And you can do this without having to leave the U.S., through the adjustment of status process, thereby avoiding the necessity to file a dreaded I-601 waiver.
Sounds too good to be true? As this presentation shares, if a I-130 family petition was filed on your behalf before April 30, 2001, an immigration petition approvable when filed, you may be eligible for grandfathering under 245(i).
What does this mean for you? It means you can win adjustment of status and become a green card holder. Even better, depending on the specific facts of your 245i eligibility, your spouse or unmarried child under 21 may be able to also win permanent residency.
Such an outcome is the product of what is called grandfathering under 245(i), which means even though there is a new set of rules controlling cases like yours that are filed today, your petition can still proceed under the old laws. You (and perhaps your spouse and children called derivative beneficiaries) have immigration grandfathered status - even though your immigration documents were filed over 20 years ago.
So, if you have not yet done so, you should start looking for your old papers. The key to your green card success may rest on them.

Hello, thank you for all your very clear and awesome videos. I have a question about 245(i). My step-father filed an I-130 for me in 2000, which I feel was approvable then. Then my mother and he started having issues involving the police and she filed a VAWA without him knowing, or so she thought. I still have all the paperwork, but he found out about the VAWA and he canceled my petition. Would I still have a chance to apply under 245(i)? Thank you for your time in responding.

Question, my grandmother filed petition for my father March 2001, that makes him elegible for the adjusmtent of status 241(i) his spouse my mother, entered with a tourist visa, but stayed here with him, does she qualify as spouse under the 245(i) ? thank you

Thank you for this video! My mom came with a visa to the US in 1996 and stayed until 2002. In 1998 My brother a US citizen filed an i130 petition for my mom (I was 15 years old) and it was approved in 2001. In 2005 I entered without inspection and in 2013 I married a US citizen. I worked for 5 years and I have a clean record no deportation no nothing. Do I qualify for 245i? Thank you
