High conflict people are very good at convincing other people you are the problem. Especially when they’re doing things that get you emotionally worked up or if there’s a history of abuse.

Absolutely! And I have not met any judges smart enough to see that....unless you spoon feed the judge, and talk to them like they are 10 years old.

Agreed. My ex has pushed buttons, dog whistling, and been manipulative. He has been verbally, emotionally, abusive for years. I've been a frog in a boiling pot of water for a very long time. He is now doing this to our child. It is infuriating me to be basically railroaded into being a great, cooperative, coparent with someone who has been abusing and intimidating me.

You are SO RIGHT!! Thank you for the advice! I went into trial against my Ex for custody. She had an attorney. I had GOD and the truth! They fired so many shots at me. I was devastated and flustered. I didn't even know how to respond. I didn't throw any shots back. I focused on telling the judge about the positive things I was in the process of doing for my daughter. The judge ruled fairly and explained his decisions thoroughly. Some of it felt like a mixed bag, but at least we have some guidelines established to move forward. There is room for hope, again! I saw this video TWO days before our court hearing! Thank you all SO MUCH! God Bless!

Lol, I guess I got a bit chatty on that one! The judge ruled fairly. I didn't get everything I wanted, but at least we have established guidelines now. We needed that more than anything else. Hope that answers your question!@@fromnothingtosomething8102

What needs to be severely addressed is Parental Alienation. It should be criminalized. Parental Alienation is premeditated mental injury to a child.

All the mother does is say the kids don't want to on visitation anymore. Or the kids are sick, next month too. The father has no chance of being in his child's life. The court don't care. All they care about is if the man is paying child support.

As a father I think it's important to understand this also happens to women. My wife is currently dealing with alienation.the father convinced the child to rebel and escalate conflict. Bio dad then Took restraining order preventing us from involving the police to address the issues. Finally, to avoid consequences,the child lied about abuse and we are both now fighting false allegations and criminal charges. He alienated the poor kid so completely against his mother he refuses all communication and is filled with anger and hatred towards her. The goal is to gain sole custody so he never has to listen to his "stupid lib" mother ever again

This happens in reverse as well. I was being a cooperative yet protective parent of my kids. Dad went to court for full custody with lies and denial of his transgressions. He won and now I have not seen or spoke to my 3 & 6 year old in two weeks. He is doing everything he wrongfully accused me of. It is traumatic for my children most importantly.

I can see why many lawyers are sociopaths. Laughing about another parent destroying the kids lives isn’t funny. Family court is like hell. Fight for your kids. The courts are not fair, fight.

I record everything. I'm in a public place. I have court on April 9th 2024. I got her ass. She is lucky I'm not a dick or I would do what she wouldn't for one second hesitant to do to me, get full custody. My children need both their mom and dad. And I would never remove their mom from their lives unless it was something absolutely extreme.

Yes, keep a record. No, don't use that record unless asked or the other party directly contradicts the record under oath and then only reveal the conflicting information.

The laughing is very off putting. This is very painful and I’d bet a lot of the people coming here for help are dealing with narcissistic partners, PTSD and abuse.

Thanks for your feedback. We’ve both been through it and understand how very painful it is. It’s a heavy subject, which we are in all day every day. So, we try to find the humor when possible. As they say, if you don’t laugh, you’ll cry. We are in no way trying to be disrespectful of the situation.

I agree....trying to prove abuse for example...and no one is listening Child begs not to go back and says disturbing ways they are mistreated........parent is a narrsissist and gets enjoyment out of so many elements of the situation...Definitely not funny.

I like the idea to build your case by point how you're a benefit to your child, how you care for the child's well being and not try to tear the other parent apart. This is a more peaceful route instead of the usual attack route. Before this video, I'm worrying about what my ex partner will use against me to tear me down and I have to figure out how to defend myself in that situation. I'm more of the peaceful, problem solve person, I can't stand fighting, especially when I was a kid, seeing my parents fight wasn't really a great sight to see. I knew once my child was born, I didn't want the same thing and made a lot of growth to where I am. I hope there's common ground in the parent confrontation room.

Makes sense. I think that with the high probability of bias against dads in court, you have to highlight the mother's major weaknesses as a parent, if any, instead of Sweeping them under the rug. But it can't be petty stuff. It has to be real things that matter, like her violence, anger mgmt issues, her keeping the kids away from dad for no reason, her lying in court, real cases of child neglect, etc.

It's obvious that you both understand the depth of this situation and are passionate about helping people in these situations. Your laughter isn't offensive to me It's proof you're human, you understand, and have experience. I'm sure you've seen all kinds of foolish things happen in attempts to get favorable results. These situations are extremely difficult and painful to work through. My focus is on advice on how to ensure I am equipped for handling things legally. I'm nervous but my child deserves love, safety, and peace. So thank you for the honest tips from the legal perspective.

