellers 95% of the time with situations like this unless they do something REALLY stupid and blatant, but Toms is in the right here and I hope they ruin this guy's business. He knew what he was doing.

I have been selling shoes all my life. This can be chalked up to Amazon and how they do things. They have a serious problem over there. It washes over the entire platform and hits every nook and cranny it can.

For someone selling on AMZ, eBay and Walmart do you know of any software to track inventory for all those platforms in one location other than excel spreadsheets? Getting difficult tracking average buy cost when listing the same item from multiple sources at different prices.

So he could have been doing E2A buying as “new”and sending these in through a prep center and never having even touched these shoes… also returns can play a factor.. that’s how I got my last inauthentic claim.. (someone returned an item but left an insert out of it) ie dirty shoes yet the Amazon worker says it’s good so they send it back into circulation 🤷🏼‍♂️ who knows.. but your business and you have to take 1000% responsibility for it

I'm pretty sure I've sold Tom's as well as similar shoes like Sanuk, in the past. However, they would have been clean, and if flawed, that flaw would have been pointed out. Is Tom's now one of those brands that we can only sell used?

@@RockstarFlipper I understood it the same way. I looked into this because I noticed a brick and mortar auction house selling Chanel jewelry as replicas or one of the many words used to define this. In my opinion, that’s where the confusion begins. In reading an auction schools lawyer blog, he defines each word used in this issue, knockoff, dupe, etc. stating that so long as the seller notifies purchaser item isn’t authentic, purchaser intends to buy for personal use it’s not illegal. I don’t agree with this at all. It just leads to individuals as you stated, selling dupes on whatnot thinking it’s okay. Maybe the law states that in fact it’s legal, but someone else who doesn’t fully grasp that dissection of the words and their definition unintentionally sells fakes thinking that saying they are makes it okay. I don’t believe in most cases it’s blatant callous for profit screw everyone else train of thought. I think it’s people misunderstanding the 10+/- words used to identify not authentic. I believe it should across the board be illegal. But then again you can just say it’s an artistic representation which is also okay to the degree even like those two sick sculpture artists that literally sell child porn as art and get away with it. It’s okay on eBay and Christie’s. It’s art. 😮
