@@HoolyDooly-si2zz The most egregious behaviors are from the "street takeover crowd". You will never find a traceable tag placed on any of those bikes. So, now we are back to the law-abiding majority. I have seen that crowd in action in Washington D.C. They were riding all kinds of non-street legal vehicles, doing wheelies, blocking intersections, etc. None had a tag, as they were mostly off-road quads and motorcycles in that case.

@@Trillville43 Just seen reviews of the videos of people on electric unicycles doing 50mph plus. Like dude you really will get yourself killed and maybe even fined for video evidence of you breaking the speed limit and some in law enforcement saying your doing street racing. Yes there have been cases where someone got in trouble posting a KZfaq vid of them street racing in a car a few years ago and when the wrong people saw it they actually got in huge trouble for it. Also there is a question to be asked as to why do we need E Bikes and scooters and Electric Unicycles to be going these speeds? That will get you in trouble in terms of basically well it drives as fast as a car now so it needs to be registered and insured. People are so dumb in 2024 it's sickening.

@@Trillville43 Exactly, if you want the speed of a motorcycle go pay for the license!! but remember it's not all do-it-yourselfers making the fast bikes, it's some manufacturers as well!! But still, it is ultimately the rider controlling the bike.

Literally they are petitioning for control over them. I say this because I’m a motorcycle rider and have been since I was a child. It’s the careless drivers killing people not the bikes. I’ve been riding street for a few years now and have had 3 separate incidents where I would have been seriously injured by a driver had I not reacted. They aren’t kidding when they say ride like you are invisible when on 2 wheels, same goes for these e bikes. People will literally almost run you over, you honk, and they still never even see you there. There’s no accountability for the drivers of 4 wheeled vehicles and it’s taken out on bikes or motorcycles. Do Not! Vote for anything they are claiming is to protect you on your e-bike. It’s just so they can implement further regulation of them. Don’t fall for the trap.

This was coming. I'm not fully for this at all. HOWEVER, I've been on rides, I've been in cities and I've seen firsthand, in Houston14 year olds doing 40 on a sidewalk, in Austin, watching people race each other on a hiking trial where countless people are walking. I've been on group rides where traffic is stopped like a funeral or parade. If we all are going to have the discussion, then we have to be honest.

LEOs are tasked to target revenue enforcement. They will find cause, any cause to write a ticket and collect a fine. Don’t come to a complete stop by putting a foot down and they will have cause. LEOs with a conscience have already found another profession because the judicial system is non-existent. Assume LEOs are NOT YOUR FRIEND, NOT YOUR GUARDIAN AND NOT IN YOUR BEST INTEREST.

HUH? Ever heard of vehicular manslaughter??? That is accountability and you're going sit there and just lie..wow...Of course there are bad apples in all walks of life yet we need rules and regulations, because human have PROVEN to be unable to police themselves. Frequently more and more say insane stuff like 'my truth' and act upon it. So people want to give anecdotal accounts like ' I have been riding for 4,553,786 years and never hit nobody, as if that speaks for the whole. No it is documented that this is out of control, and IF MOST ebikers would follow safety protocols already in place, there would be no need for further regulation. That is exactly why we have traffic signals, and speed limits because without them, the death tools become insane...

If they're going to limit the speed of my scooter then why don't they limit the speed of cars? The highest speed limits in the United States are 80 MPH which are in Texas and Utah. So, why do they allow cars on the road that can go over 200 MPH?

@lionelhowell4972 That's one of the sad parts. Those paths and lanes are broken up and essentially go nowhere. Unlike many places in Europe and Asia, where the bike paths and lanes are consistent and can be considered viable and reliable means of transportation, our bike infrastructure tends to be more for recreation. That's why I bought a scooter that can keep up with traffic on most streets.

