To give them the benefit of the doubt, the judge probably considered his incarceration as the real punishment for the crime with the fine being symbolic. Also I doubt that he will ever be allowed to reenter Japan and at this point he has vastly exceeded his visa if he entered as a tourist so he will have to leave soon or be arrested again.

They even ignored his other videos -- e.g. from Thailand, where he tried to interrupt the stoppage of some other criminal actions taking place (by another Nuisance Content Instigator IRL Streamer) and falsely tried representing himself as the defendants' Lawyer and legal representative (in order to get access to record and stream the Police investigation against them)... And he had months and months of evidence of his multiple offences through all his streams, so they should have at lease kept placing another charge upon each release [rather than only using that allowed tactic once] Sadly, it's the legit live streamers (e.g. those promoting Japan itself) are the ones the citizens are now starting to look at suspiciously, and likewise for all foreigners visiting who many Japanese will automatically be thought of as 'more foreign troublemakers)... It's the legit streamers paying the consequences for the Nuisance IRL Streamers while they profit from destroying the reputation of legit streamers. QUESTION: these Harmful IRL streamers [HIRL -- pronounced "hurl"-- in order to separate them from the legit IRL streamers] seem to go around under the pretense that they have full authority to break the laws of the various Countries and to do/say/record anything they want because that's their "job"... so the question is, do they even have authorized Work Visas [in which they would have to declare their supposed Employer that is responsible for their actions]; because otherwise they're "working" without a Work Visa. Additionally, if Kick (for Example) is compensating them to provide these streams [and are technically their employer if the individual(s) are contracted and paid through that streaming service to provide that content; then legally the authorities could hold Kick and any of its paid HIRLs actionable with these intentional nuisance stream creations, working in the country without authorization, and criminal activities (which, in truth, are also being committed on behalf of their Kick employer] Additionally: the "promise to never stream again" -- well, there have already been talks for him to join other HIRLs in Thailand, and you can bet he'll say something like: (1) that only applied to streaming in Japan, or (2) that only applied to streaming in Japan during that visit/stay, or (3) that only applied to my current streaming account and/or name, or (4) that doesn't mean I can't appear on other HIRL streams and have them financially compensate/pay me to participate on 'Their' live HIRL streams... and what stops him from just changing his real name to do it all again As well, I can easily see him using his 'Japanese Prison Time' as HIRL Clout clickbait bragging

Joey, I’m saying this as an American; Yes, people have received harsher sentences for public nuisance, but at the same time, we’ve been having an upsurge in violent crime and repeat offenders getting no charges or even incarceration into local jails because of a number of reasons. Race, terrible attorneys, financial/capacity, it goes on. But this is a far greater punishment than he’d be likely to face in the US. The very fact they actually decided fine Johnny is already an order of magnitude above what he would have received in the US, let alone deport and bar him from the country.

I can understand why. They're people who judge and enforce the laws, so they have to follow it properly. They can't arbitrarily give out heavy sentences because of their feeling. When was the last time you hear someone getting jailed and deported over playing loud music and being a nuisance? So probably what they did prolonging the case for as long as possible and keeping that pos detained for awhile was the best they could do.

He is being deported from Japan for violating his tourist visa. On top of that, he has an arrest record. If he were to fly into Japan again, and he lies on the customs form about not being arrested, he's going to automatically get flown back out of Japan at his own expense. If he tells the truth about being arrested, there will be an investigation by the customs officers, and it will be up to customs if he will be allowed to visit Japan. They can make any decision they want, if they don't like him, they can send him back.

9:30 I'd disagree that the sentence would be any different in the US. Public nuisance laws do exist here and are considered a misdemeanor. A minor crime. Generally, the punishments range from a fine to at most a few month prison/probation. Considering this crime of being a public nuisance and it is only THIS crime on trial, I am not surprised that it is only a fine. Had he been charged with all the other **** he did, then I would have expected either a larger fine or jail time. The court could only look at this crime in isolation, because the other activities have not been charged and there is no "legal" record of them.

Within the United States, there is this thing called an "amicus curiae" brief, which means "friend-of-the-court". It is legal brief created by individuals or groups that are not involved in a legal case, but have expertise that could be very beneficial to assist the court in making its decision. This is usually done in an appellate court and not a trial court. I do not know how the Japanese legal system works. I do not know if there is a similar feature within Japanese courts. If there is, it may be VERY worthwhile to take advantage of it in the future. There are plenty of content creators living within or traveling to Japan that are respectful, and whose careers heavily rely on setting a legal precedent of harsh and severe punishment for future instances like what occurred with Johnny Somali. If those content creators formed a collective body and hired a legal representative to write something similar to an amicus brief (or provide expertise on the streaming space to ensure that the court is well informed on how much money someone like Johnny Somali made on the abuse of Japanese citizens and culture, as well as how much control a content creator has over what they are doing). This will absolutely happen again, and people who stream and record videos IRL in Japan have a lot on the line. Making a solid effort to protect their own interests by lobbying, providing expertise, or whatever they can do is massively important in ensuring this doesn't destroy people's livelihoods and enable this behavior going forward.

The country of Japan has a level of tolerance that I will never understand.

To say he didn't get any jail time would be inaccurate as he spent like 3 or 4 months in jail as he was being charged with the crime so essentially it's more like 3 or 4 months plus a ~$1500 fine.

The same justice system that also gave Watsuki Nobuhiro the same ¥200,000 fine for possession of 100 child pornography DVDs (also went on to admit his attraction to 14 year old girls) and took YEARS to find Ito Shiori’s case of being raped true, after stalling it for the longest time and making her reenact her rape with a sex doll, yet will throw someone in prison for 10 years for marijuana possession… fucking absurd.

In the case of the presented crime, the fine is honestly enough. I 100% agree that the prosecutor should have brought forth past crimes. Even if no one charges him individually, there's definitely some possibility that prefectural entities would have pressed charges if presented with the available evidence. As someone who hates over criminalizing misdemeanors, this is the best way things could have gone.

Getting held for 4 months and then fined on top of that isn't exactly what I'd call "getting away with it". Given the low severity of his offenses, people expecting him to get the maximum sentence were delusional.

I'll believe that promise [about not doing it again], if only because if he gets dragged to court again for the same thing he will have a record and any leniency will be dropped. Instead he will find some other crime to commit (trespassing or such?), or better yet, a loophole, or other country. The bigger issue is the precedent that you can do it at least once and still have profit.

I have heard that Japan often arrest people once they've been let go if they have several charges they can take him for. So far all we know, he might have been arrested once again on a different charge and will now have to go to court again for a different crime. He might be stuck in a loop now with many fines coming his way. Maybe even take the most serious crimes at the end to give him a prison sentence.
