"The Supreme Court on Friday overturned a 40-year-old precedent that has been a target of the right because it is seen as bolstering the power of “deep state” bureaucrats.
In a ruling involving a challenge to a fisheries regulation, the court consigned to history a 1984 ruling called Chevron v. Natural Resources Defense Council. That decision had said judges should defer to federal agencies in interpreting the law when the language of a statute is ambiguous, thereby giving regulatory flexibility to bureaucrats."*

This is typical republican behavior. Dismantling things without coming up with something better. If they are arguing that the agencies don’t have the power to enforce the laws congress made then maybe appoint a specific group of judges who job is to work with the agencies and experts to enforce them and interpret them. I think this is overkill because like Cenk said they are basically corporate police.

So, when you pass a rule and small companies the ones in this case or freelancers say that this new rule will crush them, are they just supposed to appeal to you and hope you see it their way? With Chevron out of the way, at least we now have a better chance of fighting back.

If your small business can't survive because of illegal practices or destroying something or taking advantage of things, then it sounds like it shouldn't be a business at all. Businesses act like resources and the environment are free or limitless when they are not.

@@techboss202 This case is about a new agency rule ordering fishing boats to hire contractors to monitor their fishing because the agency didn’t have enough employees. That is a new imposed cost of $700 a day. That could drive them out of business. So, yes, they fought it. New rule. As in did not exist until this agency made it up.

@@DrSabriBebawi Then, perhaps consider another perspective. Like that of the appellants. Both cases were on behalf of family run businesses; not billion dollar corporations. From their perspective, if courts are bound to defer to the expertise of the agency, what recourse do they have if the agency imposes a rule that could financially crush them. Isn't there something about laws and rules not being unduly burdensome?

The Constitution grants the Court no authority to overturn laws, an authority the Court claimed by its own fiat. The Founders did not intend the three branches to be coequal, but to vest greatest power in Congress, the branch most answerable to the People. Alexander Hamilton first tried to make the Presidency effectively a new monarchy. The Convention so mocked that proposal, that he left in a huff and did not return for several weeks. His next gambit was to try to vest supreme authority in the unelected Supreme Court. The Convention foiled that by giving Congress both the power of impeachment and considerable discretion to define the Court’s jurisdiction. When our elected legislators claim of a problem, “We can’t do anything, because the judiciary has tied our hands,” that’s passing the buck for inaction arising from their own preference for inaction. We, the People, have allowed plutocracy to seize by corruption the power that destroyed the ancient Roman republic.

The Founders recognized that it’s impractical for a few hundred souls to make every mundane decision, and so must be able to delegate those details of implementation. It is Congress that in the first place creates agencies, and can not only tighten the reins but disband them if so desired!

5:33 Great points Cenk! Another part of that is when an accident does happen where an employee dies and there was a regulation and/or policy, that family can get made whole. Without regulations, this will be much harder. There are many multiple cases where companies put production ahead of safety and employees get impaled by robot machines, pallets dropped on them, even trapped in ovens. WTF America?

Deregulation protects profits, regulation protects people. Norfolk Southern has paid close to 1 billion dollars "fixing" the damage they caused... instead of spending a couple of hundred million to bring their system up to regulatory standards. A government of the corporations, by the corporations, for the corporations have crushed the will of the people under the weight of lobbyists.

That is a violation of the Separation of Powers because it is the expressed duty and responsibility of Congress to create, empower, delegate Authority to, and regulate their actions through Legislation. Congress is clearly listed as Custodian of the Agencies which it creates through it's innate Power to create Law. The Judiciary is not named at all let alone as sole Arbiter on a Case by Case basis! The "conservative" members of the Court are attempting to assume Authority they were never given and never meant to have!

a lot of injuries are already covered in employee/union employment agreement years ago - I was a member of the machinists union and the injury payments were along the line of $1000 for loss of finger, $5000 for loss of thumb, $25000 for loss of hand - of course I am sure those values have been adjusted for inflation The reality is that the union and the company dont care about your injuries - sometimes your employment contract prohibits you from suing because there are often arbitration clauses in contracts - AND the company usually picks the arbitration lawyer

Folks, this does not give courts any extra power. Judges are supposed read and enforce the law as written. Send it back to congress and blame congress for writing intentionally vague laws.

Well, but "as written" is pretty pliable even if intentionally written as clear as possible. Because language. Judges are needed because someone has to interpret how it's correctly applied. And then you have conservative activist judges who just take that reality of language and twist it into a tool for themselves. For example by making up ridiculous definition like for example "spending money in politics is speaking" and therefore bribery is protected under the constitution, even if the 1st was clearly not intended to imply that.

Great Case. Requres Congress to do the work in making laws. Right now Congress passes a law and the executive branch defines it enforces it. Thus the party that controls the executive branch not Congress who made the law control the law

@@StinkCabbage .....So, it's obvious that regulatory law is not a real law. There are only 3 kinds of law that are constitutional. Those are civil, criminal, and admiralty. Regulatory/administrative is not. It never has been and if it isn't there, either in article 3, or in an amendment. It is as a matter of fact, NOT ENFORCEABLE, and any law enforcement or regulatory board who tries is in violation of the rights and subject to, at a minimum, civil penalties, even criminal penalties.

Companies don't make any laws except for their own charters. It is regulatory agencies who make endless new laws and rules for the rest of us, and that is where the problem lies, because they are bureaucratic agencies who accumulate more and more power in their rule making without being accountable to anyone. Congress needs to be able to reign them in with oversight because Congress is accountable to the voters and Congress also holds the purse strings which can defund them if they don't cooperate. This gives some of the law and rule making back to the people, even if only indirectly, since we can vote the members of Congress in or out if we don't like what's been decided. With regulatory agencies the people have no power at all, direct or indirect. It's a good judgment, but not in the way you seem to understand it.

Except this ruling literally introduced more checks and balances. - Currently the regulators (appointed by whatever administration is currently in charge) make closed-door decisions in which they 'fill-in the blanks' for vague laws created by congress. - This change provides a mechanism to contest the decisions of regulators in court and have the courts rule on whether the regulators have overstepped their authority. It brings transparency, accountability and oversight while also encouraging congress to be more specific in the laws they write.

We absolutely need a democratic administration to make a judicial oversight team and just clean house on these judges and completely restructure how they function. Besides Gaza, Biden’s biggest failure will have been his institutional refusal to stack the court, or anything else to reel them in.

Corporations? Really? That's your take? The appellants in these cases (Loper Bright/Relentless) are family run fishing companies. They were concerned that this made up rule would put them under? So, if courts are supposed to defer to the expertise of these agencies, what is the recourse for these small companies. USDOL recently made a rule constricting the definition of independent contractors. During the notice and comment period, hundreds of freelancers submitted testimony how this rule would put them under. Julie su disregarded that and passed the rule, anyway. So, what are we supposed to do? Just deal with it because USDOL is comprised of experts? No. Now, with Chevron out of the way, perhaps freelancers can file a class action suit challenging this stupid rule.

@@mojrimibnharb4584 Loper Bright Enterprises is a New Jersey-based family-owned herring fishing company operating in the waters of New England according to wiki. Just to be sure I did a Business Name Search at NJ Department of the Treasury Division of Revenue & Enterprise Services for the Name Loper Bright Enterprises and got a "No Results Found ." So it seems Loper Bright is indeed NOT a corporation, though it may be another form of limited liability company.

The issue is that the courts have no expertise in many of the business they will be regulating. That is a HUGE problem. Do you want your accountant handling your open heart surgery? Congress will NOT be involved.
