The plaintiff says the defendant’s dog mauled her dog in front of her daughter, and her pet didn’t survive. The police traced the dog in question to the defendant, but he refused to compensate the plaintiff for her loss, so she’s suing. The defendant denies that his dog killed the plaintiff’s dog and insists it’s a case of mistaken identity.

That’s an exaggeration. The dog was probably new to the pitty and tentative. The dog wasn’t terrified. I’ve introduced hundreds of dogs through my rescue and it looked like they were meeting for the first time and establishing their boundaries

It sucks that if the dog was alive and went to the vet for $5,000 in vet bills, he'd be responsible for $5,000. But since it died, they just get a couple hundred dollars. 😔

Yeah, but that’s because the owner would literally be out that money. In this case, the owner technically wasn’t out anything except the pet itself. I do wish the law allowed more middle ground for pain and suffering with pet compensation cases though. I don’t think people should get compensated for every little thing when it comes to pets like she was trying to get, but something more should be allowed even if it’s just some kind of monetary minimum in general.

If it had been a mutt she would have gotten $0 .There was a case many years ago on the peoples court where a rabbit was killed by dogs.Because it was concered livestock the owner got triple damages of the animals value plus the value of the future offspring.The rabbits were expensive registered breeding rabbits so the dog owner paid dearly.

That's because a dog is considered property in the eyes of the law. It's just like if someone's in a car accident that isn't their fault. They either get the cost to repair the car if possible, or they get the market value for the car if it's totalled.

I have the sweetest, chunkiest American Bully. But I have no idea how he’d react if he was antagonized or felt threatened. I know he’s big and very strong. I would never let him off the leash, in fact, I cross the street away from other dogs. I love him too much to risk anything

At 12:16 that pit bull is NOT playing with the white dog. His tail is vertical and the tip is twitching. Behaviorally this means about the same as a rattlesnake rattling. This is not wagging in friendliness. He chased the white dog off something on the ground, perhaps what he might have thought was a piece of food.

More recent research by veterinary behaviorists at UC Davis indicate that trail wagging has no correlation to the dog's emotions, but only indicates their energy level. So, a dog can be quickly wagging it's tail in either a high state of happiness OR aggression. There can be other clues such as stiffness of the body and raised hackles are an obvious indicator. But a wagging tail by itself will not tell you anything other than energy level.

I am not going to be liked by this comment, but in my S.@.S traning the most effective way to stop a dog attack is to stomp on it it's back. This will break it's spine and stop the attack. Do not do this freely, but don't hesitate if the situation requires it.

He wasn’t playing but he wasn’t acting aggressively, either. He was showing some dominance (different from aggression) and the white dog was being submissive. Looked like two dogs meeting for the first time and feeling each other out.

Once I fell asleep w my dog outside. My Dal woke me up & dhuffled him outside in the middle of the night. I did NOT realize it was storming. He got under the concrete stairs. I was pregnant so I couldnt get him. I felt so bad even woke my husband who would go get him 😭

I think terrorizing breed is a little extensive. He is just a bad dog owner. It's nothing to do with the breed. Certain people should not own certain breeds. Most people get pit bulls because of how they look. They don't consider the fact that pit bulls need extra training just like any other big dog. My pitbull loves all people and dogs, he has been attacked by small breed dogs! Its not the dog it's the owner.

@@kalynnmewes3990 Agreed. I grew up around pit bulls and my dad would keep very firm control because he didn’t want the dogs accidentally hurting his (or any) small kids. They were always kind, and I adore dogs, but pits are big and strong, so of course smaller dogs don’t stand a chance if they get into a fight. And smaller dogs tend to be less trained and more willing to get snappy with a big dog as if they have nothing to lose. It’s an unfortunate incident and definitely his fault, especially knowing there was a crack in the gate to begin with.

