The plaintiff says the defendant is her older brother, and he works on air conditioning systems. She says she hired him to fix her furnace and he made unnecessary repairs, so she wants her wasted money back. The defendant says he replaced the stuff his sister insisted on, and he can’t believe he’s being sued.

This case is crazy. I’m a contractor, and I never charge family or friends trip charges. Depending on the size of the job, I don’t always even charge labor, and often times I’ll pay for materials to help out. The really strange part of this case, is that they fix this furnace and create this huge headache, just for the plaintiff to move out and then move in with the defendant. I don’t understand that. What the defendant should do, after they return home, is draw up a contract charging the plaintiff $300 for rent now, lmao.

8:30 As an HVAC tech I wouldn't have thought the thermostat was the cause. She said clicking, if that clicking was coming from the T-stat then she had a case. If it caused the motor to click, I would've taken the same steps her brother took.

What the brother should have explained, and should understand, is that when you change some parts out you should also change out any major ones like the motor within reason. There is no effective way to tell how much life the motor has, and a weak motor could put a strain on other parts, including a higher electric bill for not running efficiently. A $150 motor is worth avoiding the cost of the time and labor of another repair visit in the near future. The judge made the correct judgement with her explanation of the brother's reasoning. This is one of the few cases you see two parties needing more of a mediator to resolve their dispute while maintaining a positive attitude toward one another. Good on them!

I'll only do work for family as long as they help with job.. more times than not I loose money working for family, so I require the said family member to help with job. Even if I don't make a penny for the job, I feel better to have shown the family member how to do the job themselves and also understand/appreciate the labor and skill required.

Watching from Australia it does appear that people in the US are highly litigious and petty. I hope he charges her rent and tells her it's 'Just business '. Duh. Saying that, the Americans I've met personally have all been lovely people.

If I were the judge, I would want to know how much the total bill was; we don't know how much he charged her for the thermostat and labor to install. I believe the $300 was only for the $152 motor and labor to install. It seems that he didn't charge her for the capacitor because that didn't fix the problem. If the total bill did not excessive, I would have awarded her $152 for the cost of the motor only, especially since he is allowing her to stay at his place for free.

I can relate to this woman's story of having the air cond guy out several times to fix it and not fixing it, charging and coming back to fix something else. I had the guy at my business everyday for 1 1/2 weeks, doing something else every time. Argh!!

Family don't mean free. If they support you and what you're doing then they will pay. If a stranger will do it, then they should too. NOW on another note you still need to do the job/service correctly regardless who it is for.

I have an older model " stupid " thermostat that never stops working, never breaks, never needs replacing, you just set the temperature at where you're comfortable and it stays there. Did thermostats really need to get more complicated than that?

If she hired another plumber/heating professional , they would bill her $150 plus an hour. And I can tell you from the heating field - some jobs you’ll be called back a second time because the system is not working properly. This especially if the problem is intermittent. Because it could be working fine when he checks it, then the problem comes again. If they back a second time, they will charge for the additional labor. Sister is saying business is business- next time the brother should charge her the normal rate for any problem that arises, then see if she still says business is business.
