The Supreme Court has decided in favor of a small Oregon town that placed civil punishments on homeless people for sleeping in public spaces, finding 6-3 the punishments don't violate the Eighth Amendment. Former federal prosecutor Scott Fredericksen joined CBS News to discuss the ruling.

it just allows them to punish you. this will allow cities to force people who are creating entire camps and disrupting the public. it also allows them to move those camps somewhere else. i get the concerns and it sucks if you become homeless, but there’s some kind of limit that needs to be placed that allows cities in california to finally take a stand.

Exactly. Here's my idea. Instead of sending all this money overseas to Ukraine and the Middle East, instead use it to fix up vacant and abandoned houses in cities all across America, and offer them as places to live for homeless individuals and families, and also some as group homes for those with developmental and/or physical disabilities. Not only are you helping the homeless population, you're also creating jobs and improving neighborhoods.

Peoples Rights A person works 60 to 70 hours a week for generations . Takes risk opens a business or builds a building for commerce. He obeys all the laws and pays all the taxes. and does this for 40 or 50 years. Takes pride in his facility his business and his customers. Wakes up one day with 20 tents full of junkies shiting on the sidewalk in front of his business and effectively bankrupts him and his family.

We live in a country where it is lawful to arrest a person who has no money no home and no shelter for sleeping in public. Can you fathom how cruel this is? Imagine being on the streets and needing sleep but you are not allowed to because you fear going to jail or being fined. Humans need sleep it is a requirement for our survival. Banning sleeping is simply cruel unethincal and inhumane. It amounts to torture.

Why homeless set the camps in the business center of the city. Nobody saying they cannot set them, just place it whenever you dont impact other people freedom and demand for a clean and safe city.

It's actually unconstitutional. It's the 9th Amendment that affirms that. We reserve every natural right, inalienably. The whole purpose of government is to defend our rights and general well-being. This government basically says it has no such role; it will however support corporations and foreign militaries committing genocide. The Constitution has been ignored, which has been a trend longer than I think some people realize. People have given up too easily. This is becoming a worker's prison now.

If you break down the percentage of homelessness people that have a recent job loss compared to the mentally ill or drug addicts the former is small. They will be the ones that seek a shelter until they get back on their feet. The latter will not seek a shelter because drug use is forbidden

What's the point in fining people that don't have housing? Kicking people when they are down is wrong. Incarceration costs $50K a year. For that money, you could just pay rent for everyone homeless.

I have a full time job I get paid every two weeks 80 hours and I am homeless I don't have a drug problem nor am I an alcoholic after this decision ruling by the Supreme court I can be arrested for being homeless I now refuse to deposit my payroll in in my local bank and I am boycotting Nevada I will not spend a penny in this state as long as I'm homeless and am saving money

@@kjpcgaming9296 There are a lot of things that a person might have to pay for when homeless, especially if they are a low-wage worker. Car insurance, medicine, doctors visits, gasoline, childcare needs, food, temporary shelter, a gym membership (if they want to be able to shower), or even towards a debt they owe. Also, apartments usually require a deposit in order for someone to apply to housing. If someone has an eviction history due to being unable to meet ends (which is common for a lot of homeless people), then they might not be able to even access an apartment to begin with.

Im Less than one paycheck away. My rent got so high and I've been here a couple of years that I have to figure out if I eat food or pay rent😮 I'm very upset about this ruling. How many other Americans are in my shoes now??? I'm not a drug addict or do I drink

Statistically cheaper to help homeless than it costs to punish them with harsh state services, jail, emergency visits. Basic income works. It helped in every trial ever done. The quickest way to help people is to give them money. Let them decide for themselves. When stress is low, better decisions are made.

Sure they are, but public spaces are public spaces for all people, not just those who are homeless. The problem isn't going to solve itself, though, and we need to find ways to make housing affordable. In the meanwhile, make camping areas available.

You're absolutely right. The problem is not minimum wage. The problem is the cost of housing. Did you know that the #1 population of homeless people are SENIORS. Because social security retirement pays chicken scratch. But let me ask you something. If you were put in charge of lowering housing costs, what would you do?

The real problem is lack of affordable housing. Real estate is a scam for rich people to get richer. If there was affordable housing for everyone then a lot of rich people would lose a lot of money. That's why it's not happening. What if everyone had 5 houses as "investments"? There are not enough resources for that to be possible. That's why it's unethical to hoard real estate and to hoard limited resources to create artificial scarcity and artificially high prices.

I do not know if a single shelter that uses taxpayer money they're mostly funded by charitie. the ones I know I'm from Ohio. I'm not sure if any States from shelters but I know here they are run by places like Lutheran social services

Anyone who is supporting this ruling should go live out on the street for a week with no vehicle and no credit or debit card. They would shut their mouths extremely fast if they had to experience homelessness first-hand and did not have their mommies providing them everything for them.

TIMES ARE SO DIFFERENT & CHALLENGING TODAY, that I FEEL SO SAD & BAD for those trying to survive in 2024 America! I had opportunities, and TOOK ADVANTAGE and worked my way out of my sad/poor existence. TODAY, these young parent's don't have the advantages that I did, or they are just downright LAZY and don't want to do any better; but I can't believe this is for most of the Homeless! For we are WILLING TO WORK, TO WORK OURSELVES UP into BETTER SALARIES & A BETTER WAY OF LIFE!