@Kalynn Mewes I was taking a walk around a lake once by myself when I noticed a dog owner of a pit bull who hardly had any control over her dog. When they got closer and were starting to approach me (we were walking in opposite directions) the woman became anxious and was really fighting to hold it back...it growled and snarled at me in such a way that it struck TERROR in me and if the person walking behind her hadn't stepped in to help control the damn thing, that pit bull would have surely torn me to shreds and had a nice leg steak for a snack. It was salivating and barking and pulling its owner like a weak rag doll, and it scared the ever living shit outta me. So yeah- pit bulls terrorize some people. I'm one of those people who have been inches from a full on monstrous terrorizing attack by a pit bull. So terrorizing is not an extreme word for me to use because I have the personal experience of being scared to smithereens by a fierce, violent, terrorizing pit. Personally, I've never met a pit I liked. I can't abide any pit bull. In me, they strike 100% fear. Something for you to consider. Just saying. Peace. ☮️

I have a pit bull and 2 bullies. Even though my pit isn't aggressive toward me or the other 2 dogs idk how they would be around other dogs they don't know or people so I always keep them close to me on a leash and don't let random ppl pet them. Pit bulls already get a bad rep so having your dog unleashed is beyond me

Exactly. I’m the same way with my pit. Anytime he’s outside, he’s always leashed even tho he’s a sweetie and I even take extra precautions and move aside when other people approach. And that is mainly because pit bulls have an extremely bad reputation

Btw we rescued an ex fighting pit in the 90*s... She was all scared up and messy looking but boy did she love us and my mothers little dogs. She was amazing.... She had a hard life but the love they have after that is amazing. ❤

Pit bulls can be great loving dogs no doubt about it. But they are more prone to attack especially if there is more than one dog. I have purchased chickens, rabbits, and other animals depending on the breed because I am looking for certain personality traits. We need to be real with the best way to handle these dogs.

FINALLY!! They are amazing dogs, but just like so many other breeds that are bred for a specific purpose, pit bulls were bred for tasks where more aggressive individuals were chosen to found the breed. They aren’t “bad”, but genetics play a huge role in how animals behave. Just like labs are genetically born loving water, huskies are known for howling, collies instinctually have a drive to herd, and beagles are born loving to hunt and bark, pit bulls are prone to being more aggressive. Definitely, certain owners and more training have a HUGE impact on behavior, but this is facts in general.

I have a pit and a chihuahua and they love each other. I also had another chihuahua but I had to put him down because he bit the other chihuahua, me and my husband. I love both chihuahuas but he was unfortunately inbred.

I have a CHIHUAHUA that has fear aggression. She’s seen multiple behavioural trainers and even went on medication for “anxiety” at one point to help combat her aggressive tendencies. Nothing helped, not for very long anyway. All this to say that we make a conscious decision to not take her on walks or into public spaces, we always put her away if we have visitors or workmen or even when couriers come to the door, we take every precaution to keep others (and her) safe. You have a massive responsibility when you own an animal, they didn’t choose to live with you - you chose them. Even though she’s small and likely can’t do much damage, she can still do enough, and I would hate for a child or another dog to be hurt because of her unpredictable nature. She’s a danger to herself too, she can trigger much larger or more dangerous dogs with her behaviour and we are very aware of that. I can’t believe this man is so nonchalant about his dog, a dog that viciously attacked and killed another helpless dog. It’s scary to think there are so many irresponsible dog owners. Some people really shouldn’t have dogs, sorry to say.

We have a rescued chihuahua. He lived in a hoarder house for nine years. He is terrified when people come to our house. Kids want to pet him when we walk him cuz he looks cute in his clothes. We dont let them. We know he will go after you. He has trauma, its real, we keep an eye on him. Its our job. Youre right.

love that he has a smirk on his face while talking about his dog being unsupervised for 3 hours, getting through a crack in the fence he KNEW was there. This is exactly the kind of negligent dummy that shouldn't own ANY dog let alone a dangerous breed. Why is it always these braindead, irresponsible people who just LOOOOOOOOOOOVE a pitbull. I wouldn't trust this man to watch a goldfish let alone a pitbull. Poor chihuahua but lucky it was just that one poor dog and not others, or even the kids in the neighbourhood. and ofc he has pictures of his dog being sweet as can be with other dogs and kids because EVERY pitbull owner has those damn pictures acting like it's proof that their dog wouldn't hurt anyone. I watch a lot of episodes and this one right here made me comment... This elder lady is so sweet and sounds like she'll miss ole Dodger! She, the cat, and the other dog will miss Doger! No more alarm, no more greeting people. It makes me super sad that she no longer has him! 🥺 RIP Dodger! 🙏

It's all how you raise the dog & not breeding aggressive dog of any kind together. Our pitbull is a big teddy bear. I got a 7wk old Dachshund for Christmas. From day 1 that little Dachshund is the boss. Our pitbull loves playdates with other dogs too. This guy should've had his dog contained. I have empathy for the plantiff that lost their beloved pet too.

