For many Temporary Protected Status recipients, the fear of TPS ending lies in the potential life-long separation from spouse and children, home and community.
The TPS tips in this video applies to all TPS beneficiaries, past and present, including: TPS El Salvador, TPS Honduras, TPS Haiti, TPS Nicaragua, TPS Somalia, TPS South Sudan, TPS Sudan, TPS Nepal, TPS Syria, and TPS Yemen.
There are three general paths.
IMMIGRATION COURT PROCEEDINGS: PERMANENT RESIDENCE FOR TEMPORARY PROTECTED STATUS BENEFICIARIES THROUGH CANCELLATION OF REMOVAL
In deportation defense immigration court proceedings, TPS recipients may be able to win permanent resident through a showing of immigration hardship.
HUMANITARIAN IMMIGRATION SOLUTIONS: PERMANENT RESIDENCE THROUGH ASYLUM, VIOLENCE AGAINST WOMEN ACT, U VISAS, T VISAS, AND NACARA
Second, there are potential humanitarian solutions. They can be used as a pathway to win permanent resident status through filing applications at an immigration office or at deportation defense hearing at immigration court.
Asylum - Often called Political Asylum, these cases revolve around religious, gender, age, race, as well as political grounds. Winning your asylum case leads to a green card. But asylum in the U.S. is very difficult to win. This is true whether you attend an asylum case interview or asylum case at immigration court.
VAWA - The Violence Against Women Act has strong immigration components. VAWA’s drafters were heavily concerned with violence against immigrant women at the hands of U.S. or permanent resident spouses.
U Visas - This is a visa for victims of crime who assist and participate in helping law enforcement capture and punish criminal violators.
T Visas - This is a visa for victims of trafficking who assists law enforcement in capturing smugglers and other wrongdoers.
NACARA - The Nicaraguan Adjustment and Central American Relief Act, passed in 1997, could perhaps assist some Nicaraguans and Salvadorans win permanent residency.
EMPLOYMENT-BASED PERMANENT RESIDENCE APPLICATIONS
Some TPS recipients may be eligible to win permanent resident status under an employment-based petition filed by an employer.