@@dorabolick9275 Okay, I've had just about enough of your insults. You have no idea who I am, or what I've done. I'm a retired Corporate President and a Great Grandmother of 5. During my corporate years I started a bona fide 501(c)3 with 20 thousand of my own dollars to help the local schools. The joy I get in giving far outweighs my loss of revenue. Even last week, I drove up to a homeless encampment, started walking towards the blue-tarped shelters, as the mostly black men came out to see who was coming. I shouted out to them "Hey! What's that white lady doing here!?" They laughed. Then I went up to each one of them and handed them a $20 bill. That's the most fun anyone could have. Of course it wasn't enough. But maybe it will get them through one more day. Sure, people will say "They will just buy drugs with it!" Hey. It's none of our damn business what they do with it. It is our job to GIVE without stipulations.

This one is disturbing. We are breaking the social contract. Leave us alone and we will leave you alone. Now the homeless will be pushed to push back. Good luck to the police, who will eventually have to enforce these laws and increase interactions. Then you can flood the judicial system with repeat cases. For these people, they cannot even exist without breaking the law. They are breaking the social contract, expect some terrible interactions.

What I heard here is "communities" have the power to decide how to handle homeless people. Assuming that "communities" will actually provide some place(s) where they can move people to, and maybe some type of help to get them back on their feet (if they're able-bodied) or healthcare (if they're not), and not just criminalize them for being homeless and hanging where they are not wanted, then this may me a fair ruling. But the court seems to have left off any guidance, which mean some communities will not be fair in dealing with homelessness, and you can expect this will be in the courts again sooner, rather than later.

@@taanwallbanks9841 Communities did NOT have a clear mandate prior to this ruling. By communities, we mean the city government, not the people on the street. In New York, for example, police have come under scrutiny for attempts to move homeless out of the subway system; the MTA came under fire for removing benches that homeless used to sleep on with the specific intent of making it more difficult for them to sleep in the subway. So, the communities did not always have that power before SCOTUS’ current ruling that they do. Now we'll need to keep watch and see what cities across America who have issues with homelessness does with that.

@@taanwallbanks9841 You’re even misinterpreting what YOU’VE said, which was, “Communities already had the power to do everything you just said….” In your modified statement you’ve added, “…communities have always had the power to provide places for homeless people…”. What good is being able to provide places if you can’t force them to go there? Going further with the New York example, even when the city had places, shelters, for people to go, people would often refuse to go there, preferring the subway, the park’s, or the streets, and the city had been restricted from forcing them to go. So the new ruling does break new ground. My observation is that the ruling leaves a lot of room for implementation of unfair practices, which inevitably will form the basis for future court challenges. And homeless people, who have nothing and no way to defend themselves (except violence) will end up suffering the consequences till then.

@@Pulse992 the point is if there's adequate housing you wouldn't need to force them to go there. And this case wasn't about that. It was about if you could punish people for sleeping rough even when there isn't adequate shelter. That's the only thing this ruling changed.

Maybe they should stop coming to tiny southwest oregon towns hoping to get their drugs or if they're not on drugs food and housing. We don't have any housing. BTW min wage here in Grants pass is 20 dollars an hour. TWENTY that is WELL MORE than enough to rent an apartment in grants pass and pay bills and buy a car and and and. I'm sorry they chose to come to a small town. We have 150 homeless shelter beds in our town they are all empty.

There has to be something to do rather than arrest them. If their doing drugs, arrest them and have them get help. If they can afford a place, then they need to create more low income home for these people. Most of these people are military retirement.

Excuse me? You think they don't want to participate in a capitalist system is why they're homeless? Wow. But they expect people who do pay taxes - only homeowners, business owners - these are the people that pay these kinds of taxes - they expect tax payers to foot this bill for their life. I think you're mistaken. I think the homeless are made up of a mix of drug addicts, people who lost their homes because of the pandemic, people who refuse to accept help, and people that just want to be left alone (this last group is the group I think you're referring to)

Prayers for #HousingFirst because that is all that works for people who are in poverty. Min wage is too low and benefits are too low for poor people to afford housing. Allowing folks to sleep in the streets, where they are targeted by criminals and drug users, is not the answer either. At least this is a definitive answer.

I have mentioned several times. A encampment out side of city with housing,meals healthcare and maybe training for work. Maybe work on the grounds, maybe gardening ,cleanup, help in kitchen. give them a chance to mend. If anything a place to be without being illegal.

We have a lot of empty jail cells now since drugs have been decriminalized and in some cases legalized. Logical step? Lock them up in prison. 🤣 Gota keep those cells full, especially in the private prisons/jails, otherwise they lose revenue from taxpayers. I'm being sarcastic because our system has become more cruel recently and MORE homeless people are on the horizon.

​@@deadcarz4926Simple, set a profit margin that landlords are allowed to make. That way they aren't claiming "my expenses went up" to raise the rent when their expenses are actually the same. If they don't like the profit margins available to them, they can sell their property and start a real business.

The "expert" is full of shots. The ruling said the punishment is not "cruel and unusual" because it is common, i.e. the opposite of unusual.