People should be aware that there's a difference between "vicious" and "dangerous." A pit bull can be the friendliest critter imaginable but be very dangerous in the wrong circumstances because of its instinct to bite and hold on.

I hate that an entire breed is villified because of crappy owners. Not all pit bulls are like this, and it completely depends on the way the dog is raised and trained.

But surely bad pet owners don’t always have pit bulls. Surely some have poodles or labradors or golden retrievers or whatever, and yet we never hear about them. If those dogs escape due to owner negligence, the owners don’t seem to end up in court over it. It can’t all be down to raising and training. There has to be some element of instinct or innate behaviour (along with owner negligence for allowing them to escape)

That’s so sad but it’s not only Pitbulls. I’ve seen lots of other other breeds attack small dogs, for some reason they think their toys, and just like they will destroy a toy they will destroy a little dog it’s so sad.

Small toys with squeakers are made specifically to sound and look like small animals, I recommend not buying them dor your dog if thwy are a larger breed with a stigma of aggression, or if they’re around smaller dogs/pets

Pit Bulls have jaw muscles and teeth strong enough to crush a brick. THAT's the difference....other dogs' jaws aren't that strong. ps the owner's claim that the Pit Bull came home without blood or dirt on it doesn't mean much. I doubt the Chihuahua (less than 10 lbs) would have lived long enough to knock the Pittie down and roll it.

I think one of the only breeds with a stronger bite force than pitts are the German Shephard. Probably explains why they became the K-9 officer breed of choice. Plus apparently they have a great sense of smell so they are perfect for that too. Now idk about the whole brick crushing thing, but the bite force of a breed is definintely not something to sneeze at. I thought Pitts were the strongest, but heard that nope, GS's are even stronger. :o

That's why they have those bulging jaws....extra muscle fibres for exta bite (sorry, i'm a mall animl vet....experience is almost everything....plus a lot of necessary reading0 One woman went away for a couple of mos for work, and when she came back, her pit bull (nice dog!) had gone through puberty. Sadly her hubby and kids weren't home when she got back....she took one look at the dog, screamed, threw him into the car and drove to our clinic as fast as possible......she thought he'd developed cancer of the jaw while she was away! We had a fair bit of trouble convincing her that that's what happens when the Pit....and other bull breeds change from puppy to adult, but after showing her some books, she agreed. ps G Sheps USED to be good for police work, but now there are so many with hip dysplasia that have to retire early that the big cities and the army (who can afford it) go for Belgian Malinois now. Almost the same breed, slightly smaller, usually calmer, and they order them partly trained from the EU, so the commands can be givien in Walloon. (yeah, i blinked when i saw what the Belgian language was called, too) That way the villain can't order the dog off. They're $25,000 a pop though, which is why everyone doesn't use them. All the best to you and yours!! (mind you G Shep bites really do hurt though.....they just can't crush the bones in your hand or rip your skin opern and the muscle away from the bone from wrist to elbow like a Pit bull can ....i've seen both injuries.)

I'm sorry for her loss. Her story was very relatable. My ĝrand daddy's chihuahua was also the house alarm. You walk pass his house "Tiny" was his name .He's up in the living room window letting us know somebody's there 😂

ATV Judge John's comment reminded me of the renter who sued her landlord bc the house wasnt habitable. Come to find out. The house had been in a hurricane and was condemned, but the renters refused to leave. The landlord was practically begging them offering them temporary housing or even getting out of the lease.