Cars go through millions of dollars and thousands of hours of research and development. Safety standards are implemented to determine they are safe enough to use on public streets . Government standards.. Insurance standards.. consumer safety protections. Car owners are legally responsible by hundreds of laws. Subject to thousands of dollars in fines. All the vehicle parts manufacturing is subject to strict regulation and laws. People with cars are covered by insurance for all damages and medical costs are covered to high dollar amounts.. E Bikes have 0 of these except how fast you can go and how much power they have.

@kevinnashskitchen3517 Yet, in spite of everything you mentioned, people still feel entitled to drive as fast as they want while texting on their phones and doing everything else but driving the car. Is it any wonder why the traffic fatality rate is through the roof in this country? As an OTR truck driver, I see these wrecks almost every day, and whether they have insurance or not, it still scares the life out of me. These machines are big, heavy, and destructive. Our streets and roads are not race tracks, and these cars are not race cars, and these drivers- in spite of what they think - are not race car drivers. This is not a competition out here. If people want to drive as fast as they want, they should go to the local race track and do it there where everyone understands the risks involved and everyone and their cars are adequately prepared for the eminent dangers of driving fast.

The power tester would arguably be a 4th and 5th Amendment violation much like how you are not required to comply with cops' orders to lower your window for a tint tester. In this case, the 5th applies because you have the right not to offer up incriminating evidence against yourself. The burden is on the cops to come up with the evidence against you. If they take the bike by force to perform the test, it becomes a violation of the 4th. Don't let them trample over your rights.

Yeah, sounds good in theory. But courts always make 4th Amendment exceptions in the name of public safety. The record is chock full of them with regards to 4th Amendment right exceptions for vehicles. Courts will rule that there is no expectation of privacy about the power specifications of a commercially available vehicle and the test is neither intrusive, destructive or onerous enough to constitute a 4th Amendment violation. And, let's not even discuss all the many opportunities cops have for claiming "reasonable suspicion" that your bike is overpowered, thereby negating any 4th Amendment claims. Ultimately, HP tests would occupy the legal space now used for roadside sobriety and piss tests, which also violated the 5th until the courts decided that the punishment for refusing one was all administrative law, not real law, so they didn't. Not saying I agree. Just predicting the rationale that will be used to allow these tests based on 50 years of astute observation of our increasingly authoritarian Supreme and federal court rulings.

If a cop approaches you on the beach and demands you hand him your cup for him to check for alcohol, is that a 4th and 5th violation? Of course. Can they do it anyway? Of course. It happens a million times a day. Will you go to jail if you refuse to offer up this incriminating evidence against yourself? Yes, more than likely. All that any state or municipality has to do to sidestep 4th and 5th issues is to create an administrative rule with administrative penalties, mandatory education courses, driver ed, fines and fees instead of jail time. Then, nothing they do can be a violation of your constitutional rights because they aren't subjecting you to criminal sanctions, but rather "administrative penalties". They can do this, and so much more of course, under the umbrella of "Driving is a privilege, not a right and, if you aren't walking, you're driving." Your rights are as secure as some black-robed, Christo-fascist control freak put on the bench by a couple of extremist authoritarian think tanks and a wannabe dictator says they are.

You are right about putting this money towards infrastructure VS wasting it on these bills. Federal, state, and local laws can be completely different. You can be totally legal on one side of the street and when you cross into the next town, you’re a criminal on wheels because the law changed yesterday.

