I genuinely cant believe how kind, patient and helpful that judge was. He genuinely seemed to take his points on board and on several occasions he gave him advice on how he needed to make his argument since he understood that the guy had no legal knowledge at all and didn’t know how he was supposed to present things or question the witness. He seems like a genuinely nice guy.

While it sounds absurd, it's fairly common for a PhD candidate to have a specific field of study that falls under the umbrella of a more generic term. His Native American Studies degree may have been called something very wordy and complicated such as "The study of relative impacts of multilateral treaties on traditional subsistence activities of aboriginal peoples"

Dr Phillip C Bellfy was an Associate Professor in the department of Rhetoric, writing, and American Culture studies. Bellfy wrote a few books on American Indian culture and does appear to have worked with tribal administration. His doctorate is in American cultural history. It looks like since he stopped teaching he has gotten involved in a number of court disputes (tickets, suing cities on funding usage, disputes over sidewalks, etc)

After a year of her barely being able to move and constantly getting worse they FINALLY re did them! But she definitely constantly looked drunk when she walked. Ho-Kay! I screwed up and learned something because of LTWM. For the first case I read the decree of 2007. The Professor is correct. Indian members from one of the 5 tribes mentioned (or those hired by them or fishing for them) do NOT need their boat to be registered in the state if the boat is fishing in one of the mentioned waters. But the fisherperson must have his boat registered by the tribe. He must also have a tribal permit and display it at all times. He must also conform to Michigan penal codes. If he violates a penal code outside of the Tribal exceptions, the State may prosecute. Impaired operation of a vessel is a State crime not exempted by the decree. Sooooo….he doesn’t need a state boat registration. He needs a tribal boat registration. He doesn’t need a state fishing permit, he needs a tribal one. And if he violates the Tribal requirements, he may face a Tribal Court, with a prosecutor from that particular Tribe to which Mr SovvyCit belongs. Sorry. I couldn’t help it. I learned!!!

I live in the West Coast and fishing treaties were renegotiated within the last 20 years. And it gets crazy. In the treaty it says that natives can use native methods to fish for salmon, which means something called gill netting which the white fishermen are all up in arms about. gill netting can bring in lots of fish more than the whites can bring in and that pisses the white fishermen off. The treaty also says that the natives can take all the fish they can use. The white fishers want that to be more narrowly defined as only the fish the fisherman and his family can eat, the fact that the natives can sell the salmon they catch, which puts them into a more advantageous position than the white fisherman. But there's a whole bunch of other stuff going on like housing that's been promised but hasn't been built in thirty years. Fun stuff

I also looked up the decree, section 24.5 states that operating a boat in a manner that creates a threat to public safety is enforceable by both state and tribunal officer under state law. Thus the officer and this court had jurisdiction. Also, 1.2 states that the michigan district court has jurisdiction. And the interpretation, as shown above, isnt really needed, a plain language reading would be enough. Tag in me prosecutor, im ready! And the expert is kind of right about registration, but tribal registration is required as is evidence of fishing which is a tribal activity. I suspect interpretation would be required to determine whether, if you are intoxicated, then you can be fishing. Thus to do a tribal activity do you have to do it in a safe manner? Finally, 24.4 requires that the person is “currently engaged” in the activity, was the defendant currently engaged in fishing, he was at the dock, just having fishing gear may not be enough. And final, final thing. Has the defendant established that he is a bona fide member of a relevant tribe? Id be asking for proof that he is a member, you dont want non tribal members trying to abuse the rights and privileges others has fought to get.

I'm thinking there were two separate times where the defendant was handcuffed during this incident. Perhaps they cuffed him once and then uncuffed him to allow him to climb off the boat or to get documents and then cuffed him again afterwards. I'm thinking he resisted one time and cooperated the other time they cuffed him. And he, of course, is only showing the judge the tape of the time he cooperated.

The police found that McCloud's boat registration had expired, but why would he need a registration for his boat in the first place if he were a member of the Sioux tribe? I thought Mr. McCloud's "expert" witness claimed that he didn't need to register his "vessel" in the first place because he was a member of an Indian tribe in the state of Michigan. Did Mr. McCloud only find out that he was a member of the Sioux tribe after he registrated his boat, and then after that he didn't renew his boat's registration anymore? I know that all this a moot point since Mr. McCloud was arrested first for DUI, and then latter for the "expired" boat registration. I'm just curious. It should be a "doozy" of a jury trial.

I think the point that is trying to be made is that the contact was invalid. He is arguing If the officer was not legally allowed to contact the defendant, the objective symptoms of intoxication could not have been observed. Therefore, the arrest is invalid. That is why the judge asked if the tribe issued any placards etc. for boats to tribal members. He argued once the person identifies as a tribal member, no further search can be made. However, in this case the objective symptoms had been observed so the argument holds no weight, even if he was, which he is not, a tribal member.

I find them terrifying. There was one held in bend Oregon not long ago and they issued arrest warrants for the sheriff and various other people. Imagine how empowering that would be to a “sovereign”. Now they can act with the “authority of the court”. It’s not hard to see that ending in tragedy.

In the first case, everything that "expert" stated being under federal jurisdiction has to do with treaty and Indigenous rights (or Native American as they're called in the States), and their fishing rights. The defendant is not Native American, and therefore under the rules of county or states conservation law, including needing a license and his boat being registered. His "expert" conveniently left that part out (and I seriously doubt that man is really an expert in anything of consequence, and I seriously doubt he has a doctorate)..It also doesn't cancel out the fact that he was drunk, Native or non-Native. By the way, did he ever produce a status card to claim Native rights, because they don't just hand those out, you have to prove you have Native heritage.

@@SpencerfromEarth The defendant was wishy washy when he was 1st asked. Later, I believe it was the judge said he was part of Navajo tribe and the defendant agreed to that. He didn't prove it. He didn't say it when initially asked. He took what the judge said and just agreed. That's how I heard it. Might be better to go back and have a re listen. 🤔 I don't think he is Native American.

@@9babyblu I thought I heard him say "Sioux" but that's just ridiculous so I figured I heard wrong. Navajo is equally ridiculous. The Treaty + Consent Decree apply to specific contracting parties including 5 specific tribes which are obviously not going to be random tribes from places like Arizona.