I couldn’t agree more, I have a pit who has issues with other dogs at times. She NEVER goes outside without a leash on. I also don’t allow her near other dogs even when she’s on the leash with me. Also, I’ve known plenty other breeds that go after dogs. Pits get a bad rap.

How did the judge not catch this and call the defendant out on it?! First he said he had let his dog out to go play in their backyard while he and his daughter went to go take a nap til 6 pm and than a minute later he says he got home from work and that’s when some kid brought his dog to him around 630pm. How can you be taking a nap and be at work at the same time? Smfh can’t believe the judge did not catch that when it was loud and clear. Defendant seems like a nice person he should’ve just took full responsibility from the beginning to avoid all this court stuff.

You’d be surprised to learn that labs are way up there, too. Pitbulls are actually slower to attack but do more damage once they decide to attack.

@@oldageisdumb The funny thing is that even though you make that claim after 47 years of living and dealing with law enforcement, I have only seen a handful of dog attacks that were German shepherds or rottweilers. I have even seen cases that went to court because of a Chihuahua attacking somebody which of course was because the person who got bit wanted to get paid not because they had any serious damage. The rest of the attacks seem to be Dobermans and pitbulls. Of course! Pitbulls were probably about 70% of the attacks. For a breed that is slow to attack, they seem to constantly get out of their yard and wandered down the street to attack people and other dogs in other houses. But in all my years I have never dealt with a dog attack or a labrador or a golden retriever was involved. I am not saying it has never happened anywhere but it has not happened in my area. It may have gone through law enforcement and the courts while I was on vacation but other than that I have yet to have seen one. The strange thing is at least half of the pitbull attacks. Had the owners telling everybody that the dog was sweet and had never attacked anybody ever. I am not sure how many attacks it will take for people to realize the breed is a dangerous breed.

@@tmendez31 That’s pretty funny as I am also 47 (go old people! Lol) I run a rescue here in the south and there are a lot of reasons for that, as I’m sure you are painfully aware in your profession. The biggest one is the difference in the demographic of folks that own labs vs pitties. If you are a demographic that does not spay/neuter, socialize and also do not maintain fences well, you are simply setting a breed up for more attacks. You also aren’t going to be called out nearly as much for a lab bite because lab bites are usually not going to be as severe as a pittie bite. There could be 100 chihuahua bites and 1 pittie bite, and you’ll get called for the pittie bite. If you ask most vets, they will usually tell you it’s not the pitties they have issues with. I’m not saying that there are not concerns with pitbulls for sure. They are designed that when they do snap, it’s going to be ugly and severe because of their unbreakable focus. But they weren’t labeled the “babysitting dog” for nothing 100 years ago.

@@oldageisdumb I try to tell people that it's important to understand dogs and know the characteristics of each dog breed. Of course, some dogs turn out a certain way due to abuse or neglect; bad environmental factors. But most dogs usually fall into their typical category. Pitbulls not being an actual breed but a group of breeds are mainly working dogs that have great strength and are great dogs to have their energy focused on doing certain tasks. Sadly most people love the typical "gangsta" pitbull look where the ears are cut to give it a certain look. But like other breeds like dobermans, pitbull are much more prone to fight for advancement in the pack. When people don't treat dogs like dogs but more like kids, they get confused seeing how they are pampered and thus believe they can assume a more dominant role. Maybe not challenging the alpha, but certain others in the pack who have higher standing. It's much more rare to hear of a lab attack or a retriever mauling, but all dogs have the ability to be aggressive. Too many people do not understand that dogs get stressed, scared, annoyed and can take things out on kids who are not as high up in pack ranking. Heck, I got mad at myself two years ago for not watching my grandbaby closer at my friend's house. He has a Weimaraner who is very very gentle. But I still made sure to keep a close eye on my grandchild. I got into prepping some BBQ that I didn't notice she had approached the dog while the dog was in the dog bed. After several minutes of petting and messing with the dog, the dog snapped at her and scared her badly. Luckily the dog didn't actually bite her, but a more aggressive breed would have probably not held back. Pitbulls are strong and aggressive like some other breeds, but still, unlike other breeds, they have a track record of suddenly getting aggressive and attacking. As a teenager, I didn't believe my father who was a cop since I was 5 until he retired. He said pitbulls were crazy and I just thought he didn't like them. As I got older, I noticed exactly what he said, that most dogs that snap are usually pitbulls. I will admit that I think much of the fault is placed on the owners because they refuse to know the breed and don't feel the need to be cautious. They treat them like they would have treated any other breeds not knowing that the dog needs to constantly be treated like a dog and not a person. They need to have their energy focused on things such as exercise and training. And they still need to keep from leaving the children alone with the dog. Sure, many days pass with no issues, but that one day the dog is stressed out and boom. With my Rottweiler I had years ago, he never ate around people. I made sure he was fed and left alone. Only I was able to mess with him when he ate and I periodically interrupted his meals for a brief moment since he was a puppy to let him know I was the alpha. He was so well behaved. Once he saw I gave my approval, all visitors were welcomed by him.

