Australia has recently legislated Right-to-disconnect laws. An employee may now legally refuse to monitor, read or respond to contact from their employer outside of their working hours. America needs this.

Alternatively or on top of it, they could and should borrow from some South American countries (like mine, Chile), "principle of reality of work" such that facts must be given preference over what parties, *particularly employers*, state in legal texts, documents, and agreements. That makes it all the more important that, anything that has become reality, has to be in writing, for both parties involved.

@@PMMcIntyreand when the single mom refuses to answer after work hours, they will fire her, and she will have no legal protection. If she is unable to get a new job quickly, she could lose her home. All because of greedy corporations and lax regulations. In this and similar scenarios, the smart thing for that employee to do to survive is to not have any boundaries that result in them becoming homeless. All hail the corporate overlords!

@@amigos4erin nice strawman, but hardly realistic. I'm a programmer and have stood up to corporate drones before and nothing happened. I've been at the same job for almost 30 years and I have outlasted all of my bosses who tried to impose their will onto me. They bully us because people like you allow it and rely on a bloated bureaucracy to solve your problems instead of fixing them yourselves, when that same bureaucracy is responsible for the power they have to begin with.

They get away with it because many people are too afraid to set clear boundaries (both in personal and professional life). I had the *exact* same situation happen to me as depicted in the video. I accepted the phone, but outright refused to answer it after-hours without extra pay. The manager at the time told me it would impact my ability to move up in the company, but it turned out that wasn't true and now he's gone and I've been here for over a decade.

Any time an employee is performing FLSA-defined labor hours they have to be paid, including management knowing about it and turning a blind eye (called permitted as opposed to suffered) and no smart organization wants to deal with the NLRB, EEOC, or state labor organization over unpaid wages. But a new contract was designed to remove that clause from the cell phone usage agreement. Though it still has a blurb about data usage. So it remains in airplane mode.

In the US, there was a ruling a while back that said "being made available" is the same as "on-call". And on-call has to be paid. Some companies think that since the employee is salaried, it doesn't matter. Federal law says salaried employees must still make minimum wage for the hours they put in. If you're on-call 24/7, then that's 168 strait hours a week. If you use CA min wage and OT law, the company would have to pay you at $229k a year for that.

Honestly understandable he got upset about that. 1. fire hazard. Don't leave those kinds of batteries locked into anything no one else can access. 2. noise pollutant. If you forgot to turn it off then spam calls can make nosie and they have no way to stop it because no one else can access. 3. life expectancy of the device and inventory. Some workplaces provide dedicated areas where work phones and laptops should be left at. This is usually mainly for fire safety, but they might also additionally include chargers you are meant to leave it plugged into to keep the battery at a percentage improving its health and life expectancy. In this case, not doing so can be argued as "gross neglect of company property" or whatever the actual term for such stuff is (only heard about this in third part anecdotes that might not even be true, so dunno about the language they use, but my armchair-lawyer-skills felt like that phrase would be what I expect to see it called). On the flip side, as a home healthcare nurse, we will shortly be losing our company phones (along with all the shortcuts and templates I had saved over the years). We are expected to call our clients the day before, along with numerous calls to providers, each other, etc. Now we will be expected to use our personal phones for this. So no more shutting the device off at the end of the work day. I'm seeing a loss of work/home boundaries here, and most likely will retire very soon.

So he also has not paid for a new phone either in the past 20 years (he does play for a cheap plan). My clients know I work basically 9 - 5, unless their is a 'go live' or 'rollout' and I tell them they can contact me after hours. But if it's my Mom, I answer. ;-)

@@angelinacrafts5385 roaming would only count as out of norm if you incurred them outside work. Like if you for some reason brought it along on a vacation (at least if you did so without explicitly being requested to - but that is because if they explicitly did then it is considered work and you are being paid extra for it anyway). No, it is mostly to cover themselves from a disgruntled employee using it to intentionally get them billed from nsfw services or non-work roaming. Or if they don't expect that, then it is mainly there because work-phones are expected to be used for personal things too (in the video they explicitly said not to, but most employers don't. And even if they do, they often give leniency to people who explicitly request to be allowed to use it for personal stuff too - ie. because they don't afford their own phone and plan - so having the contract cover such a case is still useful), and think such bills can occur from your personal non-work usage.

This happened at my old job and I just said "OK" waiting for them to demand *explicitly* that 1) the device had to be on after work hours, or 2) I had to keep it with me after work hours, or 3) I had to answer it after work hours. They didn't - they said they "expected" those things. Afterwards I put the phone in a desk drawer and never touched it again in the three more years I worked there. Once or twice someone said I hadn't answered my phone and maybe I said, "I was in the middle of something" or maybe I just said nothing. But when they called my desk phone, I always either answered or got back to them quickly. When I had to work late, I came into the office and worked. In reality, people will only "expect" what you give them or what you _explicitly refuse_ to give them. Do things in the way that suits you and the rest of the world will adjust. Confrontations and refusals almost never produce the results you want, and when they do the cost is often high.

So, different view on this. Viewing as opposed to, say, adding work apps (email and teams, but also authenticators and similar mobile device requirements) to your personal phone, and this is a major benefit. It lets you isolate work activity to the work phone, and, for instance, leave it on your desk at 5pm. The expectation of constant availability is a secondary requirement that needs to be negotiated at the contract level.

For Vacations: explain that you're going somewhere without reliable cell phone coverage and that you'll be difficult or impossible to reach most of the time. For years I have had 2 phones, business and personal. This should be obvious to everyone but the number of people who only have the one phone is far higher than it should be. During the week carry both and out of hours vet which calls you deem important to take, otherwise voice mail does its job really well. I carry both when having the odd day off but vet calls, messages and emails depending on urgency, but again OOO does the job pretty well. First rule is never take the business mobile on vacation, I used to, but good advance planning and OOO do the job. Second rule, never schedule meetings on your first day back. As you climb the ladder and renumeration goes up, so the hours of work blur as the demand is work the hours needed to get the job done. For most however, you’re not being paid enough to take your boss and colleagues on vacation with you! Third rule be careful about who you give your personal number to! Final thought; as the saying goes the graveyard is full of indispensable people, but life goes on!

However, the safety policy for emergencies doesn’t follow this call everyone scheme but we have no choice because we need the company cell since our site offices don’t have phones. It got a lot of people angry when the policy came out. On the flip side they don’t monitor the phone too much (ie don’t watch porn on it but KZfaq and other socials are okay), and I take it with me while on vacation because the company will pay for the coverage since I need to “be on call” even though no one will actually call me. 🤨🤷‍♀️

The IT department can still everything you do with your work phone. They can even track your movements with the GPS - even if you are vacation. People don't like the idea of being tracked by their employer.

Its basically a requirement in my industry. The only time I carry it when I'm not working is when Im on my scheduled on call rotation. The only time I use it after work is to text coworkers on when we are showing up the next day. Other than that I dont answer it if it rings or otherwise goes off