I’m going to be respresenting myself in my up and coming court case. She has alienated me from my son who is 6 years of age. For the past 6 years she had blocked me from all ways of communication on and off, sometimes leading me to believe we will be on good terms and work things out, but the truth was she is very emotionally unstable and unpredictable, one month I’m seeing my son the next month I’m blocked again and being told I’ll never see him again. It’s effected me in many ways. I appreciate this video because now I’m motivated and ready to do what it takes to win my case over to joint custody.

Dealing with the same thing, went to court for preliminary 2 weeks ago, she has failed to abide by any order from the court thus far. This has gone on for four years. My biggest advice, do parenting courses voluntarily, keep a record of drug tests, keep records of all communication. Make yourself look like a saint, the judge will see what you’re doing and want you to be a part of your child’s life.

Offer to use Mediation with her. #1 first step if you haven't offered and tried. Offer to use Our Family Wizard for communications. These steps look HUGE at family court. Legal steps you've taken in your efforts that are easily documented. OFW helps document and save everything. You'll need it. Get an attorney immediately. You'll want help. See if you can put the cost on her for being alienating. Good Luck!

My sons mother always leaves my son with me for weeks to go spend time with her boyfriend, few month's ago i kept him for a whole month, so 2 weeks ago she asked me to keep him 3 weeks again this time i said no, she threw a fit and threatened to take my son away from me mind you she has custody of my son, so today i got served with a restraining order that got denied because she said i was verbally abusing her 🙄 she is a crazy bi polar narcissist, i am the calm one, well next week we have our first court hearing and idk what to expect all i know is shell lose her shit and start goimg crazy so hopefully i can get custody of my son and get him away from that psycho lol

I know how you feel. My ex blindsided me. I wasn't aware he was even planning on leaving. He didn't pay the bills, left me with nothing the three kids and moved in with someone else. Then reported me for child neglect for the utilities being off. But they were in his name so I couldn't do anything. Took me a while to get 50/50. But I got there. People can be absolutely ruthless with children.

I think a lot of parents have been told that they had to PROVE that they had to "try to communicate" so I think that's why they try to document instances on TalkingParents.

I had a similar experience when my daughter was young with a family member who was abusive to me when I was a kid 😔 She was eventually returned to me but it was devastating & the court & cps were horrible to me they didn't care about the truth! 🤔🤨 I pray your children are returned to you in the near future! My case is unique as I'm not the biological father but raised twin boys from 1-7...even had them 70% of the time for 2 years after we separated. It's very hard to not want to build your case on how manipulative, abusive and mentally ill your ex is but I keep hearing focusing on how great of a parent you are is the correct path forward. Hardest time in my life without question. July 18th I stand in front of a commissioner to see if my case gets the green light. My poor babies would cry when it was time to go to moms. :( I swore I would always be there to protect them. I feel like I'm letting them down

When you gave that tip to win i just instantly felt so much better. Because you showed me my intentions are true. Because i have been an i am already doing exactly that. And i didnt even know it. It makes me so happy to know i just gotta keep doing what im doing and be patient and try not to let the process scare me. At the moment i am self representing myself as i cant afford an attorney and my legail aid here has yet to approve me. So for right now im alone. And i dont know if i will ever be able to get someone representing me. Please wish me luck

I love it when they act as if its equal, like dads are being the jerk and not letting the mom see the kids or refusing to co-parent or making false allegation in an attempt to gain full custody with no visitation, brainwashing the kids, (parental alienation), against their mom, as much as moms do. Its not even close. Probably 80-20 at best

I guess my question is why do you say you only have 2 choices in the 10-15 minutes you get to present your case? Why can't I tear them down a little and build myself up. My goal is not to tear her down but to point out the truth and show that she is unfit to have a large part in our childs life

How can I present my case when the father is using financial hardships as ammo in the case? Saying not having a car and having a medical condition makes me a bad mother, how can I stay neutral and stand child focused with his main tactics are a personal attack against me? In today’s day and age were mental health seems to be an “excuse“ for bad behavior, how are the courts, lawyers and family services mediators taking that into consideration and educating themselves against parent who are narcissistic, traumatizing their children and or the other parent, and mental illness, such as Paranoid schizophrenia, for example?

Yes it has a lot to do with male and female. 10-15 % of the males are sneaky and 40-60 % of the females. Females plan divorce and file 90 % of the time.

I think you definitely have to prove that you are the parent that is more fit to meet the best interests of the child. But when you are facing a gender biased judge, that may not be enough if you are the father. So you have to present a complete strategy and highlight the shortcomings of the mother. But these shortcomings should not be Petty complaints about nonsense. You have to highlight real issues that negatively impact the child's development.