The reason that her son only paid $280 (or whatever) for the chihuahua is because he didn’t go to a reputable breeder. He went to a backyard breeder or a puppy mill. Chihuahua’s are irresponsibly bred everywhere and not near as expensive as other breeds.

I don't know why this annoys me so much....when she says 'why is it always a Pitbull that escapes?!' - it's not! Lots of different breeds of dog escape but most of the escapes don't result in an attack or mauling, hence they don't come before her.

Where I live a second amendment state just know I will protect mines. I'm tired of irresponsible dog owners. Just know if you move to a second amendment state you will gets yours and it will be your own fault for being a careless idiot, thinking your dog wouldn't hurt a fly. Our mixed chihuahua was the one who actually instigated for my brother’s bully to attack him. They both wanted my husband’s attention and they would stare each other down. Luckily my husband was right there and pulled the bully off. So now we don’t let them near each other.

I understand what you are saying. There seems to be a high incident rate of pit bulls who get out and attack. BUT please do not paint ALL pit bull owners with the same brush. There ARE many responsible pit bull owners, who love their pets, and who take their responsibility serious. The only ones you really hear about are ones that attacked a person, or pet, so you don't really hear about the dogs who do not get out, or are not off leash, and have not caused harm, because they are not newsworthy, or part of a court case, and it can warp your perspective. I adopted an 8 year old female pit bull at 2 years old, and she weighs about 100 pounds. She has never been off leash outside of our property. She also has never escaped our property and ran the neighborhood. We have an 8 foot brick wall on all sides of our back yard, with a metal gate, that she can not get through, around, or over. Even with that, she is still NEVER in the backyard alone unsupervised. She is the sweetest, most lovable dog I have ever owned, but I am also aware she is very strong, so we make sure never to take any chances. I also want to make sure that nothing happens to her either!

That moment when you see so many of these cases you can literally predict what types of dogs will be involved... Mauler: Pit Bull (or Boxer) Mauled: Literally any tiny breed Very rarely do I hear it being a breed of a similar size actually getting killed. Injured, yes, but not usually killed. And the judge phrased it exactly: "Why is it always a pit bull that gets out?". Agreed, I'd have a malfunction if the roles were reversed! (not that this should ever happen, but still) It also bugs me how people will always claim that "my dog gets along with MY children/pets/family!". Who cares about YOURS if it is targeting OTHERS?? Either train your dog or idk...Get a better barrier? Clearly these gates never work with these dogs, so you ought to just leave them inside with you. Don't leave doors, windows, etc open, all that jazz. It's not hard, honestly. (typing while listening and the judge pretty much remarked on the same stuff I posted, regarding the "gets along with ME" and the kind of dog that gets out) (FYI, this was not meant to be a hateful comment toward any breed, but I've watched these courts for years and they usually do end up this way. Don't @ me; I won't see it anyway. :P)

Pitbulls (and other "bully breeds") are usually very friendly to people but will have very compulsive dog and animal aggression. It's just how they're bred and it sucks to see pitbull owners deny the fact that their dog is potentially dangerous. Obviously smaller dogs are an easier target since a pitbull can kill a chihuahua in a single bite

I always keep my girl on a short leash next to me and would never let anyone pet her because of cases like this. Having any dog without a leash is asking for trouble.
