If an employee refuses to sign a written reprimand, the written warning issuer can simply mark an x and have it witnessed.

I think that the employee handled herself very well in this situation. He was not listening to her as she was being reasonable and kept calm throughout his lack of care for her point of view. I was thinking that I would also ask to speak to a superior or even request that someone in HR get involved to mediate.

Managers say "it does not matter". At that point when I hear that, you are just a number to them. Employers need employees more, otherwise we wouldn't have free money-out of-desperation sign on bonuses.

@terrence19997 жыл бұрын
As a professional he could have at least heard her out. He needs to read a book on how to be an effective leader. He also can be written up for his unprofessional tone an or tactics. I myself write up the incident print and maybe even notarize the situation. It can come back to haunt you later but my rebuttal was always in place. Some employers are at will in their respective states. And they wonder why the have a high turnover rate.

I had an employer write me up for being tardy due to a medical treatment the company had FMLA approved leave paperwork. They said I was late six times in a quarter. I checked my time card punches. And found out it was only two times. After the meeting, I contacted a former manager at home who left the company to pursue another opportunity somewhere else. I had a new job offer the next day, and accepted. I just did not go back.

Before I retired from "the wonderful world of work" in 2018 I lived by two rules most of my working career. I instituted these rules for myself after a couple of incidents. First Incident occurred when I was 18, I was asked by an employer to sign a write up or be terminated. I signed it and was terminated immediately afterwards. The other incident occured when I gave a 2 week notice and was promptly escorted off the premises. So my 2 rules of employment are #1. Never sign a write up, ever (or admit wrongdoing). #2. Unless you're in a union never give a notice. (If you're an at will employee you have every right to just leave. At will goes both ways, employers can fire you with or without cause and you as the employee can choose to just walk away. Remember, employers have all the power but don't be intimidated.

Why would Frank give her a final warning over being rude to a customer. Where were the previous offenses before this one and refusing to sign a warning notice is one
@kdlofty8 жыл бұрын
A simple call to the customer, or listening to the recording of the call (if there was one) would sort this out. I'd also ask who these two "colleagues" were, and what was actually said by each of them. This "manager" had already made up his mind (he's supposed to be impartial). This sounds like a stitch up to me, definetly with the two colleagues and possibly this poor excuse for a manager as well. She was right not to sign it (if she's not guilty of the accusation), she kept her cool and composure and was right to ask to speak to someone higher up (this was a massive dent in her manager's ego). I don't know if there were any previous incidents, although given the fact that it's written warning i would think so. It'd be good to know what the previous "incidents" were, and who reported them (i suspect it was the same two colleagues or at least one of them). This sounds like someone is trying to sabbotage her career/job, to constructively dismiss her. This has got set up written all over it. Somebody want's her out, the question is why? It'd be interesting to see what the higher up person had to say, and what the outcome was?

Prior to calling her into the office should have pulled the calling and really listen to it see if the colleagues was right. And then went ahead with your decision of disciplinary action she could be telling the truth. A final written warning would like to see the others before this one. Where is the other written warnings before the final? Bottom line according to what she saying going to side with her until there's an update on this recording. What was the real outcome of this issue?

The manager or supervisor was wrong for this and I’m glad she did not sign the paper acknowledging that falsehood. The fact that he says that it doesn’t matter what she says is completely ridiculous. Everyone has a chance to explain themselves. You can’t just silence them because there are people who ratted someone out under false pretenses. This is the example of horrible Management. Investigate further to find out what really happened. Don’t make assumptions.

I like to call an office reprimand, a "Ride In The Hot Seat". The worst time to get a "ride in the hot seat" is during the early part of your shift. You suffer more because you have to work when you're feeling bad about what you've done or being accused of. It's especially bad if you have OCD, "Obsessive Compulsive Disorder". It's so much better to get a "ride in the hot seat" at the end of your shift, because you can go home, lie down, and cry it out, or else do something enjoyable to get your mind off it. My girlfriend and I have a ritual. On the night of any day that either of us get a so called "ride in the hot seat" at our jobs, or have another disturbing experience such as a traffic stop, or other incident that involves the police, we get together our friends, and go out for dinner at our dream pizza parlor.

@@luvyatubers She states at one point 3 years of service. In some areas that then means she is entitled to other employment benefits like more vacation or termination / severance pay if let go but not if they quit. This seems like a situation crafted to take her down. She gave justification for being loud. We don't know the tone she used or how she spoke to the customer though. Anyway, let me fire you just before 3 years so I don't have to pay you more, give you more vacation or pay termination costs. That is how I read this.
