Probably not the first person to suggest this, but given the cost of hiring a wedding photographer, it is entirely possible that the bride and groom ARE in an open relationship and saw this as a way to scam the photographer and get their money back. Was there any indication that the bride and groom were divorcing because of the infidelity? If not, I would say it is very possible that they're trying to scam the photographer.

If the photographer is responsible for the post wedding actions of the second shooter, then the client should be responsible for the post wedding actions of their spouse. The client obviously has emotionally damaged the photographer by choosing to marry such a person. But in reality...it isn't the photographers fault and not their concern. I wouldn't give a refund, just tell the client I am sorry that they are going through this.

I say no refund! The contract was to photograph their wedding which I assume was contractually completed. Sure the second shooter is a POS for doing that, but the groom is far far worse. If he did it this time (and took photos of it) then he's done it before. He's a POS, dump him! The main photographer is not responsible for the behavior of the groom. Get the marriage annulled and sue the groom for any costs you may have incurred for said wedding (assuming the Bride's parents foot the bill OR she put money towards it).

Every first year law student is taught that a contract has four components, and when those elements are fulfilled the parties have no other responsibility to each other. The photographer should send the bride a list of divorce lawyers and that’s it.

The law does not necessarily favours award emotional damage. Especially when the contract is not recreationally purposes. The alleged affair is beyond the scope of their agreement. The contract was to take images which the photographer gave to her.

Most weddings ive been to have an issue. I shot one wedding (1976,) of my best friend. He was forever grateful i took shots with my Yashica MAT 124. As the photographer fell into the baptismal pool.

The hussy mistress doesn't always get away free. They can be sued for alienation of affection, and yes, in MANY states that is a law. Though I don't know how many people recently have used it. But from a business standpoint while you can be sued for ANYTHING it doesn't seem from my experience, very likely that she would be awarded any damages from legal action she would take against the photographer. In short. NO not going to give any kind of refund as I am not responsible for the actions of the husband (since this happened AFTER the wedding) or the third party.

I do not do weddings because of the nature of them where I live,there is 90% of the wedding day and events that are unplanned and involves taking the entire wedding party on a random process of going to parks, monuments, bridges over canals, for many hours and finally converging back for a party many hours later. The ceremony itself by appointment time in an ornate wedding palace, the only part that is predictable so this is not a problem I could run into. I d, however do couples sessions/engagement sets but my main work is studio sessions for actor portfolios and model books. My GF is the dresser and our good friend is MUA, when not on a cinema filming. The photographer is not responsible for the behavior off duty but the assumption that the girl was at fault is a stretch, why the bereaved bride assume the girl was not the victim of an overly aggressive client? In some countries like my native USA, everything is someone else's fault and large sums is sought. Here where I moved to 23 years ago, this case would be laughed out of court. People do not sue unless a serious breach of contract or fraud, very rare. It is a much more calm and relaxed society, where everyone gets along. The only downside is photography has a modest income potential. But the cost of living is also 1/10th for a much better quality of life than is possible back home in California. One additional reason for not doing weddings is total lack of control of sight lines, everyone with a phone or pocket camera gets in the west. I did a wedding for an ex-girlfriend years ago here that was in a spectacular 17th Century cathedral and had the planner sent out the invitations with a statement that a special area for photographers would be provided, so no photos from the galleries, and a box to check if they intended to shoot photos, so to go they needed to receive a entry ticket after submitting the questionnaire. I thought that would solve the problem of sight lines. The security was good because it was a wedding of a celebrity who was a cultural icon. A roped off area with signs for guests who were going to take photos, and they all filled that area early on, until the celebrity came down the isle, everyone crowded around, knocked over the rope stanchions and one one of the 3 shooters had a decent sight line to get anything suitable for the wedding book or publicity. Normally people are very easy going, do not intrude on others, are very polite. To get serious photos we had to arrange a midnight use of the cathedral before they flew off on a month honeymoon trip. I much prefer environments and studio work, portraits are usually nice also. In my studio I have a 36wide corner cyclorama that is demand for product and catalog work, The city is so beautiful, clean and classical that many clients want city sessions or in palaces or mansions, which are everywhere here. The city has 600 beautiful parks so there is no end to options.