Here is my problem with this, what I build myself should not fall under blanket laws meant to protect Corporate America. Corporate America does not want competition from small companies and wants total control. Those in government have no idea or knowledge of what we are doing and should not be the final word on this. I am a large person, I am built like a Football lineman. I am 6 foot tall and weigh 320 lbs. I am of Swedish descent, we are not small people. Think Samoan people but from the far North. A 500 watt or even 750 watt E bike is useless to me. I have a disability and am building my own E bike to help me. I was in the Military and was injured in Desert storm. My left foot had all of the bones in it crushed, and my right knee was torn and dislocated. I spent years rehabilitating my self on a stationary bike and improved my walking. I can't run or jog. I have a heavy framed mountain bike that I started riding on flat trails and paths. When it comes to hills and the pressure on my knee , I just can't do it very long or sometimes at all. With the advent of E bike technology, I saw a ray of hope. I tried current commercial e-bike technology and it just isn't enough with the limitations placed on them. I decided to build my own. Because of my size and the weight of the bike I have to ride the bare minimum wattage to work needs to be around 2000 watts on a direct drive rear hub motor. Direct drive hub motors work the best for my situation. They are smoother, quieter and the power or torque comes on in a more gradual way and my pedaling cadence is not always smooth or consistent. In the hills I need to get up speed on a downhill to try and not slow down too much on an uphill. To be safe as a biker you need to kind of keep up with traffic flow in town on city streets to remain relatively safe. I need to be able to throttle up max power from a stop or on a hill to be able to move out from an intersection or at a crosswalk. I need to be able to customize the extra torque to assist me. Sometimes I just can't get back to my point of origin without straight throttle or non pedal assist because my knee just can't go anymore or I just can't physically get up and over a hill pedaling or walking. I need a system that can change with my needs and situations. Many times I am out away from town on a highway or county road and I need to go faster than 25 mph on the shoulder. It is dangerous to be traveling at 5 miles an hour up a hill on a highway with traffic when cars are going 65 miles an hour 2 or 3 feet from you. Reaction time for drivers next to you is less if they need to move over. Government should not be getting involved with electric bikes. Electric motorcycles running on streets at 65 or 70 miles an hour is different. Not everyone 1 is 140 pounds and 5 foot tall.

Under the Constitutional Due Process Right of the 14th Amendment we don't need to get a drivers license for anything regardless of whether its electric bike,moped, motorcycle,car,etc., As long as we're not carrying passengers of property for profit.See 18 U.S.C. 31(6)(10) and the US supreme Court's decision in Packard v.Banton,44 Sct.259(1923)

@@Justslothin My point was that CA is not like other places where a vehicle inspection is required for vehicle registration. I haven't seen a roadside inspection station in decades in SoCal. You might be talking about big rig trucks.

@@isaiahwelch8066 And that's is exactly how it seems to be. In Japan it's the complete opposite. You don't see old crappy cars there. It keeps their auto industry afloat. But, a very nice kei car is less than $15k, a third of the average cost of a vehicle in the US. Cheers!

Yea I'm in Palm Coast. A good 15 ft off the road on the sidewalk that is already 5 feet wide, hell its literally a tarmac at certain sections.

​@@nathanphillips6423 I'm Dutch now living in the UK. I've ridden many miles on my pedal bicycle on 60 mile roads because there's just no cycling infrastructure. That's the choice I make IF I insist on riding my bike here. You don't have to use your bicycle, if there's no suitable infrastructure or you don't feel safe with the infrastructure, don't cycle

"stop driving cars! They pollute too much, we'll be taxing them more!". Ok I'll switch to an ebike. "How dare you find another form of transportation!" The furthest regulation id agree with is a boating license type deal. Multiple choice test, ok you're good for life, have fun. The whole test would just be to remind people to wear a helmet and act like everyone is trying to kill you. As for the batteries, require them to be certified. Cant imagine how repairing batteries could be so evil. Bad practices aside. Absolutely insane to make building batteries illegal. You can do a way better job than some random chinese company will do.

I'm over 50 y/o, about 300 lbs. I test rode a 750w and 1000w ebike uphill, and it doesn't have enough power to carry my big butt uphill. I test rode a 2000w ebike and it was able to carry me uphill at 11 mph. I hope they consider my weight when they test my ebike. I'm trying to ditch my suv and get into an ebike, for my health and my wallet. It is getting ridiculous to drive in Los Angeles with the high gas prices, insurance, and maintenance. They try to force us all into an EV, but I can't afford an EV because it is really expensive, now they are trying to stop us from getting an ebike. I am really getting fed up with the government incompetence.