In my case 4 plus yrs high conflict the other party were the victims of conjugal violence. It's been extremely difficult I've been told I have to co parent with someone that is causing further abuse towards myself and our child I've changed my number 3 times and blocked him I won't give out my number It's a matter of safety for me I have no direct contact he had a restraining order stalking harassing behavior threatening myself and our children long story in the beginning. There's been a lot of bullying and intimidation tactics scare tactics to take away custody if I don't sign an unreasonable agreement which nothing will be signed or agreed apon late drop offs child support unpaid 4 yrs only just started paying below the minimum. The payments are extremely late 3 weeks late long story a lot of games and its been extremely difficult to take being the alienated parent the target parent and not putting the kids in the middle when they hear his side and I won't say a word I'm not allowed. I'm heart broken 💔 for the kids because he can't and won't do what's best just to have control and conflict because I'm a villain to play the victim it won't go well. I know I'm going to a hearing theres no other choice.

Women get 90 % of all child custody. Judges believe men go to work ( they can work construction and make good money and women cant). Women get the children and nurse them. Men cannot do that. The cases where men get them are when the mother doesn't want them. ( very rare) My attorney told me the only way I can get the children is if I have pictures of her having sex in front of the children. In others words, the man won't win. Go ahead and try guys, or keep what little money you have left after divorce. Remember, you owe $250,000 in child support.

@George sontag, that's horrible! I'm not sure what state you are in but in California the trend is toward joint custody. Sometimes, Mom succeed in getting more parenting time in the beginning of the case but most of the time the parties eventually end up with some form of joint custody unless there are what we call "red flag issues".

You guys are a godsend! I was primary caretaker and provider for my son and then dad got an inheritance and got a lawyer to pester me and I signed more custody for me than him, though never practiced until I filled for child support. I’m scared as he has money and a lawyer and I don’t, but I have been in my sons life forever and have never left him. I am financially okay, but not rich. Will a judge see the unfairness. He took our son away from his primary caregiver of 5 days to 3 days just because he wanted despite being absent almost 7 years. I’m representing myself because I cannot afford a lawyer. Any tips? @Regina Villalobos, the Court isn't really judging based on what is fair or unfair. All things being equal, they want the child to have time with both parents. I don't know how old your son is but it sounds like you have been the primary parent. So, I would focus on telling the Court about your bond with your son, not on bashing Dad. What about when you're a D.V. survivor from a small southern town and his family members are members of local law enforcement and even a clerk of superior court? I can't get the case transferred I've tried twice. I was told by the judge that my fear and paranoia are "unfounded". Even though the abuser was arrested for the abuse and its well documented through medical records. I'm being railroaded. I can't even get the judge to view my documentation. I'm at a loss and losing hope.

Im going through a divorce and child custody case. Waiting to find out when the hearing will be. I have a job apartment and a vehicle. My husband quit his job he lives with his alcoholic parents that drink and drive.his dad has a bedroom his mom has a bedroom and my husband has a room. We have two daughters. They need their own rooms. My husband has a drug addiction. He didn't pay rent and he didn't pay his truck payment. I pay all our bills without his help and a battery on officer charge

What if family members in the other party made things up such as you were suicidal to try to sue police because they have issues with police and none of this was true but when a judgment was made, they had you on medication for things that were 20 years ago and you can prove that? Then they use the excuse that the judge did things, five years ago, and blah blah blah, and this one’s busy, and that one’s busy everyone’s busy, but if that doesn’t work, they act like I don’t know the definition of words. Because he was given sole legal custody, and I know what that means, but I also know that they wrote my mom left behind two children and she doesn’t have two other children, it’s all written in a court order but they’re stopping it by going on to the next topic and saying I can’t go back on the past then how do you solve it?

What about one of the spouses wanting to move to the States from overseas after she gets her divorce and gets custody of her kids. But her ex wont let her move abroad with the kids. Even tho he is not there for the kids hes only there to use the kids as a shield. And have control on his ex wife. What can she do especially knowing her kids would live a better life moving to the US because her ex is abusive and has threaten her plenty of times?

If the parents were not married and we’re not together how does the courts decide on custody of a 2 year old that has been with the mother full time since birth and she allows the father to visit for 2 hours on the weekends (he didn’t want more time than that till now cause he lives an hour and a half away. Now since he is turning 2 he said he wants him overnight every other weekend. Will the courts agree to that when the baby is still nursing and depends on mom completely. The dad has canceled a lot of his Sundays for different reasons. Child barely knows him.

Dee, the Courts will try to create a gradual plan that would eventually allow Dad to have overnights but they aren't likely to jump from 2 hour visits straight to overnight. They would likely start by increasing the length of the daytime visits with the goal of gradually doing overnights.