I was a second shooter with a friend of mine in his wedding business. Had a nice young couple. Did their engagements and never a seconds trouble. Well, wedding day rolls around. Outdoor wedding here in Hampton Roads in July. It was 100 degrees that day, near noon at the time of the wedding. Long period of a few hours between the wedding and the reception. The bridal party went to a friend's house for a pool party between the wedding and reception. Again, nothing hinting at an issue. We arrive at the reception location. Start our prep on shooting the cake and all the other things you do at a reception. People start arriving. Bride and groom arrive. Bride is in a bit of a frustrated stage. Said she had a brief issue with her mother before leaving the house. Well, apparently the mother wasn't a fan of the groom. And I'm not sure, but I believe they said she was Greek. Apparently the culture is if the mother disapproves she wears a red dress to the reception. Weeeeellllll, the mother walked in wearing the brightest red dress you can imagine. The bridal party disappears on us as we were shooting some of the other gusts and the dinning area. Finally after about 10 minutes we see the wedding planner and asked her where they all were? She was just frazzled and a nervous wreck and said and I quote...." the brides mother wore a red dress..thats a sign of disapproval of the weeding. They went to the back to hash it out....and bride proceeded to PUNCH her own mother square in the face!!!! " LMAO. Then she said, this is my second wedding and I've decided I cant do this shit....I'm going back into politics, at least there I know who's cutthroat and who you can and cant trust. We started getting on her like, why didnt you come get us??? Those images of the fight would've been fantastic in the middle of the album!!!! LOL. Sorry this is so long, but had to provide a bit of build up to it. It's not everyday you hear about the bride punching her own mother in the face on the day of the wedding.

If it were me, there are no infidelity clauses in my photography contract and said conduct between consenting adults did not interfere with the performance and delivery of the contracted service, so not my problem. If needed I would fight and have them get laughed out of court and countersue for fees and defamation.

I feel like this is kind of like that thing that teacher's deal with where they are seen drinking a beer at a restaurant and just living their lives outside school and parents get mad about it, only what this second did is actually bad. Outside the school is personal time so they can live their lives as they see fit good or bad. This second photographer and their actions are not the responsibility of the lead outside the working hours of the wedding, they went and hooked up with the groom on their own time. Would this bride have asked for a refund for the price of the dinner if it had been a guest instead of a vendor that slept with her new husband? Seems like bride just wants some cash to leave the relationship with lined pockets.

Actually several states have home wrecker laws. So the person that interferes with a marriage can be sued. As to this situation I wouldn’t give a refund unless the act happened on the day of the wedding. I would also ask for the return of all work products.

Here's my wedding horror story: Late 1980s, so medium format for film and full-size S-VHS for video. I was shooting video for this wedding, and the photographer was the local newspaper photographer. The entire evening, anytime we were completing an item on the timeline, the DJ and I would have to get the photographer from the bar firat. The photographer claims he dropped the film off at the lab that night, but the lab has no record of the film. Bottom line, the couple had NO photos, and the technology at the time didn't allow you to grab quality frames from the video...

Walked in on the best man and maid of honor mid coitus in the bridal suite during the reception. I had went in to grab a light I had left there earlier. I’ve had a drunk bride, this was pre wedding and she had just got her hair and make up done, walk around naked and decide she wanted to do some raunchy photos for the groom. That’s really bonkers … On the other hand, there’s a business opportunity here: if we can only get a refund from our ex-es on all expenses & time spent during those years of bad marriages, pretty sure that business will go through the roof!

IDK. No photos, no proof Reddit. LoL. I think the photographer did her job and the job was done. The fact that things happened afterwards, not really par of the contract. No where does it say that you get a full money back refund if you sleep with my second shooter. So... Also, nice podcast set.