Because you are test riding Hub drive e-bikes.. you need to get a mid drive motor bike so it can take advantage of the gearing. A 500w EMTB can carry me and all my gear 220 lbs and tow my daughter up very steep hills with her normal bike (about 150lbs)

I live in New York City and the people here driving their cars have no respect towards other drivers let alone people riding bikes. January 30, 2023 I was hit by a car while riding my bike by a lady driving a 4,000lbs SUV. I survived but only after spending over 3 months in the Hospital/Rehabilitation learning to do everything all over again. Instead of harassing people on bikes why don't they start by going after these reckless drivers not paying attention to the road.

I have a heart problem where I can’t ride a regular pedal bike except on flat terrain at slow speeds. In a 1 car family the bike is quite often my only way to get around. I see other people with physical challenges on electric wheelchairs and they are not bothered at all I think if you can show that you have a valid reason to drive a bike . There are trails where I live that are posted no electric bicycles but on an adjacent walking path you see motorized wheelchairs all the time why are physically challenged bikers being treated unfairly

I’ve been riding bikes as soon as I could walk and ride almost every to work. Denver has pretty decent bike lanes and paths and even that didn’t save me from someone hitting me “in the bike lane”! There’s people behind the wheel that don’t pay attention. But rather than making it safer for people with protected bike lanes they rather put bans and make money for a small percent of people making issue

I don't think fires are an issue as long as owners use standard equipment from the manufacturer, don't modify their bikes or batteries for more speed, and common sense. I'm not worried about my ANZA 750S erupting like a Volcano. I'm not surprised politicians want laws, and licencing for E-Bikes. They will target class-3 bikes like the ANZA 750S first to see what they can get away with.

They clearly do not want us to have a cheaper mode of transportation because they are losing too much money as people begin to switch to the electric bikes full term it is a loss of money not only for the companies but for the government as well which is why they're trying to enforce insurance and license at least I'm glad I live in a rural state where they don't really care

The few times I've been on the road before the winter with my bike I was ran off the road by drivers in their big trucks almost every time I was on the road it's clearly the drivers in vehicles most of the time that is causing these accidents I was even yelled at saying I wasn't allowed to be on the road it's for cars only while I was right beside of a road sign that says share the road with bicycles

Powerful lithium is located in NJ so not subject to NYC juristication. And Your exactly right brother... Kids under 12 shouldn't on them. But any legislation will deter thousands. I really hope they did the right thing in the crack down. There's alot of places that build proper safe battery packs with fuses and lithium Iron Phosphate batteries like Powerful lithium. not the cheap Lithium-Ion type. Im glad they are finally cracking down on the cheap lithium batteries.

If it gets to the point in PA then I'm going to continue w/ my crazy 72v 20kw Electro and Co kit for my Razor MX650 w/ headlight, taillights and turn signals so I can get it registered as a "small displacement" aka 50cc moped category in the DMV so I can ride it around on the street without having to worry about it being illegal.... This is starting to get ridiculous. SMH Edit:This is also a great way to teach kids how to "drive" on the streets and could teach them road rules and stuff before being drivers/Bike riders.... Not a bad idea but it'll definitely be done badly. Edit 2: If it gets to a "Speed Limit" in PA then I'm gonna be running away from the police because I'm not losing my bike because of stupid rules they don't even understand.... *Uncertified* doesn't always mean it's dangerous, it could be a home-built battery designed without a BMS because it's intended for someones personal high-power scooter/bike. I've seen my fair share of Uncertified batteries on KZfaq that are better than certified ones and I'd probably buy one of them before I bought a "certified" one from China... SMH

In Europe the laws are 250 watt max and 36 volt battery. Max speed 15.5 mph. Anything over that is classed as a moped or motorbike and can't use bike lanes and must be insured etc. Must be at least 14 years old. The rating must be displayed on the equipment. In the USA the laws have allowed for much more powerful motors hence the current debate.