@Dee Wells, rules maybe different in different states because I’m in Delaware going through the same exact thing, full time mom of a two year old and the father sees him once a week, no child support was ever given. During mediation, I stated my concerns with the father having a rodent issue and using RAT POISON to solve his issues and not to mention he has never had my child overnight, however the mediator issued him 4days during the week plus every single weekend leaving me to only see my son 3days a week. I am now looking for a lawyer that I can afford

Always frame your issues in the context of “concerns” for the child’s health, safety, etc. and not “Dad does this” or “Dad’s house has this problem”. It just changes their perception of your motivation for bringing up the problem. We hope you’re able to find affordable help in Delaware!

@@divorceuniversityonline So if I understand you correctly the courts don’t really want to hear about anything bad that the father is doing or has done. This man pretended to be British and from England for the entire time my daughter dated him along with being married. If his lips are moving he’s lying. Right now his Sunday 2 hour visits are always in the presence of my daughter (she doesn’t trust him alone with the baby) and have always been close to our home cause the baby can’t handle long drives. His family has also been a part of a lot of those visits but are now wanting him to drive the 3 hour round trip to their house. How can you build trust with man that lied about so much? Would the courts insist she drive there or would they take into consideration that the baby gets car sick and screams on long car rides? It to mention if she has to leave him for any length of time he cries the whole time. I think the courts should always consider what’s best for the child and where he is in this stage of his life. No one has been denied visits and it shouldn’t be about the fact that the grandparents want him to see their sons house etc. if it’s going to cause trauma to the child then it isn’t in his best interest. What do you think?

@@deewells8173 I agree, the grandparents probably aren’t going to be a huge priority for the Court. I’m not saying they don’t care about the issues with Dad, I’m saying, you have to be careful how that is presented. If they get the sense that this is “all about how horrible Dad is”, that won’t be as credible as something like, “I’m concerned because the child gets carsick on extended drives”. There is a bit of art to the presentation. It may also be helpful to listen to our recent podcast on Best Interest of the Child. What if I have borderline personality disorder, and I've been admitted 5 times in the past. I currently do not get treatment, but I am completely fine and don't need treatment. My primary care doctor has even stated in an appointment that my mental health is great and I should not be on medicine.

I have 70/30 custody... The decree is ambiguous on overnight stays so the mother will not allow overnights... I have 14 days vacation and overnights are permitted.... what can i expect in court or mediation.. she refuses to come to common ground and defaults to the divorce decree... it is ambiguous but also does not state overnights are not allowed... my attorneys really screwed me on the part of the divorce.. what can i do

I don't understand why this would be effective. It sounds entirely illogical. I'm supposed to focus on the fact that I went camping while my son's teeth are orange? That makes no sense. By law she has to let you see the kids if court ordered to pay child support unless you were court ordered not to see the kids . Not to mention you can get child support stopped and it is actually a criminal offense to do that to the other parent...

@Tiara Williams, These strategies can help in most situations but contempt is more complicated. You would need to file in the Court where your orders are regarding Mom withholding the kids. If you have court-ordered parenting time, then she isn't allowed to withhold them. You can also take your orders (if they are specific enough) and ask the local police if they will help enforce them. Some will, some won't but it's worth a shot if you haven't seen your kids in 7 months.

@@divorceuniversityonline we ended up filing for contempt but the judge couldn’t find her at contempt because the parenting plan wasn’t specific but the judge did order her to release the kids to us immediately she lives in Oklahoma and the custody agreement was issued in Washington but shortly after we went to court for contempt me and my husband moved to Texas so a week after we arrived in Texas he drove to Oklahoma and got the cops involved to attempt to get his kids back and after showing the cops the orders the cops told him they can’t force her to give the kids back even with the order because they don’t know who has jurisdiction and Oklahoma is a mother state so as expected she refuse to give them back so now it’s been like 2 weeks and now we have to file for petition to register the decree and parenting plan as a foreign judgement under Oklahoma law then have to file for a habeas corpus proceeding but the problem is we been doing this whole situation without a lawyer and luckily everything been falling in our favorite but we are having a problem with her following the custody agreement and she’s not doing anything to fight us back in court which is why everything been a better out come on our end but she’s basically running with the kids and getting lucky with not getting in serious trouble but it’s just a matter of time me and my husband just have to keep doing our part and everything should work out

I have very serious doubts about the first time I hired *usespy online* to help get electronic evidence. I am experienced in law enforcement, my family is a law enforcement family, and I have access to the Internet just like anybody else does. Conspiracy to cheat is a very serious deal beaker, and there's no way I could see any attorney that actually claims to be on your side saying it's inadmissible, or this is not something actionable.