What about e-bikes that can "shift" between power classes? I keep mine in class 2 mode to stay lawful but have the option to switch from 1-3 class with a full tilt option. So if I'm just coasting along (in the proper class) and then get stopped by an officer, do I get ticketed just because I have the option to go faster? If that's the case maybe others with cars should be getting fined for having a Tesla (or the like) for having the ungodly amount of power they have... seeing also the amount of electric cars batteries that have spontaneously caught fire as well.

LEOs are tasked to target revenue enforcement. They will find cause, any cause to write a ticket and collect a fine. Don’t come to a complete stop by putting a foot down and they will have cause. LEOs with a conscience have already found another profession because the judicial system is non-existent. Assume LEOs are NOT YOUR FRIEND, NOT YOUR GUARDIAN AND NOT IN YOUR BEST INTEREST.

I ride a E scooter (Jetson Bolt - love my Bolt) do these count? I have had problems with car drivers almost running me over . When I ride I treat it like a car - stop at stop signs and yeild to traffic. Never trust drivers - even if they yeild to you - I pull over and stop and let them go I am too slow anyway. In my area people drive way too fast they need to consider that too.

This is what happens when idiots have ruined a good thing. Something happens and it will always be a knee jerk movement by the government. I say: 1. Have safety courses for school children that ride them and that includes the adults. 2. Wearing of safety gear for ebikes & bicycles. 3: Since there are bike lanes and paths. Make it better. 4. Ensure that Ebike riders and bicycle riders conform to the laws such as with motorcycles. 5. Ensure that cars and other vehicles also conform to road laws and stay in their lanes and if they don’t. A very harsh punishment has to be imposed, prison time for vehicle drivers that are perpetrators to the fact. Why, I say that cuz I have seen many many vehicle drivers are on their cell phones & that includes drunk drivers.

I saw this coming! but people like "Surronster" who seems to promote doing wheelies/and other stunts on the public streets and receiving "high 5's" from kids are worrisome. They are making E-bikes as fast as some motorcycles, I have one enduro-looking one coming at the end of the month, but I have always followed speed and traffic laws and never had any problems. As far as battery problems, stay with the name brands, use the charger it came with, learn the temperatures operating, and storage parameters of the battery, and remember when they expire. I have been in the EV space for over 5 years now and have never had one problem. ( I have seen some footage of shops that keep scooters and batteries plugged in when they are green, that is a NO, NO!!)

Honestly, there needs to be way for businesses to legally build and fix ebike batteries, because it often isn't possible to get replacement batteries from the original manufacturer, and the prices being charged by original manufacturers is often extremely high.

I’ve a bike that with controller modifications if run in PAS5 will go almost 40mph. In PAS1 it will only go 20mph. It’s stickered as a Class-2 bike. I am courteous to others when I ride it. I notice many who are not and that is the problem. LE should enforce laws against reckless operation. The bikes ability for speed should not be a determining factor. There are times when in traffic on a road where there are no bike lanes that the ability to blend into traffic is safer than going slower. IMHO we get too specific with laws. Hands free phone operation while driving for instance… how many times do you see people with the phone on speaker holding the phone a couple of feet from their mouth “with their hand” while driving. That’s not hands free! Reckless operation should be the determining factor. If charged, that isn’t good on your record and insurance rates go up. Reckless Operation laws should extend to everyone on the road and bike paths. That will solve the problem.

As a Dutch person, we now see a lot of "fatbikes", which people like to pretend are Electric bicycles but which really are Electric mopeds. But they're often driven by minors, always without helmet, no licence, no insurance, no registration plate. A 13 year old shouldn't ride a vehicle that can go 50 or even 70 km/h. WITHOUT A HELMET. There's crashes with them ALL the time.

But let’s be clear it’s about the insurance companies not wanting to kick out any monies to cover potential lawsuits so therefore they pay their lobbyists to get to our politicians to institute these draconian policies instead of focusing on the crime rate educational funding healthy after school programs for the youth. If you work doing deliveries you need to register your name and info and serial number in case of accident or robbery or they steal it , in NY some people don't register those ebikes that look like vespas or dirt bikes those usually are more than 750 watts and have no pedals , an real ebike has pedal assist..but if it looks like a moped or motorbike is not an ebike or electric bicycle

😮 you got careless of car drivers everybody sees this everyday. They are not paying attention not looking at the left and right mirror.. talking Chicago experience different from New York to Los Angeles why do you need to go 200 mph in a car or a motorcycle expensive one.( Public streets stop lights the speed limit is 25 to 30 mph probably is the same in your state or not.) I'm riding my custom e-bikes made from scratch not buying something online do not care for a motorcycle ebike this what these companies are making. I ran my e-bike on the bike lane in the park ain't that many people bike trail back on topic. I see some cars driving in the bike lane while you it in share the road especially downtown Chicago bike lane is protected you are driving 25 mph it's hectic.😮 people need to be safe and watch your surroundings Vehicles people having a good day

With the amount of fires in NYC caused by E-bikes they have to do something. People in that city store the bikes and charge the batteries in their apartments. With many people living in these apartments it is a serious problem. I don't blame NYC for doing this, they are loosing people and buildings because of these batteries.

I am 100% happy with limiting kids on Surrons. Maybe, to make that work makes using a 255 watt is the unlicensed, under 16 limit. All cyclists 12 and younger are restricted by law from riding any bicycle on any street or roadway (shoulders and bike lanes are not a roadway! That is simple again! --------------------------------------------------------- I am 100% against licencing E-Bicycles under 550 watts for 500 watt legal areas as I believe in having the 50 extra covers for a system producing a small overage especially on a fresh pack (or over 800 watts in areas where 750 W is legal) Insurance should not be required for any E-Bikes. The licence must be for the rider 12-16 who do not have a car Drivers Permit, registration if warranted should not be steeply billed like $10 per bike and be an impossible to remove embossed sticker that paint can't easily cover or adhere to as a deterrent to crime. --------------------------------------------------------- Does that Dutch power test station work for Midrive setups? --------------------------------------------------------- We need a set of both UL listed Batteries and UL Listed E-Bike manufacturer's from United Laboratories as I don't trust companies to list them selves properly! --------------------------------------------------------- To purchase a Surron, a motor cycle operators permit must be provided to and recorded by the dealer with it being insured & tagged by the state immediately before pickup. If is found with a rider other than the one whom it was sold to whom is not a street MC licenced operator both the rider and the registered owner get Penalized excepting a police reported theft of the Surron! --------------------------------------------------------- Adults (like parents) driving Motor vehicles over 1000 lbs should, lose family wide access to all motor vehicles for 5 years and as part of their conviction they should required to purchase an bicycle or E-Bike valued over $500 or more and log 30 hours of riding time per month for the duration of their 5 year ban! At minimum any Car/SUV/Truck (18 wheelers incl.) at fault accident should include a 12 month parking (no use) requirement for the specific vehicle with no sale either of that vehicle! That would put the fear of god in many drivers and all businesses! These should be mandated as a Climate Protection Solution!

@Mike Fede: No state I'm aware of has annual smog inspections, let alone general inspections, anymore. That isn't to say a car can't get "reffed," or sent to be inspected by the Bureau of Automotive Repair (BAR). The issue for California is that the California Vehicle Code defers to federal law (see CVC 15210, p. 8). Which means that since the feds treat E-bikes -- which exclude Surrons and the like -- like bicycles, then that means nobody will conform to registration and licensing, especially since insurance companies are now refusing to insure EVs, including Tesla big-rig tractor-trailer cabs. Given this, even if California wanted to require insurance, no insurance company would comply. They would refuse, citing the rash of battery fires for E-bikes because of cheap Chinesium batteries from mainland China. Furthermore, any attempt to do this kind of crap is nothing more than using "public safety" to implement yet another revenue stream, since more people are riding E-bikes. This also means that if they are going to prohibit E-bikes to kids under a certain age, the only way that is valid is to also ban normal bicycles to kids under a certain age. And how do you think _that_ would fly, even in a one-party state like Commieforniastan? Edit: And Mike? This isn't the new BMX bike or skateboard, this is the new Whizzer bike -- a gas-engine bike from the 1950s. The difference? They weren't concerned with revenue generation back then, and actually respected people's rights. Now? Given how the California Uniparty has taxed the people of California into economic obliteration, and spent tax money on projects that will never see completion, i.e., the $3.2 billion "High-Speed Rail Project," this is yet another way to try and milk even more money from Californians. That's all this is. And given the amount of Karens who think they can dictate laws to, it's not surprising California is essentially trying to violate it's own law, not to mention apply federal law in such a manner the feds themselves don't. Edit 2: Mike, what the Dutch cops have is essentially an E-bike dyno. It's literally the E-bike equivalent of the same equipment that speed shops use to tune and dyno cars. Personally, I think cops using it is a violation of the Fourth Amendment, since cops here have no power or authority, let alone are not technical experts, to test E-bikes, no different than cops issuing any citation or ticket for equipment violations. Testing an E-bike's motor or power output is going to read different depending on tire size (radius, width from sidewall to sidewall), type of drivetrain (chain or belt), type of motor, etc. The only thing any cop could do is set speed limits for bicycles generally, which one, make no sense, since bicycles don't come with speedos; and two, at least in the US, where there are different speed limits is usually only on limited-access highways, like interstates and freeways. Otherwise, all conveyances, including vehicles, must obey a speed limit, if the thing on the street or road can meet that speed limit. Which means it is pointless to test motor power output, let alone speed, unless you require a speedo. Why? Ignorance of the law, especially where normal bikes are concerned, since normal bikes aren't required to have speedos, and never know how fast they are going. The point here is, government agencies are discriminating against E-bikes, simply because they are E-bikes. That's it. And that discrimination isn't perpetrated against motorcycles, cars, gas-equivalent Whizzers, or normal bicycles. And it doesn't matter if an E-bike has a motor or not. Under US federal law, the feds treat E-bikes like normal bicycles. And that is how the states should do it, because if a state thinks I'm gonna comply with stupid rules or regulations no bicyclist has to, they have another think coming.

An E-bike is more than essentially a motorcycle, it is a motorcycle. When ICE powered bikes were the only option, they were banned and treated as motorcycles. On many trails and bike paths the ICE version was not allowed. "No motor powered vehicles allowed". Along comes the E-bike and so do the same problems that are associated with motorized cycles in the past, remember the Segway? Many electric powered cycles were designed to assist the rider and they didn't have independent throttles, if you stopped pedaling the power assist would also stop. The assist is a great way to add power when the going got tough, it was also a great way for the elderly to get out and take longer trips than they ever could. One of the most popular applications was in mountain bikes, getting the rider up very difficult rises. The throttle is the problem, it allows the rider to accelerate to max speed just like motorcycle without any input from the rider. The vast majority of e-bike riders I encounter are either not pedaling at all or with little load. And they are flying around on the sidewalks, on the bike paths and across whatever path they pick. Granted those riders are typically the younger ones but there are many older people that using their bikes in the same way. I mentioned the Segway, its demise was due to same issues that E-bikes will face. A motorized, unregulated, vehicle is not compatible on the sidewalks and non-motorized bike trails. Get rid of the throttle, if you want to ride a bicycle, you need to provide at least 80% of the load and if you can't you will just slow down and continue at a slower speed, just like on a normal bike.

I thought the mph cut off was 30mph not 20mph. Class 3 PEV was legal as far as i know. Perhaps it differs for scooters?

Class 2 and 3 ebikes have a throttle cut of at 20mph. Class 3 you can get pedal assist to 28mph. The problem is there's now many makes out there that exceed 30mph, some even past 40mph. That's no longer an eBike, that's a motorbike, and should be insured and licensed as such for use on public roads.
